EVIDENCE FOR THE PROSECUTION

Joselito Severino, a house painter, was the subject of a buy bust operation
conducted by the Special Anti-Illegal Drugs Special Operation Task Force
(SAID-SOTF) of the Muntinlupa Police. A tip from the confidential informant
of the said police office prompted the creation of an arresting team
composed of five police officers and was charged of the mission of arresting
a certain person who allegedly is engaged in the proliferation of illegal drugs.
Chief Police Superintendent Edgar Ferrater instructed the team to conduct a

buy bust operation, surveillance and possible arrest of the alleged drug
pusher whose name was unknown to the arresting team and their
confidential informant. Police Officer Rondivar Hernaez, one of the arresting
officers or operatives, was presented as first witness by the prosecution. In
his testimony he admitted that the name of the subject for their buy bust
operation was unknown to them and to their informant. But, their informant
knows the subject when he sees him. The team decided that the informant
will accompany the poseur buyer, Police Officer Gary Arandia, in order to
help them identify the subject of the buy bust operation. The team
assembled and prepared in their office all the necessary documents including
the Pre-Operation Report and Coordination which was sent to PDEA which
issued the Certificate of Coordination. The said certificate gave the arresting
team legitimacy to conduct the mission.

The team, led by SPO1 Joel Vega, went to Barangay Poblacion to conduct
their surveillance and possible buy bust operation, but, yielded negative
results. They went next to Barangay Putatan that gave them the same
negative results. On or about 11:20 on the night of November 6, 2006, the
team leader received a text message from their confidential informant telling
him that the subject of their buy bust operation is present in Barangay
Alabang. The team went to Balbanero Compound in Barangay Alabang where
their subject is located according to the informant. It was here where PO1
Arandia together with the informant acted as poseur buyers and after
positioning themselves in a particular area in the compound, the target of
their operation showed up and transacted with them. After the poseur buyers
gave the marked money, the suspect pulled out from his pocket a clear
sachet

with

crystalline

substance,

which

turned

out

to

be

methyl

amphetamine hydrochloride or shabu after it was brought and examined at

the Police Crime Laboratory.

While the buy bust operation was in progress, Police Officer Bob Yangson,
one of the back-up agents chanced upon three other men allegedly
transacting illegal drugs as well. He called their attention and introduced
himself as a police officer and grabbed two of the three men. The other one
fled, but, was grabbed by Hernaez who heeded to the yelling of Yangson and
who pointed to the person as one of those whom he is arresting. The team
arrested a total of four suspected drug peddlers and they brought them to
their office. The four arrested were informed why they were arrested and
informed them of their rights.

The four malefactors were identified as

Joselito Severino, Ibrahim Domaob, Rahman Decampong, and Mohammad

Omar.

All these four together with the clear plastic sachets recovered from

them were brought to the Crime Laboratory for drug testing and examination
which all yielded positive results.

EVIDENCE FOR THE ACCUSED

On November 6, 2006, at around six oclock in the evening, the accused was
walking and going to Purok 4 of Barangay Alabang. He passed by Balbanero
Compound in the same barangay. He so a commotion ahead of him and his
initial reaction was to avoid the said commotion by proceeding to another
alley in the compound. He met five armed men whom he does not know,
but, he was told to raise his hands and so he did what he was told. While
this was transpiring, two other men were seated on a bench nearby were
ordered to stand up and raise their hands as well. All the three were asked to

bow their heads as well. The three men plus another man who is likewise
that night were brought to a nearby supermarket and to the police station in
the compound of Muntinlupa City Hall afterwards. They were all put to the
detention cell for reason they do not know up to that moment. The accused
was surprise when he learned that he is being charge of drug pushing to
which he said he is innocent and has nothing to do with. He alleged that the
mother of one of the members of the team that arrested him, Yangson, was
his mothers neighbour who had a grudge on his family. Yangsons mother is
annoyed whenever there is a celebration in the house of the accused,
particularly when they started using their videoke.

The last time Yangson

had an argument with the accuseds mother was eight years ago.
