Rigging the Gen. Election 2013 Finding of the courts/NADRA/E-Tribunals only PTI presents to the media 13 National Assembly constituencies of Punjab, Sindh and KPK where courts have adjudicated partially and given their findings Most of these cases are still awaiting final verdict PTI feels that in these constituencies they have received a raw deal and justice has not been parted to their candidates. What is un-fair and what is biased will be explained in the presentation. PTI has, in almost all cases been affected by PML-N whether in Punjab or KPK. Their mastery in the art of rigging the election has even been acknowledged and recognized by MQM who appealed against PML-N in NA-258 Karachi and were able to prove the tactics they used in rigging the elections. The Election Tribunal in Karachi has ordered re-polling in NA-258. PML-N in conjunction with the ECP has now introduced a new terminology for rigging known as the Typo Error which only benefits the candidates of PML-N and no one else.

NA-57 is the ONLY constituency where Member Election Commission (Justice Riaz Kiani) first allowed a total RECOUNT of votes on May 13th and then just after one day the SAME JUDGE, with SAME FACTs and SAME LAW changed his decision and disallowed the recounting of all the votes. The margin between winning/runner-up candidates was 2900 votes AND Rejected votes are 5466. Thus recounting of rejected votes was critical.

Since 21-Nov-2013 Mr. Usman Dar has been pleading with the court for the Election Tribunal to order thumb verification of all the votes cast in his constituency from NADRA in May-11 General Elections, 2013. Thereafter the learned Tribunal kept on adjourning the case instead of announcing order for comparison of thumb impression, on the lame excuses. The Tribunal took refuge for delaying his orders till the pending writ petition of Mr. Hamid Zaman NA-118 was decided by the Lahore High Court. The tribunal gave the understanding that whatever the High Court decided in the writ petition, the same would be applicable to Usman Dar Request. In the meantime, to show efficiency and disposal of the other trivial matters, the tribunal directed Usman Dar to complete his evidence, which was actually not needed. However as per direction of the Tribunal Usman Dar adduced his evidence and his statement was also recorded in this regard. When the time for cross examination of Mr. Dar came, he had to go abroad in connection with his overseas business engagement. The Tribunal did not adjourn the case for 2-3 days so that Usman Dar could appear for cross examination and so that the petition of Usman Dar was dismissed by an illegal order against which appeal is now pending before Supreme Court of Pakistan. Ghulam Sarwar khan has been contesting Election against PML-N stalwart Ch. Nisar Ali khan 2002, 2008, 2013. In 2013, He won by big margin of almost 10,000 votes from Ch. Nisar. In all these aforesaid elections, Ch. Nisar tried his level best to get Ghulam Sarwar khan disqualified at various stages; Returning officer, High Court, Supreme Court. But failed to do so. Similarly in 2013, Mr. Ghulam Sarwar Khan managed to get Ch. Nisar Ali khan disqualified from Returning Officer on the grounds of concealing of assets/Education qualification. However, High Court allowed Ch. Nisar. After Ghulam Sarwar khan won the General Election 2013, The contesting candidate Ch. Nisar Ali khan made petition to the Election commission who directed him to pursue this matter before the Election Tribunal which he didnt. He rather went straight to the Supreme Court requesting for a Suo-Moto application to get Ghulam Sarwar khan disqualified.

The Supreme Court Registrar rejected Ch. Nisar application because the similar matter was already being heard in Punjab high court. Being a persistent follower, Ch. Nisar Ali khan went straight to Ex-CJP Iftikhar Chaudhary through his proposer. The Ex-Chief Justice Pakistan Iftikhar Chaudhary immediately issued an notice to Ghulam Sarwar khan and heard the case personally and disqualified Ghulam Sarwar Khan. Which is against the rules for using his Suo Moto powers without notice to the affected party. Petition CMA # 4275 of year 2013
NA-53 (Background)
The height of this order was that two different orders were passed by Ex- CJP for exactly similar cases on the same date 18-July-2013. In same, judgment relief was given to respondent Mr. Makhdoom Syed Ali Raza MPA candidate of PML-N but took severe ILLEGAL action against Mr. Ghulam Sarwar khan elected MNA of PTI. Such high handedness have never been seen in Supreme Courts history. He was re-instated by a three member bench of Supreme Court after the departure of Ex-CJP Iftikhar Chaudhary.
It is also stated that Direct order issued by CJP Iftikhar Chaudhary to suspend PTI MNA By-passing the Election commission. His directive was addressed to Sectary National Assembly which is un-precedented. NA-19 (HARIPUR) SELECTIVE JUSTICE
PTI Winning candidate Dr. Raja Aamer Zaman NA-19 Haripur (Facts) PTI Winning candidate Dr. Raja Aamer Zaman On 17 th May 2013 the runner-up candidate of PML-N Mr. Omer Ayub petitioned before the ECP for recounting of the 45 polling station only without any notice given to the winning candidate of PTI. The ECP members Justice Rtd. Riaz Kayani and Justice Rtd. Fazl-ur-Rehman ordered for recounting of the entire constituency for 437 polling stations on Friday 17 th May evening. Sunday 19 th May to Friday 24 th recounting was done for the all the 437 polling stations and over 290,000 votes. PTI candidate still won in the recounting by a lead of 1304 votes. PML-N candidate still pursued the matter to Election Tribunal. The tribunal out of the blue ordered and selected seven (7) polling stations without any criterion/reason/yardstick in an arbitrary manner. The petitioner had not even prayed for this relief but the court on its own gave biased relief much beyond petitioner expectations. The Tribunal stated that there is no finding that the appellant PTI candidate or any other person on his behalf was indulged in any corrupt practice. In Election Tribunal not a single witness was produced by PMLN candidate regarding bogus voting. The notables of these seven polling stations were approached by Captain Safdar, son-in-law of Prime Minister Nawaz Sharif, took them to the Prime Minister House to meet up with the N-league leadership including Khwaja Asif, Shahid Khakan Abbasi and Gohar Ayub Khan (father of PMLN candidate Omer Ayub). NA-19 Haripur (Facts) PTI Winning candidate Dr. Raja Aamer Zaman The Federal Government immediately sanctioned development schemes for these seven polling stations in total disregard to the Election Rules: 3 transformers and 30 LT poles were brought to PS Ghazi Hamlet, Mohat Sector. Branch lines for Gas for Village Piplala Transformer of 100 KV was installed on 28 th Jan 2014 in Danna Kalinger also a generator for local mosque was provided. Branch lines of Sui gas were also given in Mamral. A local newspaper, Shamal of Hazara carried news that rupees 25K-30K were given to voters to vote for PML-N. Purchasing of votes was also shown in K-2 TV channel. NA-19 Haripur (Facts) PTI Winning candidate Dr. Raja Aamer Zaman Due to selected Re-polling on 7 polling station, the winning candidate of PTI was made to loose by a margin of 500 votes. PTI candidate petitioned the supreme court which was dismissed and the court endorsed that their decision is not approved for reporting in the journal of the supreme court. PTI MNA has gone into review of supreme court order which is still pending for final decision. The civil society in this urban area came out in large numbers to protest rigging Women and children gave dharnas on the main roads for days and nights together NA-125 Lahore Winning Candidate: Khawaja Saad Rafique PTI Contesting Candidate: Hamid Khan PTI candidate and their running mates in PP-155 and PP-156 gave their petitions to the election tribunals way back in July 2013. Besides others, the main thrust of their petition was to have thumb verification done from NADRA. PML-N had mastered the art of rigging with the help of many people in position and the only relief possible is the thumb verification result. Just one month ago, the election tribunal allowed only 7 polling stations (out of 250 plus stations) where thumb impressions got verified from NADRA

May 2013, they had not received the polling material Justice (Retd.) Riaz admitted that he had received many complaints in this constituency and the staff in the polling station were too few to discharge their duties The case of NA-125 is not seen to be concluding in the near future inspite of a 14 month lapse. The provision of law of reaching conclusion within 120 days has been flouted by almost all the Election Tribunals
Detail Review of constituencies NA-256 KARACHI (NADRA REPORT REVEALS MASSIVE RIGGING IN KARACHI CONSTITUENCY)
PTI Contesting Candidate Zubair Khan NA-256 Karachi (Background) Zubair did not have enough money to get NADRA verification for entire seat so he selected only 69 polling stations that comprised of only 84K votes from more than 200K plus cast.
NADRA report stated that only 6,815 of the total 84,748 ballots were successfully authenticated. NADRA report revealed that there were 11,343 ballot papers that contained invalid national identity card numbers, which were never issued by Nadra. 791 votes were found not registered in the constituency. NADRA report stated that there were 5,839 duplicate votes, which were cast by as many as 2,812 voters mainly in two polling stations. Seven votes were cast on one CNIC belonging to a resident of Gulistan-e-Jauhar neighborhood of the Karachi city. As many as 314 ballot papers were found without having fingerprints on them.
NADRA report stated 1,950 votes failed authentication, because someone voted against the CNIC number mentioned on the used counterfoils. In 26 polling stations the ballot papers were more than those issued (meaning Bogus cast) In 37 polling stations ballot papers were less than those issued from counterfoil (Our PTI ones destroyed).
57442 could not be matched (we claim they are all bogus but keep in mind they also include those NADRA could not read because of poor ink, smudging and of course fake finger prints)
PTI demand SC should at least suspend the MQM NA member Iqbal Mohammad Ali Khan pending final decision. This has happened in not one but in all Karachi seats (Subhan Sahil on NA 239, Ali Zaidi on NA 252, Raja Azhar on NA 251, etc.)

PTI Contesting Candidate Qurban Ali PML-N Winning Candidate Abdul Hakim NADRA report stated 2,400 of the total votes cast were genuine. NADRA report also stated that at least 1,400 of the voters had cast their votes twice. PML-Ns candidate Abdul Hakim Baloch had won in this area with a total of 51,148 votes cast for him. An earlier report presented by NADRA regarding voter verification for NA-258 Karachi had also revealed voter fraud.

NADRA report revealed that 5,893 votes were cast twice and 741 votes were not related to the area. Moreover, there were 11,346 votes cast from 40 Computerized National Identity Cards.

PTI contesting candidate Waleed Iqbal who finished as Runner-up Mrs. Bushra Aitzaz Ahsan of PPP finished 3rd Mr. Waleed Iqbal PTI candidate petitioned before the tribunal, in accordance with law on 6 th July 2013.
Mrs Bushra Aitzaz candidate of PPP petitioned before the ECP for inspection of the election documents was allowed.
On April 24 th 2014, Tribunal dismissed Waleed Iqbals application for adducement of additional evidence in a sternly worded order wherein ECP was directed to remove the ARO for reasons of having carelessly and irresponsibly issued the above said attestations, and the ECP apparently removed the ARO accordingly

Mrs. Bushra Aitzaz Ahsan was seemingly infuriated at the Tribunals aforesaid Order of 24th April 2014, and submitted a complaint against the Tribunal to the ECP, accusing Mr. Kazim Ali Malik of misconduct, corruption and illegal action, seeking his removal from office, and summarizing the state of the inspected election record in relation to a total of 264 polling bags that were presented for inspection as follows:

On 17th June 2014, Waleed Iqbal visited the office of the Secretary ECP in Islamabad and submitted an Application under Article 19-A of the Constitution read with all other enabling provisions of law, requesting certified copies of the report prepared by and for the ECP itself in relation to the state of the NA-124 election record that was presented for inspection in April 2014. ECP provided the requested certified copies of the said report, in relevant part, to Waleed Iqbal on the same day. In summary, the ECP, as custodian of the said election documents, itself acknowledged in its report (in summary and also in itemized detail) the state of the 264 polling bags as follows:

A total of only 106 polling bags were found sealed. A total of 127 polling bags were found with broken seals. A total of 31 polling bags were found with no seals at all. The parties present declined to inspect 152 polling bags as they were found with broken or no seals. Form-XIVs were missing from 49 inspected polling bags. Form-XVs were missing from 55 inspected polling bags. Electoral Rolls were missing from 47 inspected polling bags. Counterfoils were missing from 27 inspected polling bags.

PTI contesting NA candidate Malik Karamat Ali Khokar PTI contesting PP candidate Malik Zaheer Abbass Khokar A the outset tribunal observed that never in the history of Pakistan Patwaries were appointed as the presiding officers on polling stations. Raheel Asghar Patwari at PS- Shahpur Kanjra was caught red handed for stamping ballots in favor of PML-N candidates in NA and PP. The polling bags of this polling station where sent to NADRA for thumb verification but were returned without checking by NADRA for non- availability of correct material.
NA-128 (Background)
On the basis of NADRAs report the tribunal ordered the production of all bags of NA 128 and PP160.
After a delay of three months when the tribunal judge threatened to lodge FIR against non-compliance that the bags eventually were produced before it.
The tribunal ordered forming of a commission for simple verification of PS of NA-128 but not of PP-160 for unknown reasons.

NA-122 IRREGULARITIES AFTER VERIFICATION ORDERED FOR 6 POLLING STATIONS
PTI Contesting candidate Imran Khan This is the constituency of the PTI chairman Imran khan where the counting process has been stopped because of the inter-Court litigations by Speaker National Assembly Sardar Ayaz Sadiq. Consistent request for Thumb verification of the entire votes have not been carried in-spite of Imran Khans vehement demands made at various forums. However, his running mate PP-147 (PTI MPA Shoaib Siddiqui) was able to convince Election commission to investigate the bags of 6 randomly selected polling stations.

PP 147 falls under NA 122 where evidence of ballot stuffing ascertained by the Election tribunal. Total number of polling stations -117 Verification of thumb impressions allowed-06

The RO had falsely added 958 votes to the results.

So, out of the 4726 official votes reported for these 6 polling stations:
Only 1459 votes were authenticated and verified. 3,267 were unverifiable. Out of which 1,654 were bogus votes. Votes which have been confirmed as bogus before the thumb print verification has even taken place.
