Judicial developments in the Ayyash et al case

Trial preparation:
On 1 November 2013, the Legal Representative of
Victims (LRV) submitted written observations on the
modes of victims participation during trial, putting
forth a number of suggestions that would allow him to
effectively represent the 66 victims currently taking part
in the Ayyash et al. proceedings.
Later in November, the Prosecution, and counsel for
Mr. Ayyash, Mr. Badreddine, and Mr. Oneissi publicly
filed responses to the LRVs submissions.
Following the order of the Trial Chamber on 31
October, the Prosecution has put together a schedule
of the anticipated witnesses for the first part of the
case that will present what happened in and around
the crime scene on 14 February 2005. In particular,
the Prosecution seeks to rely on the evidence by 103
witnesses, including:
76 non-expert witnesses presenting evidence
in written format

Three witnesses giving oral testimony, and

one to provide a written statement for being
unavailable on medical grounds
23 expert witnesses to submit written
statements
Related to this, the Ayyash and Badreddine Defence
teams publicly filed their responses to the Prosecutions
20 November motion seeking the admission into
evidence of the statements of 76 non-expert witnesses
in written form by way of Rule 155. They challenge a
number of points raised in the Prosecutions motion.
On 6 November, the Appeals Chamber dismissed the
appeal by counsel for Mr. Sabra against the Pre-Trial
Judges decision which denied the disclosure of seven
items prepared by the Prosecution or the United Nations
International Independent Investigation Commission.
In the course of November, the Prosecution filed a
request before the Trial Chamber seeking certification
to appeal the PTJs decision ordering the Prosecution to

disclose the content of short message service (SMS) for

the telephone number of a Prosecution witness.
The Prosecution also challenged the joint Defence
motion seeking access to confidential material in the
Merhi case. In response to the joint Defence submissions
requesting access to confidential material in the case
against Merhi, the Prosecution pleads that no materials
were disclosed in support of the indictment against Mr.
Merhi that were not made available to the four other
Accused.

After leave was granted, counsel for Mr. Badreddine

and Mr. Oneissi submitted a request for reconsideration
of the 25 October 2013 Appeals Chamber decision
ruling that the applications by the Defence regarding
the re-composition of the Trial Chamber are frivolous
and imposing sanctions. Other parties submitted their
views too on this matter.
On 21 November, the Trial Chamber ordered Counsel
for Mr. Sabra to identify the list of material it is
requesting from the Lebanese authorities, and further
instructed the Prosecution to respond to the Defence
submissions in due time.

News
Third Round of Inter-University Programme on
International Criminal Law and Procedure
On 13 November, the third round of the InterUniversity Programme on International Criminal Law
and Procedure began. The programme is co-organised
with eight Lebanese universities and the T.M.C. Asser

Institute in The Hague. The President of the STL,

Sir David Baragwanath, delivered the first lecture to
the Lebanese students on the History of the Law of
International Tribunals via a video link.
This year, a record number of 229 students enrolled in
the programme

Visits
In November, the STL welcomed groups of visitors from
the Hague University of Applied Sciences, the French
Gendarmerie, the Centre for Transnational Legal Studies
in London, the Unrepresented Nations and Peoples

Organisation, the University of Amsterdam, and the

Clinique de droit international pnal et humanitaire.
