Further to the instructions below following the of abuse reported to the PRT
iiaHe allegation

Sarposa Prison reported to KABULdunng its recent visit to the KabuiN

The PRT has notified the NDS in Kandahar about the allegations

he PRT has also notified the Kandahar AlHK

office of the allegation and is
setting up meeting with Engineer Noorzai They will also contact the Kandahar ICRC

KABUL has arranged for meeting tomorrow morning between HOM and the Head of the ICRC in Kabul We are

also attempting to arrange meeting for HOM withDr Simar chair of the AIHRC

The question arises as to how we ensure meaningful investigation given that it is

likely the NDS will be

investigating themselves KABUL recommends that we ask the AIHRC to investigate these recent allegations

especially given the assistance we are providing them their capacity to monitor and investigate As we
in building up
cannot reveal the names of the individuals involved suggestion is that we ask the AIHRC to interview all Canadian
transferred detainees currently held in both Kandahar and Kabul particularly the individuals we have already met This

would allow them to gather information on their own without us having to divulge any names The report would be

presented to both the GoA and the Canadian Embassy

As we are informing the ICRC of the allegations

Note that during todays followup visit by PRT members no allegations of torture were made by the individuals

transferred to NDS custody separate report will follow from KANDH

prison we have Included below short narrative report of the meeting with prison authorities as well as the follow

up report using existing SOPs template attached

File FollowUp Visit Report Sarposa Prison wpd

This visit was undertaken with some advanced notice as to the fact that members of the PRT would conduct
visit but not as to its scope or purpose Immediately upon arrival team members were greeted by Col Qadir who
after being in an acting position for some months was Formally appointed as warden of Sarposa Prison

Congratulatory remarks on his appointment were provided by PRT LEGADConnor and CSCGarwoodFilbert As
this was the first time conducting visit iLap presented Cot Qadir with Pashtu version of the

recently concluded CanadaAfghanistan Supplementary Arrangement and explained some of the Arrangements
key provisions namely assuring full and unrestricted access to Canadiantransferred detainees by Canadian
officials the AIHRC and the ICRC as well as the ability to conduct interviews of these same individuals in private

While Col Qadir was not aware of the Supplementary Arrangement he assured team members that

With respect to identifying Canadiantransferred detainees Col Qadir indicated that this would be difficult for

him and his staff as the prison did not track whether particular individual had been originally detained
registry

and subsequently transferred by international forces He indicated however that the registry was complete note
this concords with previous CSC visits and inspection of Sarposas inmate registry which is generally speaking

fairly comprehensive and accurate and that if we had names he could make arrangements for interviews to
occur

In light of the above an Englishlanguage list of

provided transfe detainees who
are believed to be nosah Prison based on recent exchanges received from the NDS KANDH and KABUL C4
reftels of and notal Col Qadir indicated that neither he or his staff would be able to translate the

list into Pashtu and would therefore appreciate if the PRT could do so prior to formally transmitting it to his

attention PRT deavoured do so as quickly as possible We subsequently

to requested to conduct private

interviews with andomly selected individuals identified on our list Cot Qadir agreed and dispatched his one of

amount
co Understandably this took some time and as we were by the
ect the individuals limited
his guards to

of time we were able to spend at location for operational security reasons we did not conduct visit of the entire

facilities Note this has been done on several previous occasions by CSC and PRT Engineers as part of ongoing
PRT capacitybuilding initiatives In this respect the facilities at Sarposa prison are considered relative to other

facilities in Afghanistan as above average refer to CSC mission assessment and

Given were only able to interviev included

privately

detainee ae number El During the

interviews one detainee to having been beaten

on one occasion during the Kandahar NDS facility When asked if he had required any
medical treatment subsequc he indicated that none had been sought We indicated our concern
about the alleged mistreatment and advised that we would be raising the matter with NDS authorities as matter

of priority In doing so the detainee requested however that we withhold his name so as to avoid any possible
repercussions Please note that FTAGFairchild CSCGarwoodFilbert and PRT LEGADLCdr
Connor are slated to visit NDS on where we will raise this issue as matter of considerable concern and if

true as being Incompatible with the terms of the Supplementary Arrangement Please note that the PRT is slated
to meet with the Deputy Head of the AIHRC tomorrow as part of meetings established for

lLap visit and that will lLap

meet with the Head of the ICRC subdelegation in Kandahar on
where this issue can be raised would be from Ottawa on the
desired take in this

Grateful for guidance on the further distribution of the attached report and this message electronically or in

numbered hardcopy form including to KAFPOLAD for transmission to Commander JTFAfg JAG ADMPOL
and CEFCOM In the case of numbered hardcopies might be appropriate for FTAG to establish
it registry on
