COMPLAINT-AFFIDAVIT

I, Chuck Lidel, Filipino, 60, male, single, and a resident of 45 Dagupan st. City of Manila,
Philippines, after being sworn to in accordance with law, depose and state:

1. That I know the person of Chuck Lidel Jr., who is my son residing at the same house
at No. 45 Dagupan Street, City of Manila, Philippines;

2. That, at around 9:00 in the evening of October 29, 2012, after dinner, the said Chuck
Lidel Jr. Arrived at our house;

3. That, he saw my wife, Mrs Francesca Lidel in the kitchen doing the dishes, the
kitchen being at least 5 feet from the dining table;

4. That, The said Mr. Chuck Lidel Jr, without provocation, pulled a knife from the sink
and proceeded to stab my wife with it.

5. That, upon seeing what my son did, rushed to my wifes aide and called the hospital;

6. That, upon seeing that I was approaching he left in a huff without even saying
anything;

7. That, upon calling for medical assistance and reaching the hospital, my wife was dead
on arrival because of severe blood loss from the stabbing;

8. That, after attending to my wife immediately reported the said incident to the nearest
police station. A true and faithful machine copy of the police report is hereby
attached here as Annex A;

9. I am therefore executing this Complaint-Affidavit in support of the charges of
violation of Art. 246 Revised Penal Code for Parricide against the said Chuck Lidel
Jr., who may be served with subpoena and other processes of this Honorable Office at
his residence at 45 Dagupan Street, City of Manila, Philippines;

The undersigned Assistant City Prosecutor of the City of Manila, upon prior written
authority of the City Prosecutor, Franklin Santiago, accuses CHUCK LIDEL JR. of crime
punishable under Art. 246 of the Revised Penal Code, committed as follows:

That on or about the 29 day of October, 2012, in the City of Manila,
Philippines, and within the jurisdiction of this Honorable Court, the said accused, actuated
by lust, did then and there wilfully, unlawfully and feloniously commit violation of Art. 246 of
Revised Penal Code on the person of Chuck Lidel, by stabbing his mother, the complainants
wife Mrs Francesca Lidel without provocation her death.

CONTRARY TO LAW.

I, Chuck Lidel Jr., of legal age, single, Filipino and with resident address at, 45
Dagupan st. Manila, Philippines, after having been duly sworn in accordance with law, do
hereby depose and state, that:


(1) I was charged with violation of Art. 246 of Revised Penal Code Revised Penal Code
(Parricide), by the private-complainant;

(2) That, I was nowhere near the vicinity of our house but rather I was in a friends
(one Lucio See) house in 47 West Ave, Quezon City;

(3) That, I would not deliberately stab my mother Mrs. Francesca Lidel for any
reason whatsoever;

(4) That, The private complainant was forced to file this complaint because of reasons
only known to him.

I am executing this counter-affidavit, to attest to the truth of the foregoing and for
whatever legal purpose it may serve.

R E S O L U T I O N

SUBMITTED for resolution is a complaint for violation of Art. 246 of the Revised
Penal Code (Parricide) allegedly committed during the October 29, 2012, at Manila,
supported by the sworn statement of the complainant and photocopies of the police report of
the incident.

In his sworn statement, the complainant alleges that, during the afore-stated period
of time and place, the respondent without rhyme or reason stabbed the victim Mrs.
Francesca Lidel resulting to her death.

However, the respondents claim that, the filing of the complaint is without legal basis
since the there was no such act and the complainant was in his friend Lucio Sees house in 47
West Ave. Quezon city.



IN LIGHT OF THE FOREGOING, the undersigned finds sufficient cause to hold the
respondent CHUCK LIDEL JR. for VIOLATION of ART 246 OF THE REVISED PENAL
CODE (PARRICIDE).
