EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:


This AGREEMENT is entered between the following:
Name of Employer, of legal age, married/single and a resident of _______ , referred
to as the Employer.

referred as the Employee
Parties have come to an agreement in connection with the employment of _______
name of employee, by the Employer (name of employer), under the following terms
and conditions:
1. Work Designation. The employee is hired as the ___________ (name of job/work

supervisor and/or employer.
3. Status of Employment. The employee is hired as follows:
a. _____ Probationary Employee. This is subject to a maximum of six (6) month
probationary period, wherein the employee has to pass the work performance set
by the employer and known to the employee at the time of the hiring.
b. _____ Regular Employee. After six months of probation, an employee can be
considered a regular employee. He is deemed a regular employee when he/she has
been engaged to perform activities which are usually necessary or desirable in the
usual business or trade of the employer, except if there is a fixed term (contractual
employee) or when on is a seasonal employee.
c. _____ Contractual Employee. An employee who is hired based on a specific
contract and its terms (length of employment ) is provided in such a contract and is
terminated when the contract expires. The employment has been fixed for a specific
project or undertaking the completion or termination of which has been determined
at the time of the engagement of the employee
d. ______ Seasonal Employee. An employee that is hired from time to time and is not
considered a regular employee. The employee is hired only on peak seasons or

when there is a need for an additional employee to answer a specific or defined


work due to the demand of product or services. The work or services to be
performed is seasonal in nature and the employment is for the duration of the
season.
4. Compensation . The employee shall receive the salary of ______. Payment of the
salary shall be a. twice a month, usually on the 15th or 30th of the month b. on
weekends.
The employee shall enjoy all the benefits provided for by the Philippine Labor Code.
In which event, the employee shall not receive a salary that is less than what is
provided for by law. The minimum wage for employees within Cebu City is P305 per
day.
5. Work Schedule. The employee shall report to work on ____. (Example Monday to
Saturday, 8 am to 5 pm, with one hour lunchbreak. )
6. Dismissal and other Penalties. The employee is bound to follow the rules and
regulations (manual) of the employer/company and any infraction or violation shall
be penalized as provided for in its rules and regulations. Employees cannot be
dismissed or penalized without just and authorized causes and the observance of
due process.
7. Non-Disclosure Clause. The employee shall not divulge any matters relating to
said business of the employer or matters relating to any customer which may
become known to him by reason of his employment or otherwise, save in so far as
may be necessary in the interests of said business.
8. Effectivity. This contract is effective upon the signing of this contract and the
submission of the documentary requirements by the employee to the employer.
