1 Name of regulation
This regulation is the Crimes (Transitional Provisions)
Regulation 2009.
2 Commencement
This regulation commences immediately after the commencement of
the Crimes Legislation Amendment Act 2008, schedule 1, part 1.3.
Note The naming and commencement provisions automatically commence on
the notification day (see Legislation Act, s 75 (1)).
3 Modification of Act, pt 30Act, s 601 (2)
The Act, section 600 applies as if the following subsections were
inserted:
(2) That part, as in force immediately before the amendments
commence, continues to apply to the proceeding.
(3) For subsection (1), the hearing in a proceeding for an offence has
started if
(a) the defendant has pleaded guilty to the charge and the court has
accepted the plea; or
(b) the defendant has pleaded not guilty to the charge, or is taken
to have pleaded not guilty to the charge under section 375 (6)
and the court has begun to take oral or written evidence in the
proceeding (other than in relation to bail or any other
interlocutory matter).
