The respondent, who is a native ad citizen of El Salvador, appeals fom a Immigation
Judge's April 15, 2014, order.

The Depaent of Homelad Security (the "DHS") has not
responded to the appeal. The Immigration Judge's decision will be vacated, and the case
remanded to the Immigation Cour fr fer proceedings.
While unepresented by cousel, the respondent siged a wten stipulation pursuat to
8 C.F.R. 1003.25(b). This regulation allows an Immigration Judge to enter a removal order
without a heang if it is stipulated to by the respondent ad the DHS. The regulation requires
that, where the respondent is unrepresented, the Immigration Judge "must determine that te
alien's waiver is voluntay, knowig, ad itelligent." Id The April 15, 2014, "Order of te
Immigaton Judge" does not address tis regulator requirement. The now represented
respondent ha fled an appeal aguing, inter alia, that his due process rights were violated ad
that he has a far of ret to his countr of origin. Considering the entiret of circumstaces
presented, we will remand the case to the Immigation Judge fr fer proceedings.
ORER: The Immigration Judge's order of April 15, 2014, is vacated, ad te record is
remanded to the Imigration Court fr fher proceedings consistent with ts opinion.
