Re: Application for Extrajudicial Foreclosure of Real Estate Mortgage

GREETINGS:
We have the honor to deliver to you copies of the Promissory Note (Annex A) and Real
Estate Mortgage dated December 15, 2003 (Annex B) executed by __________________ ___
_____________ with postal address at _________________________________, herein referred to as
MORTGAGOR, in favor of the ____________________________________________________
created under Republic Act No. 8291, otherwise known as the GSIS Act of 1997, with principal
office at GSIS Headquarters Building, Financial Center, Pasay City, herein referred to as the
MORTGAGEE, on the property described and registered under OCT/TCT No.T-186457, issued by
the Office of the Register of Deeds for the Province/City of Bulacan, copy of which is hereto
attached as Annex C, altogether with all improvements therein.
For your information, we state the following:
The aforesaid Real Estate Mortgage Agreement was executed by the Mortgagor in favor of
the Mortgagee to secure the prompt, due and full payment of the loan obtained by the mortgagor in
the sum of Php______________, as evidenced by the Statement of Account, hereto attached as
Annex D.
The conditions of the mortgage have been violated with the default on the part of the
MORTGAGOR to pay their obligation to the MORTGAGEE, which as of February 15, 2007
amounted to Nine Hundred Seventy Nine Thousand Three Hundred Ninety Pesos and 91/100
(________________) due and demandable, inclusive of interest penalties and other charges as per
Statement of Account herein referred as Annex D.
The mortgaged property is to the best of our knowledge free of any prior liens or other
encumbrances, except those as many have been stated in the aforementioned mortgage, if any;
WHEREFORE, we request you to foreclose the abovementioned mortgage on the
property/ies described in Annex B, as well as those embraced in the after-acquired properties clause
thereof, and sell the same at public auction in accordance with the provisions of Act 3135 as
amended. We invite your attention to the following provisions of Presidential Decree No. 385, to wit:
Section 3. Upon the application for foreclosure of the collateral of delinquent borrowers,
whether judicially or extrajudicially, by any government financial institution, the court and/or
officials concerned shall immediately act and give priority to the same and schedule the publication
thereof within five (5) days from receipt of the application, the auction sale to be held not later than
ten (10) days from the date of the last publication. The Certificate of Sale must be issued on the date
of sale and the same must be registered by the Register of Deeds concerned not later then five (5)
days after submission of the Certificate of Sale.

Section 5. The Government Financial Institution are hereby directed to report to the Office of
the President any official who delays the proceedings as provided herein or who violates any of the
provisions of this Decree. Action s taken pursuant to the provisions of this Decree shall, likewise, be
reported by the government financial institution concerned to the Monetary Board, through the
Governor, Central Bank of the Philippines, in accordance with such schedule, forms and procedure as
the government may prescribe for the purpose.

existing at GSIS;
2. I further certify, that the mortgagee has not commenced any action or proceeding
involving the same parties and issues in the Supreme Court, the Court of Appeals, or any
tribunal or quasi-judicial agencies and to the best of my knowledge, no such action or
proceeding is pending therein. Should I thereafter learn that a similar action or proceeding
is filed or is pending, I undertake to inform this Honorable Office of such fact within five
(5) days therefrom.
