1531 etseq.,was enacted by Congressto conserve endangered and threatened species and the
ecosystem supon which theydepend.

withoutlimitation any m am mal,fish,bird,amphibian,reptile,mollusk,crustacean,arthropod,or


otherinvertebrate,and includesany part,product,egg,oroffspring thereof,orthe dead body or

partsthereof.Title16,United StatesCode,Section 153248).

The term threatened species''m eans any species which is likely to become an

endangered species within the foreseeable future throughout al1or a signitk antportion of its

range.Title 16,United StatesCode,Section 1532420).

A11species determined to be endangered under the ESA are listed in Title 50,

Code of FederalRegulations,Section 17.11. The Black rhinoceros (Diceros bicornis)is a


speciesofrhinocerosnative to eastern and centralAfrica. TheBlack rhinoceroswaslisted asan
endangered speciesin July 1980.45 Fed.Reg.47352,47354.

Rhinoceros are characterized by their enormous size, leathery skin and hom s.

Rhinoceroshol'
n isprized in some culturesforitsalleged m edicinalvalue orforitsuseascarved

artobjects. Illegalhunting resulting from the intemationaldemand for rhinoceros horn is a


majorthreatto thesurvivalofthe species. Libation cupsand otheromamentalcarvingsmade
from rhinoceroshorn are particularly sought-afterin China and otherAsian countries,aswellas

in theUnited States. The escalatingvalue ofthese item shasresulted in an increased dem and for
rhinoceros horn,and has helped to foster a thriving black m arket, which includes modern
carvings being sold as antiques. M ost species of rhinoceros are extinct or on the brink of
extinction asaresultofthisthrivingblack m arket.
18.

TheESA m akesittmlawfulto knowingly deliver,receive,carry,transport,orship

in interstate or foreign com m erce,by any m eans w hatsoeverand in the course of a com m ercigl

activity,endangered species of fish and wildlife,including Black rhinoceros. The ESA also

makesitillegalto selland offerto sellendangered specis offish and w ildlife,including Black


rhinoceros, in interstate and foreign com merce. Title 16, United States Code, Sections

1538(a)(1)(E)and(F)and 1540(b)(1).
The Convention on IntemationalTrade in Endangered Species (CITES) is an
intem ationalagreem ent,to which theUnited Statesisa party,which entered into force in 1975.
CITES regulates the international trade and transport of species that are threatened with

extinction (Appendix I),speciesthatare notcurrently threatened with extinction,butwould


become so absentregulation (Appendix 11),and speciesforwhich amembercountry requests
assistanceincontrollingtrade(Appendix 111).CITESisimplemented intheUnitedStatesaspart
oftheESA,Title 16,United StatesCode,Sections1537a-1538,and through regulationsfound at
Part23ofTitle 50 ofthe CodeofFederalRegulations.

20. TheAsian elephant(Elephasmaximus)isa speciesofelephantnativeto southcentral and southeastern A sia.The A sian elephant is listed in A ppendix l of CITES, and w as

listed as an endangered species in Jtme 1976. 41 Fed.Reg.24064. The African elephant

(foxodonta ajbicana)isa speciesofelephantnative to eastern and centralAfrica.TheAfrican


elephant is listed in Appendix l of CITES,though certain populations of African elephants

(specifcally those from South Africa, Namibia, Botswana, and Zimbabwe) are listed in
Appendix Il,accompanied by a specialannotation allowing only non-com mercialinternational

tradein specim ensofthose populations. TheAfrican elephantwas listed asathreatened species


underthe ESA in M ay 1978. 43 Fed.Reg.20504.

M anner and M eans ofthe C onspiracv

The mannerand meansby which the defendantssoughtto accomplish the objectsand


pum oseoftheconspiracy included,am ong others,thefollowing:

24. ln furtherance ofthe conspiracy and to effect the illegalobjects thereof,the


defendants and their co-conspirators received horns from Black rhinoceros in the course of

commercialactivity,and advertised thosehornsforsale atauction to potentialbuyersoutside the


State ofFloridaand outside theUnited States. In addition to advertising forsale atauction,the

defendantssoldhornsfrom Black rhinocerosand objectsmadefrom samedirectlytoindividuals


who the defendants knew resided outside the State of Florida and outside the United States.
Following these sales,the defendantsand theirco-conspiratorstransported,aided and abetted in

the transport,and attempted to transport,the horns and objects,knowing thattheir receipt,


acquisition,andsaleofthehornsandobjectsviolatedUnited Stateslaw.

ln furtherance ofthe conspiracy and to effectthe illegalobjects thereof,the


defendants and co-eonspirators worked with privately-owned shipping companies that assisted

purchaserstotransporthornsfrom Blackrhinocerosandobjectsmadefrom same,from theState


ofFloridato otherstateswithin theUnited States.

26. In furtherance ofthe conspiracy and to effect the illegalobjects thereof,the


defendants and co-conspirators worked with privately-owned shipping companies, which

assistedptlrchasersto smugglewildlifeand objectsmadefrom wildlife,includingbutnotlimited


torhinoceroshorn,elephantivory,and objectsmadefrom same,from theUnited States.

were committed and caused to be com mitted by atleastone ofthe co-conspirators,within the
Southern District of Florida,and elsewhere,at least one of the following overtacts,among

On oraboutFebruary 7,2012,the defendants advertised via tionline Auctions,''
an intemet-based auction database,thatthe horn the defendants received from M .B.on January

30,2012,would be sold atauction on M arch 18,2012,for an testim ated price''of $50,000 to

bidof$69,000 ($60,000plusa 15% ltbuyer'spremium''to ELITE)to aUnited StatesFish and


W ildlifeSeniceCtUSFW S'')agentworkinginanundercovercapacity,whoinformeddefendants
that he resided in the Com monwea1th of Virginia,and in factparticipated in the auction by
telephonefrom theComm onwea1th ofVirginia.

On oraboutJune 26,2012,the defendantsreceived a wire transferof$69,000 for


the horn sold on June 24,2012,to the undercoverUSFW S agentfrom the Commonwea1th of
Virginia.

rhinoceros,which wasdisplayed in aphotograph.


On or about November 10, 2012,the defendants advertised on ELITE'S own
website the horn they advertised via Online Auctions on October 15. The advertisem ent
portrayed thehorn in the identicalphotograph asw asin the Online Auctionsadvertisem ent,and

also described the horn as ttaot 101 - Antique Rhinoceros Horn...pre-sale estim ate $30,000 -

$50 000.''
On oraboutNovember 10,2012,in Boynton Beach,Florida,the defendants sold

Lot101,ahornfrom aBlackrhinoceros,atauctionforawinningbidof$36,800($32,000plusa

15% lbuyer'spremium''to ELITE)to aUSFW S agentacting in an undercovercapacity,who


informed defendants that he was participating in the auction by telephone from the
Commonwealth ofVirginia,and did,in fact,participate in the auction from the Comm onwea1th
ofV irginia.

On or aboutNovem ber 16,2012,the defendants received a wire transfer in the

amountof$36,800 forLot101,thehorn sold on November16,2012,to the lmdercoverUSFW S


agent.

On or about January 16, 2013,the defendants sold the horns received from

ColoradoConsignorinaprivatesale(notatauction)to CC-2,aresidentofTexas,for$55,000.
On oraboutJanuary 23,2013,thedefendantsreceived aw ire transferof$55,000
forthe hornssold on January 16,2013 to C C-2.

On oraboutJanuary 18,2011,in Boynton Beach,Florida,thedefendantssold Lot

72,afigurecarved from elephantivory,to apurchaserin Belgitzm for$1,600,and then,knowing


thattheproperpennitswerenotobtained,aided and abetted in shipping Lot72 outofthe United
Statesto Belgium .

On oraboutM arch 13,2012,in Boynton Beach,Florida,the defendantssold Lot

265,an objectcarved from elephantivory,to a purchaserin Hong Kong for$6,700,and then,


knowing thattheproperpermitswere notobtained,aided and abetted in shipping Lot265outof
the United Statesto H ong Kong.

On oraboutJanuary 18,2013,in Boynton Beach,Florida,thedefendantssold Lot

145,a gure carved from elephantivory,to a plzrchaserin Taiwan for$1,700,and then,knowing
