AFFIDAVIT/NARRATIVE
On 06/07/2015 at approximately 3:14 a.m. I, Deputy Ian McLaughlin was
dispatched to 351 Fairfax Ln., Greenwood reference a residential entry. The
call notes stated that the complainant woke up to find a white male in his house
wearing only boxer shorts, and that the male was now in front of his neighbor's
house. Upon my arrival a male walked out of the front door of the house and
pointed north down the sidewalk, and said that the suspect was walking in that
direction.
I continued north where I observed a white male walking on the sidewalk,
wearing nothing but boxer shorts. I stopped next to the male and asked him to
stop, which he did. I exited my vehicle and began speaking with the male. The
male verbally identified himself as Andrew Wozniak (DOB 09/26/1995). As I was
speaking with Andrew he continuously walked toward me, even after I had backed
away from him several times. I placed Andrew in handcuffs, which were checked
for proper fit and double locked, and told him that he was not under arrest and
that he was only being detained.
While speaking with Andrew his speech was slurred, his eyes were glassy,
and I could smell the odor of an alcoholic beverage coming from his person. I
asked Andrew if he had been drinking and he said that he had not. I also asked
Andrew if he had taken any medications and he said that he had not. I asked
Andrew to submit to a portable breath test, and he complied. Andrew tested
positive for the presence of alcohol with a BrAC of .106. I placed Andrew in
the back seat of my vehicle and returned to the residence of the complainant. I
spoke with the complainant, Andrew Banks and he told me that he was sleeping on
the couch in his living room when he was woken up. Mr. Banks said that when he
woke up he noticed the male standing in his living room, in nothing but his
underwear, eating his chips.
Mr. Banks said that he asked Andrew where he lived in an attempt to get
him home, but Andrew was incoherent. Mr. Banks said that after he got the male
outside he called the Sheriff's Office. Mr. Banks completed a written
statement, which is attached.
While transporting Andrew to the Johnson County Jail I had to advise him
of my name several times, because he could not remember it. I also had to
explain to him several times the reason why he was being arrested. On two
occasions when I advised Andrew that he was being arrested for illegal
consumption, he asked how I knew he was intoxicated. I would explain to him
that he tested positive for the presence of alcohol on my PBT, and he was unable

to remember that he had submitted to the PBT. Andrew also told me several times
that he was going to get my name "out to his boys", but when I asked what he
meant he would not elaborate.
Once at the Jail the Jail staff requested that I transport Andrew to
Johnson Memorial Hospital to be checked by the medical staff. While at the
hospital Andrew was extremely belligerent, including yelling profanities which
could be heard down the hall and in other rooms. Andrew was asked to be quiet
several times, but he would not comply. On two occasions a Doctor entered
Andrew's room and asked him to be quiet. After Andrew was released by the
doctor, myself and several other officers walked him out of the hospital to the
Jail van to be transported back to the Jail. Correctional Officer Potter and I
were on either side of Andrew when he stated "I'm going to snap both of you at
the same time." Andrew was placed in the jail van and transported to the
Johnson County Jail, where he was remanded to the jail staff.

during this investigation, but rather is provided solely for the purpose
of establishing probable cause in support of the complaint in this
matter.
