Oak Road, Cheadle
To report the receipt of an e petition signed by 10 signatories requesting the
Council to permanently resurface Oak Road, Cheadle and the avenues leading off
it.

In accordance with the Code of Practice no organisation has indicated that they
wished to address the Area Committee as part of the Open Forum arrangements.
(vi) Ward Flexibility Funding
To consider any applications for Area Flexibility Funding or to receive feedback
from organisations who have received funding.

The following development applications will be considered by the Area Committee:-

Single storey extension to the rear and two storey extension to the side. Internal
Alterations.
The Area Committee is request to recommend the Planning and Highways
Regulation Committee to grant planning permission, subject to the
conditions contained in the report.
(ii) DC056122 - The Malt Shovels, Councillor Lane, Cheadle Hulme (Pages 37 -
52)
Demolition of vacant and derelict former public house to provide new-build
convenience store (net trading area approximately 280 square metres) including
ATM and associated car parking.
The Area Committee is recommended to grant planning permission, subject
to appropriate arrangements to a commuted sum of 1,000 in order to
provide waiting restrictions across the site frontage and the planning
conditions contained in the report.

To consider a joint report of the Corporate Director for Place Management and

The Area Committee are requested to consider whether to dedicate a bridleway on a
section of footpath 40 Cheadle and Gatley over land owned by the Council, on Scholes
Playing Field, as shown marked A B on plan attached at Appendix 1.

13. CYCLE LINKS TO GATLEY RAILWAY STATION (Pages 97 - 110)
To consider a report of the Corporate Director for Place Management and Regeneration
The seeks the Area Committees comments regarding the proposed Cycle links to Gatley
Railway Station following the successful bid for funding from the Department for Transport
(DfT), via the Cycle City Ambition Grant (CCAG).
The Area Committee is requested to comment on the report and recommend the
Executive Councillor (Communities and Sustainability) approves the proposals
shown on drawing 0251/005 REV B, the cycle link between Springfield Road and
Beech Avenue through William Scholes Playing Fields (see drawing 0251/008), the
cycle links between the proposed Toucan Crossing and Brentwood Drive (subject to
consultation with affected residents and Ward Councillors) and the Traffic
Regulation Orders detailed in the report.

14. COUNCILLOR LANE - ROAD SAFETY IMPROVEMENTS (Pages 111 - 118)

The report sets out proposals intended to improve the levels of safety and reduce the
potential risk for road traffic incidents in the vicinity of the puffin crossing on Councillor
Lane.

A representative of the Democratic Services Manager submitted a report (copies of which
had been circulated) updating the Area Committee on progress since the last meeting on
decisions taken by the Area Committee and the current position on Ward Flexibility
Funding.

5. COMMUNITY ENGAGEMENT
(i) Chair's Announcements
The Chair advised the meeting on progress with regard to the repairs to the war memorial
on Cheadle Green, Cheadle.

(ii) Public Question Time
Members of the public were invited to put questions to the Area Committee on any matters
within the powers and duties of the Area Committee.
One public question was submitted from a member of the public enquiring whether the
Pavilion Building in Abney Park would be open to general lease in the near future.
The Chair advised that a report with regard to whether to extend the existing lease on the
Pavilion Building in Abney Park would be considered during a subsequent item on the
agenda for the meeting (Minute 9 refers).
(iii) Public Realm
David Wilson (Public Realm Inspector) attended the meeting to report on current issues
and to answer questions from Councillors and members of the public in relation to public
realm issues within the area represented by the Cheadle Area Committee.
The following comments were made/issues raised:-
The trees and vegetation which were obstructing the path from the main car park at
Bruntwood Park to the end of Bruntwood Lane needed to be cleared.
Whether action would be taken against fly tipping and people who had deposited
litter and glass in Cheadle Hulme Precinct
Litter bins were required at the car park and recycling facilities at Heald Green
Village Hall.
RESOLVED That David Wilson be thanked for his attendance.
(iv) Petitions
A representative of the Democratic Services Manager reported on the receipt of an e
petition containing 174 signatures requesting the Council to extend the current lease of the
Pavilion Changing Rooms in Abney Hall Park to Abney Garden Teas. A further hard copy
petition which had been started in 2012 and contained 250 signatures, including 71
signatures since 1 August 2014, was also submitted at the meeting.
RESOLVED That the e petition and hard copy petition be considered in connection with
the subsequent item on the agenda for the meeting regarding the renewal of a lease in
respect of the Pavilion Building, Abney Park (Minute 9 refers).
(v) Open Forum - Community Safety and Neighbourhood Policing Annual Report
Sergeant Greg Morgan (Greater Manchester Police), Rachel Smith (Community Safety
Operations Manager, Stockport Council) and Elaine Alkin (Neighbourhood Officer,
Stockport Council) attended the meeting to make a presentation in respect of the work of
the Safer Stockport Partnership to reduce crime in 2013/14 and to answer questions from
Councillors and members of the public in relation to Neighbourhood Policing issues within
the Cheadle area.

The following comments were made/ issues raised:-
The increasing prevalence of cyber crime and the need for residents to be vigilant.
Increasingly the Police used social media to convey messages, either via twitter or
facebook.
Some motorists did not adhere to the one way nature of the stretch of the Councillor
Lane service road from Brookhead Drive and this traffic order needed to be enforced.
Motorists continued to ignore the no right turn from Massie Street Car Park, Cheadle
onto the High Street and this needed to be enforced.
Victim-based crime, theft, violence, robbery, burglary and vehicle crime had all
increased in the Cheadle area between 2012/13 and 2013/14.
There needed to be improved linkages between the street lighting section of the
Council and the police in situations where the absence of an illuminated street light was
pertinent to a crime having been committed.
RESOLVED (1) That Sergeant Greg Morgan, Rachel Smith and Elaine Alkin be thanked
for their attendance.
(2) That the Area Committee be provided with information on the level of communication
between the street lighting section of the Council and the police.
(vi) Open Forum - Stockport Homes Neighbourhood Action Plans
A representative of the Chief Executive, Stockport Homes Ltd submitted a report (copies of
which had been circulated) providing an update on progress in the delivery of Stockport
Homes Neighbourhood Action Plans. The report also requested Councillors to comment
on further issues which the Action Plans may address in 2015/2016.
The following comments were made/ issues raised:-
A Member welcomed the continued support by Stockport Homes to customers through
Welfare Reform changes and the move to Universal Credit once this was rolled out in
November 2014.
Concern was expressed about anti-social behaviour and fly tipping at York Close and
The Cloisters, Cheadle.
Stockport Homes now had a dedicated Anti-Social Behaviour Officer to respond more
promptly to problems.
The improvements to the accommodation at York Close, Cheadle was commended.
Older residents needed protecting from anti-social behaviour in flats where the age limit
had been lowered.
The need to collaborate with other providers of social housing on the same estate
continued to remain an important issue.
Multi-agency working with residents who had mental health problems was raised.
RESOLVED That the report be noted.

(vii) Open Forum - Stockport Shopmobility
Mr John Leatherbarrow, Co-ordinator for Shopmobility, addressed the Area Committee on
the work of the organisation. He reported that Shopmobility provided scooters, wheelchairs
and sighted guides to take people to wherever they wanted to go in and around Stockport.
It cost 10 a year or 20 for life membership, and offered independence for over 1,500
people who used the service.
The following comments were made/issues raised:-
The feedback from Disability Stockport was that the access problems caused by
advertising boards had improved considerably.
Those present at the Area Committee were encouraged to attend Stockport
Disability Day in Mersey Square on 12 August 2014.
RESOLVED That John Leatherbarrow be thanked for his presentation and the services
provided by Shopmobility.
(viii) Ward Flexibility Funding
There were no funding applications to consider.
6. DEVELOPMENT APPLICATIONS
A development application was submitted.
(NOTE: Full details of the decisions including conditions and reasons for granting or
refusing planning permission and imposing conditions are given in the schedule of plans.
The Corporate Director for Place Management and Regeneration is authorised to
determine conditions and reasons and they are not therefore referred to in committee
minutes unless the committee makes a specific decision on a condition or reason. In order
to reduce printing costs and preserve natural resources, the schedule of plans is not
reproduced within these minutes. A copy of the schedule of plans is available on the
councils website at www.stockport.gov.uk/planningdecisions. Copies of the schedule of
plans, or any part thereof, may be obtained from the Services to Place Directorate upon

(i) DC055502 - Park Square, Bird Hall Lane, Cheadle Heath
In respect of plan no. 55502 for the erection of lighting columns to the upper floor of the
multi-decked car park at Park Square, Bird Hall Lane, Cheadle Heath, it was:-
RESOLVED That planning permission be granted, subject to the conditions contained in
the report.
7. APPEAL DECISIONS, CURRENT PLANNING APPEALS AND ENFORCEMENTS

listing any outstanding or recently determined planning appeals and enforcements within
the area represented by the Cheadle Area Committee.
RESOLVED That the report be noted.
8. POST DEVELOPMENT WORK - RESIDENTIAL DEVELOPMENT AT THE
DEMMINGS (NOW NAMED WENTWORTH GARDENS), CHEADLE
A representative of the Democratic Services Manager reported that this item had been
placed on the agenda at the request of Councillor John Pantall.
Councillor Pantall reported that the residential development at the Demmings, Cheadle
(now named Wentworth Gardens) was nearing completion and it was important that the
issues arising out of the development were managed efficiently. In addition to ensuring
that the planning conditions were adhered to, there were issues regarding the restoration
of the bridleway, the reinstatement of the grass verge on Oakmere Drive, repairs on Old
Wool Lane in order to ensure that the road was brought up to an acceptable and
sustainable standard, and landscaping works, including the provision of trees.
A representative of the Corporate Director for Place Management and Regeneration
reported that:-
All pre-commencement conditions had been agreed;
The measures to limit vehicular access to the bridleway had been implemented;
The grass verges had been reinstated;
In order to avoid further damage to the road surface, works to reinstate the road
surface would be undertaken following completion of the development, with the
works programmed to start in September this year and completed in October;
The Local Area for Play (LAP) would be provided in October this year. It was
understood that the developer had been waiting for the planting season;
Trees removed from the bridleway were located outside the application site.
RESOLVED That reports be submitted to the next meeting of the Area Committee on 23
September 2014 with regard to the planning conditions that are required to be adhered to
and other related issues, together with timetables for their resolution, in particular:-
the restoration of the bridleway to its previous condition;
the reinstatement of the grass verge on Oakmere Drive; and
repairs on Old Wool Lane in order to ensure that the road is brought up to an
acceptable and sustainable standard; and
landscaping works, including the provision of trees.
9. RENEWAL OF A LEASE IN RESPECT OF THE PAVILION BUILDING, ABNEY
PARK
A representative of the Democratic Services Manager submitted a report (copies of which
had been circulated) regarding a proposal to extend the lease on the Pavilion Building in
Abney Park to allow the occupants time to apply for planning permission in order to
develop their business model and to permit on-going monitoring of the lessee. Members

were reminded that at the meeting of the Area Committee held on 9 April 2013 they had
recommended that the Corporate Director for Corporate and Support Services be
recommended to grant a 1 year lease to Abney Park Tearooms CIC to operate from the
Pavilion Building, Abney Park.
The Area Committee commented on the proposal and was generally in support of granting
an extension to the lease for a further year (to September 2015), subject to the continued
monitoring of comments from users of the park.
RESOLVED That the Corporate Director for Corporate and Support Services be advised
of the Area Committees comments.
10. COUNCILLOR LANE AND COUNCILLOR LANE SERVICE ROAD, CHEADLE -
TRAFFIC REGULATION ORDER
A representative of the Democratic Services Manager submitted a report of the Corporate
Director for Place Management and Regeneration (copies of which had been circulated)
outlining the findings of a consultation exercise following an investigation into parking at
the junction of Councillor Lane, Cheadle and its service road, adjacent to 47 Councillor
Lane.
RESOLVED That the Executive Councillor (Communities and Sustainability) be
recommended to approve the following Traffic Regulation Order on Councillor Lane and
Councillor Lane Service Road, Cheadle at an approximate cost of 550 to be funded from
the Strategic Route Budget:-
Revocation of No Waiting Mon Fri 8.30 9.00am, 11.30am 2.00pm & 3.15pm
4.30pm
Councillor Lane, Cheadle - east side, from its junction with its service road (adjacent to
Nos 49 51) for a distance of 10 metres in a southerly direction.

COMMITTEE STATUS
Should the Cheadle Area Committee be minded to grant permission under the
Delegation Agreement the application should be referred to the Planning & Highways
Regulations Committee as the application relates to a Departure from the Statutory
Development Plan.
DESCRIPTION OF DEVELOPMENT
The application is seeking planning permission for a single storey rear extension and
two storey side extension.
The proposed single storey rear extension would project a maximum of 3.9m from
the original rear wall. The extension would be erected across the complete rear
elevation of 16.8m in width. It would be sited 1.4m from the common boundary with
No.159 Stanley Road and 1.8m from the common boundary with No.163 Stanley
Road. The overall height would be 3.2m with a flat roof
A two storey side extension is also proposed. It would begin level with the principal
front elevation. It would project out 3.4m from the existing side elevation and it would
have a length of 5.8m. Like the single storey rear extension, it would be sited 1.4m
from the common boundary with 159 Stanley Road. The eaves and overall height
would match the existing dwelling at 5.2m and 8.1m respectively. A matching hipped
roof would complete the extension.
The applicant proposes to finish the house in a white coloured render.

The applicants property is detached and from the inter-war period. It is located on
the southern row of Stanley Road. The property is located within the green belt. At
present the property is primarily composed of red brickwork, white windows and red
roof tiles on its hipped roof. It does have a front porch and a small detached garage.
Access is gained from Stanley Road and there is parking for at least three cars away
from the highway. The site is fairly level with no significant change in the gradient in
any direction.
The property has been extended in the past with a modest front porch but that
appears to be the only extension to the property built post 1
st
July 1948.
The surrounding properties are of a similar age and size to the applicants property.
They are also broadly similar in being relatively large detached properties. However,
there are minor architectural differences with regards to the finishes to the front
elevation. Some of the surrounding properties have also been extended in the past.
The surrounding streetscene can be described as being mixed and varied.
POLICY BACKGROUND
Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires
applications/appeals to be determined in accordance with the Statutory Development
Plan unless material considerations indicate otherwise.

Supplementary Planning Guidance (Saved SPGs & SPDs) does not form part of the
Statutory Development Plan; nevertheless it provides non-statutory Council
approved guidance that is a material consideration when determining planning
applications.
National Planning Policy Framework issued by DCLG on 27 March 2012 with
immediate effect (NPPF).
Paragraph 196 states that: The planning system is plan-led. Planning law requires
that applications must be determined in accordance with the development plan,
unless material considerations indicate otherwise. This Framework is a material
consideration in planning decisions.
NPPF Conformity
The Planning Advisory Services National Planning Policy Framework (NPPF)
Compatibility Self-Assessment Checklist has been undertaken on Stockports
adopted Core Strategy. This document assesses the conformity of Stockports
adopted Core Strategy with the NPPF and takes account of saved policies from the
Unitary Development Plan where applicable. No significant differences were
identified therefore the development plan is in conformity with the NPPF.

NEIGHBOURS VIEWS
The owners/occupiers of four surrounding properties were notified in writing of the
application. The neighbour notification period expired on the 2
nd
August 2014. One
letter of representation has been received regarding the application. It is from the
occupier of No.159 who is concerned that the flat roof of the single storey rear
extension could be used as a balcony area and this would invade privacy due to the
proximity to the common boundary.
ANALYSIS
Residential Amenity

The two properties either side of the applicants dwelling do not look to be adversely
affected by the proposed works. The proposed single storey rear extension would
not project past the rear elevation of No.163 Stanley Road which would result in an
acceptable impact upon this property.
The side elevation of No.159 Stanley Road contains no principal habitable room

windows at ground floor or first floor level, meaning the proposed two storey side
extension has an acceptable impact. The rear elevation of No.159 includes a
conservatory. The proposed single storey rear extension is well separated from the
conservatory, providing an acceptable impact. A condition would be placed on the
permission to stop the possible use of the single storey rear extension as a balcony,
which satisfies neighbour concerns regarding the application.
The properties on the other side of Stanley Road are approximately 50m away from
the applicants property and would not be unduly affected by the proposed scheme.
In view of the above, it is considered that the proposal would not unduly impact on
the residential amenity of all the surrounding properties in accordance with UDP
policy CDH1.8 and Core Strategy policy SIE-1.
Design
As mentioned previously, the streetscene is varied with a mixture of designs and
architectural diversity. The proposed two storey side extension is displaying
acceptable design, noting the use of a hipped roof which matches the existing
dwelling. Furthermore, a suitable distance of 1.8m has been left undeveloped from
the proposed side elevation to the side boundary, which complies with guidance
relating to a potential terracing effect.
The single storey rear extension is not visible from public vantage points and would
not be an incongruous addition to the streetscene.
The applicant proposes to finish the property in a white render. This is an acceptable
choice of material as a number of properties on Stanley Road have been rendered in
the past, including No.167 and No.175.
In view of the above, it is considered that the proposal would respect the design,
scale, materials, character, appearance and proportions of the existing dwelling and
would not result in harm to the character of the street scene, the visual amenity of
the area or the in accordance with UDP policy CDH1.8 and Core Strategy policy SIE-
1.
Energy Efficiency
Policy SD 2 from the adopted Core Strategy requires people undertaking extensions
to residential properties should take reasonable steps, where possible and practical,
to improve the energy performance of the existing dwelling. An energy efficiency
checklist has been submitted with the application, highlighting the potential for
energy efficiency measures to be undertaken.
In view of the above, it is considered that the application has complied with Core
Strategy policy SD-2
Green Belt
Saved UDP Policy GBA1.2 states that there is a presumption against the
construction of new buildings within the Green Belt unless it is for certain purposes,

including limited extension and alterations to existing dwellings. Saved UDP policy
GBA1.5 states that proposals relating to existing residential uses may be permitted
in certain cases, including alterations and extensions where the scale, character and
appearance of the property would not be significantly changed. The interpretation of
significant change will vary according to the character of the property but as a
general guideline, extensions which increase the volume of the original dwelling by
more than about one third are unlikely to be acceptable.
The material test to the acceptability of proposals within the Green Belt is the impact
of the siting, size and scale of the proposal on the character and appearance of the
dwelling and on the overall openness of the Green Belt.
The volume of the original dwelling as it stood on 1
st
July 1948 has been calculated
as 646m3 and the volume of the resulting dwelling has been calculated as 1031m3.
As such the volume of the existing extensions (6m3) and proposed extensions
(379m3) would total 385m3 and would represent a 60% increase on the volume of
the original dwelling.
In this respect, the volume of the proposed extensions would clearly exceed the one-
third increase in volume referenced in policy GBA1.5 and, as such, the proposal
would represent inappropriate development within the Green Belt by virtue of a
disproportionate addition.
Where development is considered inappropriate, it should only be granted where
special circumstances exist. The material test to the acceptability of proposals within
the Green Belt is the impact of the siting, size and scale of the proposal on the
character and appearance of the dwelling and on the overall openness of the Green
Belt. The agent for the application has submitted very special circumstances to
justify the scheme, the conclusions of which are provided below;
The property has permitted development rights and provides a realistic fallback
position for development. The agent has indicated the applicant could erect a two
storey rear extension and a single storey side extension without planning
permission. The theoretical extensions would result in a similar volumetric
increase compared to this application (60% in the application and the theoretical
extensions would equal 53%). Furthermore, the site could adequately handle a
large detached outbuilding, potentially resulting in a substantial volumetric
increase when compared to the original dwelling.
The property is located in ribbon development and has little effect on the
surrounding properties. The proposed side extension is separated by over 1.5m
to the side boundary with No.159 Stanley Road and the rear extension is over
1.8m to the boundary with No.220 Woodford Road.
The proposed extension does not unduly harm the openness of the green belt
due to the above factors.
It is acknowledged that the property is located within ribbon development on Stanley
Road comprising of many other residential properties, some of which have been
significantly extended in the past and some very recently like 175 Stanley Road in

June 2013.
The property benefits from full permitted development rights for the erection of
extensions/outbuildings. Therefore sizeable extensions could be constructed without
any control from the Local Planning Authority, to both the side and/or rear, as an
extension or detached outbuilding, which could significantly reduce the openness of
the green belt.
The applicant has submitted a plan to show their permitted development fallback
position and it would provide a realistic option should planning permission be
refused. The permitted development options would provide the living space that the
applicant desires. However, the scheme would potentially not demonstrate good
design and would appear as an awkward addition to the dwelling with a large single
storey flat roofed side extension that would be an incongorous addition to the
streetscene.
As mentioned previously, the theoretical permitted development extensions would
equal 53% of original dwellings volume. However, the applicant has not fully
exploited the permitted development fall back possibilities which could also include a
further flat roof single storey side extension and significant alterations to the roof
design. This would have a noticeable effect on the streetscene and also the green
belt, with the volumetric increase being over 60% upon the original dwelling.
The applicants site is fairly large. The use of potential outbuildings could take the
volumetric increase to over 150% on the original dwelling. This would cause
demonstrable harm to the openness of the green belt. The proposed scheme in this
planning application is the preferred option as it does demonstrate acceptable design
and would not be an incongruous addition to the streetscene.
Larger extensions albeit of a concentrated form can sometimes be accommodated
whilst avoiding harm to the overall openness of the Green Belt. In this instance the
resulting development is of a relatively concentrated form which overall, would be
sympathetic to the character of the area.
SUMMARY
The proposal would not unduly impact on the residential amenity of the surrounding
properties or prejudice a similar development by a neighbour, in accordance with
UDP policy CDH1.8 and Core Strategy policy SIE-1.
The general design of the proposed development is considered acceptable in terms
of its relationship to the existing dwelling, the character of the street scene and the
visual amenity of the area in accordance with UDP policy CDH1.8 and Core Strategy
policy SIE-1.
Other material considerations such as the Extensions and Alterations to Dwellings
SPD and the NPPF have also been considered and it is judged the proposal also
complies with the content of these documents.
Whilst the proposal constitutes inappropriate development it would have only limited

harm to the openness of the Green Belt and the case for very special circumstances
is sufficient to outweigh harm by reason of inappropriateness. On balance the
proposal amounts to Sustainable Development, consequently it is recommended that
permission be granted subject to appropriate planning conditions.

DESCRIPTION OF DEVELOPMENT
The application seeks permission to demolish the existing public house and
redevelop the site for a Spar convenience store.
The proposed replacement building would be sited in approximately the same
location as the existing public house occupying the western end of the site. The
proposed building would have a footprint dimensioning 23.2m wide x 20m deep. The
building has a modern design with a mono pitch roof sloping down to the western
boundary from a maximum height of 5m at the frontage to a height of 3.3m at the
rear. The building would be orientated to front onto the remainder of the site to the
east and this frontage would contain the main display windows and a central
entrance. The remaining elevations would be blank. Materials of construction
consist of low level brickwork and Kingspan panels for the non glazed walls,
kingspan panels for the roof and eaves. The frontage will be built from aluminium
frames with glazed panels and sliding entrance door. External roller shutters will
also be mounted to the frontage. An ATM point is included on the frontage.
The remainder of the site would be laid out as car park with 24 spaces and 2
disabled bays. Access to the site would be via a single existing western access
point from Councillor Lane which would be widened/modified. Servicing would be
carried out within the site and a new delivery bay provided in the north western
corner of the site. The plans identify a swept path turning manoeuvre within the car
park to allow a serving vehicle to reverse into the servicing delivery bay on the north
western site boundary.

noted that one tree in a the north west corner of the site lies within the adjacent land
owners land and has grown over to the application site. This is also recommended
for removal but that this will require agreement with the adjacent owner. All other
trees will be retained and some pruned/crown lifted to enhance their condition and
lifespan and outlook of neighbouring residents.
Hours of operation are specified as being from 7am to 11pm Monday to Sunday.
Deliveries would take place between 8am to 10pm Monday to Saturday.

SITE AND SURROUNDINGS
The application relates to the former Malt Shovels public house on Councillor Lane.
The pub is currently vacant and deteriorating in terms of its condition. The pub
building occupies the western end of the site and is a significant two storey red brick
structure with a pitched roof. Single storey elements with flat roofs project from the
front and rear elevations of building. A servicing bay lies to the rear of the premises
accessed via the car park and a set of gates. The remainder of the site is occupied
by car pork to serve the former pub served via access points off Councillor Lane. A
line of mature trees lies along the northern site boundary. A line of less significant
landscaping lies along the eastern site boundary.
The site is adjoined to the north by a row of residential properties on Adshall Road
which have rear elevations over looking the site and are separated by a 1.8 - 2m
high close boarded fence. To the north lies a single residential property that has its
side elevation facing onto the site. Residential properties lie on the opposite side of
the road on Councillor Lane looking onto the site. To the south lies a doctors
surgery.
POLICY BACKGROUND
The application site lies within a predominantly residential area in the UDP Review
proposals map. The following saved policies of the UDP review and Core Strategy

NEIGHBOURS VIEWS
The occupiers of 24 nearby properties have been notified in writing of the proposal.
A further 14 days consultation period has also been issued following a revision to
proposed opening times and receipt of the tree report.
In total letters of objection have been received from 7 residents on the following
grounds:
1. There will be noise from deliveries early in the morning and late in the evening.
2. The previous pub was bad enough and the proposed store will cause the same
problems of noise, traffic, car, parking, litter and lights.
3. Delivery vehicles will be parked at the bottom of residents gardens creating noise
and fumes.
4. The proposal will be a a source of alcohol related anti social behaviour.
5. The waste bins from the store will be a source of nuisance and disturbance from
fumes and odour.
6. There are enough conveniance stores in the area already another one is not
needed.
7. The proposal should not be allowed in a residential area.
8. The proposal will cause accidents on a very busy road.
9. The site should be used as a pub/restaurent to serve the local residents.
10. The existing boundary treatments are in varied states of repair. New secure
treatments should be provided to neighbours.
11. The existing trees are getting too large and should be lopped, felled and
maintained to improve residents outlook and amenity.
12. The proposal will affect property values.
13. Construction and demolition will be a source of disruption and nuisance.
14. The site should be for housing not shops.
15. Enough empty shops in Stockport and nearby the proposal should go to one of
these sites.

16. Customers will block nearby residents driveways.
17. The Council should pay for parking restrictions and remote bollards in front of
residents drives.
CONSULTEE RESPONSES
Highways Engineer:
There are a number of highways issues for consideration by the creation of this
convenience store on the site of a former public house.
The existing/previous use of this site has already established a vehicular access
onto Councillor Lane in this location and any traffic generation must also be weighed
against this use. The application has the benefit of a Transport Statement (TS) the
content of which has been fully assessed when considering the application.
The TS discusses traffic generation, accessibility by non-car modes, servicing and
car parking all of which are found to be within the acceptable criteria for this type of
development. However, issues arising from the TS are cycle and motor cycle
parking, servicing and accident data.
Although reference is made to cycle and motorcycle parking provision the supporting
plans do not show details such the location or type to be used. I would ask that this
is covered by condition.
The development proposes to modify one of the existing vehicular access points and
close the other which will provide some benefit in terms of junction proximity. The
proposed modified entrance is on the inside of a bend in Councillor Lane and does
not provide an ideal visibility splay. I am concerned that customers who wish to use
the ATM only, are likely to stop on Councillor Lane as close as possible to this facility
and park around the modified access obstructing visibility. I also note from the
supplied accident data that two of the accidents reported are associated with
vehicles parked on Councillor Lane. Therefore I would ask that a contribution is
made by the applicant of 1,000 towards the Councils costs of implementing waiting
restriction on Councillor Lane along the Development site frontage to provide
improved visibility for both drivers and pedestrians.
As the development is also within a residential area I would ask that a Servicing
Management Plan is produced to minimise the impact on residents by deliveries to
the convenience store
Recommendation: No objection subject to conditions
Retail Policy Officer:
The site is in a Predominantly Residential Area. Therefore, regard should be had to
saved UDP Review Policy CDH1.2 Non Residential Development in Predominantly
Residential Areas and Core Strategy policies DMP SIE-1 Quality Places, DMP SIE-
3 Protecting, Safeguarding and enhancing the Environment, DMP T-2 Parking in
Developments and DMP T-3 Safety and Capacity on the Highway Network.
The proposal seeks to provide a Spar convenience store at a vacant pub site at the

edge of Councillor Lane Other Local Centre. The existing pub is 500sq m and the
proposed A1 use would be approximately 280sq m net trading area. The proposed
floorplan indicates an 85sq m approx. store room and additional ancillary floorspace.
Therefore, the agent should clarify the gross floorspace of the proposal. There is no
planning policy objection in principle to the resultant loss of the A4 use and the
ancillary visitor accommodation at the site, which is outside Stockports centres.
Sequential Test
It is considered the site is edge of centre for the purpose of the NPPF sequential
test. UDP Review policy PSD2.1 (Retail Development in District and Local Centres)
indicates that edge of centre retail proposals will be required to satisfy the test of
need and to comply with the sequential approach. The floorspace involved in the
proposal falls below that referred to in the definition of a supermarket listed in the
UDP Review glossary and therefore references to supermarkets in the policy are
considered to be not relevant in this case. However, it should be noted that PSD2.1
sets out that Where a proposed retail development is adjacent to a centre but
separated from it by a highway or other physical restraint, the Council will require
that pedestrian flows can be safely and conveniently accommodated between the
proposed development and the centre at the developers expense. Thus the case
officer may wish to seek advice from colleagues on this issue.
It is noted that the GPDO would allow for the vacant Public House (500sq m gross,
300sq m sales area sales area data from Co-Star Focus commercial property
database) to be converted to A1 use, which creates a fallback position in assessing
retail impact and the sequential test. The agent has provided a sequential
assessment, which it is considered satisfies the NPPF sequential test and complies
with UDP Review policy PSD2.1 and Core Strategy policy DMP AS-3. Planning
policys vacancy surveys for spring 2014 show that 151-149 Councillor Lane, which
was previously identified as a sequentially preferable site, is occupied by a One Stop
Shop and Post Office, thereby being no longer available. In May 2014, 147
Councillor Lane, previously occupied by Spar, was the only vacancy in the centre. It
is considered that 147 Councillor Lane (180.2sq m gross) is too small to provide an
alternative site for the scale of the proposal and is thus not suitable with respect to
the NPPF sequential test. Similarly, the only vacancy in Adswood Other Local Centre
in spring 2014 was at 207 Garners Lane, which is approximately 50sq m and
therefore not a suitable alternative for the proposal.
Retail Impact Test
Core Strategy policy CS5 seeks to safeguard and enhance the vitality and viability of
Stockports Local Centres, seeking for the Local Centres to be anchored by
convenience goods development meeting local top-up shopping needs. Core
Strategy policy CS6 identifies Councillor Lane as an Other Local Centre. The policy
seeks to safeguard and strengthen Stockports centres and its hierarchy of centres.
The agent has provided a retail impact assessment, consistent with Core Strategy
policy DMP AS-3.

The draft findings of the Stockport Shopping Study Update 2014 by Hollissvincent,
show that the convenience goods capacity in The Stockport Catchment Area
(borough-wide and beyond) Under a Static Retention (80.1%) Scenario is 3201sq m
gross (2080sq m sales area) in the period 2014 to 2019, which rises to 7509sq m
gross (4881sq m sales area) over the longer period 2014-2024. If an increase in
retention from 80.1% in 2014 to 81.0% in 2024 is assumed, then the floorspace
capacity rises to 3872sq m gross (2516sq m sales area) in the period 2014 to 2019
or 9015sq m gross in the period 2014 to 2024 (5859sq m sales area). Subsequent to
these capacity figures being calculated, there has been a resolution to grant full
planning permission subject to a legal agreement (App Ref: 14/1904M) for a
proposal involving a 1579sq m GIA foodstore (assume 1026sq m net, of which
872sq m for conv. Goods sales area) and a 743sq m GIA unit (use classes A1 to A5
inclusive) at 10 London Road South, Poynton and planning permission has been
granted at Stockport Exchange (App Ref: DC/054978) for a mixed use proposal that

allows for up to 650sq m max net sales area of convenience goods floorspace which
are additional commitments to those identified in the Stockport Shopping Study
Update. Therefore, across the Stockport Catchment Area of the 2014 Shopping
Study (borough-wide and beyond), if the Poynton foodstore proposal was
implemented and the maximum net retail sales area of convenience goods
floorspace was developed at Stockport Exchange, under a static retention scenario,
there would only be 558sq m net sales area capacity remaining in the Stockport
Catchment Area. The site is located within the eastern part of Zone 9 of the draft
Stockport Shopping Study 2014. Zone 9 has a convenience goods localised
retention rate of 25-39.9%. There are pockets of deprivation to the south of the site
in the range 5% - 19.9% as assessed against the 2010 rank of IMD (compared to all
LSOAs).
The proposal would deter the occupation of the vacant Spar store at Councillor Lane
Local Centre by a convenience goods retailer and would impact on the turnover of
the One Stop Shop in the Local Centre. However, the above analysis shows the
impacts on Adswood Other Local Centre and Cheadle District Centre will not be
discernible. The healthy Councillor Lane Local Centre should be able to withstand
the retail impact of the proposal, particularly given that the One Stop Shop is a
multiple owned by Tesco that has recently opened in the centre. There is scope for
the impact on Councillor Lane Local Centre to be less than that identified where a
less conservative estimate of passing trade applied, which would be reasonable to
assume in this instance. However, on the other hand, there is scope for the assumed
sales density of the proposal site to increase in the event that a small format
supermarket retailer occupies the site instead of Spar, which justifies the
conservative impact estimates. Thus, although the proposal would undermine the
role of Councillor Lane Local Centre, contributing to the perpetuation of a vacancy in
the centre and undermining recent investment by the One Stop shop, conflicting in
these respects with the NPPF impact test and the aims of Core Strategy policies
CS5 and CS6, it is considered that the impact on Councillor Lane Other Local Centre
would not be significantly adverse, consistent with these policies. Furthermore, the
proposal would enhance both customer choice and convenience goods localised
retention rates in the local area and would generate linked trips to Councillor Local
Centre. In addition, the proposed sales area is slightly smaller than the existing sales
area of the pub, which demonstrates that the retail impact of the proposal is less
than would be generated by the impact of the implementation of the fallback position.
In respect of the NPPF, Core Strategy policies CS5, CS6 and DMP AS-3 and UDP
Review Policy PSD2.1, in the event that planning permission were to be granted for
the proposal, planning conditions should be imposed to control the following matters
to safeguard the vitality and viability of Councillor Lane Other Local Centre: -
Limit the gross floorspace of the retail unit to that proposed (to be confirmed
with the agent).

The net retail sales area of the retail unit, including any mezzanine floorspace,
shall not exceed 280sq.m. and within that limit the area devoted to
convenience goods floorspace shall not exceed 224sq.m. and the area
devoted to comparison goods floorspace shall not exceed 56sq.m.

The retail unit shall be used as a foodstore within Class A1 of the Schedule to
the Town and Country Planning (Use Classes Order) 1987 and for no other
purpose (including any other purpose within Class A1), or in any provision
equivalent to that Class in any statutory instrument revoking and re-enacting
that Order with or without modification.
The retail unit shall not be sub-divided into two or more independent units or
occupied by more than one independent company or trader.
Design Officer:
Although the frontage to Councillor Lane could be better animated, I raise no
objection to this application.
Nature Development Officer:
The development should be undertaken in full accordance with the section F.1
and F2 of the bat survey and assessment report to ensure there is no adverse
impact of the proposals on protected species.
The applicant should be encouraged to incorporate biodiversity enhancements
in to the scheme in line with national and local planning policy and a number of
other measures have been identified within the ecological report.
An informative should be attached to any permission which may be granted so
the applicant is aware that if at any time protected species are recorded on the
site, work should cease immediately and Natural England/LPA should be
contacted.
Environmental Health Officer (noise):
I have no objection to the hours bearing in mind the previous use. I would however
recommend that deliveries are restricted to 7am to 9pm on sat and Sunday. A
condition should be imposed to protect amenity from noise from fixed
plant/machinery and hours of operation/delivieries.
Tree Officer:
The proposed development on the site predominantly sits within the existing informal
garden area/hard standing area and the proposed changes will impact on the trees.
A full tree survey has been supplied as part of the planning application to show the
condition and amenity levels of the existing trees and where applicable which trees
could be retained to increase the amenity levels of the site with retained mature
trees.
There are two one main concern over the proposed scheme which is the loss of
trees on site and the lack of replacement planting in any proposed landscaping
scheme to off-set the loss of trees and hedges.
The site has a semi mature tree population along the rear residential boundary and
this has several poor specimen trees identified within the tree report which are
proposed for removal, whilst in principle these trees are poor specimens growing in
the wrong location they are still a net loss of tree cover and as such need to be off-
set by a detailed landscaping scheme to plant new trees in key locations to screen
the development and improve the biodiversity of the area.

The same principle relates to the trees along the front roadside boundary and as
such the same landscaping option would be required.
A detailed landscaping scheme would off-set the loss of the trees and enable the
scheme and site to improve its biodiversity and soften the development with
consideration being given to the use of evergreen species within the front and rear
as well as some hedges to improve screening.
In principle the design will have a negative impact on the trees on site and within
neighbouring properties, therefore it could only be accepted in its current format with
a greatly improved landscaping scheme with a large number of appropriate species
trees being planted as screening to the highway and the boundary with the existing
houses.
The following conditions would be relevant to any planning application relating to the
site;

Condition Tree 1
No existing tree within the site shall be cut down, topped, lopped, uprooted, wilfully
damaged or wilfully destroyed without the prior written approval of the local planning
authority, with the exception of those indicated otherwise on the approved plan. Any
hedgerows, woody plants or shrubbery removed without such consent or dying or
being severely damaged or being seriously diseased, within 5 years of the
development commencing, shall be replaced within the next planting season with
trees of such size and species as may be approved in writing by the local planning
authority.
Condition Tree 2
No development shall take place until all existing trees on the site except those
shown to be removed on the approved plans, have been fenced off in accordance
with BS 5837:2012 "Trees in relation to construction - Recommendations". The
fencing shall be retained during the period of construction and no work, excavation,
tipping or stacking of materials shall take place within any such fence during the
construction period.
Condition Tree 3
No development shall take place until details of all proposed tree planting, including
the intended dates of planting, have been submitted to and approved in writing by
the local planning authority. All tree planting shall be carried out in accordance with
the approved details prior to the development being brought into use.
ANALYSIS
At the out set is should be noted that there is an existing vacant public house on site
providing 500sqm gross/300sqm retail area in floorspace and under current planning
legislation that there is a permitted change from Public House use (A4) to retail (A1)
without the need for planning permission. This means the existing building could be
converted to a convenience store without any planning control from the Council. The
existing retail floorspace currently on site is slightly greater than that proposed
(300sqm existing/280sqm proposed) so the proposed use could be accommodated

into the existing building on site if the applicant wanted to operate from the existing
building format. This situation provides a legitimate fallback argument that is highly
relevant to the assessment of this application and benefits of the applicant in several
respects as will be outlined below. Putting the fallback position to one side the
application requires consideration in respect of the following areas:
1. Principle: Landuse and Retail policy.
The application site is allocated as lying within a Predominantly Residential Area.
Saved UDP policy CD1.2 will permit non residential development in such locations
provided there is no detrimental impact on residential amenity taking into
consideration a variety of issues including noise, traffic, parking, hours of operation,
proximity to dwellings, scale and impact on the character of the area. An
assessment of the impact of the proposal with regard to these areas follows within
the report section below. The existing lawful and unrestricted public house use is a
relevant factor and all impacts should be considered on their own merits but also in
comparison to those that could occur if the building was to be reused for its lawful
use. In respect of landuse principle it should however be noted that the development
does not therefore preclude this type of development from predominantly residential
areas.
The other key consideration in respect of planning principle relates to retail policy.
In this respect the fallback argument outlined above is again highly relevant as this
provides a substantial justification for the proposal. However, regardless of this
fallback case,and in accordance with policy requirements the application includes a
retail impact assessment and sequential test assessment as required by the NPPF
and development plan policies PSD2.1, CS5 and AS-3. In respect of this work a full
assessment has been undertaken by the planning policy officer as will noted from
comments above. In summary it is agreed that there are no sequentially preferable
sites. Furthermore although there would be some impact on Councillor Lane Other
Local Centre this would not be significantly. In respect of the two principle tests
(sequential site assessment and impact) the proposal is considered consistent with
national and local policy requirements. It should be noted that the proposal would
also offer some retail benefit in enhancing both customer choice and convenience
goods localised retention rates in the area and would generate linked trips to
Councillor Lane Other Local Centre. On this basis, even discounting the fallback
argument, there does not appear to be any grounds to resist the proposal in retail
policy terms. Conditions are recommended to limit the use of the premises/prevent
sub-division to safeguard the vitality and viability of Councillor Lane Other Local
Centre.
2. Residential Amenity.
The proposed site is sited close to residential properties. Notably properties on
Adshall Road back onto the site with rear elevations and gardens facing the site and
properties on Councillor Lane adjoin the site and lie on the opposite side of this main
road. As outlined above saved Policy CDH1.2 will permit non residential uses
provide there is no overall detrimental impact on residential amenity. Additionally
policy SIE-1 gives positive consideration to development which provides and
maintains satisfactory levels of privacy and amenity for neighbouring residents. The
proposal would introduce a retail convenience store to the site and replace the
existing public house. Commercial/retail activity is therefore not new in this location

and clearly the existing lawful public house use would generate traffic, noise and
disturbance from use and servicing and could operate to late in the evening. The
main consideration is therefore whether the proposed retail use would be
significantly worse than the fallback position.
The main impact from the proposed store relates to hours of operation for both
trading and deliveries. Hours proposed are 7am to 11pm Monday to Sunday for
trading and 8am to 10pm for deliveries Monday to Saturday. It should also be noted
that the service bay for the store is located on the north side boundary close to the
residential properties that back onto the site on Adshall Road. The proposal will
clearly have some impact on local residents from noise and disturbance when the
store is in general operation and from deliveries. Local residents have objected with
concerns on these grounds.
There will undoubtedly be some impact from the proposed store. The agent
estimates deliveries would be:
6 fresh deliveries a week (Mon Sat) by artic generally in the morning with an
approximate duration on site of 20 minutes.
Up to 2 ambient stock deliveries a week by artic (Mon Sat) any time during the
day into the evening with an approximate duration on site of 30 minutes.
Daily bread deliveries (Mon Sat) which tend to be earlier in the day with an
approximate duration on site of 5 10 minutes.
Newspapers delivered daily (early) into a container outside of the building.
The Council environmental Health Officer has been consulted on the application and
raises no objection to the proposal from a residential amenity point of view based on
the existing use of the site. Hours of operation are therefore considered satisfactory
however it is recommended deliveries should be from 8am until 9pm on a Saturday
(rather than 10pm as proposed). On this basis the above delivery schedule is also
not considered excessive. Whilst not directly comparable these deliveries should not
be significantly different to those that could occur at a public house and it should also
be noted the existing servicing arrangements to serve the pub are in the same
location as those proposed here i.e. against the northern boundary. The existing
public house is unrestricted in terms of hours of operation and would be likely to be
open later than the proposed store.
It is considered necessary to improve the existing northern boundary treatment with
a more uniform and substantial fence. The application also includes no details in
terms of lighting. Both matters can be satisfactorily dealt with by planning condition
and will ensure a improved and protected situation for residents than currently exists.
On this basis the proposal is considered to comply with policies CDH1.2 and SIE-1.
4. Design/Impact of building.
The existing building would be demolished and replaced with a modern convenience
store building. The present building is vacant, boarded up and alongside the
remainder of the site untidy and does not contribute positively to the locality. The
proposed building is a stand alone modern structure made from flat panel cladding, a
mono pitched roof and glazed frontage orientated towards the car park. The
proposal present a blank elevation to both sides and its rear elevation (apart form

areas designated for signage). The new building will be lower than the existing
building and, despite the modern design the proposal, offers the opportunity to tidy
up the appearance of the site to the benefit of the wider locality. The building does
not offer any animation directly onto Councillor Lane and whilst it would be good to
have some active frontage facing onto the highway this is not considered a
significant concern. The design officer has considered the proposal and raises no
objections to the development.
In terms of the physical impact of the building and works on nearby residential
properties the proposal is also considered to be relatively unproblematic. The
building will be sited no closer to the residential properties off Adshall Road than the
existing building and overall is lower in height. The physical impact of the building is
therefore not considered to raise any grounds of objection.
Overall the proposals would not materially harm the living conditions of local
residents or cause unacceptable harm to the quality of the local environment and as
such accord with policies CDH1.2 and SIE-1. Conditions should be imposed to
agree building materials.
3. Highways
The proposal has been supported by a Transport Statement and assessed by the
Councils Highways Engineer. The application raises no objections in terms of traffic
generation, parking provision, access or servicing taking into consideration the
existing use of the site and the modifications/layout proposed as part of this
proposal. The submission does not fully detail how cycle and motorcyle parking will
be accommodated on site however planning conditions can satisfactorily deal with
these matters. Accident records indicate there have been accidents associated with
the use of the site access and therefore it is considered necessary to provide waiting
restrictions across the site frontage to improve and provide safe visibility at the
access point. A commuted sum of 1000 from the applicant will be necessary to
deal with this. On this basis there are no highways reasons to resist the proposal
and the proposal is considered to comply with policies T-1, T-2 and T-3 of the Core
Strategy.
4. Trees and Wildlife
The application has been accompanied by a Bat Survey and Arboricultural
Development Report. Both documents have been assessed by the relevant
specialist officers at the council and their comments are enclosed above. In terms of
bats there are no objections raised to the proposal provided all demolition work is
carried out in accordance with the recommendations outlined in the report. In terms
of trees it is noted there is a mature line of trees along the northern site boundary.
These provide an attractive amenity feature for the locality and also provides
residents with a significant screen to the site and proposal. The tree reports
identifies that three trees within the site would be removed from the northern
boundary. A further tree (a large white poplar) lies in the grounds of an adjacent
property. This is also scheduled for removal subject to the adjacent properties
owners agreement. The remainder of trees are scheduled for pruning/crown lifting.
Residents have commented on the trees on site. The majority want the trees
retaining and or pruning. The proposal seeks to achieve this and the report
advocates that retention of the better species and compensatory planting would be

the best way forward. All existing trees to be retained would be protected during
construction This approach is supported by the Council Tree Officer who does not
object to the proposal subject to conditions relating to tree protection and
replacement planting.
Summary
Overall it is not considered that there are any planning issues sufficient to warrant
withholding planning permission subject to conditional control. The proposal would
not reduce the quality of the environment below a generally acceptable standard,
accords with the prevailing policies of the Saved UDP Review, LDF Core Strategy
and amounts to Sustainable Development. There are no outstanding issues of
concern and consequently it is recommended that planning permission is issued
subject to appropriate arrangements for the collection of 1000 for highways waiting
restrictions and planning conditions as referred to above.

Report of the Corporate Director for Place Management and Regeneration
1. Introduction
1.1 At the meeting of Cheadle Area Committee on the 5
th
August 2014, a
representative of the Corporate Director for Place Management and Regeneration
provided a verbal update regarding issues raised by Members and nearby residents
concerning the above site.
1.2 At the meeting, Councillor Pantall requested that a report be submitted to the
September meeting of Cheadle Area Committee to provide an update of the related
issues regarding the development.
1.3 Councillor Pantall reported that the residential development was nearing
completion and it was important that issues arising out of the development were
managed efficiently. Councillor Pantall requested a written update concerning the
following issues :-
Planning conditions that are required to be adhered to;
The restoration of the adjacent bridleway to its previous condition;
Re-instatement of the grass verge on Oakmere Drive;
Repairs on Old Wool Lane to ensure that the road is brought up to an
acceptable and sustainable standard;
Review of trees and landscaping.
2. Planning application
2.1 On the 20
th
December 2012, planning permission for the redevelopment of the
site (refer to Appendix 1 for approved site plan), comprising the demolition of the
existing buildings on site and the erection of 26 no. dwellings with associated
access, landscaping, open space and car parking was granted by the Council
following consideration by both Cheadle Area Committee and the Planning and
Highways Regulation Committee. (Reference : DC049456). The planning permission
was granted subject to conditions and an Agreement under Section 106 of the Town
and Country Planning Act 1990. A copy of the decision notice is attached at
Appendix 2.
2.2 Development of the site commenced in early 2013 and is nearing completion.

3. Planning conditions
3.1 A total of 29 conditions were imposed on the planning permission, some of which
were required pre-commencement of development, pre-occupation of development
and following completion of development. A requirement of the planning permission
is that the development must be implemented in accordance with the conditions
imposed.
3.2 Applications seeking to discharge relevant planning conditions were submitted to
the Council prior to the commencement of the development. It is confirmed that all
pre-commencement conditions have been agreed by the Council.
4. Restoration of bridleway
4.1 Condition 17 of the planning permission requires the provision of improvements
works to the Old Wool Lane bridleway to the East of the site.
4.2 The Council Highway Engineer has recently met with a representative of the
developer (Wain Homes) to discuss the works required to the bridleway. The final
package of bridleway works has been agreed and a legal agreement is in place. It is
anticipated that works will be undertaken in late October/early November 2014. A
written programme of delivery has been requested from the developer. The
developer will be writing to and advising nearly residents who would be affected by
the works in due course.
4.3 It is noted that recently and for a short period of time, the temporary barrier
control which has been in place across the bridleway has been removed. The
developer has, following instruction, put the barrier back in place to prevent
unauthorised vehicular passage between the adopted part of Old Wool Lane and the
adjacent industrial estate. The temporary measures will remain in place whilst
construction on site continues, with a permanent means of managing the use of the
route to be put in place when improvement works to the bridleway are undertaken.
5. Grass verges
5.1 Following concerns raised by Members and local residents, repairs to damage
caused by construction vehicles to grass verges on Oakmere Drive were undertaken
in early August.
6. Repairs to Old Wool Lane
6.1 Condition 16 of the planning permission requires the provision of improvement
works to Old Wool Lane and Oakmere Road.
6.2 In order to avoid further damage to the road surfaces, it has been agreed that the
road improvement works will be undertaken following completion of the
development.

6.3 The Council Highway Engineer has recently met with a representative of the
developer to discuss the works required to Old Wool Lane and Oakwood Road. The
final package of footway, carriageway and grass verge works has been agreed and a
legal agreement is in place. In is anticipated that the works will be undertaken in late
October/early November 2014. A written programme of delivery has been requested
from the developer. The developer will be writing to and advising nearly residents
who would be affected by the works in due course.
7. Trees and landscaping
7.1 In consideration of the planning application and with regard to trees within the
site, the Council Arboricultural Officer stated None are of great merit and any loss of
these trees will be compensated for by the proposed new planting
7.2 Conditions 3 and 4 of the planning permission require the submission and
implementation of a scheme of landscaping within the site. A scheme of landscaping
has been submitted and considered acceptable. As required by condition 4, the
landscaping scheme should be carried out within 6 months of completion of the
development.
7.3 Condition 9 of the planning permission requires the submission of a scheme for
the provision of a Local Area for Play (LAP) to the West of the site. A scheme for the
LAP has been submitted and considered acceptable. It is understood that the
developer has been waiting for the planting season and the LAP will be provided in
October 2014.
7.4 Member and local residents concerns raised to works to trees along the
bridleway are noted. However, as these trees are located outside the application
site, works to such trees cannot be controlled as part of the planning permission. The
Council Arboricultural Officer has confirmed that the two Council owned trees which
have been removed adjacent to the site will be replaced. Any concerns regarding
issues to works to trees outside the application site should be directed to the Council

9. Condition
With the exception of demolition, no development shall take place until a
scheme for the provision of a Local Area for Play (LAP) has been
submitted to and approved in writing by the Local Planning Authority. The
LAP shall be completed in accordance with the approved scheme and the
development shall not be occupied until the LAP has been laid out,
equipped and made available for use.

10. Condition
No existing tree within the site shall be cut down, topped, lopped, uprooted,
wilfully damaged or wilfully destroyed without the prior written approval of
the Local Planning Authority, with the exception of those indicated
otherwise on the approved plans. Any hedgerows, woody plants or
shrubbery removed without such consent or dying or being severely
damaged or being seriously diseased, within 5 years of the development
commencing, shall be replaced within the next planting season with trees
of such size and species as may be approved in writing by the Local
Planning Authority.
Reason
In order to protect existing trees on the site and to ensure compliance with
in accordance with polices SIE-1 : QUALITY PLACES and SIE-3 :

11. Condition
No development shall take place until all existing trees on the site except
those shown to be removed on the approved plans, have been fenced off
in accordance with BS 5837 : 2005 'Trees in relation to construction -
Recommendations'. The fencing shall be retained during the period of
construction and no work, excavation, tipping or stacking of materials shall
take place within any such fence during the construction period.

14. Condition

15. Condition
With the exception of demolition, no development shall take place (unless
otherwise agreed in writing by the Local Planning Authority) until detail
drawings of all highways within the approved development, which shall
include the following details, have been submitted to and approved in
writing by the Local Planning Authority :-
(i) A general arrangement based on a topographical survey and to

retained and remain available for use for parking at all times thereafter.

being occupied the approved travel plan shall have been brought into
operation and the shall be operated at all times thereafter that the
development is occupied and shall be reviewed and updated on an annual
basis in accordance with details that shall be outlined in the approved plan.
The travel plan and all updates shall be produced in accordance with
current national, regional and local best practice guidance and shall include
details on the method of operation, appointment of a Travel Plan
Coordinator/s, targets, infrastructure to be provided, measures that will be
implemented, monitoring and review mechanisms, procedures for any
remedial action that may be required and a timetable for implementing
each element of the plan.
Reason
To ensure that measures are implemented that will enable and encourage
the use of alternative forms of transport to access the site, other than the
private car and to ensure compliance with policies CS9 : TRANSPORT
AND DEVELOPMENT, T-1 : TRANSPORT AND DEVELOPMENT and T-3
: SAFETY AND CAPACITY ON THE HIGHWAY NETWORK of the adopted
Stockport Core Strategy DPD supported by the Supplementary Planning
Document SUSTAINABLE TRANSPORT.
22. Condition
No development shall take place until a method statement detailing how
the development will be constructed has been submitted to and approved
in writing by the Local Planning Authority. The method statement shall
include details on traffic management and control measures; details of
means of access to the site for construction and contractor traffic; details of
vehicles sizes, frequencies and programme for such movements; details of
hoardings and signage; parking arrangements; details of deliveries and
details of how and where materials will be loaded, unloaded and stored
and contact arrangements for site management. Development of the site
shall not proceed except in accordance with the approved method
statement.

23. Condition
No development shall take place until details of the precautions to be taken
to prevent the deposit of extraneous matter (mud, debris etc.) onto public
highways by vehicles travelling from the site, together with a timetable for
their implementation has been submitted to and approved in writing by the
Local Planning Authority. These precautions shall be implemented in
accordance with the approved timetable and shall be retained and
operated until such time as the Local Planning Authority agrees in writing
to their withdrawal
Reason
To ensure that the construction of the approved development does not
affect the safe operation of the highway network and to ensure compliance
with policy T-3 : SAFETY AND CAPACITY ON THE HIGHWAY NETWORK
of the adopted Stockport Core Strategy DPD.
24. Condition
The Site Investigation Report submitted has identified potentially
unacceptable risks from contamination and ground gas and further site
investigation is required. Unless confirmed in writing by the Local Planning
Authority that an Exploratory and/or Main Site Investigation is not required,
with the exception of demolition, no development shall take place until an
Exploratory and/or Main Site Investigation in accordance with a scheme to
be prior approved in writing by the Local Planning Authority, has been
carried out. Any Exploratory Site Investigation conducted shall be used to
inform any Main Site Investigation. The Main Site Investigation shall validly
conclude what if any remediation works are required. The investigation and
reports should be completed by competent appropriately knowledgeable,
qualified, trained and experienced person(s).

Reason
To ensure that any unacceptable risks from contamination to the future
users of the land and neighbouring land are minimised, together with those

the development can be carried out safely without unacceptable risks to

25. Condition
The Main Site Investigation identifies a need for remedial works at the site
then unless confirmed in writing by the Local Planning Authority that a
detailed remediation strategy is not required, with the exception of
demolition, no development shall take place until a detailed remediation
strategy and method statement to bring the site to a condition suitable for
the specified use by removing unacceptable risks to human health,
buildings and other property and the natural and historical environment has
been submitted to and approved in writing by the Local Planning Authority.
The remediation strategy and method statement should be completed by
competent, appropriately knowledgeable, qualified, trained and
experienced person(s).

The strategy to be submitted shall specify but not be limited to :-
(i) The proposed remediation objectives and remediation criteria;
(ii) All remedial works to be undertaken including the quantities of materials
to be removed from and imported to the development site;
(iii) The proposals for sourcing and testing all materials imported to the site
including testing schedules, sampling frequencies and actual and allowable
contaminant concentrations (as determined by appropriate risk assessment
in accordance with the document "Model Procedures for the Management
of Land Contamination" (CLR11)).

Reason

To ensure that any unacceptable risks from contamination to the future
users of the land and neighbouring land are minimised, together with those
to controlled waters, property and ecological systems, and to ensure that
the development can be carried out safely without unacceptable risks to
workers, neighbours and other offsite receptors in order to ensure
compliance with policy SIE-3 : PROTECTING, SAFEGUARDING AND
ENHANCING THE ENVIRONMENT of the adopted Stockport Core
Strategy DPD.

26. Condition
The development shall not be occupied until the approved remediation
scheme works have been implemented and a verification report for the
works and all issues relating to the required remediation measures at the
site has been submitted to and approved in writing by the Local Planning
Authority. The verification report shall provide an accurate and permanent
record of remediation and the standard it has achieved to support

compliance with agreed remediation objectives and criteria. It shall confirm
if any further remediation measures are necessary and indicate how and
when these measures will be undertaken. The report must also address
whether ongoing post installation management measures are required to
maintain and monitor the effectiveness of the remediation works and how
these will be implemented in a monitoring and maintenance plan.
Reason
To ensure that any unacceptable risks from contamination to the future
users of the land and neighbouring land are minimised, together with those
to controlled waters, property and ecological systems, and to ensure that
the development can be carried out safely without unacceptable risks to

27. Condition
With the exception of demolition, no development shall take place until a
scheme, prepared by a suitably qualified person, to protect the occupants
of the proposed dwellings from noise caused by aircraft movements to and
from Manchester International Airport has been submitted to and approved
in writing by the Local Planning Authority. No building shall be occupied
until the approved soundproofing measures have been incorporated into
the fabric of the building(s) and this has been certified in writing to the local
planning authority by the suitably qualified person.
Reason
In order to protect the occupants of the proposed dwellings from excessive
noise and to ensure compliance with saved policy EP1.10 : AIRCRAFT
NOISE of the adopted Stockport Unitary Development Plan Review and
policy SIE-3 : PROTECTING, SAFEGUARDING AND ENHANCING THE

28. Condition

has been submitted to and approved in writing by the Local Planning
Authority. The scheme shall subsequently be implemented in accordance
with the approved details before the development is completed. The

30. Statement under Article 31(1)(cc) of the Town and Country Planning
(Development Management Procedure) (England) Order 2010 (as
amended):
The Local Planning Authority worked positively and proactively with the
applicant to identify various solutions during the application process to
ensure that the proposal comprised sustainable development and would
improve the economic, social and environmental conditions of the area and
would accord with the development plan. These were incorporated into the
scheme and/or have been secured by planning condition. The Local
Planning Authority has therefore implemented the requirement in
Paragraphs 186-187 of the NPPF.
REASONS FOR DECISION
The Council has granted planning permission, subject to the conditions
listed above, because the proposed development is in accordance with all
relevant policies of the Development Plan (Saved UDP Policies, the Core

Strategy DPD, the Greater Manchester Joint Waste DPD and the Regional
Spatial Strategy for the North-West), as is required by Section 38 of the

ADDITIONAL INFORMATION
1. This permission should be read in conjunction with the Agreement under
Section 106 of the Town and Country Planning Act 1990, dated 20th
December 2012.
2. The applicants attention is drawn to the need to enter into an agreement,
under the Highways Act 1980, regarding the improvement works to Old Wool
Lane, Oakmere Road and the bridleway (for which there will be a fee). The

The Local Planning Authority should be fully informed as information is
produced, to confirm that the information is sufficient for the purpose intended.
Consultation with the Local Authority Environmental Health Officer and, when
applicable, the Environment Agency (EA) should cover methods of ground
investigation.
It is vital to consult the (EA) to ensure that potential risks to controlled waters
and underlying aquifers, caused by the creation of migration routes during site
investigation measures such as boreholes, are avoided.

5. Should contamination be suspected, found or be caused at any time when
carrying out the development that was not previously identified, the Local
Planning Authority should be notified immediately and development affected
or potentially affected by the contamination should stop and an investigation
and/or risk assessment and/or remediation carried out to establish the most
appropriate course of action. Failure to stop and notify may render the
Developer/Owner liable for the costs of any investigation and remedial works
under Part IIA of the Environmental Protection Act 1990.
7. Surface water run-off should be controlled as near to its source as possible
through a sustainable drainage approach to surface water management
{SUDS). SUDS are an approach to managing surface water run-off which
seeks to mimic natural drainage systems and retain water on or near the site
as opposed to traditional drainage approaches which involve piping water off
site as quickly as possible. SUDS involve a range of techniques including
soakaways, infiltration trenches, permeable pavements, grassed swales,
ponds and wetlands. SUDS offer significant advantages over conventional
piped drainage systems in reducing flood risk by attenuating the rate and
quantity of surface water run-off from a site, promoting groundwater recharge,
and improving water quality and amenity.
The variety of SUDS techniques available means that virtually any
development should be able to include a scheme based around these
principles.

Under the terms of the Water Resources Act 1991, and the Land Drainage
Byelaws , the prior written consent of the Environment Agency is required for
any proposed works or structures, in, under, over or within 8 metres of the top
of the bank of Micker Brook which, is designated a 'main river'.
The Environment Agency has discretionary powers to carry out maintenance
works on the channels of "main river" watercourses to remove blockages and
ensure the free flow of water. The responsibility for the repair and condition of
Micker Brook, its channel, banks and adjacent structures, lies ultimately with
the riparian owner.
6. The CLAIRE Definition of Waste : Development Industry Code of Practice
(version 2) provides operators with a framework for determining whether or
not excavated material arising from site during remediation and/or land
development works are waste or have ceased to be waste. Under the Code
of Practice :-
excavated materials that are recovered via a treatment operation can
be re-used on-site providing they are treated to a standard such that they fit
for purpose and unlikely to cause pollution
treated materials can be transferred between sites as part of a hub
and cluster project
some naturally occurring clean material can be transferred directly
between sites. Developers should ensure that all contaminated materials
are adequately characterised both chemically and physically, and that the
permitting status of any proposed on site operations are clear. If in doubt,
the Environment Agency should be contacted for advice at an early stage to
avoid any delays.
The Environment Agency recommends that developers should refer to their
Position statement on the Definition of Waste : Development Industry Code
of
Practice and;.
Contaminated soil that is, or must be disposed of, is waste. Therefore,
its handling, transport, treatment and disposal is subject to waste
management legislation, which includes:
Duty of Care Regulations 1991
Hazardous Waste (England and Wales) Regulations 2005
Environmental Permitting (England and Wales) Regulations 2010
The Waste (England and Wales) Regulations 2011
Developers should ensure that all contaminated materials are adequately
characterised both chemically and physically in line with British Standard BS
EN 14899:2005
'Characterization of Waste - Sampling of Waste Materials - Framework for the
Preparation and Application of a Sampling Plan' and that the permitting status
of any proposed treatment or disposal activity is clear. If in doubt, the
Environment Agency should be contacted for advice at an early stage to avoid
any delays. If the total quantity of waste material to be produced at or taken

off site is hazardous waste and is 500kg or greater in any 12 month period the
developer will need to register with us as a hazardous waste producer.
9. Developers are asked to ensure that all publicity and contractual documents
to be viewed by prospective purchasers contain details of the location,
landscaping, surfacing and equipment for all proposed Local Areas for Play
(LAPs) within the site.
10. Further information upon the appropriate design of Local Areas for Play
(LAP's) may be found in the Supplementary Planning Guidance Note
'Recreational Open Space and Commuted Sum Payments' published by the
Local Planning Authority.
11. This decision does not imply consent to carry out any work which may
encroach over a common boundary. Such work may include excavation,
positioning of walls, fences or other construction such as roofs or gutters
which overhang the boundary line. The applicant is therefore advised to obtain
the consent of any landowner prior to the commencement of such work. The
applicant attention is also drawn to the provision of the Party Wall Act 1996,
which sets out the rights and responsibilities of adjoining landowners in
respect of the construction or alterations of any party walls, excavations and
other construction works adjacent to the boundary line. Before proceeding
with the development professional advice on the provision of the Act should
be sought.
12. Your attention is drawn to the Councils Supplementary Planning Document
entitled 'Sustainable Design and Construction' which provides guidance on
sustainable design and construction in relation to current development plan
policy.
13. The council encourages the highest standards of construction and invites all
developers of new houses to consider and utilise the Code for Sustainable
Homes in order to achieve the highest possible sustainability rating.
14. In view of the presence of a protected species on or close to the site, the
applicant should bear in mind the need to obtain an appropriate licence from
Natural England prior to development commencing.
15. This planning permission has been granted subject to an agreement between
Stockport Metropolitan Borough Council and the applicant for an extension in
time to determine the application until the 21st December 2012 to allow the
signing of an Agreement under Section 106 of the Town and Country Planning
Act 1990.

For most types of application you have six months to appeal from the date of the
attached Decision Notice. However if the decision involved the refusal of planning

1 MATTERS FOR CONSIDERATION
1.1 Committee are requested to consider whether to dedicate a bridleway on a
section of footpath 40 Cheadle and Gatley over land owned by the Council, on
Scholes Playing Fields, Gatley, as shown marked A - B, on plan attached at
Appendix 1.
2 BACKGROUND
2.1 The funding for the access improvement project in Gatley is from Transport
for Greater Manchester as part of the Cycle City Ambitions Grant. The access
improvement project will guarantee the implementation of a 20 miles per hour zone
between Beech Avenue to Gatley Station.

2.2 A significant obstacle in linking the use by equestrians and cyclists between
Foxland Road and Hawthorn Road will be removed through the dedication to a
bridleway.
2.3 As part of the drive to reduce carbon emissions and other greenhouse gases,
the proposed dedication of a bridleway will increase accessibility to other areas of
the community without needing to drive.
2.4 The proposed bridleway will provide the pupils attending nearby schools,
especially Kingsway School with a safer and healthier travel option to school. It is
especially so, as the government is encouraging the public to walk and cycle more
often.
2.5 If dedicated, the bridleway will form beneficial links for the already existing
network of highways by providing an additional cycle route to Gatley Station amongst
other destinations.
2.6 It is considered that the bridleway will add to the number of beneficial local
circular routes and useful links to longer distance routes leading out of the Borough.
The bridleway would be maintainable at public expense once dedicated.
3. DESCRIPTION OF THE ROUTES
3.1 The route which is the subject of this report is shown on the plan attached at
Appendix 1, and is as follows:-
1 proposed bridleway between points A - B as shown on the plan at Appendix 1
- Point A (end of adopted highway at Foxland Road), along a westerly direction via
the railway viaduct for a distance of 66.7 metres to Scholes Playing Fields, then
continues in a generally north westerly direction for a distance of 375.8 metres to
Hawthorn Road at Point B.
4. LEGAL POSITION

4.1 The Council has the power under Section 2 Local Government Act 2000 to do
anything which they consider promotes or improves the economic, social or
environmental wellbeing of their area.
4.2 A landowner can dedicate a public right of way across their land for the use of
the public if they wish to do so. As landowner, the Council may dedicate the route for
use by the public and on dedication, the path will become maintainable at public
expense.
5 RECOMMENDATIONS:
5.1 That Committee resolve to:-
(i) dedicate a bridleway over the route between points A B.

Cycle Links to Gatley Station
Report of the Corporate Director for Place Management & Regeneration
1. INTRODUCTION AND PURPOSE OF REPORT
1.1 To seek comments regarding the proposed Cycle links to Gatley Railway Station
following the successful bid for funding from the Department for Transport (DfT), via
the Cycle City Ambition Grant (CCAG).
2. INFORMATION
2.1 Members may be aware that the Council has been granted funding from the DfT to
provide cycle safety improvements on/off the highway within the Borough. Funding
has been made available throughout Greater Manchester for selected similar
schemes, where it was agreed that significant real or perceived hazards to cyclists
had been identified. One of the schemes proposed is to upgrade the existing
pedestrian crossing on Gatley Road to a Toucan Crossing. A Toucan Crossing is a
signal controlled crossing in which both pedestrians and cyclists can use there are
now numerous examples of these in use throughout Stockport.
2.2 Underpinning all CCAG proposals, both across Greater Manchester, and nationally,
is the objective of providing for people who are not confident enough to cycle in traffic
some form of segregation from traffic, or use of lightly-trafficked roads, is seen as
key. Both the DfT and cycling champions now hold the view that without this type of
step-change in cycle route infrastructure, the desired growth in levels of cycling will
not materialise.
2.3 The proposed Cycle Links to Gatley Station would enable people within a sizable
catchment area around the station to either cycle or walk there without being in traffic
along any busy road. It is reasonable to suppose that more residents could thus
travel into central Manchester, via a train to Piccadilly, without using a car.
2.4 To allow cyclists to gain access to the crossing point it is proposed to widen the
eastern footway of Oakwood Avenue and the southern footway of Gatley Road. This
will allow the Council to provide a shared use pedestrian/cycle facility on both sides
of the crossing. To allow cyclists to access/egress the facility on Oakwood Avenue it
is proposed to extend the existing double yellow lines on the east side of Oakwood
Avenue by approximately 10 metres. The Council is also in discussions with Network
Rail to ascertain if the existing retaining wall can be re-constructed to the south west
of the bridge structure so to provide additional shared space and visibility at the
corner of Gatley Road and Oakwood Avenue. (See drawing 0251/005 REV B for
details).
2.5 It is also proposed to introduce a 20mph speed limit within the residential areas on
both sides of Gatley Road to provide a safer environment for vulnerable road users,
(pedestrians/cyclists). See drawing 0251/002 for the limits of the 20mph zone.

2.6 Three automatic traffic surveys were undertaken to ascertain actual vehicle speeds
within these residential areas. The surveys revealed the following:
Belmont Road
Average Speed North Bound = 14.4 mph;
Average Speed South Bound = 15.3 mph.
Oakwood Avenue
Average Speed North Bound = 18.3 mph;
Average Speed West Bound = 17.4 mph.
Pendlebury Road
Average Speed North Bound = 19.2 mph;
Average Speed South Bound = 18.3 mph.
2.7 The last three years accident statistics have also been ascertained. These revealed
12 incidents. Nine of which occurred on Church Road (eight classed as slight severity
and one classed as serious), two occurred at the junction of Gately Road/Oakwood
Avenue (both classed as slight severity) and one on Old Hall Road (classed as slight
serverity).
2.8 Consultation Gatley Road Toucan Crossing
A consultation exercise was undertaken with residents of 1-5 Oakwood Avenue, The
Hollies and 94-96 Gatley Road with regards to the crossing upgrade. The Council
received five replies expressing the following concerns:
i) Some residents were concerned that extending the double yellow lines by 20
metres on Oakwood Avenue will only displace more vehicles closer to the
reisential properties.
Following this comment the Network Engineer has reduced the extent of the
double yellow lines to 10 metres. This will mean displacing two vehicles
rather than the four if the original proposal was approved. The double yellow
lines are required to allow cyclists to safely access/agress the shared use
footway on the eastern side of Oakwood Avenue.
ii) A concern was raised regarding congestion if the junction of Oakwood Road
with Gatley Road was narrowed to accommodate the shared use facility.
The Network Engineer has observed this junction in both the morning and
evening peak periods. Queuing does occur on occasions but is not constant.
Vehicles also try to form two lanes when exiting Oakwood Avenue which is
very tight/unsafe as some vehicles wishing to turn left (although it was
observed that there was not many left turners at this junction) mount the
footway to by-pass the queuing right turners. The proposed widening of the
eastern footway would physically prevent two lanes forming as the lane
widths will be reduced to normal single lane widths.
iii) One consultation reply was concerned about the safety implications of
pedestrians/cyclists sharing the footway on the approaches to the crossing.

The Council will be providing shared use signing on all approaches to the
crossing warning pedestrians/cyclists of the shared use facility. Further the
footways in the area will be widened to 2.5 3 metres so to safely
accommodate both cyclists and pedestrians.
iv) A number of the residents requested that a resident permit parking scheme
should be introduced on Oakwood Road as some residents sometimes have
issues with parking adjacent there properties.
In order for the Council to gauge the level of support amongst all households
on the street a petition of signatures needs to be collected, indicating that a
minimum of 51% of households in the street would support the introduction
of a scheme; whether this is for a whole street, part of a street or more than
one street.
2.9 Consultation 20mph Speed Limit
The Council delivered 1300 consultation letters/drawings to the streets affected by
the scheme. 217 replies were received (16.7%), of these 181 (84%) were for the
proposal and 35 (16%) were against it. Of the replies that were against the proposal
the majority thought it was a waste of tax payers money as vehicles tend to drive at
or below 20mph and that drivers who currently ignore the 30mph speed limit will
ignore the new 20mph limit.
The Corporate Director would comment that introducing a 20mph speed limit on
these streets will highlight to drivers that they are no longer on the Strategic Highway
Network and that they have entered a residential area. It is hoped that drivers will
adjust their speed accordingly and take into consideration the vulnerable roads users
in the area.
2.10 Both these schemes will link into the proposed cycle link through William Scholes
playing fields between Springfield Road and Beech Avenue (see drawing 0251/008).
The Council is also trying to negotiate with Network Rail and other landowners with
regards to cycle links through/around the station car park through to South Park
estate which will link into the A34 Cycle scheme recently constructed. The type of
less confident cyclist referenced in 2.2, above, could cross the boundary into
Manchester, and access the Mersey Valley and, eventually, the Trans Pennine Trail.
3. FUNDING
3.1 The estimated cost of the scheme to upgrade the crossing, resurface footways and
carry out retaining wall works is 200K
The estimated cost of the 20mph zone is 20k.
Both these elements have been included in the 2014/15 Highway Capital Programme
and will be funded from Cycle City Ambition Grant.
4. CONCLUSIONS AND RECOMMENDATIONS
4.1 The Area Committee is asked to comment on this report and recommend that the
Executive Member (Communities and Sustainability) approves the proposals shown

on drawing 0251/005 REV B, the cycle link between Springfield Road and Beech
Avenue through William Scholes playing fields (see drawing 0251/008), the cycle
links between the proposed Toucan Crossing and Brentwood Drive (subject to
consultation with affected residents and Ward Members), and the following traffic
regulation orders.
4.2 Moving Traffic Regulation Order
The following areas of footway are to be converted into a cycle track under Section
65(1) of the Highways Act 1980 so to provide a shared use cycle/pedestrian facility:
i) Cambridge Road, Gatley, east side, from its junction with Gatley Road for a
distance of 15 metres in a northerly direction.
ii) Gatley Road, Gatley, north side, from its junction with Cambridge Road for a
distance of 52 metres in a easterly direction.
iii) Gatley Road, Gatley, south side, from its junction with Oakwood Avenue for a
distance of 20 metres in a easterly direction.
iv) Oakwood Road, Gatley, east side, from its junction with Gatley Road for a
distance of 25 metres in a southerly direction.

Councillor Lane - Road Safety Improvements

1. INTRODUCTION AND PURPOSE OF REPORT
1.1 To outline proposals intended to improve the levels of safety and reduce the potential risk
for road traffic incidents in the vicinity of the Puffin Crossing on Councillor Lane
2. INFORMATION
2.1 The Greater Manchester Casualty Reduction Partnership (GMCRP) invited Local Authority
partners to submit bids to fund collision and casualty reduction projects in May 2014. The
bid submission had to show that casualty savings could be made from areas that had
concentrations of Killed and Seriously Injured (KSI) incidents within the period 2008 2012.
2.2 The number one site determined from the KSI density summary information provided by
GMCRP was the area of Councillor Lane shown below. In the period 2008 - 2012, there
were nine injury incidents, resulting in:
5 serious (3 child pedestrians; 1 pedal cyclist and 1
elderly pedestrian)
4 slight incidents (1 pedestrian; 1 child cyclist; 1 adult
pedal cyclist and 1 car driver)
incidents at the crossing both involved children
2 pedestrian incidents at Peover Walk (1 child)
1 serious child pedestrian from central grass verge
2 serious incidents at the service road I elderly
pedestrian and an adult cyclist
*There was a further serious injury at the crossing in
February 2014 which involved a child on a scooter
(although this incident is relevant to the scheme; it was
outside of the data period considered for the funding and
so was not included as part of the submission).
2.3 Traffic Services Officers compiled a successful bid for a potential local safety scheme and
were awarded 41k to deliver engineering improvement measures.
3. SCHEME OBJECTIVES
3.1 The main objective of the scheme is to target child pedestrian incidents in and around the
area of the shops on Councillor Lane. There is evidence of child pedestrians entering the
carriageway at the puffin crossing against the green signal for traffic. There are another 2
serious incidents either side of the crossing where a child has entered the carriageway and
has suffered serious injuries. The intention is to target the child pedestrian incidents
through both Engineering and Education Training & Publicity (ETP) proposals.
3.2 The Engineering measures seek to improve visibility to and from the crossing by removing
a large tree; relocating bus shelters to the back of footway as they are obscuring forward

visibility; reforming pathways and providing a safer place to cross the service road (not in
between parked cars). Appendix A includes photographs highlighting the problem areas.
3.3 The Educational measures will be aimed at the problem of children crossing in between
parked vehicles and entering the carriageway without due care. It is proposed to develop
educational resources for schools including a DVD. We propose to film our Step Outside
initiative in operation showing the correct way to cross busy roads which are parked up with
vehicles; and also how to use a number of controlled crossings. A member of the Road
Safety Team would head up the session talking to a small number of children and going
through Step Outside programme. The crossing points would be at a number of locations
within Stockport; and we intend to produce 200 DVDs for circulation to all Schools following
Road safety visits for Safety initiatives such as Operation Eagle Eye.
4. SCHEME PROPOSALS AND CONSULTATION
4.1 The main aim of the scheme is to improve visibility of the puffin crossing for both
pedestrians and road users together with improving pedestrian crossing facilities across the
Service Road. The proposals also include formalising the parking arrangements including
alterations to the waiting restrictions on the South side of the Service Road near the
junction with Councillor Lane.
4.2 A consultation of 45 properties was undertaken between 8

4.3 There were 8 (18%) responses to the consultation and the results were:

5. COSTS AND FINANCIAL JUSTIFICATION
5.1 It is estimated that the engineering package of measures proposed would cost in the region
of 41k. The funding will be met from the successful GM Casualty Reduction Partnership
Award Fund bid for (GMCRPAF) 2014/15.
5.2 Based on current injury accident costs (Appendix A - DfT 2012), the all injury average cost
is 72,739. The nine incidents total a cost of 654651 or 130,930 per year. The treatments
would seek to save at least three of the nine incidents over the 5 -year period; this would
equate to savings of 218,217 or 43,643 per year.
The First Year Rate of Return (FYRR) would thus calculate to:
FYRR = Accident Cost Savings x 100 = 43643 x 100 = 106%
Scheme Cost 41,000
The scheme would achieve savings within the current guidelines which indicate that first
year rate of returns should be in excess of 100%, with a one third reduction in casualties.

5.3 Appendix C includes costs for the scheme and also details the additional match funding
element from the Council to be met from the Road Safety Revenue Fund.
6. RECOMMENDATIONS
6.1 The Area Committee is requested to recommend that the Executive Councillor (Economic
Development & Regeneration) approves the proposals stated in this report and the
following traffic regulation orders.

The incidents record potential lack of due care on the part of the child pedestrian as a contributory
factor. An education resource is proposed to deal with this problem and that the DVDs will be

developed and that these will contribute to additional incident savings throughout the Borough;
although it is hard to attribute them directly to this initiative.

1. INTRODUCTION AND PURPOSE OF REPORT
1.1 To report the results of a consultation exercise and to seek approval for the
introduction of a Traffic Regulation Order (TRO).
2. INFORMATION
2.1 Traffic Services received requests with regards to parked vehicles causing safety
issues on roads in the vicinity of Etchells Primary School, Heald Green.
2.2 It had been citied that parked vehicles were causing a narrowing of the highway and
a lack of forward visibility particularly on East Avenue at its junctions with Hambleton
Road and Merwood Avenue, Heald Green. It had also been said that the situation
was at its worst during the school start and finish periods.
2.3 Therefore, as a result of the requests, the Ward Spokesperson was contacted and it
was agreed to attend a site visit with the Ward Spokesperson and a Ward Councillor
at the end of the school day to assess the situation.
2.4 During the site visit it was observed that vehicles were being parked on both sides of
the carriageway and at junctions, which did result in a narrowing of the carriageway,
reduced forward visibility which inhibited traffic flow.
2.5 It was agreed that a consultation exercise would be conducted with local residents
on a proposal to introduce traffic management measures (No Waiting at Any Time)
outlined on plan NM8/4551/2014/001.
2.6 A total of 21 letters were delivered, of which 11 (52%) replies were received. Of the
replies 9 (82%) were in favour of the proposal, 1(9%) was against and 1(9%) did not
specify a preference. Comments received as part of the consultation can be found in
Appendix A.
2.7 The Ward Spokesperson, having been issued with the results of the consultation,
requested that the matter be referred to the Cheadle Area Committee for a decision.

1. INTRODUCTION AND PURPOSE OF REPORT
1.1 To report the findings of a consultation exercise and to seek approval for the
introduction of a Traffic Regulation Order (TRO).
2. INFORMATION
2.1 As the result of a recent Planning Application for Gatley Reformed Church on Elm
Road, local residents were advised to contact Traffic Services with their concerns
regarding traffic issues.
2.2 It had been citied that that through traffic had increased and that parked vehicles
were causing a narrowing of the carriageway with vehicles often parking half on the
footway.
2.3 Therefore, the Ward Spokesperson was contacted and it was agreed that a
consultation should take place with local residents on a proposal to introduce No
Waiting at Any Time (Double Yellow Lines) and a Restriction of Waiting 8am 11pm
(Single Yellow Line).
2.4 From a total of 21 letters delivered, 13 (62%) replies were received. Of the replies,
10 (77%) were in favour of the proposal, 2 (15%) were against and 1 (8%) did not
specify a preference. However, 7 replies also stated that they would prefer No
Waiting at Any Time in place of the proposed restriction of waiting and 1 reply
requested the introduction of a Disabled Persons Parking Bay.
2.5 As a result of the response to the consultation, the Ward Spokesperson was issued
with an amended proposal as outlined on plan NM8/4713/002.
2.6 Having considered the response to the scheme consultation and the amended
proposal, the Ward Spokesperson requested that the matter be referred to the Area
Committee for a decision.

1.1 To request funding for the introduction of an A Frame on Motcombe Road, Heald
Green.

2.1 At the request of the Ward Spokesperson, Traffic Services were asked to investigate
concerns regarding the passageway entrance to Rose Vale Park.
2.2 The local Police had raised the issue that motorised bikes were using the
passageway to cut through to the park.
2.3 Therefore, as the area forms part of a Public Right of Way (PROW), a site meeting
was held with a PROW Officer to assess what could be done to assist.
2.4 It was suggested that as the entrance to Rose Vale Park from Rosevale already had
an A Frame in place it would be useful to replicate this on the passageway from
Motcombe Road.
2.5 This recommendation was discussed with the Ward Spokesperson and it was
agreed to obtain a costing for this recommendation.
2.6 After considering the cost, the Ward Spokesperson requested that the matter be
referred to the Area Committee for a decision.

Summary:
At present the monthly Cheadle Makers Market organised by Niche Event Hire is being
held on the car park at the rear of the White Hart Tavern. The Cheadle Village Partnership
is requesting that the organisers be permitted to extend the market onto Hall Street Green;
initially for the next two market dates. It is anticipated that if approved a similar application
will be submitted for the Green/White Hart to become a regular market venue in 2015,
interchangeable with a proposal to hold the market, limited to three dates, on Cheadle
Green.
This application is for 10 producer stalls to be located on Hall St Green, selling a range of
speciality goods from hot and cold food stuffs to hand-made jewellery. It is not known what
percentage of the stall holders will be locally based. However the organisers encourage
local traders to be involved and offer first refusal on a pitch.
Saturday parking is of concern along Hall Street and other side roads. The organisers
have accounted for this in their management plan. The addition of 10 stalls on the Green
should not exacerbate this issue unduly.
The Friends of Hall Street Green have been consulted and are supportive of this
application.
It should be noted that commercial markets are normally subject to an event fee in
accordance with Council policy. Niche Event Hire and the Cheadle Village Partnership are
keen to promote the Makers Market as a community event that they believe increases
footfall and brings economic and social benefits to the Village.
Recommendation(s):
The Greenspace Team recommends that the application is granted subject to the
production of appropriate papers, all licenses, and the payment of a refundable bond, to be
used should the venue sustain any damage due to the event.

This application is to extend the current monthly Makers Market from the White Hart Car Park
onto Hall Street Green resulting in a much fuller community event than can currently take
place in the White Hart Car Park. Activities: Market style stalls, community/charity focussed
stalls, background music, street food all creating a focus for the local community. This event
is supported by the Village Partnership in keeping with previous events held on Cheadle
Green (May-Dec 2013) and this year in the White Hart Car Park (May-Aug 2014 because of

its positive impact on the local community giving a monthly focus to Cheadle

for Cheadle residents. Currently there is nothing else like this on a regular basis. The Village
Partnership values the contribution this event makes to Cheadle and would be sad to see the
Makers Market withdraw from Cheadle if a suitable sized venue cannot be found for them to
feel confident in continuing their association with Cheadle. Please see the attached
income/expenditure figures from the Makers Market showing a current net loss from the
Cheadle Market throughout 2014 which attests their commitment to Cheadle, whereas an
organisation solely focussed on profit would have withdrawn before now.
