Upon conducting a DOR check of Critchlow, it was discovered the subject described by appeared to be one in the same. At approximately 1844 hours, | completed my crash investigation at the above scene and responded to an attempt to locate Critchlow, due to the vehicle being registered to that address, At approximately 1852 hours | arrived at the above address. It should be noted upon my arrival | observed a tan Toyota Tundra parked in the above drive way. Upon checking the vehicle located damage to the left side front bumper, which is consistent with the damage from the above crash. It should also be noted that the hood to the above vehicle was still warm to the touch, which indicated that the vehicle had been driven recently. | responded to the above residence and made contact with the home owner identified as, | askeciIP if Critchlow was home, she advised that he was and she would go get him. Prior to (@BBBMeetting Critchlow | asked her how long he had been home, and she advised for about 30-40 minutes. | waited outside the residence for a short time and at approximately 1858 hours iy tesponded back to the door and invited me in to speak with Critchlow. It should be noted upon entering into the residence, | located Critchlow exiting the bedroom of the residence. Critchlow was wearing a brown hooded sweatshirt, black pants and blue shoes. This matches the exact outfit the driver of the Toyota was wearing shown in osu. Photo. | asked Critchlow if there was a place we could talk about the crash, to which he escorted me to the attached garage of the above residence. It should be noted while walking to the garage Critchlow was walking directly in front of me and appeared to be unstable on his feet by swaying and bumping into the walls of the residence. Upon our arrival to the garage, | asked Critchlow what occurred tonight at Richardson Rd. At first Critchlow appeared to be confused, advising that he did not know what | was talking about and that he had been sleeping for the last two hours. While speaking with Critchlow | smelled a moderate odor of an intoxicating beverage coming from his breath as he ‘spoke. | also noticed his eyes were watery and bloodshot. | asked Critchlow if he had been drinking and he stated "NO". | informed Critchlow of the crash and also informed him that his vehicle was seen leaving the scene of the ‘crash and that there was a picture of the driver, who was wearing the exact clothing he had on. 1 asked Critchlow a second time to tell me what occurred at the crash and he stated that he was not involved in a crash. | inquired if Critchlow had been drinking, to which he advised that he had a few drinks when he got home. | questioned Critchlow, due to the fact he just informed that he had been sleeping for the last couple hours, to which he had no response. The only alcoholic beverage | observed was a half full botle of Corona beer located in the middle of the garage fioor. Due to the above information | advised Critchlow that | was placing him under arrest for leaving the Scene of a motor vehicle crash and for a DWI investigation. At approximately 1914 hours, Critchlow was placed in handcufis, behind his back and secured in the rear seat of my patrol vehicle Critchlow was later transported to the APD booking facility. Upen my arrival to the APD booking facility, Critchlow was escorted to the APD "Sally Port to perform field sobriety testing. The testing area had a flat and level concrete surface, free of any debris. The fist test | performed was the Horizontal Gaze Nystagmus. | observed Critchlow’s eyes to track equally, having both pupils of equal size, and no resting nystagmus. Critchlow had lack of smooth Pursult, distinct and sustained nystagmus at maximum deviation and | also observed onset nystagmus prior to 45 degrees, in both eyes. While performing the test, Critchlow was swaying in a circular motion during the test (approximately 3"). See page one for results, The second test was the Walk and Tum. | instructed Critchlow to stand in a heel to toe stance with his right foot in front of his left foot until instructed him to do otherwise. Critchlow was unable te stand heel to toe during the instruction phase of the test and had had to be placed back into the heal {0 toe stance. | began the demonstration portion for the test and Critchlow started to perform the test brior to being instructed to. | reposition Critchlow a second time and finished explaining and demonstrating the tests. At this point Critchlow broke the heel to toe stance a third time and never resumed the stance. | asked Critchlow if he could perform the tests as | instructed him. Chtchlow tated "have a bad right ankle". | again asked Critchlow if he was willing to perform the test, to which he advised "NO", See page one for results. The third test was the One Leg Stand. | explained and demonstrated the test for Critchlow. | asked Critchlow if he could perform the test as | instructed him. Critchlow advised he could perform the test. Critchlow stood on his left foot during the test. Critchlow began to the test, swayed while balancing and used his arms for balance (Raised Approximately Waist High) and counted to 1003, at which time he placed his foot down and looked at me. | advised Critchlow to pick his foot up and Continue the test. At approximately 1935 hours | advised Critchlow of his Constitutional Rights (Miranda Warning). Critchlow advised he understood his rights, however refused to complete the interview portion of the AIRS Form, I completed the booking process on Critchlow. |i should be noted that while completing the booking process Critchlow made a spontaneous utterance, stating "she slammed on her brakes". | asked Critchlow who siammed on their brakes, to which he stated "the lady in the crash’, Critchlow further advised me that he had lied to me originally and was in fact involved in the above crash, and that he was driving the Toyota at the time of the crash. issued Critchlow the following citations: Leaving the Scene of a Motor Vehicle Crash- 140501044 Fail to Keep Proper Lookout- 140501045 Operated a Motor Vehicle in an Intoxicated Condition -140501047 and he was advised his court date was 04/27/15, at 1900 hours, at 2101 Jeffco Blvd Pus to Critchlow not having his Missouri Drivers License at the time of arrest, it was not seized, however he was issued a 15-Day Driver's Permit, which he refused to sign, Critchlow was then placed in cell 6A, pending release to a sober driver.
