TREASURERS TERMINAL REPORT

January 20 til May 15, 2012

Treasurers Note

Coming from the Pine Tree Festival in December 2011, it was a shock to learn of the
planned tree cutting of SM City Baguio. One hundred eighty two trees were going to be cut/
earthballed to give way to a parking building. It sounded like the Joni Mitchell song, They paved
Paradise and Put Up a Parking Lot. It sounded bad.
When the January 20, 2012 rally was over with and planning was done on the 23rd, I offered to help Dr. Michael A. Bengwayan & the group the only way I can by using my financial setups to save the trees.
Financial donations started pouring in once Dr. Michael Bengwayan announced I was the
Treasurer. The role kept me busy in checking where the donations were coming from (making sure
we were not laundering money and that our motives were apolitical and clear) for this seems like a
protracted fight. In 2010, my friends and I had stopped the sale of the Athletic Bowl with just a
dinner, but this expansion project seemed gargantuan in size.
Hopefully, I did as much as I could, and now could hand over the reigns to the next volunteer Treasurer.
God bless us all in fighting for beings with no voices who give us life.

STOP THE CUTTING/UPROOTING OF TREES


AT SM BAGUIO

Background (Preamble):

The SM Development Corp (SMDC) is set to cut 43 fully grown Alnus japonica trees while also intending to uproot 97 growing pine trees (Pinus kesiya) and 42 saplings virtually sentencing to death a total of 182 trees
within the Luneta Hill area where SMDC is found to pave way for another parking lot.
This is totally unacceptable, and callously insensitive to the importance of trees to the environment and ecology. We protest vehemently this intended act.
It appears that on Oct. 27, 2011, the Department of Environment and Natural resources (DENR granted a cutting, balling and pruning permit to SMDC upon the instruction of a clearance signed by DENR Sec. Ramon Paje
on Oct., 2011.
This shows that DENR does not fully appreciate and understand the contributions of these trees which have
already grown up in view of the global warming and environmental threats.
By issuing a tree cutting permit, DENR allows itself to be questioned publicly of its worthiness as well as its role
as defender of the environment and natural resources. By ruling in favor of tree cutting by a business entity, it
is fast losing public support to an already tarnished image.
DENR also shows preferential treatment for business establishments against original inhabitants, locals and
residents who have long cared for the environment. Economy at the expense of the environment is greed.
We finds this utterly senseless and call on the immediate stoppage for these trees from being harmed or killed.
Please sign now! Let us all work to stop such stupid acts where our environment is sacrificed for financial gain
by a few profiteers. Let us stop these tree cutters. Let us save what is left of our beloved Baguio. If our political leaders and agency public servants do not do what is mandated of them, let us show what a citizens' initiative can do. We can do this.

Petition:

We the undersigned call for the President of the Philippines Benigno Aquino 111 and Sec. for Environmental
Protection Nereus Acosta to immediately stop the intended cutting and uprooting of the trees. We call on all
concerned to :
1. BOYCOTT SM,
2. Join us in a street protest to dramatize our cause; and,
3. Occupy the intended area where the tree cutting and uprooting will be done if SM is allowed to do its dastardly act.

Luneta Hill was where the famous Pines Hotel once stood.
Luneta Hill is oneo f the very few remaining forested areas in Baguios
Central Business Disctict, and is home to mature pine trees, which Baguio is
famous for, and other tree species that continue to provide breathable air in
the otherwise already heavily-polluted CBD. It also helps in containing water
preventing the flooding of lower lying areas in the vicinity.
Luneta Hill is where a mall, SM City Baguio was built which opened in
2003. SM has ben enjoying a very huge market share, displacing a lot of
smaller businesses in the city. Despite this advantage, SM City Baguio wants
to expand, which would affect 182 mature trees in the area. While they
claim they will not cut any of the trees and will instead earthball them to be
transferred somewhere else, and what theyre building is a green building,
the environmental impact of their expansion plan will greatly affect the
community and the well-being of the people.

On January 20, 2012, thousands of people marched down Session Road to


protest the impending harming of trees up on Luneta Hill. Then on February
5, 2012, led by Dr. Mike Bengwayan, hundred of volunteers planted more
than 182 pine trees at Pine Trees of the World in protest of SM City
Baguios expansion. This was followed by a 12-hour concert of local
musicians and guest artists to show their support for the cause.
We are here to protect Baguios remaining forests that give us air to breathe,
water to nurture life, and protection from natural calamities. We are here
because this is what Baguio is all abouta community of caring people and
a healthful, nurturing natural environment.

Luneta Hill is one of the very few remaining forested areas in Baguio, and
is home to mature pine trees and other tree species that continue to provide
breathable air in the otherwise already heavily-polluted Central Business
District.
In urban areas with 100% tree cover (i.e. contiguous forest stands), short-term
improvements in air quality (one hour) from pollution removal by trees were as
high as 15% for ozone, 14% for sulfur dioxide, 13% for particulate matter, 5% for
nitrogen dioxide, and 0.05% for carbon monoxide USDA Forest Service (David
Novak)

Luneta Hill also helps in containing water that prevents flooding in lowerlying areas in the vicinity.
Mature evergreen trees (evergreens, such as magnolias or pines, retain their leaves
all year round) can intercept more than 4,000 gallons per year. University of

Luneta Hill is where a mall, SM City Baguio, stands and wants to expand,
which would affect 182 mature trees in the area. The environmental impact
of their expansion plan will greatly affect the community and the well-being
of the people.

On the first day of the Session in Bloom (February 26, 2012) we did not have any collection, we did not set up any Piso Para sa Puno fund, the food was donated by Gregory Rugay including the C2 water.
The next day (February 27, 2012), some musicians came to help during the campaign, they told me they are bound for Manila but they do not have any money
for the fare, they were asking me to lend them money but I cannot give them any. One of them suggested (Delfin, percussionist) that he will play together with
the others Yangs (percussionists) as well in order to gain attention for the Project 182 petition. They will help us get the attention and support but asked that
we also help them in exchange. We put up one box in front of them and Delfin did a fire dancing show for 5 hours straight. Because of him and his friends,
we got a lot of donations for Piso Para sa Puno.
I was too busy inspecting everything from the drums, the scotch tape, the people signing, the ballpens, etc. During that time there were only 7 of us in the table
working with the signature campaign, we are not able to get away from the table. Too many people are signing up and we cannot possibly check everything
that is going on. When Delfin told me that they will already go home at around 11:30pm and asked for the money I just said yes and he got some. I failed to
ask him to list down how much he took; I did not have the time so to speak.
All of us 7 in there were not even able to eat starting from 12:30pm until 11pm in the evening. During this time the CGNs Atty. Donaal and Sir Gideon texted
me that they will bring us some food after the signature campaign. Earlier Ellen Lao was kind enough to give us water as well.
During that time we are so tired already, we went home at around 2am. We did not even have the time to count the money anymore, there were too many
coins, if I counted them it would have taken me another 2 to 3 hours and my body was just too tired to be able to do that.
The next day (February 28, 2012) what I did was just bring the coins and add them to the additional coins collected. Again, there were no stationary individuals to guard the signatures, it was pure volunteerism. If someone chanced upon to walk by our area, they stopped for several minutes to help us out. There
was no way I would be able to recall everyone who was on the table, a lot of people volunteered. The only ones that I am acquainted with are Myke Abaya
Sotero, Andrea Leigh Cosalan, Gregory Rugay, Richard Basa, Mac Reyes, Junie Torre, and Guia Limpin. The rest are new faces to me.
We are not able to set up any log books I found it impossible to be able to handle everything, Sometimes, Richard and I would be photocopying the papers
for the signature campaign, we had to print it over and over again because the papers were not enough, we volunteered our own money. I cannot exactly compute how much we spent for the photocopying, as some just used their money and did not ask for a refund. I was in charge of setting up the drums, getting the
tables, photocopying the signatures even charging the megaphones and I hope that you understand that there was no time for me to still think about how I am
going to list everything else.
The same thing happened when we were given money to purchase snacks by Ellen Lao (P500. The receipt, I was not able to find. We bought 25 hotdogs,
juice and 2 Gardenia bread from 7/11 -- all of which I failed to keep the receipts. That day, we were provided water once again. And we finish ed around 12.
Manong Gideon Omero told me to use the money we have collected to feed the volunteers, because no one was going to donate this time. I forgot the exact
date where Andrea provided 500 pesos for the food, but there was this one day that she gave money so that we can eat, I think that was on the third day, I am
still looking for the receipt, the other receipts from Good Taste.
For the remaining days of signature campaign a lot of people volunteered and most of us did not eat for the entire day. A lot of UP students came to volunteer
until midnight and all were famished.
Every day we had to feed 15 to 20 people who have volunteered together with some musicians and students. This bonding time was very important because
we needed to know who each other was, in fact because of this bonding sessions we have been able to create a team that is working with us right now, if it
were not for this eating sessions I dont know if some of the people that are with us today would even be here like Mac Reyes, Brian Amaro, Positive Khayst,
Jarlow Virgino, Indobitable Rako, Marti Cabangon, Wyler Addamag and the rest of the team. It was an absolute must for people to eat after the intense work. I
hope that other people will understand that we have bonded and created our support group from this sessions and I hope they will not question why we needed
to feed people who volunteered in the petition signing, the bonding over food was very instrumental to reaching the support group that we have now.
The only money that needs to be refunded is the 500 pesos for Andrea Cosalan, I cannot find the receipt as of this moment but I will testify that she has given
money for the food, I hope this is enough.
The money we have used to feed all of those who helped us.
I submitted some money to Marie Balangue with the Audit Team as witnesses.
Some of the money, we used to buy some props for the March 10 rally (the zombie concept). Some of the materials that we have used are still kept at the
house of Richard Dean Basa so that we can use it again for future rallies. We used the money for purchasing pens, scotch tape, water, cups and I am sorry
for not being able to collect all of the receipts, I hope you understand that 5,000 to 10,000 people signing up for the trees is not exactly an easy thing to manage especially when we never really planned this activity.
Some of this pens were given at HQ2 but I cannot tell into details how many as I have no way of remembering due to the fact that everything happened simultaneously, even the putting up of the tarpaulins were assigned to me that day. I was not able to create a team, because most of them are volunteers, people I
did not even know the names of.
Please remember that it was just me who was able to stay there for 5 straight days and to any person trying to work out everything this is not an easy task.
Many of the members who joined were sometimes there for several hours and would go home afterwards. Only several people like Myke Sotero was there but
he constantly needed to go around the area to promote the cause, the same thing with the others. We also had to photocopy the signs that we used and
placed on the t-shirts of the volunteers.
The signature campaign was a huge success, with 30,000 signatures and counting and it was made possible due to community effort, trust and the spirit of
volunteerism. We already know what to expect and what to do the next time. We will set up a log book, a secretary, and someone who will really check on
the funds.

Pack Road at Harrison Road na maaaring maging sanhi ng pagbaha dito?

At kung walang mga punong maglilikom ng tubig ulan, maaring lumambot ng labis ang lupa at magdulot ng mga
nakamamatay at nakapipinsalang landslides.

Nililinis din ng mga puno ang hangin sa pamamagitan ng paglilikom ng mga nakapipinsalang Carbon sa himpapawid.
Sa mga puno rin nanggagaling ang oxygen na ating hinihinga.

Kapag hinayaan natin ang SM City Baguio na ipagpatuloy ang kanilang maitim na balak upang itaguyod ang
kanilang kasakiman sa pera, paano pa natin mapipigilan ang iba pang nagbabalak ding gahasain ang ating
kalikasan? Hahayaan nga ba nating tuluyang mabura ang imahe at alala ng Baguio bilang City of Pines?

Even then in just doing the retaining wall, the 182 trees would have been affected. It was then we felt since we have to do a retaining wall,
we might as well do something good for the city and let the people to appreciate us, hence the parking structure came about. It was never
about the parking structure first. It was an option of a problem.
Just like what we have done in other parts of the city and other parts in the country. Like a bus station in SM City North EDSAs property, the
bus station in SM Mega Malls property. Both we believe that since, eased a lot of traffic in EDSA.
The more than 6M liters of rainwater collection tank in SM City must be enough which works very well helping the flood control in the area.
The storm ??? (early just slides) in Iloilo, Novaliches, Gen San and others which helped in the flood control.
On the environment issue, we had installed STP, sewage treatment plant, in our malls, big or small, all coupled with tertiary treatment plants
to recycle and reduce all the water for our cooling power and watering our landscape.
We recently introduced our sky garden on SM City North EDSA, which is really a sustainable earth garden as it collects excess rainwater that
we dont have to water our plants the next 4 days every time it rains for about 15 minutes.
We really want to do something good for the city of Baguio a much needed parking structure, a sky garden, a rainwater collection tank,
and replanting of trees for every tree moved. Our objective is to make our effort as benchmark or requirements to all future developments in
Baguio City which I believe will contribute to the good of the city.
I firmly wish and hope for understanding and trust to see how responsible developer SM can give back. Thank you.
so I really just wanted to explain, it was really from a problem na we encountered and we wanted to really do something that would be
good for the city but instead, weve been cursed, weve been anothats why I felt na its a bit unfair. Sana naman, we have track records to
show you what are the bad things we really have done but throughoutat least I can say that for the last 10 years, SM has been doing a lot
of efforts in helping the environment improvement. Although something we are just a bit weak of is how to advertise also. We dont really
advertise what we are doing but recycling of all water is not a requirement but we are doing all that even if we know that its a bit expensive
because we really do want to contribute something back to the environment. So, thats all Im asking na sana understanding and appreciation give us this chance to be able to prove to everyone that we can do something. In fact, using us as a benchmark for all future development. Hindi yung kasi SM malaki, SM ganito. You know, in terms of employment, sana nabigyan nyo ng pansin, how can it can be because
of progress, if its ano ... tapos nakasulat progress is greed. Sabi ko, Eh, sana you stop the population growth and then blame it to progress? How can people be able to find job if you dont create job for them. So, those are the intentions of SM. The tax issue as Ive explained
earlier is something for the government to settle because we are just following what we were told. If we pay it everything to Baguio [some
lines not clear]
Sana naman, I really wish that look at the good side of what SM has been doing for the whole country and look forward in what we can really do for Baguio City.

So, its very clear that what SM did is a retaining wall in order to prevent the mall from further sinking. So, apparently its enough that you
just put up a retaining wall, thats what is really clear because if you put up that mall you have to sacrifice all those trees there and in fact,
that area is very special to the city of Baguio. The city of Baguio started there

If you put up a retaining mall there and Im sorry for using that word but I think thats the appropriate one. There will really be a lot of environmental damage as compared to a retaining wall which is precisely what you need. And what really has angered the community is the fact
that you went ahead despite the public announcement by your lawyer Sigfrid Fortun that those trees will not be touched while the case is
pending. Your company went ahead on cutting trees and made us appear like we are all liars when you said that you earth-ball trees. I was
personally there. I was mauled by your guards and we know that those trees were cut despite the existence of Temporary Environmental
Protection Order and of course, very suspicious of you that to put up that all those hideous walls, fences that definitely obstruct human view
of whats happening on the ground. We could not see what is happening. If we are inside the mall, we could not see because in the veranda,
there are several fences that obstruct human view. At the same time, just above the road you also put up fences so, what is SM trying to
hide. How can you ask us now to trust you and believe, even at face value, what you just said when youve had not given us the chance to
believe that you are trustworthy. Why do you have to do all these? What is everything has to be done in secrecy and why is everything had
to be done in the depth of night.

Good afternoon, first the fence is a requirement for every construction, noh ah to secure the area and also to prevent dust and also the noise
because the veranda tenants are mostly food tenants so were trying to protect them for them to feel that business as usual while doing the
earth-balling of trees because theres been a lot of heavy machineries, dust and noise, noh. Ah, doing the balling of trees at night is really a
requirement of the DENR and not SM. Its easier to work at daytime but we are required to really do it at night when the sun is down. So,
when the moisture is much much higher. It is a requirement by the DENR.
Atty Daytec Yangot
So, why the need for a wall then if youre just going to protect the stores from dust. Theres no dust at night. There are no stores open at
night?

Yah, but of course, in the morning we also do the preparatory works, noh and thats where the excavation are on-going noh because those
walls are provided not only for the tree-balling but throughout the construction of the building and ahthe construction of the building will
be done in the morning also.

Let me just organize this; lets just have a framework as to how we resolve this. For the point of view of the environment groups, exactly,
how do you see this? What is it that you would like to happen noh so that you know at the end of the meeting, is it that we agree? Is it that
we disagree? At least there is a direction that we are pursuing. So from your, lets say for instance ha, at this point in time, lets make the cut
off as today. Lets forget about what happened yesterday, two days ago. Lets start looking at it from today. Exactly, what is your suggestion? Can you ask them, will this be workable? If its not, what is there suggestion? And if you say its not workable, at least we try resolving in a manner wherein the requirements of both sides are heard.

Mr. Secretary, before we articulate what we feel should be done from hereon, we have to state that this is not just an environmental issue
for us. This is also an issue of good governance. So, uhm our concern is not only those trees being cut but also about those trees being cut
ahh with all these governmental practices as having been uhm, you know, uhm not followed. So from hereon, what we want is those trees
will be safe. SM cannot stand but please save the trees and please comply with government rules and regulations and we are not directing
this to SM only we ask it to government as well. We ask the DENR and other government agencies. Please follow the law.

Okay, so can we ask the to explain to everyone exactly what is the process and if the processes were complied with. They are nothing

Exactly, given the situation, what is the process? Can we do it step by step?

Actually, Secretary, I brought with me the Regional Executive Director of the CAR who will explain to us the actual situation [some lines not

Salamat ho. Magandang hapon po sa lahat. So, if we start from the beginning, well of course, SM came about with this expansion project

and because of their planned expansion project, there were trees that were going to be affected by this project. So necessarily, they had to
apply. So for which they did and in the course of their application, there are requirements. They had to go to through and submit to us.
And among the requirements po are: ownership of the land,

Opo, of the national government and then also yung endorsements/ clearance ng local govt units. Barangay resolution that was issued in
their favor. And this was also followed by an endorsement from the Mayor that was addressed to the Secretary. And then also

Ano ba yang endorsements na yan, required Barangay Resolution, Barangay consultation? Anu-anong requirements

Barangay Resolutionthe Barangay Resolution or Clearance as would have done by the local government. So the process of that is nasa
Barangay popagdating sa amin may en banc Resolution na they went through this consultation, meeting and that there was no objection to
the expansion of the project and to the cutting of trees. And then following that, so magkakaroon na po ng inventory.

Inventory conducted by the local DENR?
DENR-CAR Regional Director?
Opo, upon the submissionyung mga plano po, yung mga blueprint ng expansion project nila, then ano yung mga trees that are to be affected, saan yan, so minapo po to, in-assess po ng mga tao namin sa Baguio. Then, submission ng inventory report, so lumabas po doon na
merong planted trees, these are the alnus and yung mga Benguet pine trees na natural. So following Executive Order no. 23 na inissue po
ng Pangulo, wala kaming full authority doon dahil ang nakalagay po sa Moratorium ay the cutting ay nasa owner ng trees. So eto pong report naming, inelevate namin sa central office for guidance. In-assess naman nila sa central office, so merong mga requirements, yung ECC
na Environment Compliance Certificate na galing naman sa Environmental Management Bureau which was issued ng head ng central office
namin and thenso, yun basically yung mga ano kobasic requirements na nacomply and so bumalik po sa amin yung mga documents with
the clearance of our Secretary to issue the earth-balling permit for the naturally growing Benguet pine trees and cutting permit for the planted alnus trees. And then with 10 conditions may nirelease po tayo. So, correspondingly, with the clearance nag-issue po kami ng permit
doon stating the same provisions na to SM. So, yun po yung in short nangyari dun sa proseso.
Atty Daytec-Yangot
Weve spoken to several councilors and with all due respect to the Mayor of the city who happens to be my relative, we feel that the city
council should have been consulted. There should have been a resolution coming from the body which the Mayor may either have approved
or have vetoed but this matter was never referred to the city council and in fact it was the movement the communitys movement that
referred this to the council from which they held some meetings and today theres going to be a meeting.
Another thing Sir, theres a worry regarding the ECC because we found out that, actually SM does not have an ECC. What happened was
that, the ECC issued in favor of SM Investment Corporation in 2001 covering the construction of the existing mall was amended in favor of
another entity not SM IC but rather SM Prime Holdings and that apparently is the ECC that theyre showing now. So, the ECC process was
not followed and in our view, this is highly irregular because theres going to be a new structure which will cover a different area and therefore there should be a new ECC. Its no wonder that when we went to your office to ask for a copy of the Environmental Impact Statement,
we were not able to get any. There were several other documents that we were not able to obtain and then it dawned upon us when we
look at the ECC that SM presented that it actually has no real ECC, and we feel Mr. Secretary that that is highly irregular.

Can we just clarify that? Several questions be raised afterwards. The position that theyve taken is that, there is a requirement for a Sangunian Resolution endorsing the request for the cutting of trees?
Atty Daytec-Yangot
For the expansion, the whole project.

Yes, so these are the questions, the Sangunian resolution for tree-balling and tree-cutting, this is the Sangunian Resolution endorsing the

Let me just clarify the points that are being raised. The first one is, an issue as to whether the endorsement of the Mayor is sufficient or the
endorsement of the Mayor requires a resolution from the Sanggunian and that will be resolve by way of the process of DENR. So, my question is, Is Sanggunian resolution required?
Mayor Domogan
Thank you Sir Secretary. It is a legal issue and I think if we debate here, I think we cannot solve that. Their position is, It needs Sanggunian
resolution. This is a mall development which even our Zoning Officer says it doesnt need a Sanggunian endorsement. It would be different if
it were a subdivision development like what happened in John Hay. It needs a Sanggunian resolution. Now, this is the resolution of the Barangay, thats why I think we cannot resolve it here. It will be the court. Anyway, because this is pending issue with the court. There are
confused here and I am happy because the Secretary is here and the Executive Director because I am being branded as have pressured
DENR to issue the tree-cutting and balling permit. I can face anybody here. I never talked with either the Secretary or to any personnel of
the DENR relative to that one. In fact, klarong klaro, No. 1, this is now a private property. We have a limit of authority and the DENR has
their own separate limit of authority. As far as the city is concerned, what we have to watch is, Is it in conformity with the land use? And the
zoning ordinance of the city which it appears that it had been cleared by the Zoning Officer, the Planning Officer that it doesnt violate the
land use and zoning ordinance and because it is a private property then as we said, we do not object with the development. Thats what we
said to the DENR, thats the tenor of our endorsement. Ah, but even on that way, on the issue on whether or not it requires resolution of
endorsement of the city council, as I said that is a legal issue because the zoning officer said, it doesnt need because this is just like Euro
Hotel and the other hotels in the city of Baguio, it doesnt need an endorsement of the city council. It would be different if it is a big development that it really needs the endorsement. Thats why, yung reniquire ng DENR is for SM to inform the city government and thats ECC. Now,
on the issue of the ECC as pointed out, well according to Atty. Yangot, walang ECC na na-issue to SM because what has been issued was to
this name of a corporation and was amended and later on issued to this new corporation and the latest ECC nowthe letter of DENR says
that this is actually the expansion of an old project and there was a previous ECC that had been issued and the requirements of the other
requirements for the issuance of ECC is no longer necessary. Thats why I repeat, what is required by DENR is for SM to inform and . . . inform the city of Baguio of the said expansion. Thats what is stated in the

Ah, Mr. Secretary, theactually Im texting the Environmental Management Bureau Director on the basis for the decision that EMB gave for
the expansion na yan. But, ahyung issue ho kasi ng ECC, matagal na ho kasi etong issue sa amin na inaabot ng isang taon, dalawang tao.
Actually DTI has been pressuring us to please tell the industry...meaning yung investment nila umaabot na raw ng three hundred billion
dyan sa [name of place mentioned not clear] nabibinbin dahil saang nangyari dyan, in a manner na makakatulong kami for example
yung ganito, existing naman yung structure, andun yung SM eh, the SM Baguio is much bigger than the expansion, usually if the activity is
will be much bigger than the original size, then there could be a much bigger impact to the environmentit will require a new scoping but for
this particular case, the original SM is much bigger than the expansion that could be the reason why sinasabi ng EMB, we just look at the
original condition of the ECC and say, uy applicable din yan dito, most probably yun yung tinitext nya sa akin because it happened several
times kasithe DTI has been complaining na hinahabol nila yung ECC ng dalawang taon and the investment naman nabibinbin. So problema
rin naming yan, how to balance investment and the environment. So, the other thing na sabi nga ni [name of person mentioned not clear]
yung social acceptability kasi, before I became Secretary, there is an Executive Order saying that the social acceptability isa yun sa nagpapatagal sa ECC naming so sabi naman ng EMB, sa amin technical lamang, we will tell you the environmental impact. The social acceptability is
a requirement so ngayon ang sabi nila, sabi naming sa DTI, we can give you the ECC in 60 days or in 45 days but remove from us the social
acceptability kasi yung hearing-hearing, naibigay ata sa LGUnaibigay sa LGU yung social acceptability, meaning kapag binigyan kami ng
LGU ng endorsement, nasettle na nila yung social acceptability. So, ganyan ho ang nangyari dyan dahil sa pressured din nga kami ng investors, nohthe Chamber of Commerce and Industry, may DTI and so on that yung ECC namin tumatagal ng husto, wala pa ho dyan yung
NCIP endorsement, di ba yung mga ganun. So kami, sabi namin, kung gusto nyong madaliin kami, then leave the technical from us; remove
from us the social acceptability. So what they did before I came in, the DENR issued an executive order deleting that component at ipinamigay sa iba that is the only time na nabilisan yung pag-issue ng ECC.
Save 182 Lawyer?
Apparently, Mr Secretary obvious naman na mukhang wala talagang social acceptability di ba dahil sa mga protests, movements na nangyayari and yungits our position talaga na that requirement kahit na patatagalin ang proseso, that is a requirement that has to be complied
with. Social acceptability is an important form of development. As far as yung sinasabi mo na pinasa sa LGU yung pagconduct ng survey sa
social acceptability, wala kaming nakita. Wala ring ininform ang SM sa mga tao kung paano nila ginawa yun, kung paano nila ginawa yung
social acceptability.

Sa aming position po Mr. Secretary, aside from yung sinabi ni Atty Daytec kanina na panibagong project tapos nag-issue sa panibagong korporasyon, entity ginamit na din ng SM. Noong unang sinerve yung 72-hour TEPO, ayaw tanggapin ng SM Baguio because they claim that
they are SM Prime Holdings and it should be served to SMIC. That is the reason why they did not comply with the 72 hour TEPO.

Yun nga eh, noong 2001 lets assume na merong social acceptability yun, sige pumayag yung taon-bayan na ganyan yung structure, noh so,
yun yung social acceptability noon. Pero ngayong ganyan, ibang usapin yun so sa pagtingin natin, hindi pwede yung nangyari na i-a-amend
yung ECC noong 2001 at yun nga aside from the fact that the new ECC is in the name of a different entity iba rin talagang project ito. Kami
rin namay talagang nalulungkot na sa tingin naming kayong mga taga DENR ay hindi you did not walk the straight path na lumihis kayo

sa matuwid na daan. So yun sana yung hinihingi namin na doon na tayo sa matuwid at kung kailangang simulan ang proseso, simulan natin.
Kung matagal, eh talagang ganyan. We cannot sacrifice the state of the people for the sake of [some lines not clear].
Ipasok na natin ang investment, bilisan na natin ang proseso. Huwag sana nating pilitin na magkaroon ng social acceptability kasi napakaimportante yun. Yung people empowerment, its the cornerstone of our new constitution po.

Actually, sa totoo ho, sabi ko nga sa inyo, balancing the environmental protection and economic development brings sustainable development [some lines not clear], for example you tell me that in the case of Mindanao now with respect to power production. Of course, mam-

BAGUIO DECLARATION
Reclaim our Rights to Land, Resources and Ecological Sustainability
Protecting the rights of the poor should take precedence over corporate greed. Genuine development must prioritize the need to ensure ecological sustainability over market profitability. We must never sacrifice people and the
environment for short-term benefit of the few. - Fr. Edwin Gariguez, a Catholic priest who led a group of indigenous
and community leaders in 2009 in an 11-day hunger strike to protest large-scale mining in Mindoro, and recipient of the
2012 Goldman Environmental Prize.
These words resonate as we, participants of the Baguio Environmental Summit, unite and resolve to continue our struggle to reclaim our rights to land, resources and a sustainable environment in the City of Baguio.
We are alarmed that Baguios environment is now in deep crisis, reaching such a state of environmental degradation,
that we experience daily its stark impacts. We suffer the evidences of urban blight such as the garbage problem, the lack
of water, dying rivers, the poor air quality, traffic and congestion, the increase in natural disasters, food insecurity, unemployment, homelessness, shrinking forest areas and watersheds, and biodiversity loss. These phenomena are clear
signs that we may be crossing critical boundaries and approaching dangerous tipping points in the state of the citys, if
not the planets, environment.
We are concerned that the limited land and resources of Baguio City, originally indigenous peoples ancestral territory
and designed as a colonial hill station to serve a population of 25,000, are now stretched beyond its limits. The carrying
capacity of the city has already been exceeded. We believe that the development of Baguio Citys land and resources
should be managed and planned in a rationale, cohesive and holistic manner to take into consideration the welfare of
the people, of future generations and the sustainability of the environment.
We are aghast at the wanton disregard by government officials of the peoples sentiments in giving priority to profitgenerating development for a few elite corporations over the needs and welfare of the majority of the people. We hold
the public authorities accountable for their failure to stop this reckless violation of the rights of the Baguio people to
land, resources and a healthy environment.
We condemn the manipulation of land tenurial instruments in the city to give favor to the rich and powerful over the
rightful ownership claims and access rights of indigenous peoples, actual occupants, settlers and other bona fide residents of the city.
In our desire for a Baguio City that is progressive, sustainable and responsive to the needs and sentiments of its people;
in our deep respect for Mother Nature, its ecological balance and integrity of creation; and after thorough and allrounded discussions and deliberations while keeping the common good of the people of Baguio in mind;
We now forward our recommendations, with the expectation that these serve as a guide for our policy-makers, decision
-makers and urban planners, as well as our own respective organizations in defining the future development plans of
Baguio City.

Baguio Environmental Summit (continued)


On Land Use:
1. Ensure that the Comprehensive Land Use Plan of Baguio strikes the proper balance between economic development and environmental
protection. Ensure that the remaining forest cover, watershed areas and parks of the city are protected, conserved and further developed,
while regulating the need for residential, institutional and commercial zones. Conduct wider consultations with the people and communities affected in the formulation of laws, policies, projects and programs on land use.
2. Conduct a comprehensive study and enact appropriate legislation to reconcile conflicting land surveys, land use, titles, townsite sales applications and other tenurial instruments of land disposition in the city. Implement and fast-track programs to recognize indigenous peoples land rights while addressing the perennial problem of squatting through mass housing and recognition of rights of actual occupants.
Initiate dialogues between the Ibaloi land claimants and settlers in ancestral lands towards resolving issues of ownership and acquisition.
Declare a moratorium on demolitions
3. Investigate illegal and anomalous land transactions, land grabbing, graft and corrupt practices in the disposition of land in the city. Punish
those accountable for these crimes and initiate measures of redress to correct the injustices committed against rightful landowners and
occupants. Uphold the Ibaloi peoples struggle for justice over the dispossession of their ancestral lands.
4. Conduct widespread public consultations in Baguio to surface the true sentiments of the people before any further action is taken by Congress to approve the proposed Baguio City Charter.
5. Conduct geo-hazard mapping to determine dangerous land areas in Baguio as a basis for disaster risk reduction and preparedness, while
ensuring that this is not mis-used to justify relocation and/or demolition of informal settlers and rightful owners.
On Garbage and Waste Management:
1. Conduct a comprehensive study and hold public consultations and multisectoral dialogues towards arriving at a sustainable solution to the
garbage problem of the city. Close down, clean up and rehabilitate the Irisan dumpsite to make it safe for community residents and surrounding barangays.
2. Intensify programs to reduce, reuse and recycle waste in the city. Encourage and support viable household-level and community-level
initiatives, as well as indigenous and innovative practices of waste management as an integral part of the comprehensive program of
waste management of the city, including the use of vermiculture, the eco-compost receptacle and residual waste terrace.
3. Promote alternative materials such as bayong, paper bags and other alternatives to plastics and Styrofoam in the city of Baguio, and assert political will for the implementation of the law on the use of plastics.
4. Hold the government accountable for the millions of pesos budget allocated for waste management and information, education campaign.
Ensure multisectoral collaboration in waste management and form a working group to study the budget, where is it going to ensure that it
is used for its real purpose of waste management.
5. Conduct community grassroots organizing for waste management at the source.
On Management of Land, Water and Natural Resources:
1. Give recognition to the importance of trees in the development of Baguio and their indispensible role in maintaining the environment,
land, air and water resources of Baguio City, as well as in mitigating carbon emissions, global warming and climate change.
2. Ensure that development plans of Baguio City promote equitable access, use, management and benefit-sharing of the citys natural resources and address the identified priority needs of the citys populace. Guard against attempts to monopolize resources for profit by a
few private and foreign corporations and the powerful elite. Conduct a grassroots- based campaign for sustainable pro-people development by starting in our own little ways.
3. Revoke the permit given to SM Prime Holdings for its expansion project. Stop the cutting and earthballing of trees in Luneta Hill and rehabilitate the forest to return it to its original condition. Investigate the status and legality of SM Prime Holdings land ownership over Luneta
Hill and surrounding areas. Promote good governance and hold the concerned City officials, the DENR and other government officials and
agencies accountable for their decisions and wrongdoings.
4. Conduct public consultations as a standard operating procedure and ensure that the free, prior and informed consent of affected communities is obtained before any development program or project is implemented in the city. Declare a moratorium on large-scale development in the city.
5. Promote clean and green development, environmental education programs in the schools and communities, indigenous knowledge and
practices in natural resource management, and grassroots involvement in environmental management. Promote sustainable urban agriculture.
6. Revive and strengthen the consumerism movement in Baguio City for people to become responsible for the things they buy and use and
for each of us to look into our lifestyles and responsibility in the use of our resources.
7. Ensure equitable allocation and distribution of water resources and take measures to protect the water quality in the city of Baguio.
8. Consider urban planning on a wider scale such as the Baguio-La Trinidad-Itogon-Sablan-Tuba-Tublay (BLISTT) framework for development, as a way to ease the increasing pressure on the carrying capacity of Baguio, while giving a proper place to pro-people development,
environmental sustainability and indigenous heritage values of the people of Baguio and the adjacent municipalities.
These recommendations come with the guidance of the words of Macliing Dulag, the Kalinga leader who was killed on April 24, 1980 for his
militant opposition to the construction of the Chico Dams. He said: What is the most precious thing to man? Life! If life is threat-

ened, what ought a man do? Fight! This he must do, otherwise he is dishonored. That will be worse than death. If we do not
fight and the dams push through, we die anyway. If we fight, we die honorably. Thus I exhort you all then
KAYAW! (Struggle!)

Sirs:
As a concerned private citizen and tax payer, and in support of the 15,000 signatories of the opposition filed with
the Office of the President of the Philippines, opposing the removal and/or cutting of over 180 pine and alnus trees
at Luneta Hill above the Victory Liner Bus Station, as well as ecavation and construction of a multi-storey parking
building therein, may I respectfully bring to your attention the fact that the aforesaid area, is covered by Original
Certificate of Title No. 1 issued in the name of the Insular Government, now Republic of the Philippines. The area
covered by OCT No. 1 has not been disposed of to any other party to the present time. It is also a fact that SM
holds a title to the same area, derived fro a Free Patent Title issued in 1963. I respectfully point out that a Free Patent Title is issued in administrative proceedings, over disposable lands of the public domain, and not over those
which have become private lands by virtue of land registration proceedings. May I also respectfully point out the fact
that the said area appears to be within the road right of way of Gov. Pack Road, hence may not be occupied for private purposes.
I understand that a tree cutting permit may only be issed ot the registered owner of land where tree cutting or removal is to be made. Under the aforesaid circumstances, it is evident that the area is registered under two separate
and different titles, in the name of two different entities, only one of whom has filed application for tree cutting and
for removal, and therefore I respectfully request that all permits issued for tree cutting and/or removal, construction
of a multi-storey parking building, and excavation be suspended until the lawful registered owner is determined by
proper authority.
