AS OF THE 4TH OF DECEMBER 2014

A partir del 4 de diciembre de 2014 ser aplicable en Espaa

el Reglamento (UE) N 923/2012 Standardised Rules of the
Air (SERA), de acuerdo al Artculo 11 del Reglamento SERA
y el Real Decreto 552/2014.

As of the 4th of December 2014 the Regulation (EU) N

923/2012 Standardised Rules of the Air (SERA) shall be
effective within Spain, in accordance with Article 11 of SERA
Regulation and Royal Decree 552/2014.

1. INTRODUCCIN

1. BACKGROUND

El Reglamento de Ejecucin (UE) N 923/2012 de la Comisin

de 26 de septiembre de 2012 por el que se establecen el
reglamento del aire y disposiciones operativas comunes para
los servicios y procedimientos de navegacin area (SERA) ha
sido desarrollado conjuntamente por Eurocontrol, la Agencia
Europea de Seguridad Area (EASA) en nombre de la Comisin Europea, y los Estados Miembros de la Unin Europea.
Su introduccin permitir disponer de un conjunto armonizado
de reglas del aire para volar en el espacio areo europeo.
SERA se fundamenta en reglas establecidas por la Organizacin Internacional de Aviacin Civil (OACI).

Commission Implementing Regulation (EU) N 923/2012 of 26

September 2012 laying down the common rules of the air
and operational provisions regarding services and procedures
in air navigation (SERA) has been jointly developed by Eurocontrol, the European Aviation Safety Agency (EASA) on
behalf of the European Commission and the EU Member States. It is intended to introduce a harmonised set of operational rules of air when flying in European airspace. SERA is
based on International Civil Aviation Organization (ICAO)
requirements.

Por otra parte, el Real Decreto por el que se desarrolla el Reglamento del aire y disposiciones operativas comunes para los
servicios y procedimientos de navegacin area y se modifica
el Real Decreto 57/2002, de 18 de enero, por el que se aprueba el Reglamento de Circulacin Area, completa la regulacin
nacional en aquellas materias que SERA permite desarrollar y
regular a los Estados miembros y adems, adecua la normativa nacional en otras cuestiones relativas a la navegacin area
ya reguladas por reglamentos comunitarios.

Furthermore, the Royal Decree whereby develops the Rules

of the Air and the common operational arrangements for services and air navigation procedures develops and modifies
the Royal Decree 57/2002 of 18 January, by which approves
the Air Traffic Regulation, complete national regulation in
those matters that SERA allows the Member States to develop and regulate and also adapts the national legislation on
other matters relating to air navigation and already regulated
by EU regulations.

Adems, el Real Decreto incorpora las ltimas enmiendas de

los Anexos al Convenio Internacional de Aviacin Civil (Chicago 1944), relativas a procedimientos para los Servicios de
Navegacin Area, Gestin del Trnsito Areo, como en particular las relativas a combustible mnimo, y tiene en cuenta
varias recomendaciones de la Comisin de Investigacin de
Accidentes e Incidentes de la Aviacin Civil (CIAIAC).

In addition, the Royal Decree includes the latest amendments

to the Annexes to the Convention on International Civil Aviation (Chicago 1944), concerning procedures for Air Navigation
Services, Air Traffic Management, such as those related to
minimum fuel, and takes into account a number of recommendations of the Investigation Commission of Accidents
and Incidents of Civil Aviation (CIAIAC).

Las materias reguladas comprenden contenidos tcnicos y

procedimientos de autorizacin as como la atribucin de
competencias en estas materias.

Matters covered include technical content and authorization

procedures as well as the allocation of powers in these
matters.

De esta manera, SERA junto con el Real Decreto permitirn

disponer a partir del prximo 4 de diciembre de 2014 de un
marco regulatorio nico, integrado y armonizado con las disposiciones de la Unin Europea en materia de circulacin
area, con lo que se da un paso ms en la convergencia normativa que establece la iniciativa de 'Cielo nico Europeo'.

This way, as of the 4th of December 2014 SERA in conjunction with the Royal Decree will allow to have a single, integrated, and harmonised regulatory framework with European
Union provisions on air traffic, taking a further step towards
the regulatory convergence established at the Single European
Sky initiative.

Las Reglas del aire, as como la regulacin de la circulacin

area, basadas en las reglas de la Organizacin Internacional
de Aviacin Civil, a nivel nacional se han venido recogiendo
en el Reglamento de Circulacin Area (RCA), aprobado por el
Real Decreto 57/2002, y sus respectivas enmiendas.

Rules of the air, and regulation on air traffic, based on International Civil Aviation Organization (ICAO) requirements, at
national level, have been complied within Air Traffic Regulation (RCA), approved by the Royal Decree 57/2002, and its
amendments.

Buena parte de las disposiciones recogidas en el Reglamento

SERA ya venan establecidas en el Reglamento de Circulacin
Area, especialmente en su Libro Segundo y Libro Tercero.
De hecho, el Libro Segundo del RCA quedar sin efecto a
partir del 4 de diciembre de 2014 por la aplicacin del Real
Decreto 552/2014.

Most SERA Regulation provisions were already compiled

within Air Traffic Regulation, specifically at its Libro Segundo
and Libro Tercero. In fact, as of 4th of December 2014 Libro
Segundo Air Traffic Regulation (RCA) will be not effective as
Royal Decree 552/2014 will apply.

Sin embargo, se quiere llamar la atencin sobre algunos asuntos relevantes que se contemplan en el Reglamento SERA,
que a su vez se complementan por el Real Decreto 552/2014.
De esta manera se resaltan algunos de los aspectos y cambios ms destacados:
Planes de vuelo. Se enfocan en el contenido de los planes
de vuelo para determinados tipos de vuelo, el procedimiento para su presentacin (tiempo de antelacin) y la forma de
cerrar los mismos.
Zonas obligatorias de radio y zonas obligatorias de transpondedor. La Autoridad competente podr establecer zonas especficas donde se exija disponer de equipo de radio y/o
transpondedor; estas zonas sern publicadas en la AIP-Espaa.
Vuelo VFR nocturno. Se introducen los requisitos para poder
realizarlos segn las disposiciones recogidas en SERA y en
el Artculo correspondiente del Real Decreto 552/2014.
Alturas mnimas de vuelo. Se han introducido modificaciones respecto a la altura mnima de vuelo permitida en determinados casos y se establece la autoridad competente para
fijar una altitud mnima de vuelo distinta de la prevista en
SERA.
Fallos de comunicaciones. A la espera de que la Unin Europea establezca procedimientos comunes europeos (previsto
para diciembre de 2015), se seguirn las disposiciones de
OACI a este respecto. Vase mayores detalles en el Reglamento de Circulacin Area (Libro Cuarto) y la AIP-Espaa.
Operaciones especiales. Se establecen, a travs del Real
Decreto 552/2014, las disposiciones concretas previstas en
el artculo 4 del reglamento SERA en relacin con el procedimiento comn para conceder a las operaciones especiales
exenciones a las reglas de SERA y del Reglamento de Circulacin Area y tambin se establece la autoridad competente para otorgar estas exenciones.
Emergencia por combustible. Se incorporan las ltimas enmiendas adoptadas por la Organizacin de Aviacin Civil Internacional (OACI) a los Procedimientos para los Servicios
de Navegacin Area, Gestin del Trnsito Areo (PANSATM) (Doc. 4444), a los Procedimientos suplementarios regionales (Doc. 7030), as como al Anexo 6 al Convenio Internacional de Aviacin Civil (Chicago 1944) y al Manual de
planificacin y gestin del combustible (Doc. 9976), teniendo en cuenta, adems, las recomendaciones de la Comisin
de Investigacin de Accidentes e Incidentes de la Aviacin
Civil (CIAIAC).
Interferencia ilcita. El Reg. (UE) N 923/2012 recoge disposiciones acerca de esta materia, e igualmente el Real Decreto
552/2014 remite a lo dispuesto en el Programa Nacional de
Seguridad para la aviacin civil, aprobado segn lo previsto
en el artculo 3 de la Ley 21/2003, de 7 de julio, de Seguridad Area y sus normas de desarrollo.
VFR especiales. Se establecen condiciones para la expedicin de estas autorizaciones para pilotos y ATCOs.
Concepto de autoridad competente. El Real Decreto
552/2014 establece quien es la autoridad competente referida en las disposiciones del reglamento SERA.

Nonetheless, attention is drawn about some relevant subjects

established at SERA Regulation, complemented by the Royal
Decree 552/2014. Accordingly, some of the most remarkable
aspects and changes are the following:

Flight plans. Focus on flight plans contents for certain types

of flight, submission procedure (time in advance) and the
way of closing them.
Radio Mandatory Zones and Transponder Mandatory Zones.
The competent Authority may establish specific zones where
radio equipment and/or transponder will be required. These
zones shall be published on the AIP-Espaa.
VFR flight at night. Requirements are introduced in order to
carry them out according provisions contained in SERA and
the corresponding article of Royal Decree 552/2014.
Minimum height of flight. Modifications have been included
related to the minimum flight height for some cases and
also the competent Authority to set a minimum flight height
different to those provided by SERA is established.
Communications failure. Waiting for the European Union to
establish common European procedures (foreseen for December 2015), for the time been the related provisions of
ICAO will be followed. For more information see Air Traffic
Regulation (Libro Cuarto) and the AIP-Espaa.
Special operations. The specific provisions provided for in
article 4 of SERA regulation are established by Royal Decree
552/2014, in relation to the common procedure to grant
exemptions to special operations regarding the SERA and
Air Traffic Regulation rules and also the competent authority
to issue these exemptions.
Fuel emergency. The latest amendments to the Procedures for Air Navigation Services, Air Traffic Management
(PANS-ATM) (Doc. 4444) the Regional Supplementary
Procedures (Doc. 7030), and Annex 6 to the Convention on
International Civil Aviation (Chicago 1944) and the Flight
Planning and Fuel Management Manual (Doc. 9976) adopted by the International Civil Aviation Organization (ICAO),
are incorporated, taking into account, also, the recommendations of the Civil Accident and Incident Investigation Commission (CIAIAC).
Unlawful interference. Specific provisions provided in Regulation (EU) N 923/2012 as well as Royal Decree 552/2014
refers to the provisions of the Programa Nacional de Seguridad para la Aviacin civil, approved as provided in Article 3
of Act 21/2003, of 7th July, on Air Safety and its implementing rules.
Special VFR. Conditions for issuing these authorizations for
pilots and ATCOs are established.
Concept of competent authority. Royal Decree 552/2014
establishes who the competent authority is referred to in
the provisions of SERA Regulation.

La actualizacin del Reglamento de Circulacin Area (RCA)

que introduce el Real Decreto 552/2014 transpone a la regulacin nacional la disposicin de los PANS-ATM (Documento
4444 de OACI) apartado 15.7.3.2. Por lo tanto la entrada en vigor de dicho Real Decreto deja sin efecto la Directriz de Seguridad de la Agencia Estatal de Seguridad Area relativa a la
operacin ATC ante avisos de resolucin ACAS (RA)
(DIRS-2013/01/1.0, con fecha de emisin 19/11/2013).

The update of the Air Traffic Regulation (RCA) made by the

Royal Decree 552/2014 transposes into national regulation
the provision 15.7.3.2 of the PANS-ATM (ICAO Doc 4444).
Therefore the entry into force of the above mentioned Royal
Decree cancels the Safety Directive of the Spanish Aviation
Safety and Security Agency (AESA) related to ATC operations
towards ACAS Resolution Advisories (RA) (DIRS-2013/01/1.0,
issued on 19/11/2013).

A non-legal binding compilation of the Air Traffic Regulation

including the amendments from the SERA Regulation and
Royal Decree 552/2014 will be available from the Ministry of
Transport website.
