PORT TO PORT

a) Where the carriage is Port to Port, then liability (if an) of the Carrier for loss or damage to the
Goods occurring between the time of loading at the Port of Loading and the time of discharge at
the Port of Delivery shall be determined in accordance with any national law making the Hague
Rules, Hague-Visby Rules, COGSA or any other rules compulsorily applicable to this bill of lading or
any other case in accordance with the Hague Rules Article 1-8 inclusive (excluding Article 3 rule 8)
only.
b) The Carrier shall be under no liability whatsoever for loss or damage to the Goods while in its
actual or constructive possession before loading or after discharge, howsoever caused.
Notwithstanding the foregoing, in case and to the extent that any applicable compulsory law
provides to the contrary, the Carrier shall have the benefit of every right, defence, limitation and
liberty in the Hague Rules, Hague-Visby Rules, COGSA or any other rules as applied by Clause 6 (1)
(a) during such additional compulsory period of responsibility, notwithstanding that the loss or
damage did not occur at sea.
c) If COGSA applies then the provisions stated in COGSA shall govern the Carrier's liability
throughout the Carriage by sea and the entire time that the Goods are in the actual custody of the
Carrier or his Sub-Contractor at the container yard, freight station or area immediately adjacent to
the sea terminal before loading onto the vessel or after discharge therefrom as the case may be.
Where the Merchant requests the Carrier to procure Carriage by an inland Carrier in the United
States of America, such carriage shall be procured by the carriage as agent only to the Merchant
and such carriage shall be subject to the inland Carrier's contract tariff. If for any reason, the
Carrier is denied the right to act as agent only a these times, his liability for loss, damage or delay
to the Goods shall be determined in accordance with clause 6(2) hereof.
d) If the Goods are discharged at a Port other than the Port of Discharge or (save in USA) at Place
of Delivery instead of the Port of Discharge, and the Carrier in its absolute discretion agrees to a
request to such effect, such further Carriage will be undertaken on the basis that the Terms and
Conditions are to apply to such Carriage as if the ultimate destination agreed with the Merchant
had been entered on the reverse side of this Bill of Lading as the Port of Discharge or Place to
Delivery.
COMBINED TRANSPORT
Save as is otherwise provided in this bill of lading, the Carrier shall be liable for loss or damage to
the Goods occurring from the time when he receives the Goods into his charge until the time of
delivery to the extent set out below.
A. Where the stage of Carriage where the loss or damage occurred cannot be proved by the
Merchant:

1. - The Carrier shall be relieved from liability where such loss or damage was caused by:
a) An act or omission of the Merchant or Person acting on behalf of the Merchant
other than the Carrier, his servant, agent or Sub-Contractor;
b) Compliance with the instructions of a Person entitled to give them;
c) The lack or insufficiency of or defective conditions of packing in the case of Goods
which, by their nature are liable to wastage or to be damaged when not packed or
when no properly packed;
d) Banding, loading, stowage or unloading of the Goods by or on behalf of the
Merchant;
e) Inherent vice of the Goods;
f) Strikes or lock outs or stoppages or restraints of labour from whatsoever causes
whether partial or general;
g) Fire, unless caused by the actual fault or privity of the Carrier, for which the
Merchant shall have the burden of proof;
h) A nuclear incident;
i) Any cause or event which the Carrier could not avoid as a consequence whereof
he could not prevent by the exercise of reasonable diligence.
2. - The burden of proof that the loss or damage was due to one or more of the causes or
events specified in this Clause 6(2)(a) will rest upon the Carrier. Save that if the Carrier
establishes that, in the circumstances of the case, the loss or damage could be attributed
to one or more of the causes or events specified in Clause 6(2)(a)(1)(c), (d) or (e), it shall be
presumed that it was so caused. The Merchant shall, however, be entitled to prove that
the loss or damage was not, in fact, caused either wholly or partly by one or more of these
causes or events.
B. Where the stage of Carriage where the loss or damage occurred can be proved by the
Merchant:
1. - The liability of the Carrier shall be determined by the provisions contained in any
international convention or national law of the country, which provisions;
a)

Cannot be departed from by private contract to the detriment of the Merchant,


and;
b)
Would have applied if the Merchant had made a separate and direct contract with
the Carrier in respect of the particular stage of Carriage where the loss or damage
occurred and had received as evidence thereof any particular document which
must be issued in order to make such international convention or national law
applicable.
2. Where 6(2)(b)(1) above does not apply any liability of the Carrier shall be determined
by 6(1) if the loss or damage occurred during a sea leg or by 6(2)(a) in all other cases.

PUERTO A PUERTO
a) Cuando el carro se encuentra Puerto a Puerto, entonces la responsabilidad (si hay una) del
transportista por la prdida o dao de las mercancas que se produce entre el momento de la
carga en el puerto de carga y el tiempo de descarga en el puerto de entrega se determinar de
conformidad con cualquier ley nacional que las reglas de La Haya, la Haya-Visby Rules, COGSA o
cualesquiera otras normas aplicables obligatoriamente a este conocimiento de embarque o
cualquier otro caso de conformidad con el Reglamento de la Haya artculo 1-8 inclusive (con
exclusin del artculo 3 regla 8) solamente.
b) El Transportista no tendr ningn tipo de responsabilidad por prdida o dao de la mercanca
mientras est en su posesin real o constructiva antes de cargar o despus de descargar,
independientemente de su causa.
No obstante lo anterior, en el caso y en la medida en que una ley obligatoria aplicable disponga lo
contrario, el transportista tendr el beneficio de todo el derecho, la defensa, la limitacin y la
libertad en las Reglas de La Haya, las Reglas de La Haya-Visby, COGSA o cualesquiera otras normas
aplicada por la clusula 6 (1) (a) durante dicho perodo adicional obligatorio de la responsabilidad,
a pesar de que la prdida o el dao no se produjo en el mar.
c) Si COGSA aplica entonces las disposiciones establecidas en COGSA regula la responsabilidad del
Transportista en todo el transporte por mar y por todo el tiempo que stas se encuentran bajo la
custodia efectiva de la Aerolnea o de su Sub-contratista en el patio de contenedores, la estacin o
el rea inmediatamente adyacente flete al terminal de mar antes de la carga en el buque o
despus de la descarga del mismo como el caso puede ser.
Cuando el comerciante solicita al portador para adquirir carro por un transportista interno en los
Estados Unidos de Amrica, como el transporte deber ser adquirido por el carro como agente a la
marina mercante y que dicho transporte estar sujeto a la tarifa del contrato del transportista
interno. Si por alguna razn, la Aerolnea se niega el derecho de actuar como agente slo estos
tiempos, su responsabilidad por prdida, dao o retraso de los bienes se determinar de acuerdo
con la clusula 6 (2) del presente documento.
d) Si las mercancas son descargadas en un puerto que no sea el Puerto de Descarga o (salvo en
EE.UU.) en el lugar de la entrega en lugar del Puerto de Descarga, y el Transportista a su absoluta
discrecin acuerda una peticin a tal efecto, como otro transporte se llevaron a cabo sobre la base
de que los Trminos y Condiciones son aplicables a su transporte como si el destino final de
acuerdo con el comerciante haba sido introducido en el reverso de esta Carta de Porte como el
Puerto de Descarga o Lugar de Entrega.
Con excepcin de lo dispuesto en este conocimiento de embarque, el transportista ser
responsable de la prdida o dao de las mercancas se producen desde el momento en que recibe

las mercancas en su cargo hasta el momento de la entrega, en la medida que figura a


continuacin
TRANSPORTE COMBINADO
A) Cuando la etapa de transporte en el que el dao se ha producido no pueden ser probados por
el Comerciante:
. 1 - El transportista quedar exento de responsabilidad cuando dicha prdida o dao haya sido
causado por:
a) Un acto u omisin del Comerciante o persona que acte en nombre del comerciante que no sea
el transportista, su sirviente, agente o subcontratista;
b) El cumplimiento de las instrucciones de una persona que pueda darles;
c) La falta o insuficiencia de condiciones defectuosas o de embalaje en el caso de mercancas que,
por su propia naturaleza sean susceptibles de desperdicio o que sufran daos cuando no est llena
o cuando no envasados correctamente;
d) Anillamiento, carga, estiba o descarga de las mercancas por o en nombre del Comerciante;
e) vicio propio de las mercancas;
f) Huelgas o cierres patronales o paros o restricciones del trabajo de alguna causa ya sea parcial o
general;
g) Incendio, menos que sean causados por la falta concreta o culpa del transportista, para las que
el comerciante tendr la carga de la prueba;
h) Un incidente nuclear;
i) Cualquier causa o evento que el transportista no pudo evitar, como consecuencia de lo cual no
pudo impedir que por el ejercicio de diligencia razonable.
2 -. La carga de la prueba que la prdida o el dao se debi a una o varias de las causas o eventos
especificados en la Clusula 6 (2) (a) descansar sobre el Carrier. Con todo eso, si el portador se
establece que, en las circunstancias del caso, la prdida o los daos que se pueden atribuir a una o
varias de las causas o eventos especificados en la Clusula 6 (2) (c) (a) (1), (d ) o (e), se presumir
que fue por lo caus. El Comerciante, sin embargo, tiene derecho a demostrar que la prdida o el
dao no era, de hecho, causado en su totalidad o en parte, por una o varias de estas causas o
eventos.
B) Cuando la etapa de transporte cuando la prdida o el dao producido puede ser demostrado
por el Comerciante:

1. - La responsabilidad del Transportista se determinar por las disposiciones contenidas en


cualquier convenio internacional o ley nacional del pas, cules son las normas;
a) No se puede dejar de aplicarse por contrato privado, en detrimento de la marina mercante, y;
b) se habra aplicado si el comerciante haba hecho un contrato independiente y directo con la
compaa en caso de la fase particular del carro donde se produjeron las prdidas o daos y que
haban recibido para que as conste ningn documento en particular que debe ser emitido con el
fin de realizar dicha convencin internacional o legislacin nacional aplicable.
2. Si 6(2)(b)(1) anterior no se aplica ninguna responsabilidad del Transportista ser determinada
por 6 (1) si el dao se ha producido durante un trayecto por mar o por 6 (2) (a) en todos los dems
casos.
