A regular session of Troy City Council was held Monday, May 18, 2015, at 7:00 p.m. in Council Chambers.
Members Present:
Clark, Heath, Kendall, Oda, Schweser, Snee, Tremblay and Twiss.
Upon motion of Mr. Schweser, seconded by Mr. Clark, Mr. Phillips was excused from this meeting by
unanimous roll call vote.

INVOCATION: The meeting began with the Pledge of Allegiance, followed by an invocation given by Council
Member Clark.
PUBLIC HEARING: At 7:03p.m., Mrs. Baker declared opened the public hearing on 0-12-2015, rezone part of
IL 9891, area of 25.422 acres from A-R, Agricultural-Residential District, to R-3-B, Single-Family Residential
District.
Speaking in favor of the rezoning, Jessica Minesinger, Nottingham Development, 7 S. Plum Street, the
applicant, commented that the minimum lot size under R-3-B is 12,000 square foot, this development is
contiguous to the current Nottingham Development that has a requirement of a minimum of 9,000 square foot
lots, this development would be 51 lots, about two lots per acre, and will have a connector to Troy-Piqua Road,
which should be an advantage for the residents of the area and provide an additional access for fire and police
purposes. In response to Mr. Clark, Mrs. Minesinger stated that all the lots in the existing Nottingham
Subdivision have been sold to builders or home owners.
-Dan Dalton, 612 Shaftsbury, stated he did not have a position on the rezoning, but was concerned about
construction traffic by his residence, the only access to this land, and asked that an access road for construction
purposes be made available sooner than later. Mr. Titterington commented that while he may concur with Mr.
Dalton's comment, that is not a matter of zoning. If the land is rezoned, the subject of a construction access
road would be discussed with the developer as a part of the preliminary and final plan process.
There were no comments opposing the rezoning. There being no further comments, at 7:08 p.m., Mrs. Baker
declared this public hearing closed.
MINUTES: The Clerk gave a summary of the minutes of the May 4, 2015, meeting of Troy City Council. There
were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Twiss, to
approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Community & Economic Development Committee: Mr. Twiss, Chairman, reported that Committee recommends
approval of the rezoning covered by Ordinance No. 0-11-2015.

Finance Committee: Mr. Tremblay, reported that Committee recommends legislation be prepared authorizing
the City of Troy to make purchases through the governmental cooperative purchasing program known as
HGACBuy. Committee supports emergency legislation, as it was discussed that a demo fire rescue unit is
currently available through HGACBuy that would meet the needs of the Troy Fire Department, and at a lesser
cost than appropriated.

Law & Ordinance Committee: Mr. Schweser, Chairman, reported that Committee recommends legislation be
prepared approving the Miami County Solid Waste Management Plan Update, noting that the plan is updated
approximately every five years to project procedures for the next 15 years in dealing with changing solid waste
management issues.

Recreation & Parks Committee: Mr. Heath, Chairman, reported that Committee recommends legislation be
prepared authorizing the Director of Public Service and Safety to execute the ODNR Capital Improvement Project
Grant for a $150,000 grant for the Treasure Island Improvement Project, and more specifically for the parking lot
reconstruction. Committee noted that these funds were made available through HB 497.

Streets & Sidewalks Committee: Mrs. Snee reported that Committee recommends legislation be prepared
authorizing the Director of Public Service and Safety to enter into a contract with L. J. DeWeese Co., Inc. in an
amount not to exceed $650,000 for the Streetscape 38 Project. It was noted that the bids came in over the
initial $575,000 authorized for the project, and of the project cost, 4 7%, or up to $300,000 will be funded by
ODOT. Committee noted that while City costs for the project would be increasing; there is no increase to the
assessments for this project as previously accepted by Council. In that a contract must be completed in June to
receive the ODOT funding for this project, Committee supported emergency legislation.

Discussion. Mrs. Oda asked about the process for establishing an estimate and why the bid on this project was
over. Mr. Titterington commented that factors were the timing of the bids and adding storm water after the initial
design/estimate, that the City relies on outside engineers for most project design and estimates, and that most
bids are under the estimates.
Utilities Committee: Mr. Tremblay, Chairman, reported that Committee recommends legislation be prepared
authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for a lime
slaker system for the Water Treatment Plant, including installation costs, at a cost not to exceed $182,000.

COMMENTS OF THE MAYOR: Mayor Beamish commented as follows:


-City offices are closed Memorial Day (May 25), but refuse and recycling will be on schedule.
-Observances have been scheduled for Memorial Day.

COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington commented that the
new recycling contract will result in some positive changes. Rather than bins the containers will be 65 gallon
containers on wheels, and this should help curb appeal as material will not blow out of the new containers. This
should also help the City determine if residential refuse collection should use similar containers in the future. He
stated it will be about eight weeks before containers are received and delivered, and the City and vendor will
work together to help provide information to citizens regarding the new recycling containers.

Committee members Kendall and Schweser met on May 26 to review a recommendation from the Troy Planning
Commission that part of lnlot 9891 be rezoned from A-R, Agricultural-Residential District, to R-3-B, Single-Family
Residential District. This is a 25.422 acre parcel located west of Piqua-Troy Road and east of the Nottingham
Subdivision. The rezoning was recommended by the Troy Planning Commission.
RECOMMENDATION: (to be read at Council meeting)
We support the recommendation of Troy Planning Commission and recommend that Ordinance No. 0-12-2015 be
approved to provide for the rezoning of part of lnlot 9891 from Agricultural-Residential to R-3-B, Single-Family
Residential District.

DETAILED REPORT:
Committee members Kendall and Schweser met on May 26, 2015 to review the recommendation from the Troy
Planning Commission that part of lnlot 9891 (part of parcel D45-002548) be rezoned from A-R, AgriculturalResidential District, to R-3-B, Single-Family Residential District. This meeting was also attended by Council
Member Oda, members of the City staff, the applicant, and citizens.
This area proposed to be rezoned consists of 25.422 acres of undeveloped land, and is located west of Piqua-Troy
Road and east of the Nottingham Subdivision . R-3-B zoning has a minimum lot size of 12,000 square feet. The
land owner is TTF Brown, LLC. The applicant is Nottingham Development, LLC; Jessica Minesinger, President.
The proposed use of the property is a residential development. From information provided from the Planning
Commission we understand that the development would consist of approximately 50 lots and be developed in three
sections. The development would provide a second point of ingress and egress for the residents of the existing
Nottingham Subdivision by requiring access to Piqua-Troy Road. The Troy Planning Commission recommended
approval of the rezoning. Council held a Public Hearing on the rezoning at the May 18 meeting, with no comments
made opposing the rezoning.
RECOMMENDATION:
We support the recommendation of Troy Planning Commission and recommend that Ordinance No. 0-12-2015 be
approved to provide for the rezoning of part of lnlot 9891 from Agricultural-Residential to R-3-B, Single-Family
Residential District. In making this recommendation we support the findings of City staff and the Planning
Commission that:
-The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code;
-The proposed rezoning is consistent with the surrounding zoning districts;
-The proposed use is consistent with permitted uses in the R-3-B district;
-The proposed rezoning is consistent with the City of Troy Comprehensive Plan;
-The development would provide a second point of ingress and egress for the residents of the existing Nottingham
Subdivision by requiring access to Piqua-Troy Road, and allows the city to require the looping of utility lines in the
area.

Committee members Snee and Schweser met on May 29 to consider legislation related to sidewalk safety
and the annual painting of strawberries on certain City streets. Because of safety issues related to some
substances that have recently been placed on sidewalks, the Law Director has recommended that
legislation be considered to prohibit anyone from placing on a sidewalk any substance that cannot readily
be removed with non-pressurized water and a broom and without damaging the sidewalk. The Law Director
has also recommended that the City consider legislation that would support the continuation of the painting
of strawberries on certain City streets due to the identity of the City of Troy with the Troy Strawberry
Festival.
RECOMMENDATION: (To be read at Council meeting)
This Committee recommends that legislation be prepared to:
1. Amend Section 521.04 of the Ordinances regarding sidewalk obstructions; damages or injury to
prohibit the use of any substance on sidewalks that cannot be readily removed with non-pressurized
water and a broom and without damaging the sidewalk. We support emergency legislation so that
there is no delay in addressing the safety issues.
2. Authorize the painting of strawberries on City streets around the square area to the same area
where the Strawberries have been painted. As the Strawberry Festival will be held soon, we support
emergency legislation.

DETAILED REPORT:
Committee members Snee and Schweser met on May 29, 2015, to consider legislation related to sidewalk
safety and the annual painting of strawberries on certain City streets. The meeting was also attended by
the Director of Law, the Director of Public Service and Safety, Council Member Oda, members of the City
staff, and citizens.
Mr. Livingston, Director of Law, advised the Committee that the City has the duty to keep sidewalks free and
clear and undamaged. There is a silicone substance that has been used to apply messages to sidewalks,
and the substance becomes slippery when wet. That substance cannot be removed without damaging the
sidewalk and it also takes time to wear off naturally. Allowing the substance to be placed and to remain
creates a potential liability for the City when the City is aware of the danger of the substance and does
nothing to prohibit it. The Director of Law has proposed that Section 521.04 related to sidewalks be
amended to prohibit anyone from placing on a sidewalk any substance that cannot readily be removed with
non-pressurized water and a broom and without damaging the sidewalk. The language would specifically
prohibit paint and the silicone-based, superhydrophobic substances. This provision would apply to any
sidewalk within the City. This should address any potential liability matters and addresses the responsibility

of the City to have sidewalks safe for pedestrians. There would not be a prohibition against temporary
markings or messages using items such as chalk. So that there is no concern that there would be a
prohibition against the strawberries that are annually painted on City streets in the downtown square area,
Mr. Livingston suggested that there be legislation that recognizes the identity of the painted strawberries
with the City and Troy Strawberry Festival, and that would further permit the annual painting of the
strawberries on the street within the specific area where they have been painted in past years.
Mr. Brian Kemper confirmed that Council had received a letter from his attorney by email on this matter. Mr.
Kemper was advised that removal of existing sidewalk markings are not being required.
REQUESTED ACTION:
This Committee recommends that legislation be prepared to:
1. Amend Section 521.04 of the Ordinances regarding sidewalk obstructions; damages or injury to
prohibit the use of any substance on sidewalks that cannot be readily removed with non-pressurized
water and a broom and without damaging the sidewalk. We support emergency legislation so that
there is no delay in addressing the safety issues.
2. Authorize the painting of strawberries on City streets around the square area to the same area
where the Strawberries have been painted. As the Strawberry Festival will be held soon, we support
emergency legislation.

2014 REGARDING AN OHIO DEPARTMENT OF
TRANSPORTATION RESURFACING PROJECT THAT
WOULD HAVE INCLUDED PART OF STATE ROUTE 718

WHEREAS, on October 20, 2014, Resolution No. R-46-2014 was approved by


Troy City Council, consenting to the Ohio Department of Transportation (ODOT)
resurfacing part of SR 718 (Project PID No. 88689), a small portion of which project
would have been located within the City of Troy, and
WHEREAS, ODOT has now advised the City that such project will be cancelled
by ODOT due to changes in the Pavement Program from the OODT Central Office, and
ODOT requests that the City's Resolution be rescinded.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, as
follows:
SECTION 1: That Resolution No. R-46-2014 is hereby rescinded as requested
by Ohio Department of Transportation.
SECTION II: That this Resolution shall be effective at the earliest date allowed
bylaw.

RESOLUTION ACCEPTING THE PAINTED STRAWBERRIES


AFFIXED TO LIMITED AREAS OF CITY STREETS AROUND
THE SQUARE DOWNTOWN AND AUTHORIZING THE
ANNUAL PAINTING OF STRAWBERRIES TO CONTINUE IN
SUCH AREA AND DECLARING AN EMERGENCY

WHEREAS, the Troy Strawberry Festival began in 1977 and during the ensuing 38
years, has become an annual event that regularly attracts upwards of 100,000 people per day to
the City of Troy, Ohio, its community and the region; and
WHEREAS, many people throughout the State of Ohio and elsewhere associate the City
of Troy, Ohio with the Troy Strawberry Festival; and
WHEREAS, the annually painted strawberries on the City's streets by the Troy Area
Chamber of Commerce and the Troy Strawberry Festival, Inc. serve as a reminder to residents
and visitors alike that the City of Troy is home to the Troy Strawberry Festival, and
WHEREAS, the annual painting of strawberries on the streets of Troy, has traditionally
been limited to areas around the Square downtown, as shown on exhibit "A" attached hereto
NOW THEREFORE, BE RESOLVED by the Council of the City of Troy as follows :
SECTION 1:

That the City of Troy hereby accepts the painted strawberries affixed to

the City's streets in areas as shown on Exhibit "A" attached, as they directly relate to the City of
Troy's history as home to the Troy Strawberry Festival.
SECTION II: That the City of Troy hereby authorizes the Troy Area Chamber of
Commerce and the Troy Strawberry Festival, Inc. to continue their annual painting of
strawberries upon the streets of Troy within the limited area shown on Exhibit "A" attached
hereto.
SECTION Ill: That this Resolution is an emergency measure necessary for the
immediate preservation of the public peace, health, and safety of the City of Troy, Ohio, and for the
further reason that the Troy Strawberry Festival is held the first full weekend of June and the
annual painting of strawberries on the streets must be completed prior to that time, NOW,
WHEREFORE, this Resolution shall be effective immediately upon its adoption and approval by
the Mayor.

On April 8, 2015, the Troy Planning Commission considered the rezoning of part of lnlot 9891 (part of parcel D45002548) from A-R, Agricultural-Residential District, to R-3-8, Single-Family Residential District. This area proposed
to be rezoned consists of 25.422 acres of undeveloped land, and is located west of Piqua-Troy Road and east of
the Nottingham Subdivision. R-3-B zoning has a minimum lot size of 12,000 square feet. The land owner is TTF
Brown, LLC. The applicant is Nottingham Development, LLC; Jessica Minesinger, President.
The Commission had received a report from City staff, which was reviewed as part of the meeting discussion.
That report indicates that the intended use of the property is a residential development. A copy of the information
provided to the Commission is attached.
The applicant commented that this would be the last area of the Nottingham Subdivision; the proposed zoning
would result in approximately 50 total lots, developed in three sections, and an anticipated build out schedule of
about 12 houses per year.
The Planning Commission determined not to hold a public hearing on this rezoning application.
By unanimous vote, the Troy Planning Commission recommends to Troy City Council that Council approve the
rezoning of part of lnlot 9891 (part of Parcel 045-002548) on Piqua-Troy Road from Agricultural-Residential to R-38, Single-Family Residential District, as requested by the applicant and as recommended by City staff based on:

The proposed rezoning is consistent with the surrounding zoning districts; and
Proposed use is consistent with permitted uses in the R-3-B district; and

The development would provide a second point of ingress and egress for the residents of the existing
Nottingham Subdivision by requiring access to Piqua-Troy Road, and allows the city to require the looping
of utility lines in the area.

This request is forwarded herewith to Council for consideration.

BACKGROUND:
Jessica Minesinger, President of Nottingham Development, Inc., has applied for Planning
Commission to consider allowing the rezoning of part of Inlot 9891, parcel D45-002548
(25.422 ac.) located west of Piqua-Troy Road. Currently the property is zoned A-R
Agricultural-Residential, and the applicant requests that the zoning of the parcel be
rezoned to R-3-B Single-Family Residential.
The land is currently undeveloped and located west of Piqua-Troy Road and east of the
Nottingham Subdivision. The surrounding zoning districts include County Zoning of A-2
General Agriculture to the north, City of Troy zoning of Agricultural-Residential to the
east, Office-Comt;n.ercial Zoning (OC-1) to the south, and R-4 Single-Family Residential
to the west of the parcel. A map depicting the surrounding zoning districts has been
attached to this report
DISCUSSION:

The applicant has cited that the reasons for the proposed rezoning are to develop the
property as an extension of the Nottingham subdivision.
The Zoning Code describes the current A-R zoning district as "designated to provide for
both agricultural and residential activity on large tracts and open land with a minimum of
five (5) acres or greater of lot per dwelling unity. This district is mapped in undeveloped
areas along existing roadways where there is minimal water and sewer service."
The Zoning Code describes the proposed R-3-B zoning district as "designed to
accommodate single-family dwellings on lots with areas of at least twelve thousand
(12,000) square feet per dwelling unit. This district will be mapped for selected areas
which will develop in the future. The Comprehensive Plan describes the R-3-B District
as medium density."
Attached to this report is a list of all the A-R and R-3-B zoning districts uses. Also
attached is a list that shows comparisons between permitted uses of each zoning district.
The Comprehensive Plan's Future Land Use Map (Figure 14-2) displays this property as
future residential use. Specifically, in Chapter 14, under the Northeast Sub-Area, the
Comprehensive Plan states "The desired future residential development for this area is
low-density residential, due to the both the characteristics of the land and the adjacent
uses to the south. The existing road network cannot support unrestricted or increased

numbers of similar residential densities. With future improvements to the road network,
however, higher densities could be accommodated."

In accordance with the Thoroughfare Plan, the City is in the process of improving the
road network in the area and is making a significant improvement to the intersection of
Piqua-Troy Rd. & Troy-Urbana Road. With the improvements, any future residential
development on this property can be handled by the current road network.
A copy of Figure 14-2 has been attached to this report.

In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to


base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose

ofthis Zoning Code.


The proposed rezoning is consistent with the Zoning Code. Section 1131.02(o) & (r)
state the purposes of the Zoning Code are to preserve and enhance property value, and
direct particular land uses to the parcel of land best suited for them. The proposed
rezoning request achieves these purposes.
(B) Whether the proposed amendment is made necessary because ofchanged or

changing conditions in the area affected, and, ifso, the nature ofsuch changed or
changing conditions.
The proposed rezoning is not made necessary because of changing conditions in the
affected area. The proposed use will not have any adverse effects in the area and is
similar to the residential uses that currently exist to west

(C) Whether the uses that woul(i be permitted on the property if it were reclassified would
be compatible with the uses permitted on other property in the immediate vicinity.
The proposed use is compatible and similar to the residential uses that currently exist to
west and will provide a second point of ingress and egress to the residents of the
Nottingham Subdivision.

(D) Whether adequate utility, sewer, and water facilities, and all other needed public
services exist or can be provided to serve the uses that would be permitted on a property
if it were reclassified
All utilities can be provided.
(E) The amount ofvacant land that currently has the same zoning classification as is

proposed for the subject property, particularly in the vicinity of the subject property, and
any special circumstances, in any, that make a substantial part ofsuch vacant land

unavailable for development.


In the vicinity of the subject property, there is no available vacant land with the R-3-B
zoning classification.

(F) Whether the proposed amendment would correct an error in the application ofthis
Zoning Code as applied to the subject property.
Not applicable in this request.

PUBLIC BEARING:
Due to the straight forward nature of the rezoning request, the compliance with the City
of Troy Comprehensive Plan, and the fact that City Council is required to hold a public
hearing ifthe request proceeds on, staff does not feel that a public hearing before the
Planning Commission is warranted.

RECOMMENDATION:

It is staff's opinion that the proposed rezoning will achieve the desired residential
development as is discussed in the City of Troy's Comprehensive Plan. The intent of the
R -3-B zoning district is to be mapped for selected areas which will develop in the future.
The Comprehensive Plan shows this area to be development as residential.
The proposed residential use will provide an opportunity for the City to provide a second
point of ingress and egress for the residents of the existing Nottingham Subdivision by
requiring access to Piqua-Troy Road and allows the city to require the looping of utility
lines in the area.
Concerns related to traffic in this area are currently being addressed by the realignment of
the Piqua-Troy & Troy-Urbana Rd. intersection. The realignment of this intersection
should be completed in the near future.
Staff is recommending that the Planning Commission recommend approval of the
proposed rezoning from A-R Agricultural-Residential to R-3-B Single-Family
Residential, based on the following:
o The proposed rezoning is consistent with the intent and purposes o~ the City of
Troy Zoning Code; and
o The proposed rezoning is consistent with the surrounding zoning districts; and
o Proposed use is consistent with permitted uses in the R-3-B district; and
o The proposed rezoning is consistent with the City of Troy Comprehensive Plan.

Oh behalf of Nottingham Development, Inc., I am seeking a zoning amendment on 25 .4 Acres located on


Troy-Piqua Road in the City of Troy to R3-B Single Family Residential zoning. The parcel is contiguous to
the Nottingham Subdivision and is currently zoned Ag-Residential.
We are seeking a zoning change to R-3B which requires a minimum of 12,000 s.f. lots. It is our intention
to develop the property as an extension of the Nottingham neighborhood with 51 single family
residential lots. The lots would be developed as Sections 9, 10 & 11 of Nottingham, comprising
approximately 171ots per section. The current Nottingham Covenants and Restrictions, including the
square footage requirements, etc.) will be applied to these lots.
We will begin developing the final19 lots of Nottingham this spring. This neighborhood has been a
great addition to the City of Troy. The price range of homes is averaging $275,000- $400,000 including
lot.
Rezoning the 25.4 acre property from Ag-Residential to R3-B is a benefit to the City of Troy for the
following reasons:
The rezoning will provide additional lot inventory for homes in the $275,000-400,000 price
range

Based on the current absorption rate in Nottingham, the 51 lots, once developed, would provide
approximately 4-5 years of lot inventory.
Rezoning to R3-B results in a lot density of 2 lots per acre
The Nottingham subdivision is zoned R-4 (9,000 s.f. minimum lots). The R3-B zoning requested,
requires larger lots that are a minimum of 12,000 s.f.
This extension of loxley lane will provide access to Troy-Piqua Road for current Nottingham
residents and will provide a second means of ingress and egress forth~ subdivision.
The rezoning will facilitate the looping of utility lines for the existing subdivision and future
development.

Rezoning and development of this property will provide for the future removal of the existing
sewer lift pump station in Nottingham.

ORDINANCE AMENDING SECTION 521.04 OF THE CODIFIED


ORDINANCES OF THE CITY OF TROY. REGARDING
SIDEWALK OBSTRUCTIONS; DAMAGES OR INJURY. AND
DELCARING AN EMERGENCY
WHEREAS, the Council of the City of Troy has determined that it is necessary and
appropriate to prohibit certain substances from being used on public sidewalks in order to
assure that the sidewalks are safe for the pedestrian traffic for which they were intended.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio, as
follows :
SECTION 1:

That Section 521.04 of the Codified Ordinances of the City of Troy,

attached hereto as Exhibit "A" is hereby repealed .


SECTION II:

That Section 521.04 of the Codified Ordinances of the City of Troy, Ohio is

hereby enacted as follows :

"521 .04 SIDEWALK OBSTRUCTIONS; DAMAGE OR INJURY.


No person shall place or knowingly drop upon any part of a sidewalk, playground
(a)
or other public place any tacks, bottles, wire, glass, nails or other articles which
may damage property of another or injure any person or animal traveling along or
upon such sidewalk or playground.
(b)
No person shall knowingly or recklessly spray, mark, brush, or otherwise place
upon any public sidewalk, any substance that cannot be readily removed from
the sidewalk with non-pressurized water and a broom and without damaging the
sidewalk. Such prohibited substances shall include but are not limited to paint
and sprays or chemicals that are silicone-based and/or identified as
"superhydrophobic" and/or marketed with names such as "WaterBeader" or
"NeverWet".
(c)
No person shall walk on, or allow any animal upon, or injure or deface in any
way, any soft or newly laid sidewalk pavement.
(d)
No person shall place, deposit or maintain any merchandise, goods, material or
equipment upon any sidewalk so as to obstruct pedestrian traffic thereon except
for such reasonable time as may be actually necessary for the delivery or pickup
of such articles, and except as provided in Chapter 717.
(e)
No person shall unload upon, or transport any heavy merchandise, goods,
material or equipment over or across any sidewalk or curb without first placing
some sufficient protection over the pavement to protect against damage or
injury. The affected area shall be rendered safe and free from danger.
No person shall allow any cellar or trap door, coal chute or elevator or lift opening
(f)
in any sidewalk to remain open without providing suitable safeguards to protect
and warn pedestrian traffic of the dangerous condition.
(g)
Whoever violates subsections (a) or (b) of this section is guilty of a misdemeanor
of the third degree.
(h)
Whoever violates subsections (c), (d), (e), or (f) of this section is guilty of a minor
misdemeanor.
SECTION Ill: That this Ordinance is an emergency measure necessary for the immediate
preservation of the public peace, health, and safety of the City of Troy, Ohio, and for the further
reason that the prohibition must be in place to assure that the sidewalks are safe, NOW,
WHEREFORE, this Resolution shall be effective immediately upon its adoption and approval by
the Mayor.

Major Project Update:


o Sidewalk Program 8 - work has restarted with the remainder of the
sidewalk marked for replacement. Once the contract is complete,
assessments will be finalized.
o Adams Street Phase 2- contractor is working on the bike path portion of
the project, and the bike path access ramp work will commence after the
Troy Strawberry Festival. The Hobart Arena Sign has been installed and
has been activated.
The Community Park fence railing has been
installed.
o Sewer Lining Project - Miller Pipeline has completed the relining in
Southview and northeast of the river. Miller Pipeline is also progressing
with lining of manholes in conjunction with the sanitary sewer lining.
Downtown manhole replacement is complete. Layne Inliner has
completed lining the Southwest Interceptor and a walk through for final
site restoration was performed.
o ODOT Paving - final ODOT Legislation was approved. Paving is scheduled
to commence after the Troy Strawberry Festival. Paving will occur during
the night between Sunday - Thursday.
Affected tenants are being
contacted with the help of downtown organizations.
o Water Tower - Council authorized an agreement for the design of a new
Extra High Service Water Tower with the firm of EMH&T.
The design
kick-off meeting was held and potential sites determined. The City
Engineer has contacted property owners to discuss the available
opportunities for water tower siting along Washington Road and West
Stanfield Road. Positive feedback on potential sites has been received.
Site analysis is proceeding by the design engineer.

o Curbside Recycling Program for FY 2015-2017 was awarded to Rumpke of


Ohio, Inc., the current vendor.
Under this new contract, we will be
switching to 65 gallon containers on wheels. It is currently anticipated
that these new containers should be delivered to the residents around
mid-July. Residents will be permitted to request a second recycling
container as part of this contract at no additional charge. This larger size
container will allow a resident to recycle more materials, so we hope it will
encourage more recycling. Also, as the container will have a lid, there will
be fewer incidents of the recycled materials blowing around. Because this
system is less labor intensive for the contractor, the new contract is only
a slight increase over the expiring contract cost, even though it is based
on more collection points. With these containers, the contractor will be
able to use an automated system of the driver being able to manipulate
the equipment to empty the container without exiting the vehicle. City
staff has held an initial meeting with the contractor to look at the number
of alleys where the recycling collection will need to be changed to street
collection due to the automated collection vehicles. There are a number
of alleys where recycling is currently collected that the automated
collection vehicle cannot be used due to the configuration of the alleys.
The City and the contractor will be working together to provide
information to citizens regarding the new containers, where they should
be placed (i.e. not next to a mailbox), and specifically working on the
communication to the residents where the collection site will need to be
moved.

It is officially Strawberry Season! The Troy Strawberry Festival activities start


Friday, June 5, at 6:00 p.m. with the Friday night activities and continue
throughout the weekend downtown and on the levee. It is hoped that the
weather forecast is for sunny days for the festival.

The Downtown Troy Farmers Market will begin on June 13 and will be located
on Cherry Street between Main Street and Franklin Street. This Farmers
Market will be open Saturdays for business from 9:00 a.m. until noon and will
run until September 19. The Downtown Farmers Market plans to have
seasonal produce, home-made bakery goods, herbs, honey, jams and jellies,
and artisan cheeses for sale.

We appreciate all the efforts for the Memorial Day holiday, especially the
members of the local veterans' organizations who provided the Memorial Day
Program, all who participated in the program, and all who were involved in
preparing the Veterans Memorial Park and the cemetery.

On May 28 the City of Troy was advised that the League of American Bicyclists
has awarded the City of Troy the Bicycle Friendly Communities Bronze
Recognition. The news release in this regard is attached.

CITY OF TROY AWARDED BICYCLE FRIENDLY COMMUNITIES BRONZE RECOGNITION
FOR IMMEDIATE RELEASE

At twelve o'clock noon, on Thursday, May 28, 2015, Steve Clark, the Bicycle Friendly Community
Program Specialist, will present the Bicycle Friendly Communities Bronze award to Troy Mayor Michael
L. Beamish. This presentation will take place in Troy Council Chambers. This award is presented by the
League of American Bicyclists.
There is an application process that requires a community to demonstrate achievements in five
specific categories to be considered for an award. The categories are: Engineering, Education,
Encouragement, Enforcement, and Evaluation & Planning. A description of each category is attached.
The comprehensive audit and application process is designed to yield a picture of a community's work to
promote bicycling. As communities reach more significant achievements in these five categories, there
may be a higher award. In recent years through the application and audit process, the City of Troy had
received "honorable mention" recognition. The award categories are bronze, silver, gold, and platinum.
In being advised of the bronze recognition for the City of Troy, Mayor Beamish commented: "I
am extremely proud of the City of Troy in meeting the bronze recognition criteria. This is a great stride
for our bicycling citizens. I wish to recognize and commend the efforts of City staff and volunteers in
promoting bicycling in the Troy community, and for achieving this recognition. While I have been
proud of our honorable mention recognition, it has been my goal that Troy works towards the higher
levels of recognition." Mayor Beamish also commented that: "An award by the League of American
Bicyclists is designated for four years. The City of Troy will need to continue to work hard to maintain,

Collected and transported 261 tons of residential trash since the last report of
257 tons.
Delivered recycling bins as requested.
Sign shop worked on various sign projects.
Asphalted 6 water services and 26 areas marked for repair.
Dura-patched over 150 areas marked for repair.
Made asphalt repairs with our infrared machine.
Repaired catch basin and concrete on Drury Lane.
Completed one round of our right-of-way and ditch mowing operations.
Collected T-bags and brush. Several letters were sent out for non-compliant
brush piles. We continue to remind citizens that brush must be bundled or
placed in T-bags in order for it to be collected by the city. We also are reminding
citizens that the Dye Mill Road Facility is open, and we offer that facility in lieu of
placing brush at the curb.
Cleaned the downtown area for upcoming events.
Delivered barricades and swept the cemetery for the Memorial Day ceremony.
Repaired the seam on west bound lanes of West Main up to the railroad track.

Water Distribution/Sewer Maintenance - Tom Parsons, Foreman


Marked numerous Ohio Utilities Protection Service tickets.
Investigated numerous high consumption alerts.
Completed a number of work orders for Billing and Collection.
Shut-off non-payment customers and reconnected as payments were made.
Upgraded water services on McKaig Road and on Ellis Street.
Repaired three main breaks, discovered by the leak detection company, on
Greenfield Drive, Miami Street, and Littlejohn Road.
Tested the new line on Oak Street and it passed.
Made eight- 1" taps on Nottingham Road.
Repaired the following hydrants:
o Experiment Farm Road and Corporate Drive, which were hit by vehicles;
o Linwood that was discovered by the flushing crew;
o Stonyridge and Skylark that was discovered by the leak detection crew.
Dug a line up for the Wastewater Treatment Plant and installed a 4" tee and
couplings.
Jetted and TV'd the sewer line on Adams Street; it was a county backup.
TV'd the sewer line on Shaftsbury for mapping.
Water Treatment Plant - Jeff Monee
The Carbonair Air Stripper was restarted after complete removal of all scale
deposits from the west transfer pump. Air blower output was reduced by
approximately 60o/o after inorganics sampling showed full removal of all
contaminants at these reduced air flows. The east transfer pump has been
removed and is being thoroughly cleaned of all scale. Modifications to tower
discharge piping and chemical feeds are pending evaluation of airflow
adjustments.
Well 17 control cabinet will be installed in the next few weeks following
construction of a new pad and mounting assembly. This control cabinet will be
raised two feet to remove any possibility of flooding at this site. This well should
return to service by the end of June.
Contractor will soon begin removal of 3,600 dry tons of lime residuals from the
west sludge lagoon. This is the minimum amount of annual removal designated
by the Lime Agreement initiated with the City of Dayton in 2014. Under the
agreement all costs for this sludge removal are covered by Dayton, saving the
City of Troy over $100,000 annually.
After no internal applications were received, the vacant WTP Operator position
has been posted externally and will remain open until the position is filled.
Tyler Henry of Covington has been added as the summer intern for the WTP.
Tyler is a student at Ashland University.
Wastewater Treatment Plant - Tim Snider
Completed the installation of soft starts on the aeration blowers. These devices
will temporarily reduce the load and torque in the power train, and electrical
current surge of the blower motors during start-up. This reduces the mechanical
stress on the motor and shaft, extending the lifespan of the system as well as
reducing peak power demands.
Made upgrades to the Wastewater Plant's SCADA radio system. This will
complete a project that was begun last year separating the two Plants' radio
networks and upgrading communication speed.

Completed replacement of the influent level sensor, which allows the plant's
influent screw pumps to again operate as designed with extra pumps coming into
service automatically as the incoming flow increases.
Michael Hinnegan passed his Class II Wastewater Treatment exam in May 2014
but lacked the three year work experience requirement until now. Mike is now a
certified Class II Operator and plans to take the Class III exam this fall.
Don Knife, the Plant's newest Operator, received his Lab Analyst I certification
this month and plans to take the Class II exam in the fall.

water main installation and testing is complete.
Contract was awarded to Finfrock Construction. All water main is installed. The contractor is performing punchlist
items prior to final completion including record drawings.

Contract has been awarded to Layne lnliners and Miller Pipeline. We will be notifying property owners as
Southview & NE River Sewer Relining necessary for this project. Layne lnliners has completed the lining of the SW interceptor and a walk through for final
SW Interceptor Relining
site restioration was performed. Miller Pipeline has completed relining in Southview and NE of the river. Miller
Pipeline is progressing with manhole lining in conjunction with the sanitary sewer relining.

This phase of the project is between the Adams Street Bridge and Staunton Road. Project was awarded to LJ
DeWeese. Underground utility work is complete. Stone wall work is complete and railing is installed. Contractor is
working on bike path portion of the project. Bike path access ramp will commence after TSF. Decorative poles
have been installed and are operational. MV Lighting has been contacted to remove the existing street lighting that
was used during construction.
Troy-Urbana intersection was completed on schedule and opened May 1. Final restoration and punchlist items are
being performed. Site distance issues to the north are being reviewed.

ODOT will fund a portion of this project. Design has been done by Poggemeyer Design Group and has been
MIA- Troy East Main Street Downtown approved by ODOT. Council authorized the AEB's recommendation of modified assessments and Council has
authorized the bidding of the project. Council approved an increased authorization at the May 18 meeting, and bid
Streetscape (PID 93240)
information has been forwarded to ODOT for approval. LJ DeWeese Co., Inc. is the low bidder for the project.

with the external tower cap work remaining. Canopy connection to the building is being reviewed.
Council approved bidding the project in an amount not to exceed $1 ,873,000. Awaiting MCD final approval of the
design. The project was awarded to Double Jay Consruction, Inc., and a preconstruction meeting was held last
week.

authorized bidding the project in the amount not to exceed $1,142,000. The contract is awarded to Finfrock
Construction Company of Covington, Ohio.
Council authorized an agreement for the design of a new Extra High Service Water Tower with the firm of EMH&T.
The design kick-off meeting was held and potential sites determined. The City Engineer has contacted property
Extra High Service (EHS) Water Tower owners to discuss the available opportunities for water tower siting along Washington Road and West Stanfield
Road. Positive feedback on potential sites has been received. Site analysis is proceeding forward by the design
engineer.

Water Regionalization Study

Council has authorized a contract with RA Consultants. Staff has submitted all requested information for
evaluation, Workshop #2 was held, and the project will continue. Staff and the consultant met with West Milton to
discuss details of their existing water system. A separate meeting with Miami County will be scheduled in the near
future when RA is ready to proceed with a similar Sewer Regionalization meeting.

ODOT Paving (PID 91802)

Council authorized bidding for the Phase 8 sidewalks where the property owner did not take out a permit to do the
work. Project was awarded to I. F. Weber. Work has restarted with the remainder of the sidewalk marked for
replacement. Once the contract is complete, assessments will be finalized.
Council authorized a paving program in the amount of $1 ,068,000. That amount includes paving of City streets and
other City properties. The contract was awarded to the only bidder, John R. Jurgensen Co.
Staff is working with ODOT regarding the paving along SR 55 on the west side of town as well as the traffic circle.
ODOT has issued the Final Legislation which City Council passed and our payment has been made. Paving is
scheduled to commence after the Troy Strawberry Festival. Paving will occur during the night between SundayThursday. Affected tenants are being contacted with the help of downtown organizations.

MV Lighting Street Light ContractStreet Light Conversion

Staff has started working with Miami Valley Lighting (MVL) and MVCC to determine the best way to convert the
City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS) street lights as required by law. As a trial,
LED street lights have been installed on Plum Street, Short Street, Adams Street, and along Shaftsbury Road at
Adams Street. Street light additions and possible excess lighting are being monitored in conjunction with the Police
Department.

Engineering Electronic File


Reorganization

Staff has been working with an outside contractor to make the Engineering electronic files organized in such a way
that all staff can have access to most documents. This will improve efficiency with document filing and is expected
to reduce the volume of space necessary to keep the electronic files. Staff is re-implementing project numbers as
well. Record drawings organization and personnel file clean-up continues.

Updating City Construction Standards Staff is working with Choice One Engineering to update our standards.
Collection of data continues.

GPS Data Collection

listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.

States that the neighbor at 1035 Frontier is putting
their dog excrement in trash cans with holes drilled in it and sitting the cans on the property line 10' from his house. He
stated you can smell it 2 doors away the odor is so strong. He also stated that kids have vomited when they've walked by the
cans because of the smell. Told him I would go out and inspect.
Explained that if there is no trash overflowing the cans, I
really can't do anything about it other than send a letter making the tenants aware of the complaint and asking them to
discontinue doing this. Also told him that if I smell anything, I will refer it to the health dept.

fiesta site. I spoke with Arturo fuentes on 5-13-15 and he said he would remove this and come in the morning of the 14th to get
