II.1.5) Short description of the contract or purchase(s)
The contract scope ranges from preliminary design services to the construction of the PF coil winding building
until the hand-over of such.
The building will house the PF coil sequential construction responsible for confining the plasma inside the
Tokomak Cryostat. The dimensions of the building are roughly 40 m in width, 247 m in length and about 14 m in
height.
It is a non nuclear building which scope will include the structure of the building plus the construction and
placement of two cranes 1 standard crane 25 T and 1 50 T crane with 10 arms (both 35 m width) and regular
building services ; HVAC, electrical, piping.
The PF coil building will also include a small set of offices, a parking and a lay down area for 80 people and two
docking areas for the unloading and temporary placement of Coils.
The actual responsibilities will be the ones proper of a civil engineering design company plus the ones of a
construction one: study of basic documents, development of technical specs and drawings (Catia models
included), construction, testing and final hand-over. Therefore it will be within the responsibility of the future
contractor the coordination of all the Works.

III.1) CONDITIONS RELATING TO THE CONTRACT

Tenders can be submitted by groupings of service providers who will not be required to adopt a particular legal
form prior to the contract being awarded. In case of award, each member of the grouping shall be jointly and
severally liable towards Fusion for Energy.
However, a grouping of companies must nominate 1 party to be responsible for the receipt and processing of
payments for members of the grouping, for administrative management of the service, and for coordination and
safety.
Groupings of companies must provide the documents and information required in points III.2.1, III.2.2 (b), (c)
and III.2.3 (a), (c) and (d) for all members of the grouping.
The documents and information required in points III.2.2 (a) and III.2.3 (b), (e), (f) and (g) apply to the grouping
as a whole.
A company cannot be coordinator of several groupings at the same time, nor can it simultaneously submit its
candidacy as coordinator of a grouping and individually.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on

This procurement procedure shall be open on equal terms to economic operators that are nationals of a
member of Fusion for Energy or are established in the territory of a member of Fusion for Energy (i.e. Member
States of the European Union and Switzerland).
Full name of the entity, legal status, VAT status and registration number, address, telephone and fax numbers,
the name of the contact person responsible for the tender and his e mail address as well as the name of the
legal representative of the entity.
The company will also provide a document indicating that the person signing the document has been delegated
the signature authority.
The information to be provided under (a) shall be accompanied with a transcript or a certificate, issued by the
competent body - namely the commercial register - in the country of provenance or the country of the main
office of the candidate.
Non-commercial undertakings may provide a copy of their act of incorporation, if, under the law of their country
of provenance or the country of their main office, they are not subject to public registry.
Non-commercial physical persons must provide a copy of their passport or other equivalent identification
document.
To be eligible for participation in this contract award procedure, tenderers must not be in any of the exclusion
situations referred to in Articles 83 and 84 of the Financial Regulation of Fusion for Energy adopted by
the Decision of the Governing Board of 22 October 2007 and as last amended on 18 December 2007.

In particular, tenderers shall be excluded from participation in a procurement procedure if:

(i) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into
an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning
those matters, or are in any analogous situation arising from a similar procedure provided for in national
legislation or regulations;
(ii) they have been convicted of an offence concerning their professional conduct by a judgement which has the
force of res judicata;
(iii) they have been guilty of grave professional misconduct proven by any means which the contracting authority
can justify;
(iv) they have not fulfilled obligations relating to the payment of social security contributions or the payment of
taxes in accordance with the legal provisions of the country in which they are established or with those of the
country of the contracting authority or those of the country where the contract is to be performed;
(v) they have been the subject of a judgement which has the force of res judicata for fraud, corruption,
involvement in a criminal organisation or any other illegal activity detrimental to the Communities financial
interests;
(vi) they are currently subject to an administrative penalty imposed by the Community institutions as referred to
in the general Financial Regulation.
Moreover, candidates shall be excluded from the award of the contract if during the present procurement
procedure:
(vii) they are subject to conflict of interest;
(viii) they are guilty of misrepresentation in supplying the information required by the contracting authority as a
condition of participation in the contract procedure or fail to supply information.
For each of these points (from (i) to (viii), candidates shall submit a declaration on honour duly signed and dated
by its legal representative attesting that they are not in any of such situation.
The tenderer to whom the contract is to be awarded shall provide, within a time limit defined by the contracting
authority and preceding the signature of the contract, the relevant documentary evidence, as detailed in the
tender documentation.

This contract notice has been published on the Joint Undertaking website on 09-Apr-2009, the
same date of its dispatch to the Supplement of the Official Journal of the European Union. Please
note that only the contract notice published on the Joint undertaking's official internet website
(http://www.fusionforenergy.europa.eu/Procurement_operational.htm ) is authentic.
The envelope, containing the documentation referred to in Section III.2 shall be addressed to the Procurement
Officer indicated under Section I.1 and shall be marked as follows:
Expression of Interest - F4E-2009-OPE-026-(SB.PS) Not to be opened by the internal mail department.
It should be noted that the present procurement procedure is governed by the rules laid down in the Financial
Regulation of Fusion for Energy adopted by the Decision of the Governing Board of 22 October 2007 as last
amended on 18 December 2007 and the Implementing Rules of the Financial Regulation adopted by the
Decision of the Governing Board of 22 October 2007 as last amended on 08 July 2008.
The official language of Fusion for Energy is English. Documentation provided under Section III.2 shall be in
English or accompanied by a translation of the relevant parts. Failure to comply with this requirement, may
lead to the exclusion of the candidate from the tender procedure.
By submitting a request to participate the economic operator agrees that Fusion for Energy may publish on its
webpage a list with the names and addresses of the selected candidates. In case the economic operator does
not agree, he shall express this disagreement in writing to the above mentioned contact point (Section I.1),
before the time limit for receipt of the requests to participate.
Fusion for Energy is organising four procurement procedures in parallel, one to procure architect / engineering
services (reference F4E-2009-OPE-023-(SB.PS)), one to procure so-called "support to the owner"
(reference F4E-2009-OPE-024-(SB.PS)), one to procure PF Coil Building design and build (reference
F4E-2009-OPE-026-(SB.PS)) and another to procure "Safety Health Protection Coordination and Legal
Inspection" (reference F4E-2009-OPE-025-(SB.PS)).
The missions of the contractor providing "support to the owner" and those providing the "Safety Health
Protection Coordination and Legal Inspection" involve overseeing the architect engineer and the PF Coil
Building design and build on behalf of Fusion for Energy. For this reason, it is important that the former
are fully independent from the latter. Against this background, Fusion for Energy draws tenderers attention
to Article 84 of Fusion for Energy's Financial Regulation requiring that "a contract shall not be awarded to
candidates or tenderers who during the procurement for this contract are subject to a conflict of interest.
This should notably be taken into account by tenderers considering participating either individually or as part
of a consortium or as a subcontractor in:
both the architect engineering services or PF Coil building design and build and the support to the owner
tenders
or in both the architect engineering or PF Coil building design and build and the legal inspection or
Safety and Health Protection Coordination tenders.

According to article 84 above mentioned, F4E will not award the contracts for the support to the owner or
Legal Inspection" or "Safety Health Protection Coordination and Legal Inspection" to a company which, as
individual contractor or as member of a grouping or as subcontractor, will be awarded the architect engineer
services or the PF Coil Building design and build unless it is able to demonstrate that there is no conflict of
interest at the moment of the award. This shall not preclude the possibility of participating in any of the above
mentioned procurement procedure.
The expected time for call for tender is June 2009 and the expected award of the contract is December 2009.
These dates are given for information but do not compel F4E to send the documents nor award the contract at
those specific dates.
