Re:

Application for Zoning By-law Amendment


Part Lot 51, Concesson 2 EGR, Geographic Township of Holland
Owners: Robert Beirnes / David and Betty Peck

The following has been drafted to provide Council with planning comments concerning
the above-noted rezoning application:

The subject lands comprise three properties that are located along the west side of
Concession 2, approximately 260 metres south of Negro Creek Road. The first property,
owned by Robert Beirnes, comprises 39.52 hectares of land is vacant and partially

farmed. The majority of this lot is forested and scrub land. The other two properties are
owned by David and Betty Peck, and comprise'1.18 hectares and 0.94 hectares
respectively. A dwelling was recently constructed on the 0.94 hectare lot. The Pecks
are in the process of merging their two properties into one parcel.
Recently, the Committee of Adjustment conditionally approved the severance of 1.02
hectares of land from the Beirnes' property, with that land being added to the Peck
consolidated parcel. The end result will be a3.14 hectare residential lot which does not
comply with the lot area and frontage requirements and a 38.6 hectare property which
also does not comply with the lot frontage requirements of the '41' zone. The proposed
Amendment will adjust the Zoning By-law accordingly.

ln terms of evaluating this rezoning application, it s important to note that the recent
severance was deemed to conform with the County Official Plan and the Provincial Policy
$tatement, and therefore, the proposal to reduce the lot area and frontage requirements
of the '41' zone should also be deemed to comply with these land use documents.
Based on the foregoing, the proposed By-law should be given favourable consideration
by Council.

This opinion is provided without the beneft of having received comments from any other
goncy or any adjacent land owners. Should new information arise regarding this
proposal, Gouncil is advioed to take such information into account when considering the
application.

The purpose of the Amendment is to reduce the 'minimum lot area' and 'minimum lot
frontage' requirements of the '41 ' zone as required to fulfil a condition of severance . The
severance was recently approved by the Township of Chatsworth Committee of
Adjustment, and involved the removal of a 1.02 hectare parcel from a 39.62 hectare
holding, with the 1.02 hectare parcel being merged on title with two adjacent, residential
properties that are also merging. The end result will be a 3.14 hectare residential lot
which does not comply with the lot area and frontage requirements and a 38.6 hectare
property which also does not comply with the lot frontage requirement of the A1 zone.
The proposed Amendment will adjust the Zoning By-law accordingly.
The lands subject to rezoning are located within the'Rural' and 'Hazard Lands'
designations of the County of Grey Official Plan.
ANY individuals, corporations and public bodies may attend the Public Meeting and/or
make written or verbal representation either in support of or in opposition to the proposed
Zoning By-law Amendment. An individual, corporation or public body that does not
make an oral submission at the public meeting or make a written submission to the
Township of Chatsworth with regard to the Zoning By-law Amendment prior to the
amendment being adopted is not entitled to appeal the Zoning y-law Amendment, nor is
such person entitled to be added as a party to the hearing of an appeal before the Ontario
Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do
so"

BEING

By-law

to amend Zoning By-law No. 2006-45, entitled the "Township of

Chatsworth Comprehensive Zoning By-law";

WHEREAS the Council of the Corporation of the Township of Chatsworth deems it in the
public interest to pass a By-law to amend Zoning By-law No. 2006-45;
AND WHEREAS pursuant to the provisions of Sections 34 of the Planning Act, R.S.O.
1990, as amended, By-laws may be amended by Councils of Municipalities;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
CHATSWORTH ENACTS AS FOLLOWS:

1.

Schedule "5" to Zoning By-law No. 2006-45 is hereby amended by changing the
zone symbols affecting the lands described as Part Lot 51, Concession 2 EGR,
Geographic Township of Holland, Township of Chatsworth, as shown more
particularly on Schedule "A" attached hereto.

2.

Section 27 af By-law No. 2006-45 is hereby amended by adding the following


exceptions:

TAKE NOTICE that the Council of the Corporation of the Township of Chatsworth passed
