InstitutionalArea,Gurgaonlatestby3.00P.M.,on.2011,andwillbeopenedonthesameday
by5.00P.M.inthepresenceofthetenderersortheirauthorizedrepresentatives.

Tenderers must get acquainted with proposed the work and study the drawings, designs, specifications,
scopeofworks,conditionsofcontractandotherconditionscarefullybeforetendering.Norequestforany
change in rates or conditions for want of information on any particular point shall be entertained after
receiptoftenders.

5.

Thetenderersshouldquoteratesforeveryitemandwriteratesveryclearlytoavoiddiscrepancies. Thebill
ofquantitiesisapproximateonlyandliabletovary.

6.

Tenderersmustsubmitwiththeirtender,acrosseddemanddraft Rs.10,000/(Rs.Tenthousandonly)in
favor of the Owner National Horticulture Board, Plot no.85, SECTOR18, Institutional Area,
Gurgaon againstEarnestMoney.Tenders,whicharenotaccompaniedwithEarnestMoney,shallnotbe

CONTRACTORSACQUAINTANCE
Thesubmissionofthisbiddingdocumentbythecontractorwillbeconclusiveevidencetothefactthat:

executiveoftheContractorsfirm.

4.

CONTRACTPRICE
ThecontractpriceatthetimeofsigningthiscontractisassumedtobetheBiddingPrice(orasnegotiated)
but eventually the Contract Price shall be the amount computed on the basis of the rates quoted in the
Bill/ScheduleofQuantitiesmultipliedbytherespectivequantitiesofworksexecutedatthecompletionof
theworks,howeversubjecttothenotehereunder.
Note:TheEmployerreservestherighttomakechangesintheBillofQuantitiesbyadditionandomission
ofitemslistedintheBillofQuantitiesandtointroducenewitemsatratestobenegotiatedortobedecided
asperthetermsofthecontract.Thebiddingratesshallbefirmforthedurationofthecontract.

5.

SALESTAX/OTHERDUTIES&TAXES
TheratesshallincludeSalesTaxetc.,andoranyothertaxesleviedonmaterials/servicesinrespectofthis
contractshallbepayablebythecontractorandemployer NationalHorticulture Boardwillnotentertain
anyclaim,whatsoever,intheserespect.

6.

SCOPEOFWORK
TheEmployershallhavetherighttoincreaseordecreasethescopeofwork.Noclaimorcompensation
shallbeadmissibleduetosuchvariation.

7.

CONDITIONALTENDERBYCONTRACTOR
Conditionaltenderswillnotbeaccepted.

VALIDITYOFTENDERBID
Tendersshallremainopenforacceptanceforaperiodof30daysfromthedateofopeningofthetenders.
If any tenderer withdraws histender before the said period ormakesany modifications in thetermsand
conditionsofthetenderwhicharenotacceptabletoemployerNationalHorticultureBoard, Plotno.85,
SECTOR18,InstitutionalArea,GurgaonthentheemployerNationalHorticultureBoard, Plotno.
85,SECTOR18,InstitutionalArea,Gurgaonshallwithoutprejudicetoany,otherrightorremedybeat
liberty to forfeit the entire amount of the earnest money amount of earnest money absolutely and the
decisionoftheemployer NationalHorticultureBoard, Plotno.85,SECTOR18,InstitutionalArea,
Gurgaoninthisbehalfshallbefinalandbindingonthetenderer.

ACCEPTANCEOFTENDER
The acceptance of a tender will rest with employer National Horticulture Board, Plot no.85,
SECTOR18, Institutional Area, Gurgaon who do not bind themselves to accept lowest tender and
reservetothemselvestheauthoritytorejectanyorallthetendersreceivedwithoutassigninganyreasons.
Theyalsoreservetherightacceptingthewholeoranypartofthetenderandthetenderershallbeboundto
performthesameattheratesquoted.Alltendersinwhichanyoftheprescribedconditionsarenotfulfilled
orareincompleteinanyrespectorthereisanycorrectionnotdulyinitialedbythetendererareliabletobe
rejected.

CONTRACTORSLOCALCONTACT
Onacceptance of thetender, thename of the accreditedrepresentatives of the contractor, who would be
responsiblefortakinginstructionsfromtheArchitectand/orhisrepresentativeshallbe communicatedto
theArchitect,andtheemployer.IftheHeadQuarterofthesuccessfultendererisattheplaceotherthan,
GurgaonheshallhaveadulyauthorizedagentinGurgaonfromthedateofcommencementofthework
until the work is virtually completed. Such agent shall be authorized to act on behalf of the successful
tenderer.Anynoticeunderthecontractshallbedeemedtohavebeenservedonthesuccessfultendererif
served upon such agent or sent by registered latter at his address in Gurgaon. Such agent shall not be
changedandshallnotleaveGurgaon duringtheperiodof thecontractwithoutthepriorapprovalofthe
Architects, if the Architect shall require the successful tenderer to carry out the rectifications of defects
underthetermsofthecontractduringdefectliabilityperiod,thesuccessfultenderershallhavesameor
anotherdulyauthorizedagentinGurgaonwhilesuchrectificationsarebeingcarriedout.

SIGNINGOFAGREEMENT
ThesuccessfultenderershallsignthenecessarycontractdocumentswithinSixdaysorthetimespecified
in the letter communicating the acceptance of the tender. In case of delay the earnest money may be
forfeited and the tender cancelled or the contract enforced as per terms of tender and the invitation to
tender,andthetenderershallthusbeboundbytheconditionsofcontracteventhoughtheformalagreement
hasnotbeenexecutedandsignedwithinthespecifiedtimebytenderer.

COMMENCEMENT&COMPLETIONOFWORK
The time allowed for completion of work will be one month The successful tenderer will start the
constructionwithinSixdaysofcommunicatingtheacceptanceoftender.Ifthecontractorselectedforthe
workfailstosigntheformalagreementwithinSixdaysfromthedateofintimationorfailstostartwork
withinSixdaysfromthedateofworkorder,thentheemployerNationalHorticultureBoard, PlotNo.
85,SECTOR18,InstitutionalArea,Gurgaonshall,withoutprejudicetoanyotherrightorremedy,beat
liberty to forfeit the entire amount of earnest money absolutely. The decision of employer National
Horticulture Board, Plot No.85, SECTOR18, Institutional Area, Gurgaon) in this behalf shall be
finalandbindingonthetenderer.

EXTENSIONOFTIME
Extensionoftimebeyondthestipulateddateofcompletionofworksshallbegrantedonlyonaccountof
followingoccurrencesaffectingtheprojectareaand/oranydelayincompletionofbasiccivilworks,with
whichtheelectricalworkistobecoordinated

Manifestedcivildisturbances.
2.
Manifesteddislocationofeconomicnature.
3.
Naturalcalamities
4.
InstructiontosuspendworksissuedinwritingbytheEmployer/Architectforanyreason.
TheextensionoftimetobegrantedonaccountoftheaboveshallhavethesolediscretionoftheEmployer.

SECURITYDEPOSIT
FromtheContractorbillswhosetenderisaccepted,adeductionof10%ofgrossvalueofexecutedwork
againstsecuritydepositwillbemadefromeachrunningbill.Theearnestmoneyaftertheawardofwork
will be treated as security deposit of the successful tenderer, and the said amount would be adjusted
towardssecuritydepositintherunningbills.Thissecuritydepositwillbelimitedto Rs.5,000/maximum
fund.

UNDERTAKING/DECLARATION
Thecontractorshouldgivetheundertakinganddeclarationontheprescribedperforma,regardinghiswell
conversancewiththebestconstructionpractice.

OTHERIMPORTANTCONDITIONSOFCONTRACT
16.1

16.2

TIMEOFCOMPLETION ThecontractorshallfurnishtotheEmployertheScheduleasC.P.M.
and/orBarChart,forthecompleteproject(consideringtheprogressesofconnectedcivilworks)
before the commencement of work. Maximum time allowed for completion of the work is one
month.
FACILITIES TO THE CONTRACTOR Facilities to be given by the employer to the
contractorareElectricityandwaterconnectionetc.,atanyonepointatsite,freeofcost.

16.3

DEFECTS LIABILITY Any defects developed/noticed within Defects Liability Period of 12


monthsafterthecompletionofwork,duetothebadworkmanship,negligenceoftheworkers,(but
not due to the material used as supplied by the owner, being underspecification) or otherwise
whereresponsibilitycomesontherateratecontractorasperIndianContractAct,theContractor
is liable to bear the expenses to repair or replace the defects. The cost of materials used in
rectifyingthedefectsshallalsobebornebythecontractor.

16.4

CLEARING OF SITE ON COMPLETION Contractor shall remove all the unnecessary


materials from the vicinity of the project and dump the same at the location decided by the
EmployerinconsultationwiththeArchitect.Heshallcleanthesite,shrubs,anddebrisandshall
makealltheareagoodtothesatisfactionoftheEmployer,andshallkeepthesitecleanduringthe
constructionperiodaswell.

16.5

COMPENSATIONANDACTIONINCASEOFBADWORKMANSHIP Ifitshallappearto
the Architect/Employer, that any work has been executed with unsound or unskillful
workmanship,thecontractorathisowncostshallrectifyorremoveandreconstructtheworkso
specifiedinwholeorinpartasthecasemayrequire,withintheperiodintimatedbytheArchitect,
failingtodosowithintheaboveperiod,thecontractorshallbeliabletopaycompensation@1%
ontheestimatedamountputtotenderforeverydateexceeding10days.Detailsshallbereferred
asperCPWDnorms.

16.6

SECURITYDEPOSITofthesuccessfultendererwillbeforfeitedifhefailstocomplywithany
oftheconditionofcontract.

16.7

DAMAGE TO WORK The contractor shall be responsible for all damages except damages
causedbyriots,civilwar,earthquake,thunderstorms,designfailureandbyaircraft,tillthework
ishandedover.

16.8

QUALIFIED ENGINEER FOR SUPERVISION OF WORK Where the contractor is not a


qualifiedengineer,heshallathisownexpenses,employadegreeholderengineer,qualifiedfrom
Government recognized institution or a Diploma holder in engineering from a Government
Recognized institution with five to six years experience of work throughout the duration of
contractandensurehisalltimeavailabilityatsite.

16.9

PAYMENTOFINTERIMCERTIFICATETOCONTRACTORAllsuchpaymentsmadeon
Interimcertificatesshallberegardedaspaymentbywayofanadvanceagainstthefinalpayment
only and not as a payment for work actually done and completed and shall not include the
repairing of bad, unsound, imperfect, or unskilled work to be removed and taken away and
reconstructedorerected,orbeconsideredasanadmissionofthedueperformanceofthecontract
oranypartthereofinanyrespectoftheaccruingofanyadjustmentortheaccountsorotherwiseor
inanyothervaryoreffectthecontract.
Partpayment(stagewisetobemadetothecontractor)shallbesettledbetweenthecontractorand
theemployerasmentionedinthepaymentschedule.

16.10 ACCIDENTWITHLABOURATSITEIncaseofanyaccidentatsiteduetonegligenceofthe
contractor,heshallpayallthedamagesetc.,andbearalltheresponsibilitydetailsasperCPWD
norms). To affect this the contractor shall get the group insurance of labor engaged in the
constructionsworketc.,atthesite.
16.11

NODIRECTPAYMENTTOTHELABOUR Incaseofanydisputebetween
contractorandtheowner,theownershallnotbeliabletomakeanypaymenttothelaborersand
the Ownerhasgotalltherighttoensurethatthepaymenttothelaborersbeingmaderegularly
(detailsasperCPWDnorms).

16.12

ESCLATIONNolaborEscalationwillbegivenunderanycircumstances.

TAXDEDUCTIONST.D.S. willbedeductedaspertheIncome Taxrulesasapplicable.

16.14

CANCELATIONOFCONTRACTFORSUBLETTING,INSOLVENCYETC.,
The Employer,inconsultationwiththeArchitectsmaywithoutprejudice,cancelthecontractin
anyofthe followingcases:
If the Contractor being an individual or if a firm, any partner thereof shall at any time be
adjudgedinsolventorhavereceivedorderorordersforadministrationofhisestatesmadeagainst
him or shall take any insolvency Act., for the time being in force or make any conveyance or
assignmentofhiseffectsorcompositionorarrangementsforthebenefitofhiscreditorsorpurport
to do so, or if any applications be made any insolvency Act for the time being in force the
sequestrationofhisestateorifatrustdeedbegrantedbyhimonbehalfofhiscreditors:
Assigns, transfers, subjects or attempt to assign, transfer or subject, any portion of the work
without the written permission of Architect/Employer. Whenever the Architect/Employer
exerciseshisauthoritytocancelthecontractundertheconditions,hemaycompletetheworkby
anymeansattheContractorsriskandcost.Thesecuritydepositsandothercontractmoneywill
beattheabsolutedisposaloftheArchitect/Employer.

16 GENERAL

tender documents as prepared by the Architect Prof. Mandeep Singh (SPA), 4/305, Community Centre,
PreetViharNewDelhi,andhiselectricalspecialist.
Theemployer/ownerinconsultationwiththeArchitectreservesthe rightofawardinganypartofthework
toany otheragency,ifitprefersso.Theemployeralsoreservetherighttochangethescope of workor
omitoraddormodifyanyworkwithoutanyprejudicetothecontract
Rates quoted in the tender are for finished work at site and shall include all charges for scaffoldings,
centering,.,alltoolsandplantsrequired,shedsforstorageofmaterialsetc.,completeincludingpaymentof
salestaxorothertaxesandroyalties

20.

GENERAL
The site after completion of the work is to be handed over clean and the work include removal of
unserviceableanddisposalofMalbaincludingcartagetothedumpingground.
The bidding contractor must make himself familiar and acquainted with the site as also the scope
anddesign ofcivilinteriorworkswithwhichtheelectricalworksaretobecocoordinated.

THIS NOTICE INVITING TENDER AND THESE TERMS AND CONDITIONS OF BIDDING TENDER
SHALLFORMPARTOFCONTRACTUALAGGREMENT.

comprehensiveand conclusive. I affirm that intention of the contract is to execute work in the best engineering
traditionsandpracticesandIshalltakethemeaningimpliedinthespiritandnotinletter.Ifcashcompensationis
notclaimeditshallmean,noclaim.

IhavestudiedcarefullyTenderDocumentandunderstandtherequirements.

I have discussed with consultants about all possible construction problems sequences, requirement

To the best of my knowledge rates are quoted are balancedrates, based on availability, losses and other
requirementsoflaborresourcesetc.Iagreethatconsultantshaveeveryrighttoaskfordetailedanalysisof
any or all rates, before or after completion of works. Any item can be taken away at the consultants/
employerdiscretion.

shall nominate for that purpose provided always that no person subsequently appointed to be Architect
under this Contract shall be entitled to disregard or overrule any certificate, or opinion or decision or
approvalorinstructiongivenorexpressedbytheArchitectforthetimebeing.

4.

ENGINEERORWORKSorSITEENGINEERshallmeanapersonorfirmappointedandpaidby
the Owner Employer, and acting under the instructions of the Architect for supervision, inspection,
checking and measuring the work at site, and keep the records of works, and progress and payments
relatingtothiscontract.

5.

AGREEMENT shall comprise of and include conditions of Tender (NIT), the Contract, General
Conditions and appendix thereto special conditions, Drawings (including subsequent details to be issued
duringexecution)specifications,pricedscheduleofquantitiesandany otherdocument,whichtheparties
agree hereinafter, and all the aforesaid documents shall be read and construed as forming part of this
agreement and the parties as hereto shall respectively abide by submit themselves to the conditions and

ANY DISPUTE arising out of or in any connection with this agreement shall deem to have arisen in

Tenderasthepriceofthatitemasimilarpercentage
or proportionate sum. Provided always that in
determinethepercentageorproportionofthesumso
added or deducted by the Contract or the total
amount of any Prime Cost items and provisional
sums of money shall be deducted form the total

Instructions

2.

TheContractorshallcarryoutandcompletethesaidworkineveryrespectin
accordancewiththiscontactandwiththedirectionsofandtothesatisfactionof
Architect. The architect may in his absolute discretion and from time to time
issue further Drawings and/or written instructions, details, directions and
explanations which are hereafter collectively referred to as Architects
Instructionsinregardto:
(a)

The variation or modification of the design, quality or quantity or


worksortheadditionoromissionorsubstitutionofanywork.

(b)

Any discrepancy in the Drawings or between the Schedule of


Quantities/sand/orDrawingsand/orSpecification

(c)

The removal from the site of any materials brought thereon by the
contractorandthesubstitutionofanyothermaterialtherefor.

(d)

The remove and/or reexecution of any works executed by the


contractor.

(e)

Thedismissalfromtheworkofanypersonsemployedthereupon.

(f)

Theopeningupforinspectionofanyworkcoveredup.

(g)

TheamendingandmakinggoodofanydefectsunderClause19.

The Contractor shall forthwith comply with and duly execute any work
comprised in such Architects instructions provided always that verbal
instructions directions and explanations given to the contractor or his
representativeupontheworksbytheArchitectshall.Ifinvolvingavariation,be
ifnotdissentedfrominwritingwithinfurthersevendaysbytheArchitectsuch
shallbedeemedtobeArchitectsinstructionswithinthescopeof thecontract.
If compliance with the Architects instructions as aforesaid involves work
and/orexpenseand/orlossbeyondthatcontemplatedbythecontractthenunless
thesame wereissued owingtosome breachofthiscontractbythecontractor,
theEmployershallpaytothecontractorontheArchitectsCertificatetheprice
of the said work (as an extra to be valued as hereinafter provided) and/or
expensesand/orloss.
Drawingsand
3.
ScheduleofQuantities

ThecontractshallremaininthecustodyoftheArchitect/hisagentorthe
siteengr.andshallbeproducedbyhimathisofficeasandwhenrequiredbythe
Employer or the Contractor. The contractor on the signing hereof shall be
furnished by the Architect free of cost with a copy of the priced Schedule of
Quantitiesonecopyof eachofthesaidDrawingsandofthespecification,one
copy of all further Drawings issued during the progress of the works. Any
furthercopiesofsuchDrawingrequiredbyContractorshallbepaidforbyhim.
ThecontractorshallkeeponecopyofallDrawingsonthefinalCertificatetothe
Contractors, he shall forthwith return to the Architects all Drawings and
Specification.

4.

Thecontractorshallprovideeverythingnecessaryfortheproperexecutionof
theworksaccordingtotheintentandmeaningoftheDrawings,Scheduleof
QuantitiesandSpecificationtakentogetherwhetherthesamemayormaynotbe
particularly shown or described therein provided that the same canreasonably
be inferred there from, and if the contractor finds any discrepancy in the

5.

ThecontractorshallconformtotheprovisionsofanyActoftheLegislature
relatingtotheworks,andtotheRegulationsandByelawsofanyAuthorityand
of any water, lighting and other companies and/or Authorities with whose
systemthestructureisproposedto beconnected,andshallbeforemakingany
variations from the Drawings or Specification that may be necessitated by so
conforming give to the Architect written notice, specifying the variation
proposedtobemadeandthereasonformakingit,andapplyfortheinstructions
thereon. In case the Contractor, shall not within ten days receive such
instructions,heshallproceedwiththeconformingtotheprovisionsregulations
ofbyelaw,inquestion,andanyvariationsonecessitateshallbedealtwithunder
clause No.13. The contractor shall bring to the attention of the Architect all
notices required by the said Acts, Regulations or Byelaws to be given to any
AuthorityandpaytosuchAuthority,ortoanyPublicOfficeallfeesthatmaybe
properly chargeable in respects of the works, and lodge the receipts with
Architect.
The Contractor shall indemnify the Employer against all claims in respect of
patent rights, and shall defend all actions arising from such claims, and shall
himselfpayallroyalties,licensefees,damagecostsandchargesofallandevery
sortthatmaybelegallyincurredinrespectthereof.

6.

TheContractor shallsetouttheworksandshallberesponsibleforthetrueand
perfect setting out of the same and for the correctness of the positions, levels,
dimensionsandalignmentofallpartsthereof.Ifatanytimeaanyerrorinthis
respectshallappearduringtheprogressoftheworkstheContractorshallathis
ownexpenserectifysucherrorifsorequiredtothesatisfactionoftheArchitect.

Appendixhereto.TheContractorshallalsoduringthewholetimetheworksare
in progress employ a competent representative who shall be constantly in
attendance at the building while the men are at work. Any directions,
explanationsinstructionsornoticesgivenbytheArchitecttosuchrepresentative
shallbeheldtobegiventotheContractor.
TheContractorshallontherequestoftheArchitectimmediatelydismissfrom
theworksanypersonemployedthereonbyhimwhomay,intheopinionofthe
Architect,beincompetentormisconducthimself,andsuchpersonshallnotbe
againemployedontheworkswithouttherepermissionoftheArchitect.

Clerkofwork

11.

ThetermsSiteEngineerandClerkofworksshallmeanthepersonapproved
by Architect and appointed and paid by the Employer and acting under the
ordersoftheArchitecttoinspecttheworkintheabsenceoftheArchitect.The
ContractorshallaffordtheClerksofWorksandSiteEngineer,everyfacilityand
assistanceforinspecting theworkandmaterials,andforcheckingand
measuringtimeandmaterials.Neitherthesiteengineer/ClerksofWorksnor
any representative of the Architect shall have power to set out works or to
revoke, alter, enlarge or relax any requirements of the contract, or to sanction
anydayworkadditionsalternatives,deviationsoromissions,oranyextrawork
whatever except in so far as such authority may be specially conferred by a
written order of the Architect. The Site Engineer, Clerk of works, or any
representativeoftheArchitect,shallhavepowertogivenoticetotheContractor
ortohisrepresentativeofnonapprovalofanyworkormaterialsandsuchwork
shall be suspended or the use of such materials shall be discontinued until the
decision of the Architect is obtained. The work will from time to time be
examinedbytheArchitect,theSiteEngineer/ClerkofworksortheArchitects
representative, but such examination shall not in any way exonerate the
contractorfromtheobligationtoremedyanydefectwhichmaybefoundtoexist
at any stage of the works on after the same is completed. Subject to the
Limitation of the Clause the Contractor shall take instructions only from the
Architect.

Assignment&
Subletting

12.

ThewholeoftheworksincludedintheContractshallbeexecutedbythe
ContractorandtheContractorshallnotdirectlyorindirectlytransfer,assignor
underlet the Contract or any part share there of or interest therein without the
writtenconsentoftheArchitectandnoundertakingshallrelievethecontractor
from the full and entire responsibility of the contract or from active
superintendenceoftheworksduringtheirprogress.

vitiatecontract

13.

Noalteration,omissionorvariationshall vitiatethiscontractbutincasethe
Architect thinks proper at any time during the progress of the works to make
anyalterationsinoradditionstooromissionsfromtheworkoranyalterationin
the kind or quality of the materials to be used therein and shall give notice
thereof in writing underhis hand to the Contractor, the Contractor shallafter,
addtooromitfromasthecasemayrequire,inaccordancewithsuchnotice,but
the Contractor shall not do any work extra to or make any alterations or
additions to or omissions from the works or any deviation from any of the
provisions of the Contract. Stipulation, Specification or Contract Drawings
withouttheprevious,consentingwritingoftheArchitectandthevalueofsuch
extras,alterations,additionsoromissionsshallinallcasesbedeterminedbythe
ArchitectinaccordancewiththeprovisionsofClause17hereof,andthesame
shallbeaddedtoordeductedfromtheContractAmountaccordingly.

ScheduleofQuantities 14.

The Schedule of Quantities unless otherwise stated shall be deemed to have


been prepared in accordance withthe Standard Methodof Measurement of
BuildingworkslastbeforeissuedbytheIndianInstituteofArchitects.
Anyerrorindescriptionorinquantityorinomissionofitemsfromtheschedule
of Quantities shallnot vitiatethis Contract but shall be rectified and the value
thereof as ascertained under Clause 17 hereof shall be added to or deducted
fromtheContractAmount(asthecasemaybe)providedthatthereshallbeno
rectificationoferrorsintheContractorsScheduleofRates.

Sufficiencyof
15.
ScheduleofQuantities

TheContractorshallbedeemedtohavesatisfiedhimselfbeforetenderingasto
the correctness and sufficiency of this Tender for the works and of the prices
stated in the Schedule of Quantities and / of the Scheduleof Rates and Prices
whichratesandpricesshallcoverallhisobligationsundertheContract,andall
mattersandthingsnecessaryforthepropercompletionoftheworks.

MeasurementofWorks 16.

TheArchitectorhisrepresentativemayfromtimetotimeintimatetothe
contractorthatherequires the works to be measured, andthe Contractor shall
forthwith attend or send a qualified Agent to assist the Architect or the
Architectsrepresentativeintakingsuchmeasurementsandcalculationsandto
furnishallparticularsortogiveallassistancerequiredbyeitherofthem.
ShouldtheContractornotattendorneglectoromittosendsuchAgentthenthe
measurementtakenbytherepresentative ofArchitectorapproved byarchitect
shallbetakentobethecorrectmeasurementsoftheworks.Suchmeasurements
shall be taken in accordance with the Standard Method of Measurement of
BuildingWorkslastbeforeissuedbytheIndianInstituteofArchitects.
The Contractor or his Agent may at the time of measurement take such notes
andmeasurementsashemayrequire.
All authorized extra works, omissions and all variations made without the
Architects knowledge, if subsequently sanctioned by him in writing, shall be
includedinsuchmeasurements.

PriceforExtrasetc.
Ascertainmentof

17.

Shoulditbefoundafterthecompletionoftheworksfrommeasurementstaken
(inaccordancewiththeprevious paragraph)thatanyofthequantitiesor
amounts of works thus ascertained are less or greater then the quantities or
amount specified for the work in the priced schedule of Quantities and or
Tenderorthatanyvariationismade,thevaluationofsuchquantities,amounts
or variations, unless previously or otherwise agreed upon, shall be made in
accordancewiththefollowingrules:
(a)

ThenetratesorpricesintheoriginalTendershalldeterminethe
Valuation of the extra work where such extra work is of similar
character and executed under similar conditions as the work priced
therein.

(b)

Thenet prices of the original Tender shall determine the value of the
items omitted provided if omission vary the conditions under which
anyremainingitemsofworksarecarriedoutpricesforthesameshall
bevaluedunder(c)hereof:

Where the extra works are not of similar character and/or executed
under similar conditionsas aforesaid or wherethe omissions vary the
conditionsunderwhichanyremainingitemsofworksarecarriedoutor
iftheamountofanyomissionoradditionrelativetotheamountofthe
wholeoftheContractworksortoanypartthereofshallbesuchthatin
the opinion of the Architect the net rate or price contained in the
PricedScheduleofQuantitiesorTenderoforforanyitemofthework
involve loss or expense beyond that reasonable contemplated by
contract is by reason of such omission or addition rendered
unreasonableorinapplicable,theArchitectshallfixsuchotherrateor
priceasinthecircumstancesheshallthinkreasonableandproper.

(d)

Where extra work cannot be properly measured or valued the


Contractor shall be allowed day work prices as thenetrates statedin

theTenderorthepricedScheduleofQuantitiesor,ifnotsostated,then
inaccordancewiththelocaldayworkratesandwagesforthedistrict
providedthatintheeithercasevouchersspecifyingthedailytime(and
if required by the Architect, the workmens names) and materials
employed be delivered for verification to the Architect of his
representativeatorbeforetheendoftheweekfollowingthatinwhich
theworkhasbeenexecuted.
The measurement and valuation in respect of the Contract shall be
completed within the Period of final measurements stated in the
appendixorifnotsostatedthenwithin6monthsofthecompletionof
theContractworksasdefinedinClause20hereof.
Unfixedmaterialswhen 18.

WhereinanyCertificate(ofwhichtheContractorhasreceivedpayment)the
Architecthasincludedthevalueofanyunfixedmaterialsintendedforand/or
placedonoradjacenttotheworkssuchmaterialsshallbecomethepropertyof
the employer and they shall not be removed, except for use upon the works,
withoutthewrittenauthorityoftheArchitect.TheContractorshallbeliablefor
anylossordamagetosuchmaterials.

19.

TheArchitectshall,duringtheprogressoftheworks,havepowertoorderin
writingfromtimetotimetheremovalfromtheworkswithinsuchreasonable
time to times as may be specified in the order, of any materials which in the
opinion of the Architect are not in accordance with the Specification or the
instructions of Architect, the substitution of proper material, and the removal
and properreexecution of any work executed with materials or workmanship
not inaccordance with the Drawings and Specification or instructionsand the
Contractor shall forthwith carry out such order at his own cost. In case of
defaultonthepartoftheContractortocarryoutsuchorder,theEmployershall
havethepowertoemployandpayotherpersonstocarryoutthesameandall
expenses consequent thereon incidental thereto as certified by the Architect
shallbebornebythecontractorormaybedeductedbytheEmployerfromany
moneysdueorthatmaybecomeduetheContractor.

DefectsafterCompletion 20.

Anydefect,shrinkage,settlementorotherfaultswhichmayappearwithinthe
DefectsLiabilityPeriodstatedintheappendixheretoor,ifnonestated,them
within twelve months after the virtual completion of the works, arising in the
opinionoftheArchitectfrommaterialsorworkmanshipnotinaccordancewith
the Contract, shall upon the directions in writing of the Architect, and within
suchreasonabletimesasshallbespecifiedtherein,beamendedandmadegood
bytheContractor,athisowncostunlesstheArchitectshalldecidethatheought
to be paid for such amending and making good and in case of default the
Employer may employ and pay other persons to amend and make good such
defect,shrinkage,settlementsorotherfaults,andalldamages,lossandexpenses
consequent thereon or incidental thereto shall be made good and borne by the
Contractorandsuchdamage,lossandexpensesshallberecoverablefromhim
by the Employer or may be deducted by the Employer upon the Architects
Certificate in writing from any moneys due to that may become due to the
Contractor,ortheEmployermayinlieuofsuchamendingandmakinggoodby
the contractor deduct from any moneys due to the Contractor a sum, to be
determinedbytheArchitectequivalenttothecostofamendingsuchworkand
intheeventoftheamountretainedunderClause32beinginsufficient,recover
thebalancefromtheContractor,togetherwithanyexpensestheEmployermay
have incurred in connection therewith. Should any defective work have been
done or material supplied by any SubContractor employed on the works who
hasbeennominatedorapprovedbytheArchitectasprovidedinClausesIIand

The works shall not be considered as completed until the Architect has
certifiedinwritingsthattheyhavebeenvirtuallycompletedandtheDefects
LiabilityPeriodshallcommencefromthedateof suchCertificate.

NominatedSub
Contractors

22.

AllSpecialist,Merchants,Tradesmenandotherexecutinganyworkor
supplyingandfixinganygoodsforwhichprimecostpricesorprovisionalsums
are included in the Schedule of Quantities and/or Specification who may be
nominated or selected by the Architect are hereby declared to be Sub
Contractors employed by the Contractor and are herein referred to as
nominatedSubContractors.
No nominated SubContractor shall be employed on or inconnection withthe
works against whom the Contractor shall make reasonable objection or (save
where the Architect and Contractor shall otherwise agree) who will not enter
intoaContractproviding:
(a)

ThatthenominatedSubContractorshallindemnifytheContractor
against the same obligations in respect of the Sub Contract as the
ContractorisunderinrespectofthisContract.

(b)

That the nominated SubContractor shall indemnify the Contractor


againstclaimsinrespectofanynegligencebytheSubContractor,his
servantsoragentsoranymisusebyhimorthemofanyscaffoldingor
other plant the property of the Contractor or under any Workmens
CompensationActinforce.

(c)

Payment shall be made to the nominated SubContractor within


fourteendaysofhisreceiptoftheArchitectsCertificateprovidedthat
before any Certificate is issued the Contractor shall upon request
furnish to the Architect proof that all nominated SubContractors
accountsincludedinpreviousCertificateshavebeendulydischarged:
indefaultwhereoftheEmployermaypaythesameuponaCertificate
oftheArchitectanddeducttheamountthereof fromany sumsdueto
theContractor.Theexerciseofthispowershallnotcreateprivitiesof
ContractasbetweenEmployerandSubContractor.

Otherpersonengaged
byEmployer

23.

TheemployerwiththeconcurrenceoftheArchitectreservetherighttousethe
Premisesandanyportionsofthesitefortheexecutionofanyworknotincluded
inthisContractwhichhemaydesiretohavecarriedoutbyotherpersons,and
theContractoristoallowallreasonablefacilitiesfortheexecutionofsuchwork
but is notrequired to provide any plant ormaterials for the execution of such
work except by special arrangement with the Employer. Such work shall be
carriedoutinsuchmannerasnottoimpedetheprogressoftheworksincluded
in the Contract and the Contractor isnot to be responsible for any damage or
delaywhichmayhappentoorbeoccasionedbysuchwork.

Insuranceinrespect
ofdamagetoperson
andproperty

24.

TheContractorshallberesponsibleforallinjurytopersons,animalsorthings,
andforallstructuralanddecorativedamagetopropertywhichmayarisefrom
thetooperationsorneglectofhimselforofanynominatedSubContractors
employees,whethersuchinjuryordamagearisefromcarelessness,accidentor
any other cause whatever in any way connected with the carrying out of this
Contract. This Clause shall be held to include, INTER ALIA, any damage to
building, whether immediately adjacent otherwise, and any damage to roads,
streets,footpaths,bridgesorwaysaswellasalldamagecausedtothebuildings
andworksformingthesubjectofthisContractbyfrostorotherinclemency of

weather.TheContractorshallindemnifytheEmployerandholdhimharmless
in respect of all and any expenses arising from any such injury or damage to
personsorpropertyasaforesaidandalsoinrespectofanyclaimmadein respect
of injury or damage under any Acts of Government or otherwise and also in
respectofanyAwardofcompensationordamageconsequentuponsuchclaim.
TheContractorshallreinstatealldamageofeverysortmentionedinthisClause,
so as to delivery up the whole of the Contract works complete and perfect in
everyrespectandsoastomakegoodorotherwisesatisfyallclaimsfordamage
tothepropertyofthirdparties.
TheContractorshallindemnifytheEmployeragainstallclaimswhichmay be
madeagainsttheEmployerbyanymemberofthepublicorotherthirdpartyin
respectofanythingwhichmayariseinrespectoftheworksorinconsequence
thereof and shall at his own expense arrange to effect and maintain, until the
virtual completion of the Contract, with an approved Office a Policy of
Insurance in the jointnames of the Employer and the Contractor against such
risks and deposit such Policy or Policies with the Architect from time to time
duringthe currency of this Contract. The Contract shall similarly indefinitely
theEmployeragainstallclaimswhichmaybemadeupontheEmployerwhether
undertheWorkmensCompensationActoranyotherStatuteinforceduringthe
currencyofthiscontractoratCommonLawinrespectofanyemployeeofthe
Contractor or any SubContractor and shall at his own expense effect and
maintain, until the virtual completion the Contract, with an approved office a
Policy of Insurance in the joint names of the Employer and the Contractor
against:suchrisksanddepositsuchPolicyorPolicieswiththeArchitectfrom
timetotimeduringthecurrencyoftheContract.
TheContractorshallberesponsible foranythingwhichmay beexcluded from
the Insurance Policies above referred to and also for all other damages toany
propertyarisingoutofandincidentaltothenegligenceordefectivecarryingout
ofthisContract.HeshallalsoindemnifytheEmployerinrespectofanycost,
chargesorexpensesarisingoutofanyclaimorproceedingsandalsoinrespect
ofanyAwardoforcompensationofdamagearisingtherefrom.
The Employer with the concurrence of the Architect shall be at liberty and is
hereby empowered to deduct the amount of any damage, compensation, costs,
chargesandexpensesarisingoraccruingfromorinrespectofanysuchclaimor
damagefromanysumorsumsduetobecomeduetotheContractor.
FireInsurance

25.(a) TheContractorshallatthetimeofsigningtheContractinsuretheworksand
keep them insured untilthe virtual completion ofthe Contract againstloss or
damagebyfire,inanOfficetoapprovedbytheArchitect,inthejointnamesof
theEmployerandContractor(thenameoftheformerbeingplacedfirstinthe
Policy), for the full amount of the Contract and for any further sum if called
upontodosobytheArchitect,thepremiumofsuchfurthersumbeingallowed
totheContractorasanauthorizedextra.SuchPolicyshallcoverthepropertyof
the Employer only, fees for assessing the claim and in connection with his
servicesgenerallytherein,andshallnotcoveranypropertyoftheContractorof
any SubContractor or employee. The Contractor shalldeposit the policy and
receipts for the premiums with the Architect withintwenty one days from the
dateoftheContractorunlessotherwiseinstructedbytheArchitect.Indefaultor
theContractorinsuringasprovidedabove,theemployerortheArchitectonhis
behalfmaysoinsureandmaydeductthepremiumspaidfromanymoneydueor
whichmay becomeduetothecontractor.TheContractorshallassoonasthe
claimunderthePolicyissettled,ortheworkreinstatedbytheInsuranceOffice,
shouldtheyelecttodoso,proceedwithallduediligencewiththecompletionof
workinthesamemannerasthoughthefirehadnotoccurredandinallrespect
underthesameconditionofcontract.TheContractor,incaseofrebuildingor

reinstatement after fire, shall be entitled to such extension of time for


completionastheArchitectdeemsfit.
(b)

The amount so due as aforesaid shall be the total value of the works duly
executedandoftheContractmaterialsandgoodsdelivereduponthesiteforuse
in the works upto and including a date not more than seven days prior to the
dateofthesaidCertificatelesstheamounttoberetainedbytheEmployer(as
hereinafter provided) and less any installments previously paid under this
Clause. Provided that such Certificates shall only include the value of said
material and goods as and from time as they are reasonably, properly andnot
prematurely brought upon the site and then only if properly stored and/or
protectedagainstweather.

Dateofcommencement 26.
andcompletion

TheContractorshallbeallowedadmittancetothesiteonDateof
Commencementstatedinthe Appendix,andheshallthereuponandforthwith
begintheworksandshallregularlyproceedwithandcompletethesame(except
suchpaintingorotherdecorativeworkastheArchitectmaydesiretodelay)on
orbeforetheDateofCompletionstatedintheAppendixsubjectnevertheless
totheprovisionsforextensionoftimehereinaftercontained.

Damagefor
noncompletion

27.

IftheContractorfailstocompletetheworksbythedatestatedinAppendixor
withinanyextendedtimeunderClause28hereofandtheArchitectcertifiesin
writingthatinhisopinionthesameoughtreasonablesotohavebeencompleted
theContractorshallpayorallowtheEmployerthesumnamedintheAppendix
as Liquidated Damages for the period during which the said works shall so
remainincompleteandtheemployermaydeductsuchdamagesfromanymoney
duetotheContractor.

Delayandextension
oftime

28.

IfintheopinionoftheArchitecttheworksbedelayed(a)forcemajouereor
(b)byreasonofany exceptionallyinclementweatheror(c)byreason
ofproceedingstakenorthreatenedbyordisputewithadjoiningorneighboring
owners or public authorities arising otherwise than through the Contractors
own default of (d) by the works or delays of other Contractors or Tradesmen
engaged ornominated by theEmployer orthe Architectandnotreferredto in
theScheduleofQuantitiesand/orSpecificationor(e)byreasonofArchitects
instructions as per Clause 2 or (f) by reason of civil commotion, local
combination or workmen or strike or lockout affecting any of the building
tradersor(g)inconsequenceoftheContractornothavingreceivedinduetime
necessary instructions from the Architect for which he shall have specifically
applied in writing the Architect shell make a fair and reasonable extension of
timeforcompletionoftheContractworks:incaseofsuchstrikeorlockoutthe
Contractor shall, as soon as may be, given written notice thereof to the
Architect,buttheContractorshallneverthelessconstantlyusehisendeavorsto
preventdelayandshalldoallthatmayreasonablyberequiredtothesatisfaction
oftheArchitecttoproceedwiththework.

FailurebyContractor 29.
tocomplywithArchitects
instructions

Ifthecontractorafterreceiptofwrittennotice fromtheArchitectrequiring
compliancewithintendaysfailstocomplywithsuchfurtherdrawingsand/or
ArchitectsinstructiontheEmployerwiththeconsentoftheArchitectmay
employandpay otherpersonstoexecuteanysuchworkwhatsoeverthatmaybe
necessary to give effect thereto,andall costs incurred in connection therewith
shallberecoverable fromtheContractorbytheemployerontheCertificateof
the Architect as a debt or may deducted by him from any money due or to
becomeduetothecontractor.

Terminationof
30.
ContractbytheEmployer

IftheContractorbeinganindividualorafirmcommitanyactofinsolvency,
orshallbeadjudgedanInsolventorbeinganincorporated Companyshallhave
and order for compulsory winding up made against it or pass an effective
resolutionforwindingupvoluntarilyorsubjecttothesupervisionoftheCourt

and of the Official Assignee of the Liquidator in such acts of insolvency or


windingupshallbeunablewithinsevendaysafternoticetohimrequiringhim
todoso,toshowtothereasonablesatisfactionoftheArchitectthatheisableto
carryoutandfulfilthecontract,andtogivesecuritytherefore,ifsorequiredby
theArchitect.
Or if the Contractor (whether an individual, Firm or Incorporated
Company)shallsufferexecutiontobeissued.
OrshallsufferanypaymentunderthisContracttobeattachedbyoronbehalfof
anyofthecreditorsoftheContractor.
Or shall assign or sublet this Contract without the consent in writing of the
Architectfirstobtained.
OrshallchargeorencumberthisContractoranypaymentsdue orwhichmay
becomeduetotheContractorthereunder.
OriftheArchitectshallcertifyinwritingtotheEmployerthattheContractor.
(I)

hasabandonedtheContract,or

(II)

has failed to commence the works, or has without any lawful excuse
under these Conditions suspended the progress of the works for 14
daysafterreceivingfromtheArchitectwrittennoticetoproceed,or

(III)

hasfailedtoproceedwiththeworkswithsuchduediligenceandfailed
tomakesuchdueprogressaswouldenabletheworkstobecompleted
withinthetimeagreedupon,or

(IV)

hasfailedtoremovematerialsfromthesiteortopulldownandreplace
work for seven days after receiving from the Architect written notice
that the said materials or work were condemned and rejected by the
ArchitectundertheseConditions,or

(V)

hasneglectedorfailedpersistentlytoobserveandperformalloranyof
theacts,matterorthingsbythiscontracttobeobservedandperformed
by the contractor for seven days after written notice shall have been
giventotheContractorrequiringtheContractortoobserveorperform
thesame,or

(VI)

has to the detriment of good workmanship or in defiance of the


ArchitectsinstructionstothecontrarysubletanypartoftheContract,

ThenandinanyofthesaidcasestheEmployerwiththewrittenconsentofthe
Architect, may notwithstanding any previous waiver, after giving seven days
noticeinwritingtotheContractor,determinetheContract,butwithouthereby
affecting the powers of the Architect or the obligations and liabilities of the
Contract the whole of which shall continue in force as fully as if the Contract
hasnotbeensodeterminedandasiftheworkssubsequentlyexecutedhadbeen
executed by or on behalf of the Contractor. And further,the Employer under
instructionsoftheArchitect,byhisagentsorservantsmayenteruponandtake
possession of the works and all plants, tools scaffoldings, sheds, machinery
steam and other power utensils and materials lying upon the premises, or the
adjoininglandsorroads,andusethesameashisownpropertyormayemploy
the same by means of his own servants and workmen in carrying on and
completingtheworksorbyemployingandotherContractorsorotherpersonor
personstocompletetheworks,andtheContractorshallnotinanywayinterrupt
ordoanyact,matterorthingtopreventorhindersuchotherContractororother

personorpersonsemployedforcompletingandfinishingorusingthematerials
and plant for the works. When the works shall be completed or as soon
thereafter as convenient the Architect shall give a notice in writing to the
Contractor to remove his surplus materials and plant, and should the
Contractorfailtodosowithinaperiodof14daysafterreceiptthereofbyhim,
theemployershallsellthesamebypublicauction,andshallgivecredittothe
Contractorfortheamountrealized.TheArchitectshallthereafterascertainand
certifyinwritingunderhishandwhat(ifanything)shallbedueorpayabletoor
by the Employer for the value of the said plant and materials so taken
possessionofbytheEmployerandtheexpenseorlosswhichtheEmployershall
havebeenputtoinprocuringtheworkstobecompletedandtheamount,ifany,
owing to the Contractor and the amount which shall be so certified shall
thereuponbepaidbytheEmployertothecontractororbythecontractortothe
Employer,asthecasemaybe,andtheCertificateoftheArchitectshallbefinal
andconclusivebetweentheparties.

PrimeCostand
ProvisionalSums

IfpaymentoftheamountpayablebytheEmployerundercertificateofthe
Architectwithinterestasprovidedforhereinaftershallbeinareasandunpaid
for thirty days after notice in writing requiring payment of the amount with
interestasaforesaidshallhavebeengivenbytheContractortotheEmployer,or
iftheEmployerinterfereswithorobstructstheissueofanysuchCertificate,or
the Employer commits any act of insolvency or if the Employer (being an
Individual, or Firm) shall be adjudged an Insolvent, or (being an Incorporate
Company)shallhaveanordermadeagainsthimorpassaneffectiveResolution
for winding up, either compulsorily subject to the supervision of the Court or
Voluntarily or the employer shall repudiate the contract or if the Official
Assignee/ortheLiquidatorinanysuchwindingupshallbeunablewithinfifteen
days after notice to him requiring him so to do, to show the reasonable
satisfactionoftheContractorthatheisabletocarryoutandfulfiltheContract
andtomakeallpaymentsdue,andtobecomeduethereunderand,ifrequired
byContractor,togivesecurityofthesameoriftheworkbe stopped forthree
monthsundertheorderoftheArchitectoftheEmployerorbyanyinjunctions
or other order of any Court of Law, then and in any of the said cases the
Contractor shall be at liberty to determinethe Contract by notice in writing to
theEmployer,throughtheArchitect,andheshallbeentitledtorecoverfromthe
Employerpaymentforallworksexecutedandforanylosshemaysustainupon
any plant ormaterial supplied or purchased orprepared for the purpose of the
Contract.InArrivingattheamountofsuchpaymentthenetratescontainedin
theContractorsoriginalTendershallbefollowedorWherethesamemaynot
apply,valuationshallbemadeinaccordancewithClause17hereof.

32.(a) WherePrimeCost(P.C.)pricesorprovisionalsumsofmoneyareprovided
foranygoodsorworkinthespecificationorScheduleofQuantitiesthesame
areexclusiveofanytradediscountsorallowances,discountforcash,orprofit
whichtheContractormayrequireandofcarriageandfixing.
(b)
All goods or work, for which prime cost prices or provisional sums of money
areprovidedmaybeselectedororderedfromanymanufacturersorfirmsatthe
discretion of the Architect or Employer and Employer reserves to himself the
rightofpayingdirectforanysuchgoodsorworkanddeductingthesaidprices
or sums the amount of Contract. Should any goods or work for which prime
costpricesorprovisionalsumsareprovidedorportionsofsamebenotrequire,
such prices or sums, together with the profits slowed for the same and such
additionalamountastheContractormayhaveallowed forcarriageandfixing,
willbedeductedinfullfromtheamountofthecontract.Whetherthegoodsbe
orderedbytheContractororotherwise,thecontractorshallathisowncost,fix
thesameifcalledupontodosoandtheContractorshallalsoreceiveandsign
forsuchgoodsandberesponsiblefortheirsafecustodyasandfromthedateof
theirdeliveryupontheworks.

In cases in which the provisional quantities of material are contained in the


ContracttheContractorshallprovidesuchmaterialtosuchamountortogreater
orlessamountsastheArchitectshalldirectinwritingasthenetratesatwhich
heshallhavepricedsuchitemsinhisScheduleofQuantities,should,however,
anysuchitemsbeentirelyomitted,whichomissionsshallbeattheArchitects
discretion, noprofitonsuchitemsshallbeallowedtotheContractor.
No prime cost sum or sums (or any portion thereof) shall be included in any
Certificate for payment to the Contractor until the receipt accounts relating to
them have been produced by the Contractor to the Architect. Such accounts
shallshowalldiscountsandanysumorsumsinrespectofsuchdiscountsshall
betreatedasatradediscount.Providedalwaysthatshouldthecontractorinlieu
ofproducingsuchreceiptedaccountsrequeststhe Architectinwritingtoissuea
CertificateontheEmployerforsuchsumsdueeitheronaccountinsettlementto
SubContractorordirect,theArchitectshall,uponsatisfyinghimselfthatthe

SubContractorinentitledtothesame,soissuetheCertificate,andsuchsumor
sums shall be deducted from the amount of the Contract at the settlement of
accounts and any profit or further sum to which the Contractor is properly
entitledinrespectofsuch.SubContract,andwhichisinconformity withthe
terms of the Contract, shall be allowed to the contractor at the settlement of
accounts as though the amount of such Certificate to the SubContractor had
beenincludedinaCertificatedrawninfavouroftheContractor.
(e)

(f)

IftheContractorneitherproducesthereceiptnorgivesauthoritytotheArchitect
toissueaCertificateinfavourofsuchSubContractordirect,theArchitectmay
upongivingtheContractorsevendaysnoticeinwritingofhisintentiontodo
so, issue to the SubContractor such Certificate direct on the Employer and
obtain the receipt from the SubContractor, which receipt shall be deemed a
dischargefortheamountofsuchCertificateasthoughgivenbythecontractor.
Intheeventofsuchdefaultonthepartofthecontractor,heshallnotbeallowed
any profit he may have added in the Schedule of Quantities upon such Sub
Contract
.
Theexerciseoftheoptionbeforereferredtobythecontractorandtheissueof
Certificatesasbeforedescribed toSubContractorsuponthecontractorsrequest
or the issue to the SubContractor direct of Certificates by the Architect shall
not, however, relieve the contractor from any of the liabilities in respect of
insufficientfaultyorincompleteworkoftheSubContractorforwhichhemay
beliableunderthetermsoftheContract.

(g)
Ifanyprovisionalitemsareprovidedforworkofanatureusuallycarriedoutby
theContractorintheordinarycourseofhisbusinesstheEmployershallgivethe
Contractor an opportunity of tendering for the same without prejudice to the
EmployersrighttorejectthelowestofanyTender.

TheContractorshallbepaidbytheemployerfromtimetotimebyinstallment
under Interim Certificates to be issued by the Architect or his authorized
representative to the Contractor on account of the woks executed when in the
opinionoftheArchitectorhisrepresentative,theworktotheapproximatevalue
namedintheappendixasValueofworkforInterimCertificates(orlessatthe
reasonable discretion of the Architect) has been executed in accordance with
this Contract, subject, however, to a retention of the percentage of such value
named in the Appendix hereto as Retention percentage for Interim
Certificates until the total amount retained shall reach the sum named in the
AppendixasTotalRetentionMoneyafterwhichtimetheInstallmentshallbe

upto the full value of the work subsequently so executed and fixed in the
building.TheArchitectmayinhisdiscretionincludeintheInterimCertificate
suchamountashemayconsiderproperonaccountofmaterialsdeliveredupon
thesitebytheContractorforuseinthework.Andwhentheworkshavebeen
virtually completed and the Architect shall have certified in writing that they
havebeencompletedthecontractorshallbepaidbytheEmployerinaccordance
withtheCertificatetobeissuedbytheArchitectthesumofmoneynamedinthe
Appendix as Installment after Virtual completion being a part of the said
TotalRetentionmoney.AndtheContractorshallbeentitledtothePaymentof
theFinalBalanceinaccordancewiththeFinalCertificatetobeissuedinwriting
by the Architect at the expiration of the period referred to asthe Defect
LiabilityPeriodintheAppendixheretofromthedateofVirtualCompletionor
assoonaftertheexpirationofsuchperiodastheworksshallhavebeenfinally
completedandalldefectsmadegoodaccordinglytothetrueintentandmeaning
hereof whichever shall last happen, provided always that the issue by the
ArchitectofanyCertificateduringtheprogressoftheworksoratoraftertheir
completionshallnotrelievethecontractorfromhisliabilityunderClause2and
20notrelievetheContractorofhisliabilityincasesoffraud,dishonesty,or

fraudulentconcealmentrelationtotheworksormaterialsortoanymatterdealt
withintheCertificate,andincaseofalldefectsandinsufficienciesintheworks
or materials which a reasonable examination would not have disclosed. No
certificateoftheArchitectshallofitselfbeconclusiveevidencethatanyworks
ormaterialstowhichitrelatesareinaccordancewiththeContract.
TheArchitectshallhavepowertowithholdanyCertificateiftheworksorany
partsthereofarenotbeingcarriedouttohissatisfaction.
The Architect may be any Certificate make any correction in any previous
Certificatewhichshallhavebeenissuedbyhim.
Payments upon the Architects Certificate shall be made within the periods
named in the Appendix as Period for honoring of Certificates after such
CertificateshavebeendeliveredtotheEmployer.
34.

AnyamountspayablebytheEmployertotheContractorinpursuanceofany
Certificategivenby theArchitecthereundershallifnotpaidwithinthePeriod
forhonoringCertificatesnamedintheAppendix,carryinterestattherate
namedintheAppendixastheRateofInterestfordelayedpaymentfromthe
dateuponwhichsumoughttohavebeenpaidbytheEmployeruntilpayment.

Mattertobefinally
35.
determinedbyArchitect

Thedecision,opinion,direction,Certificate(exceptforpayment)withrespectto
alloranyofthemattersunderclauses2a,2b4,7,12,19,28(a,b,c,d,f)and 30
hereof (which matters are herein referred to as the excepted maters) shall be
final and conclusive and binding on the parties hereto and shall be without
Appeal. Any other decision, opinion, direction Certifiable or Valuation of the
Architectorany,refusaloftheArchitecttogiveanyofthesameshallbesubject
totherightofArbitrationandreviewinthesamewayinallrespect(including
the provision as to opening the reference) as if it were a decision of the
ArchitectunderthefollowingClause.

36.

Alldisputesanddifferencesofanykindwhateverarisingoutoforinconnection
with the Contract or the carrying out of the works (whether during the
progressoftheworksoraftertheircompletionandwhetherbeforeorafterthe
determination,abandonmentorbreachoftheContract)shallbereferredtoand
settled by the Architect who shall statehis decision in writing Such decisions
may be in the form of a Final Certificate or otherwise. The decision of the

Architectwithrespecttoanyoftheexceptedmattersshallbefinalandwithout
appeal as stated in the preceding Clause. But if either the employer or the
ContractorbedissatisfiedwithdecisionoftheArchitectoranymatter,question
or dispute of any kind (except any of the excepted matters) or as to the
withholding by the Architect of any Certificate to which the Contractor may
claimtobeentitled,thenandinanysuchcaseeitherparty(theEmployerorthe
Contractor)maywithintwentyeightdaysafterreceivingnoticeofsuchdecision
giveawrittennoticetotheotherpartythroughtheArchitectrequiringthatsuch
matters in dispute be arbitrated upon. Such written notice shall a specify the
matters which are in dispute and such dispute or difference of which such
writtennoticehasbeengivenandnoothershallbeandisherebyreferredbeing
to the Arbitrationand final decision and a single Arbitrator beinga Fellow of
the Indian Institute of Architects to be agreed uponand appointed by both the
partiesorincaseofdisagreementastotheappointmentofasingleArbitratorto
theArbitrationofTwoArbitratorsbothbeingFellowsoftheIndianInstituteof
Architects, one to be appointed by each party which Arbitrator shall before
takinguponthemselvestheburdenofreferenceappointanUmpire.
The Arbitrator, the Arbitrators or the Umpire shall have power to open up,

L.T. CABLES
a)

GENERAL
L.T. Cables shall be supplied, inspected, laid tested and commissioned in accordance with drawings,
specifications, relevant Indian Standards specifications and cable manufacturer's instructions. The
cable shall be delivered at site in original drums with manufacturer's name clearly written on the
drums. The recommendations of the cable manufacturer with regard to jointing and sealing shall be
strictly followed.

b)

MATERIAL
The L.T. power cable shall be PVC insulated PVC sheathed type aluminum conductor armoured
cable and L.T. control cable shall be PVC insulated PVC sheathed type copper conductor
unarmoured cable conforming to IS : 1554 : 1988 (Part-I) with upto date amendments.

c)

INSTALLATION OF CABLES
Cables shall be laid directly in ground, pipes, masonary ducts, on cable tray, surface of wall/ceiling
etc. as indicated on drawings and/or as per the direction of Engineer - in - Charge. Cable laying shall
be carried out as per CPWD specifications.

d)

INSPECTION
All cables shall be inspected at site and checked for any damage during transit.

e)

JOINTS IN CABLES
The Contractor shall take care to see that the cables received at site are apportioned to various
locations in such a manner as to ensure maximum utilization and avoiding of cable joints. This
apportioning shall be got approved from Engineer-in-Charge before the cables are cut to lengths.

f)

LAYING CABLES IN GROUND


Cables shall be laid by skilled experienced workmen, using adequate rollers to minimize stretching of
the cables. The cable drums shall be placed on jacks before unwinding the cable. With great care it
shall be unrolled on over wooden rollers placed in trenches at intervals not exceeding 2 metre. Cables
shall be laid at depth of 0.75 metres below ground level for LT Cables and 1 metre below ground
level for HT cable. A cushion of sand total of 250mm shall be provided both above and below the
cable, joint boxes and other accessories. Cable shall not be laid in the same trench or along side a
water main.
The cable shall be laid in excavated trench over 80mm layer of sand cushion. The relative position
of the cables, laid in the same trench shall preserved. At all changes in direction in horizontal and
vertical planes, the cables shall be bent smooth with a radius of bent not less than 12 times the
diameter of cables. Minimum 3 metre long loop shall be provided at both end of cable.
Distinguishing marks may be made on the cable ends for identifications of phases. Insulation, tapes
of appropriate voltage and in red, yellow and blue colors shall be wrapped just below the sockets for
phase identifications.
Cable route marker shall be provided as per CPWD specifications. Cost of cable route markers is
deemed to be included in the cost of cables/cable laying.

g)

PROTECTION OF CABLES
The cables shall be protected by bricks laid on the top layer of the sand for the full length of
underground cable. Where more than one cables is laid in the same trench, the bricks shall cover all
the cables and shall project a minimum of approximately 80mm on either side of the cables. Cable
under road crossings and any other places subject to heavy traffic shall be protected by running them
through Hume Pipes of suitable size. Pipes for cable crossing the road shall be laid at a depth of
1000 mm.

h)

EXCAVATION & BACK FILL


All excavation and back fill required for the installation of the cables shall be carried out by the
Contractor in accordance with the drawings and requirements laid down elsewhere. Trenches shall
be dug true to line and grades. Back fill for trenches shall be filled in layer not exceeding 150mm.
Each layer shall be properly rammed and consolidated before laying the next layer.
The Contractor shall restore all surface, road ways, side walks, curbs, wall or the works cut by
excavation to their original condition to the satisfaction of the Engineer-in -Charge.

i)

LAYING OF CABLES ON CABLE TRAY/SURFACE OF WALL/ CEILING


Cable shall be laid on perforated M.S. Cable tray/ladders. Cables shall be properly dressed before
cable ties/clamps are fixed. Wherever cable tray is not proposed, cables shall be fixed on surface
of wall or ceiling slab by suitable MS clamps/saddles. Care shall be taken to avoid crossing of
cable.

j)

CABLES ON HANGERS OR RACKS


The Contractor shall provide and install all iron hangers racks or racks with die cast cleats with all
fixings, rag bolts or girder clamps or other specialist fixing as required.
Where hangers or racks are to be fixed to wall sides, ceiling and other concrete structures, the
Contractor shall be responsible for cutting away, fixing and grouting in rag bolts and making good.
The hangers or racks shall be designed to leave at least 25mm clearance between the cables and the
face to which it is fixed. Multiple hangers shall have two or more fixing holes. All cables shall be
saddled at not more than 150mm centres. These shall be designed to keep provision of some spare
capacity for future development.

k)

CABLES TAGS
Cable tags shall be made out of 2mm thick aluminium sheets, each tag 1-1/2 inch in dia with one
hole of 2.5mm dia, 6mm below the periphery. Cable designations are to be punched with
letter/number punches and the tags are to be tied inside the panels beyond the glanding as well as
below the glands at cable entries. Tray tags are to be tied at all bends. On straight lengths, tags
shall be provided at every 5 metres.

l).

TESTING OF CABLES
Prior to installation burying of cables, following tests shall be carried out. Insulation test between
phases, phase & neutral, phase & earth for each length of cable.
a. Before laying.
b. After laying.
c. After jointing.
Along with the test as prescribed in IS Code, cross sectional area shall also be checked.

On completion of cable laying work, the following tests shall be conducted in the presence of the
Engineer in Charge.
a. Insulation Resistance Test (Sectional and overall).
b. Continuity Resistance Test.
c. Earth Test.
All tests shall be carried out in accordance with relevant Indian Standard code of practice and
Indian Electricity Rules. The Contractor shall provide necessary instruments, equipments and labour
for conducting the above tests & shall bear all expenses of conducting such tests.

EARTHING
a)

GENERAL
This section covers the general arrangement of the earthing, i.e. all non-current carrying metal
parts of the electrical installation shall be earthed as per IS 3043(1987) and general
specifications for electrical works (part-1, internal) of CPWD specifications.
All metal
conduits, trunkings, cable sheaths, switchgear, distribution Board, meters, light fixtures, fans
and all other metal parts forming part of the work shall be bonded together and connected by
two separate and distinct conductors to earth electrodes. Earthing shall also be in conformity
with the provisions of Rule 32, 61, 62, 67 and 88 of IER 1956. The earth electrode shall not
be situated less than 1.5 mtr.

b)

EARTHING SYSTEMS
It shall comprise of earth electrodes, earth strips, earth continuity conductor and all earthing
conductors shall be of high conductivity copper, GI or aluminium and shall be protected
against mechanical damage and corrosion. The size of earth conductors shall not be less than
half that of the largest current carrying conductor. The connection of earth continuity
conductors of earth bus and earth electrodes shall be strong and sound and shall be rigidly
fixed to the walls, cable trenches, cable trays or conduits and cable by using suitable clamps
made of non ferrous metals.

c)

EARTHING ELECTRODES
Earthing electrodes shall be designed as per the requirement of IS 3043 (1987). The number
and size of earth electrodes shall be calculated so that under fault conditions no electrode is
loaded above its maximum permissible current density. The resistance of earth electrode shall be as
low as possible, the maximum allowable value being one ohm.
Earthing electrodes of either plate type or pipe type may be adopted. The choice of plate or pipe
electrode shall be decided according to the anticipated fault level of the network and local soil
conditions. Generally, plate electrodes shall be used for substations and large medium voltage
network and pipe electrodes for small medium voltage network and installations.

d)

Location of Earth Electrodes


Normally on earth electrode shall not be situated less than 1.5 m from any building. Care shall be
taken that the excavation for earth electrode may not effect the column footings or
foundation
of the buildings. In such cases electrodes may be further away from the building.

The location of the earth electrode will be such where the soil has reasonable chance of remaining
moist. As far as possible, entrances, pavements and road ways, are to be definitely avoided for
locating earth electrode.
e)

Water Arrangement
Method of watering arrangement shall comply with General Specifications.

f)

Plate Electrode
Plate electrodes shall be made of GI plate of 6 mm thick and 60x60 cm. size. The plate shall be
buried vertically in ground at depth of not less than 3.5 metres to the top of the plate, the plate
being encased in charcoal to a thickness of 15 cm. all round. It is preferable to bury the
electrode to a depth where sub-soil water is present. Earth leads to the electrode shall be laid in
a GI pipe and connected to the plate electrode with GI bolts, nuts and washers. A GI pipe of
not less than 19 mm dia shall be placed vertically over the plate and terminated in a funnel at 5
cm. above ground. The funnel shall be provided with a wire mesh. The funnel shall be enclosed
in masonry chamber of 100 x 50 cm. dimensions. The chamber shall be provided with CI frame
cover of 100 x 50 cm size. The earth station shall also be provided with a suitable permanent
identification label/tag.
Note : If copper plate is used it shall be of 3mm thickness.

g)

Pipe electrode shall comprise of a 2.5 Mtr. long 40 mm dia GI pipe buried vertically in a pit of 35x
35 cm size and filled with alternate layers of charcoal, salt and river sand and connected at the top to
a GI pipe of 19 mm, 1 Mtr. long with a funnel at the other end, 5 cm above the ground. The earth
lead shall be properly fixed to the pipe electrode with brass bolts, nuts and washers. The funnel and
earth lead connections shall be enclosed in a masonry chamber of 30 x 30 x 30 cm. dimensions. The
chamber shall be provided with a CI frame and CI cover. Proper
permanent identification
tag/label shall be provided for each electrode.

h)

INSTALLATION
All joints shall be reverted and sweated. Joints in the earth bar shall be bolted and the joints faces
tinned. Where the diameter of the bolt for connecting earth bar to apparatus exceeds one quarter of
the width of the earth bar, the connection to the bolt shall be made with a wider piece of flange
of copper jointed to earth bar. These shall be tinned at the point of connection and special care
taken to ensure a permanent low resistance contact to iron or steel. All steel bolts, nuts, washers, etc
shall be cadmium plated. Main earth bars shall be spaced sufficiently away from the surface to which
they are fixed, such as walls or the side of trenches to allow for easy connections. Copper earth bars
shall not be fixed by ferrous fittings. The earthing shall be suitably protected from mechanical injury
by galvanized iron within ground shall be buried at least 60 cm deep. The earthing lead shall be
securely bolted and soldered to the plate or pipe as the case may be. In the case of the plate, the lead
shall be connected by means of cable socket with two bolts and nuts. All washers shall be of the
same materials as the plate or pipe. All iron bolts, nuts and washers shall be galvanized.

i)

Method of Installation of watering arrangement


In the case of plate earth electrode a watering pipe of 20 mm dia of medium class GI pipe shall be
provided and attached to the electrode. A funnel with mesh shall be provided on the top for
watering the pit. In case of pipe earth electrode a 40 mm x 20 mm reducer shall be used for
accessing the funnel. The watering funnel attachment shall be housed in masonry enclosure of not
less than 30 cm x 30 cm x 30 cm. A cast iron cover having locking arrangement shall be suitably
embedded in the masonry enclosure.

j)

PRECAUTIONS
Earthing system shall be mechanically robust and the joints shall be capable of retaining low
resistance even after passages of fault currents.

Joints shall be soldered, tinned and double riveted. All the joints shall be mechanically and
electrically continuous and effective. Joints shall be provided against corrosion.

The earthing lead from electrode onwards shall be suitably protected from mechanical injury by a 5
mm dia GI pipe in case of wire and by 40 mm dia medium class GI pipe in case of strips. Portion of
this protection pipe within the ground shall be buried at least 30 cm deep (to be increased to 60 cm
in case of road crossing and pavements). The portion within the building shall be recessed in walls
and floor to adequate depth.

l)

TESTING

On the completion of the entire installation, the following tests shall be conducted and no earth
electrode shall have ohmic resistance of more than 2 ohm and in rocky soil not more than 3 ohms.

All meters, instruments and labour required for the tests shall be provided by the contractor. The
