Soi" In!estigation s5a"" onsist 1& 6arrying out field survey of about 57 acres land allotted to 'amiti for construction of !"# complex . 4he field survey would consist of contour mapping, geo-technical survey, survey of underground water resources, soil investigations and determining the bearing capacity of soil, type of soil and type of foundation to be used etc.

(iii) .andscape +lan ;& .ui"ding AorBs 4he &stimated cost of ,uilding :or1s shall be based on 6+:% +$3 rates -77? duly updated by latest cost index as approved by 6+:% for the place of wor1s. *f latest cost index is not available, cost index of the nearest available place as approved by 6+:% will be adopted. .atest cost index means cost index applicable at the time of issue of $2$ ( &2'. E& De!e"o#ment AorBs 1& De!e"o#ment 6orBs and e<terna" ser!ies of e!ery ,NV om#"e< s5a"" onsist of t5e fo""o6ing7- (i$ %evelopment of the ground including cutting2filling as per the ./+. @ (ii) 3oads, paths, culverts and storm water drains including final disposal arrangement of storm water. (vi) $ny other services re0uired to ma1e the buildings and services functional. -. 4he estimated cost for development wor1s shall be based on latest 6+:% %elhi schedule of rates for civil wor1s and latest 6+:%, %elhi electrical schedule of rates for electrical wor1s duly up-dated by-latest cost index, as approved by 6+:% for the place of wor1. *n case the cost index for the place of wor1 is not available, cost index of the nearest available place, as approved by the 6+:% will be adopted. @& Re#etiti!e AorBs +hase =$> wor1s shall be considered as original wor1 and +hase =,> wor1s shall be considered as repetitive wor1s. 'amiti may decide to follow standard architectural design, in such cases architectural fee shall be paid under repetitive wor1s.

9& ADDITIONAL *ONDITIONS (1) 4he above rates shall be inclusive of complete consultancy services to ma1e the entire !"# complex complete and functional including all changes2modifications2revision etc. re0uired during execution of the wor1 as per site condition etc. and all taxes, incidental charges, what so ever. "othing extra shall be payable over the accepted rates. (-) 6onsultant shall be liable to pay *ncome 4ax for any other tax leviable or enforced by Govt. of *ndia time to time . (5) 4he entire consultancy wor1 shall be carried out according to the specifications, guidelines and instructions given by the 'amiti. "o changes2deviations shall be permissible without obtaining written approval of the 'amiti. (@) 'amiti reserves the right to reBect or to accept the offer in part or whole without assigning any reason. C plinth area of each 0trs. @7 m - . 11& Inidenta" Ser!ies 11.1 4he broad scope of services is classified in terms of activities at clause "o. @.1 of #olume-* (instruction to 4enderer), the entire incidental services related with the activities shall be deemed included in the scope of services. "o extra payment shall be made for the incidental services. E 11.- 3evision of drawings, design as per the re0uirement of the authorities shall be made as per re0uirement and no extra charges shall be payable on this account. 11.5 $t any sites if old structures exist, $rchitect shall be re0uired to prepare proposal for getting approval for dismantling of the old structures at no extra cost. 1/ De"i!era>"es >y t5e Ar5itet 1-.1 $ll the approved drawings from local 2 statutory authorities shall be the property of the 6lient 2 /wner. 4he same shall be submitted to the /wner immediately after getting them approved. 1-.- 4he architect shall be re0uired to submit A (six) copies of the approved conceptual plan along with scheme details to the /wner for reference and record. 1-.5 %uring execution phase, the $rchitect shall supply A (six) sets of all HGood for 6onstructionI %rawings (structural ,architectural, shop etc.) of all the structures i.e., buildings and services structures li1e drainage, sewerage, water supply, fire fighting, roads, horticulture, H#$6, acoustics, external electrification, lifts, rainwater harvesting etc. to the /wner as per schedule. 1-.@ 4he co-ordination drawing may also be re0uired during execution of the wor1 to ensure integrated construction of all the components. *t is the responsibility of the $rchitect to prepare the additional 2 revised drawings re0uired for the proper execution of the wor1 which may be visuali;ed during construction wor1 at no extra cost. 1-.9 4he owner may review the wor1 carried out by the $rchitect at architectural planning detailed engineering or at any pre-constructional stage to get satisfied with the standards and procedures adopted by the $rchitect. *t shall be the responsibility of the $rchitect to ma1e available the concerned documents to the 6lient on demand. 1-.A $ll structural drawings shall be got proof chec1ed by the consultant from any **4 2 Govt. &ngineering 6ollege and no extra charges shall be paid on this account. 1@& Referene Standards for Ser!ies 4he $rchitect is re0uired to provide services based on extant rules, local bye C laws, applicable standards and sound engineering practices. 4he reference of standards is detailed below for application in services of $rchitect. 4he $rchitect shall refer the standard documents in case they are not mentioned below in any case8 D 1@&1 De!e"o#ment ("an3 Ar5itetura" ("an3 .ui"ding ("an and t5eir a##ro!a"s7 15.1.1 $pplicable laws of local bodies, orest %eptt. and other concerned agencies. 1@&/ Design of strutures3 (re#aration of dra6ings3 detai"ed estimation et7 15.-.1 "ational ,uilding 6ode, -779 15.-.- *'8 1ED5 (latest edition) 15.-.5 *'8 15D-7 (latest edition) 15.-.@ *'8 15E-E (latest edition) 15.-.9 /ther applicable standards 15.-.A 'ound &ngineering +ractice for detailed estimation 1@&@ (re#aration of .i"" of Huantities et& 15.5.1 %elhi 'chedule of 3ate, -77? 15.5.- 6+:% 'chedule of 3ate for &lectrical, ire ighting items 15.5.5 6+:% 'chedule of 3ate for H#$6 *tems (if any) 15.5.@ $dditional *tems based on Jar1et 3ate $nalysis ("on C %'3 *tems) as per scope of wor1 for standard materials 2 items proposed to be used in this wor1 for civil, electrical, fire fighting, internal roads, horticulture wor1s etc. 1:& Sett"ement of Dis#utes ? Ar>itration *n the event of any dispute on difference between parties, such disputes or differences shall be resolved amicably by mutual consultations. 4he un-resolved disputes or differences, if any, shall be referred to 'ole $rbitrator to be appointed by the 6ommissioner ("#') from the empanelled list of $rbitrators of "#'. . 1D& )ore MaGeure *f at any time, during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of public enemy, civil commotion, sabotage, serious loss or damage by fire, explosions, epidemics, stri1es, loc1outs or acts of God (hereinafter, referred to events>) provided, notice of the happening of any such event is given by either party within 17 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such non-performance of delay in performance, and wor1s under the contract shall be resumed as soon as practicable after such event has come to an end or ceased to exist, and the decision of the 6lient as to whether the wor1s have been so resumed or not shall be final and conclusive, +3/#*%&% K34H&3 that if the performance in whole or in part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding D7 days, either party may at its option terminate the contract by giving notice to the other party. 17 1; (erformane Seurity 4he L$rchitectI shall be re0uired to submit an acceptable ,an1 Guarantee for an amount e0uivalent to 79 M (five percent only) of the accepted +rofessional 6harges (fee) towards +erformance 'ecurity within 17 days of signing the 6ontract $greement. 4he estimated value of the wor1 as given in $$(&' to be issued by owner to 6$ shall be ta1en into account for calculating the amount of performance security. 4he validity of the ,an1 Guarantee(s) shall be initially for -@ months from the date of award of wor1 to $rchitect, which will be extended if the completion of proBect is delayed by the architect. 4he format of the ,an1 Guarantee(s) shall be got approved by the L/wnerI. *n the event of the contract being determined or rescinded under provision of any clause 2 condition of the agreement or the performance of the $rchitect Budged to be poor, the performance guarantee shall stand forfeited and the amount such received shall be absolutely at the disposal of owner. 1E Notie $ny notice to be given hereunder will be sent by registered post 2 courier2hand receipt at the last 1nown head office address of the L$rchitectI and shall be deemed to have been served at the time at which the letter would be delivered in the ordinary course of post. 12 Li=uidated Damage+ (ena"ty for de"ay& 12&1 IArchitectI shall be responsible to complete the wor1 within stipulated time period as mentioned in 4ime 'chedule. 12&/ 4ime is the essence of contract. *n case of delay or default on part of $rchitect for any ati!ity desri>ed in *"ause J D of Vo"ume-I (Instrution to Tenderer$3 the $rchitect shall be liable to pay the Gwner L6ompensation at the rate of 1M (one percent only) of the total fee of the $rchitect, per wee1 of delay subBect to maximum of 17M (ten percent) of the total fee of the $rchitect or such amount as may be fixed by the /wner. 4his compensation shall be levied even if any particular activity is delayed beyond its time schedule. 19 Insurane +rofessional .iability *nsurance (+.*) including deficiencies 2 inade0uacies in the design of structures and other components for the minimum period of three years or as per applicable .aw if specifies longer period with a minimum coverage e0ual to $rchitect>s total 0uoted fee shall have to be obtained by the $rchitect and proof of obtaining such +.* insurance shall be submitted to the owner. &mployers .iability and wor1er>s compensation *nsurance in respect of the personnel of the $rchitect and any of its 'ub C 6onsultants, in accordance with the relevant 11 provisions of the agreement and of any such life, health, accident, level or other insurance as may be appropriate shall have to be ta1en by $rchitect. *t may please be noted that all insurance and policies should start from the date of commencement of services and remain effective as per relevant re0uirements of 6ontract agreement, or upto completion of consultancy contract, which ever is longer except +.* which shall be for the period as provided above. /0& O>"igation of Ar5itet -7.1 4he $rchitect may be as1ed to submit alternative models (if decided by the owner) to decide the plan and architectural view of the buildings. 3ate for preparation of one model and complete 5% ,*J (,uilding *nformation Jodel)2 virtual construction model on computer software is deemed to be included in the 0uoted rates. However for
- nd or thereafter extra payment shall be payable to the $rchitect on the rate decided by the owner. -7.- $rchitect shall carry all modifications as desired by /wner. -7.5 $rchitect shall provide detailed computations and bac1 C up of design sheets to /wner. -7.@ $rchitect shall provide all drawings ( designs on $uto 6ad, '4$%% C +ro 2or any relevant computer programme in editable format 6opy of final design2drawings shall be made available to /wner in editable soft copy on compact disc also. /1 O>"igation of t5e O6ner -1.1 4he owner shall provide all re0uired inputs about the utilities and functional re0uirements of the buildings to optimi;e the plan. -1.- 4he owner shall provide all possible assistance to the $rchitect in getting approval of buildings from local2statutory authorities if re0uired. // %enera" //&1 Ade=uay of Design 4he 'ervices to be rendered by $rchitect shall be based on latest "ational ,uilding 6ode, relevant applicable codes and sound engineering practices. JaBor decision and specification shall be reviewed by owner to the extent desired. $pproval of any design 2 drawing by owner shall, however, not relieve the $rchitect in discharging their responsibilities regarding the ade0uacy of design and proper functioning of the wor1s. 4he $rchitect shall be fully responsible or the ade0uacy, accuracy and 0uality of entire services performed by them in accordance with accepted standards of safety, earth0ua1e re0uirements, environment protection, rainwater harvesting and public health. $rchitect shall also be re0uired to get the ade0uacy of design proof chec1ed for **42Govt.&ngg.6ollege or any other *nstitution of repute on its own cost and owner reserve its right to get the design approved 2 chec1ed again from any reputed 1- independent agency. *n that case it will be the responsibility of the $rchitect to depute their executive and furnish necessary clarification 2 calculations 2 assistance for the approval of the drawings 2 design calculations. However owner shall bear the cost of engagement of independent agency for carrying out design2 drawings rechec1ed. ,ut in case the designs are found unsatisfactory, the $rchitect will be liable to pay the fee of the independent agency. //&/ Additions and A"terations 4he /wner shall have the right to re0uest changes, additions, modifications or selections in the design and drawing of any part of the wor1 at any time and to re0uest additional wor1 in connection therewith and the $rchitect shall comply with such re0uest. 4he decision of owner shall be final on whether the deviations and additions are substantial and re0uiring any compensation to be paid to the $rchitect. 4he applicable fee as per 0uoted percentage shall be payable on additional amount (if payable) and nothing extra shall be payable on this account. However for the minor modification or alteration which does not affect the entire planning and design etc., no amount will be payable. //&@ )ore"osure of ontrat owner reserve the right for foreclosure of contract without assigning any reason whatsoever. 4he payments in the event of foreclosure of contract shall be restricted to the amount defined for each activity independently and in the event of such termination the $rchitect shall be entitled to all such fee for the services actually completed and liable to refund the excess payment if any made to them over and above what is due in terms of this agreement on the date of termination. 4he /wner may ma1e full use of all or any of the drawings prepared by the $rchitect. *n case of an activity is partly completed at the time of foreclosure of contract, owner shall asses and decide the part fee payable to $rchitect and his decision shall be final and binding and no claims shall be entertained. //&: Resinding of ontrat *n the event of failure on the part of the $rchitect to complete wor1 in time or to the complete satisfaction of the owner or in the event of committing breach of any one or more of terms and conditions of the agreement, /wner shall be entitled to rescind this contract without preBudice to right to claim damages or remedies under the law. 4he period of notice to be given to rescind contract will be 19 days and in the event of such termination, $rchitect shall be liable to return the excess payment, if any made to them over and above due to them on the date of termination and owner will be entitled to ma1e full use of all or any of the drawings 2 documents prepared by $rchitect. *n such case owner shall have power to engage another $rchitect and2or carry out the wor1 through its own resources to complete the balance wor1. *n this case the excess amount, if any incurred by the owner shall be debited to the $rchitect subBect to a maximum of 10F (4en percent) of the total fee which would have been paid. $rchitect shall pay to 15 owner such excess expenditure within 57 days of issue of notice failing which $rchitect shall be debarred from consultancy Bobs of owner in future besides ta1ing other course of action to recover such amount. //&D Non-su>mission of Douments .idders s5a"" ensure su>mission of a"" douments re=uired + asBed for in t5e >id doument& O6ner s5a"" not re!ert >aB for seeBing defiient douments and may fina"ize t5e >ids at its So"e disretion >ased on su>mission >y >idders& T5e >ids are "ia>"e to >e reGeted in ase t5e re=uired douments are not su>mitted a"ong 6it5 t5e >id& //&; *o#yrig5t + (ro#rietary rig5t 4he $rchitect hereby agree that the fee to be paid as provided in this agreement will be in full and final for functions to be performed by him and no claim whatsoever shall be made against owner in respect of any part relating to the plans, drawings and other documents submitted by $rchitect. 4he drawings, design, planN related details prepared and ac0uired by the $rchitect for the wor1 entrusted to him under this agreement will become the property of owner. 4he drawings, design, plan and related details can not be issued to any other person, firm or authority or used by the $rchitect for any other proBect without prior permission of owner. However the drawings and drawings and design can be utili;ed by owner for other wor1s and $rchitect shall not have any obBection whatsoever. //&E *ontrat Agreement $fter acceptance of bid a formal contract agreement shall be executed on a non Budicial stamp papers of 3s. 1772- (3upees one hundred only), the cost of the same shall be borne by the $rchitect.
