Trespass to dwelling
Art. 128. Violation of domicile.
any public officer or employee who, not being authorized by
judicial order, shall
- enter any dwelling against the will of the owner thereof
- search papers or other effects found therein without the previous
consent of such owner, - having surreptitiously entered said dwelling,
and being required to leave the premises, shall refuse to do so.
Crimes Against Security
Art. 280. Qualified trespass to dwelling
Any private person who shall enter the dwelling of another
against the latter's will. by means of violence or intimidation
PENALTY
Minimum 2 years, 4 months and 1 day maximum of 6 years
and a fine not exceeding 1,000 pesos.
Bail required P12,000.00
You have the right to refuse entry to anybody, especially collectors.
Ask them WHAT IS THEIR BUSINESS ( more often mag-dala lang ng 1/4 piece of
paper yan)
If they request entry, ask for:
1.Their authority from the supposed collection agency
2.Appointment of their Collection Agency from the bank

3.Board Resolution of the bank authorizing such appointment


marami pa - ID,Statement of Account duly signed by authorized
signatory of the bank,etc.and etc.
Normally WALA silang maipakita. Conclusion? they are just there to harass you and
milk money from you and its EXTORTION/FRAUD/ESTAFA/DECEIT:
Revised Penal Code states :
..By means of any of the following false pretenses or fraudulent acts executed prior
to or simultaneously with the commission of the fraud:
(a) By using fictitious name, or falsely pretending to possess power, influence,
qualifications or imaginary transactions, or by means of other similar deceits.
(b)By inducing another, by means of deceit, to sign any document.
Art. 318. Other deceits.
any person who shall defraud or damage another by any other deceit not
mentioned
Penalty? why, kulong, of course!

Be it a reminder to all collectors and trespassers:
1. As per Philippine laws, pag kayo nabaril dahil nag-trespass kayo sa isang bahay,
LIGTAS ang may-ari ng bahay sa demanda.
2. Pag kayo nag-occular o nagmanman secretly, discretely, or against the will of the
owner of the house, you can be sued for INVASION TO PRIVACY and/or
TRESPASSING. Even for taking a picture of a house without the permission of the
owner, YOU ARE LIABLE.
3. Bakit kayo nago-occular? Without court order, DI RIN NAMAN NINYO MAKUKUHA
ANG LAHAT NG MAKITA NYO SA OCCULAR! Huwag kayong magpakilalang SHERIFF

kasi alam namin dito na ang SHERIFF representante yan ng KORTE at HINDI NG
AGENCY NINYO na gusto ding kumita.
4. Nawalan kami ng SAPAT NA KITA kaya kami hindi nakabayad. At the time we used
our credit cards, we found it manageable to pay our dues. Banker is right when he
points out that an "immoral debt" is a different story.
5. DO NOT ACT as if you are the bank. We know that even if the banks have written
off our debts, YOU WILL NOT STOP COLLECTING.
6. Your harsh collection practices are the reason WHY YOU ARE BEING IGNORED. If
you only employed a more professional approach, WE WOULD CHOOSE TO TALK TO
YOU.
7. TANUNGIN NYO MUNA SARILI NYO kung wala ba kayong mga utang BAGO NYO
KAMI MURAHIN. Kasi kung pareho pala tayong may utang din, pag mumurahin nyo
kami, WE WILL GLADLY RETURN THE FAVOR.
8. Lastly, WE DON'T INTEND TO RUN AWAY FROM OUR OBLIGATIONS. Pag meron na
kaming maitabi PAGKATAPOS MAKAKAIN, sino bang di gusto magbayad? However,
we would like to talk to the banks AND NOT YOU, COLLECTORS. Even the bank itself
apologizes for your RUDE practices.

Your site is very helpful.. I accidentally discovered it today while searching sa
meaning ng CREDIT ESTAFA which a certain Mr. Charlie blah blah ang citibank
threaten to file a case daw against me for missing my credit card due for merely two
months..
Since it is my first credit card medyo kinabahan ako talaga.. he is asking for like
5,000 pesos to be settled daw within 1 day or else..
Theres no way i can scrimp up P5000 in just 5 hours he will be calling me before the
bank closes kung nakapagsettle daw ako...
i guess after reading your whole blog i would just have to say wala talaga akong
pambayad. At hihintayin ko nalang ang Credit Estafa ko whatever!!

you have said it right and complete, nawa maintidihan ni kolektor at ni anonymous.
wala kaming baril pero may aso kami dalawa at di pa nainjection ng anti rabies,
naku wag silang pumunta sa bahay kasi baka kagatin sila, mahal pa naman ng
gamot at injection.

Hayyyyy Hulog ka ng langit..
I accidentally stumbled upon your blog while desperately searching for the meaning
of CREDIT ESTAFA which a Charlie Blah-Blah from Citibank threatened to file against
me for missing my credit card due for merely two months.
Medyo kinakabahan padin ako kasi 1st ever credit card ko eto. He is asking me to
pay up like P5000 within the day. Sa isip ko lang it is impossible for me to scrimp
P5000 in such short notice!
Sya na nga ba si dreaded COLLECTOR?? whew.. whammy kasi pag sya na nga ill
have the time of my life mamaya habang kausap sya (nakakatakot kasi boses nya
sa phone bwehe)

thanks ulet sayo banker at least nawala ang stress ko kakaisip ano nga bang
magiging kaso ko..

thanks ever so much for the recognition. I think I still had a lot of comments on your
previous posts, remember the threat of arrest na kamuntik ako mabangga while
driving, ako po un (Six Cards).

Guys, FYI, I found out about this when I visited a friend living close to my previous
rented place (the first of my three houses).
i was told that "Citibank" was harrassing the new occupants of the house that I first
rented - the address that I registered at Citibank. I did not renew the contract of that
house, but apparently, the phone number, even if I've had it canceled at Citi when I
was still in good standing, ginagamit pa rin ng agencies to harrass the the new
occupants.
It so happened naman na pulis (Major) ang new occupant, together with his family.
They were so disturbed by the harassment kasi minumura sila ng kolektor na
nagpapakilalang Sheriff.
So the Major (he was so pissed din kasi MAY NAG-OCCULAR)threatened the agency
na pag sila nagpakita pa sa bahay nya, uubusin nya sila at raratratin nila ng mga
tao nya. Yes, he and his men did wait one whole morning, the day mentioned in the
call. Pero walang dumating.
Aparrently, after the threat was given, these guys stopped.

I have the same experice with EJ. I moved out from the 1st house I've rented
(actually, studio type na room lang un) for more than a year na. It so happened I
was not able to change the billing address of my cards (fortunately or
unfotunately?). Anyway, when I visited my previous landlady she said that there
were some people who came to visit them and asked about me. My previous
landlady told them that I've moved out already tapos kinuha nila name ng landlady
ko or kung sino man ang makausap nila. Some of them (collectors or messengers)
naman, just threw the letters at the gate bcoz they were informed already by my
previous landlady that I am no longer staying there and they refuse to receive the
letters.
Nahiya naman ako sa previous landlady ko bcoz of this incidents.
Baka pati cla maharass din.
Banker, ano po ba mangyayari kung di nila ako mahagilap?

Need everybody's advice:
Early this year, I entered into an agreement (via telephone) with a collection
agency/law firm to settle my long-standing credit card dues.
Ang kaya ko lang po ay 1k per month at mukhang acceptable naman sa kanila dahil
every month ay ina-acknowledge nila ang receipt ng aking deposito.
Last month, may sulat ang vice president ng credit card company, sinisingil ako sa
bouncing checks na previously issued, na ngayo'y akin namang sinusubukang isettle kahit paunti-unti.

Tapos, may ibang law firm na sumulat sa akin at ipinapasagot sa akin ang bouncing
checks.
I reported this to my handler/account officer, who told me that I should disregard
the bouncing checks-related demands altogether, since I am already in agreement
with their agency/firm.
Besides daw ay 2004 pa ang mga checks na ito at ang dapat kong sundin ay ang
aming current agreement.
Recently, my handler's agency/firm stopped communicating with me. Sabi eh
automatically tinanggal na sa jurisdiction nila ang account ko at may iba pa akong
standing loan sa same bank, which I really don't have.
Ayaw na rin akong kausapin nu'ng handler ko. The last time we talked, the handler
made me think that there was going to be a case filed against me.
Ano po kaya ito, for the bouncing checks I issued a long time ago, but which I am
trying to religiously replace through the current agreement?
Ano po ang dapat gawin dito, gusto ko pong ituloy na magbayad hanggang fully
settled ako, pero sino ang tatanggap ng payments ko kung wala naman na ang
aking account officer?
In case kasuhan ako, paano ko sasabihin na wala naman akong intention to defraud;
in fact, regular na nga ang payments ko kahit mas maliit ito kaysa sa dine-demand
sa akin?
Please help me, I am really confused. To be fair, ang galing nilang mag-torment ng
mga tao.
Ano ba'ng action laban sa ganito na ginugulo ng kung sinu-sino ang standing
agreement? Lalo pong naco-complicate ang situation.
Meron na po bang natulungan ang regulating bodies ng gobyerno tungkol dito, kung
meron nga talagang regulating bodies ang gobyerno?
My immediate concern is to continue paying, so I won't be faulted for reneging on
my obligation.
Please help me.

same fate with others.got 2 cc both from the former pcibank since 2o04.when
"famine" hits us i called the bank n told them to just cut off n lang my cards then il
just pay ung kaya ko lang.d cla payag kaya i stopped paying n lng since
Aug.2006.ayun leftnryt dn calls n pnnkot sakin.Nplitan n lag tlg ako pay kc sobrang
lumobo na int.Ung isa from 70t naging 136t agad n d ader one from 90t naging 160t
agad.honestly lam mo banker kung san ako ntkot?dun sa SOA ng collection agency
cum lawyers kuno kc from 136t naman from the bank naging 236t s knila n from
160t from the bank naging 260t s knila.Pay n lang dn po ako halos maloka ba
naman ako kaiisip n bka makulong ako pano n lang mga kids ko.Again i started
pying 5t each card startng April 2007.Nung nwala ang pci la na rin akong narrcv na
SOA from the bank since then.pero pay pa rin po ako tg 1t mo. til last june kc cge pa
rin po pdala ang arteche etc... sakin as well as calling tru r landlines n my cp.Until i
saw ds blog of urs sir.Knina calln txt n nman po sila do i have to pay pa rin po ba

its been 2 months or three nung last post ko...di na ko gaano nakakabasa ng blogs
mo kc naputol na internet ko..hehe
just this moring,,,me pumunta daw sa bahay ng mommy ko,,kc un permanent
address ko saying he is from metrobank,,nag uupdate lang ng files ng clients...he is
polite nad all,,kaya lang faurd pa din,,,binilin ko na kc sa mommy ko to ask for an
official id,,,when did that nagcram daw,,didn't know what to say,, nagpakiklala
joshua daw but doesn't have a surname,,, my mom is quite old so she told him to
write his complete name if he doesn't have an id,,di na daw bale,,he just left a
number to call ko daw..after reading ung bawal pumasok,,naenlighten po ako..what
a relief,,desperado nga sila,,,kaya lang nakakhiya din kc baka kung ano ano ang
pinagsasabi nun sa bahay,,eh medyo respetado po kami sa community,,lalo na
mommy ko,,and another concern is may sakit sa puso mommy ko,,, is thre anthing i
can say to them,,they are responsible for their actions,,baka may mangyari sa
mama ko kakaharass nila... what do you think po...i am thinking to call them early
bukas to point out to them that if they continue harassing my mom and somethign
happens to her,,they will be liable... can i do that..tnx po

Hello Sir Rene..I guess it was an answered prayers that I came upon your blog.
You see just a while ago, I received a text message na may nakafile na raw na civil
case against me. But wala namang info kung sino nag send or san landline ako
tatawag to verify (or beg?).
Prior to this, a collecting agency na just a block away from my house came and
gave me an amnesty letter.
Knowing masama rin naman po talaga di magbayad ng utang and to clear my
conscience, I would like po sana to settle this matter in a manner na "win-win"
situation kami pareho ng bank (i mean po, sa paraan na kaya ko lang mabayaran at
the moment.)i entertained the two ladies sa house and i honestly told them my
situation, im unemployed, blah, blah, blah..halos talagang magmakaawa ako na
pumayag kahit 500.00 a month lang ang bayaran ko (my outstanding balance raw is
36,000.00 but when i received a bill again from the bank it was for only 26,000)
bibigyan raw nila ako ng palugit they'll suggest to the bank to give me atleast a
month to settle my credit limit of 15,000 nlang raw. But I begged for atleast 2
months para makahagilap ako ng said amount. It was saturday. Monday came and
boy I was surprised, when their big boss wrote a letter that i have to settle the 15T
in TWO days!! na praning po ako, naintindihan ba nila situation ko.I know my
obligation, and Im willing to pay but hindi ganun kalaki. It was my hubby's
suggestion to check sa business permit bureau kung registered nga sila, and i was
surprised again na nagooperate pala itong collecting agency, without a business
permit (was it legal for them or not? the bureau suggested that I file a complaint
against the collecting agency but ayoko na ppo na gulo at sakit ng ulo). Im not sure
if na visit na sila from the bureau of permits from the city hall, but i guess natakot

rin sila kasi tinigilan na nila ako but then i guess pinasa naman nila sa iba ang info
ko. So i have to stick again to the harassments of this Domingo & Molaer group.
Hay, please pray for me, ayoko po ma-stress since I'm on my last trimester of
pregnancy.

1 lang ang card na problem ko as of now pero 80 thousand pesos na outstanding
balance , So as a resulta. di na kayang bayaran. minimum amount lang parati. so
hirap na. daig ko pa ang butas na alikansya.
nagpaparestructure ako kung ano ano sinasabi sa customer support. gusto payment
in full. HELLO wala ngang pambayad eh.inuubos na nila sa interest.

ADVISE NOT TO REMOVE, DISPOSE, SELL OR TRANSFER your real and personal
propeerties nor to withdraw your bank deposits or your salaries and wages. For
immediate withdrawal of the case we are giving you 24 hrs to coordinate with Atty
Percival Cendana at (02)4110100.
Is this legal warrant thru text?I received this text last Jan 7, 2009.Wal apa akong na
receive na letter from them.

Meron akong utang sa standard chartered bank nung nagki pag usap ako sa kanila
i'm asking for my balance showing the principal and then the interest for I haven't
used my CC more than a year. Nag total na sya ng 30k plus.
Please advise me what to do. Short ako sa budget ngayun may karapatan ba silang i
hold ang salary ko.
Please enlighten me.

may ganyan din ako case sa HSBC di ko pinansin tapos nagpadala pa letter same
halos s txt nila di ko pa din pinansin kasi pinakita nila sakin ang legal n warrant..and
hindi daw gnun ang nilalaman nun parang invitation daw s isang court at nkasealed
un ng isang brown envelope n my snsabi a sila itsura ng sealed..and if u recive that
dapat magpunta ka..pero sabi nila wala pa nmn gumagawa ng gnun as per MY HR
Manager..

hi banker,
Been reading your posts for quite awhile. Like everyone else here, I have been
receiving letters and 1/4 sheets from DMLO.
I just got off the phone with them so I questioned them about the so called ocular
inspection, and followed your instructions.(I'm not usually at home, just my dad
which is unfamiliar on what to do). I politely and discreetly made him feel i know the

rules (via ur guidelines).


I discussed with him what I think I initially owe the bank and he admits to that. He
claimed the outstanding bal he is asking me to pay off includes attorney's fee.
He told me if I could make a deposit of 2000, they will waive the interests and just
pay off what i really owe, and pay in increments. I'm not really comfortable about
that because it happened before (with a diff collections agency and before knowing

advise me? From there, I am unsure what to do.
DMLO is the worst. Everyone else has given up except for this one. And tough that

so, i finally got the proposal from a certain Leandro Gonzales, a claimed Legal
Officer of Domingo Molaer LO. The proposal says the usual, pay in increments. There
were affixed signatures but from an acct supervisor, and a name over the tag, "for
the firm" (when in question, Mr. Gonzales claimed that the name appeared thereon
is their lawyer--the signature does not show any PRC# or something to identify as a

legal lawyer). The letter did not come dry sealed nor notarized.
I called the number stated in the letter, and looked for Mr Gonzales. He does not
know one by the name and claimed baka sa ibang dept. He gave me another
number to call, ganon din. i called back then I started probing, "anong company po
ba ung tinatawagan ko?" "san po ba located to?" He said, ano ba sa tingin mo
tinatawagan mo?" Sabi ko, "Sir, nagveverify lang naman po, wag kayong magalit.
(hehehe). Then he quipped, "(mumbling) Domingo Molaer. me 500 employees dito,
di ko kilala hinahanap mo." E di sabi ko, "500 po ba? Andami pala. (Wow, parang call
center). E di sigurado me reception kayo o tel operator man lang?" As expected
binagsakan ako ng phone.
So finally nagsawa ako kakatawag, nag ring naman phone ko. Ayun, si Gonzales na.
Me nagsabi daw kase sa kanya me naghahanap sa kanya. Usap ulit.
I told him what I think is wrong (or right) about the letter. And as you have advised,
ask for SOA. They're showing I owe 50k, reduced to 40k, 10k difference pa din. Sa
kakahingi ko ng SOA, wala daw sila nun at di daw i iisue un ng bangko til the civil
case (accdg to him RA 8484) is filed for security and confidentiality purposes. E ako
na nga ang nagre request. At the end of it all, lumabas din sa bibig nya na 29k lang
naman talaga nagamit ko. We can settle with that amount kung mabibigay ko by
the end of the month. Musta naman?
E mas madali ata ipunin un at bayadan ng buo kesa magbayad ng doble. un nga
lang, nanggigipit sila sa time. Pero like he said, un ung due date nila sa bank, so
most probably malilipat ng ibang collections agency at panibagong amnesty
program ekek na naman un. And the letter states pa na it takes 1 month before
they can issue you the certificate of full payment.
Sorry po sa mahabang post, fresh pa kase ung paguusap namin kaya in full detail.
So banker, di daw nila mai issue ung SOA. I've read this before but need to double
check (ganon talaga pinoy, makulit, sorry na po!) should i do this in writing (req for
SOA) and send to the bank (or the law firm?) via registered mail?

Laking pasalamat ko po sa kaofficemate ko when she gave this blog to me. Nabasa
ko po halos lahat ng mga experiences ng mga cc victims. Talagang pong nareleive
po ako sa sobrang takot. In my case, everytime na may naghahanap sa akin thru
phone or may nagpupuntang ca sa bahay at office, i instructed our lobby guard at
mga tao sa bahay na sabihing wala ako o lumipat na ng bahay. Sinunod ko po ang
magic workd na "SUE ME". Ang nangyayari po lilipat lang ng ibang CA, then office
and house visit na naman ang bagong CA. Dasal ko lang matapos na ang pasa-pasa
sa different CA. May intention naman po akong magbayad kaya lang talagang gipit
na gipit pa rin ako. Sa tingin po ba ninyo mga ilang CA po ang dinadaanan ng isang
cc account?

Thank you very much for the reply. Actually po isa-isa ko na pong sinesettle lahat ng
cc ko without coordinating with ca, kaya lang yung iba pang cc di ko pa
nababayaran yun ang mga makukulit na CA. Ms. Hopefull, bayad ko na po yung 1 cc
ko sa bdo last sept. 2008 pa, up until now di ko pa rin narereceived ang certificate
of full payment at meron pa ho silang charge na 100 pesos for processing. I made a
lot of follow up for the certification. Sa ganito po bang case, pwede po bang
magsumbong sa BSP o san kaya pwedeng agency magsumbong sa bagal nilang
pag-issue ng certification

Your site is very informative. I also have problems with chinatrust loan. Nag loan ako
nung June 2005 thru my company. Amount is 34k only. The amortization deducted
to my payrol monthly is 656.71 only. When I received my payslip, I asked the
chinatrust bakit ganun lang yung amount, nagtaka din yung mga nakakausap sa
customer service kung bakit, pinapasa pasa lang ako sa ibang tao na di rin
makasagot sa mga tanong ko. The deduction went thru until aug08 when I asked
our hr to stop the deduction. Hindi rin nila alam bakit ganun lang yung amount kasi
nagresign na yung nagprocess nung loan ko. Nag follow up ako sa chinatrust,
napudpud na daliri ko kakatawag sa customer service (corporate division), i even
emailed them kasi when i called di nila ako masagot, hindi raw nila maacces and
data system nila kasi rebooked daw yung account ko. kung susumahin nasa 9k na
lang dapat utang ko pero sa kanila as of today nasa 35k na! Halos monthly may
nakakausap ako since nov08, babalikan daw ako asap after i explained the long
story. Until june08 na tinarayan ko yung chinatrust customer service kasi tawag sila
ng tawag sa office monthly, explain naman ako ng explain again and again. di
naman nila ginagawa yung hinihinigi ko. willing na nga akong bayaran ng buo yung
balance basta tanggal lahat ng interest, hayun, finorward nila yung account ko sa
collection agency. kainis, ako na nga itong willing magbayad, ako pa napipirwisyo.
wala na akong work ngayon, naninigil na naman yung bagong collection agency,
ano gagawin ko banker? - evie

Hi! I have an unpaid credit card bill from citibank. They are saying through text that
Police will drop by to pick me up at home and they are filing a case of estafa. I have
so many debts that came my way since I am the only one working for my family. my
5 kids all depends on me. I have evaded their calls because they call not just once
everyday and it's kinda annoying but now I am scared because I don't want to go to
jail for it. I close my light when I'm at home, I lower the volume of the tv so no one
hears and even tells the kids to lie for me to tell anyone who's looking for me that I
dont live there anymore... I owe them 33,000. I would pay if I have money but I
don't..I really am so broke. What do I do...Please let me know.

Greetings and hello to all posters.
I just wanted to share the ordeals that I went through that I appropriately call my
"dark days".
To start, I can sympathize to those that are hiding from creditors/CAs because of
financial setbacks that they are currently experiencing.
I was in deep financial s**t starting around 2000 to 2005. It started when I tried to
go into a business venture with my wife that eventually failed. I also I did not know
that I was living beyond my means, hence the problem snowballed. Patung patong
credit card bills ko, i had outstanding loans that I took from a bank, my friends and
other family members. In short, kaliwa't kanan ang mga naniningil sa akin ng
walang tigil. To survive, our lifestyle took a dive and had to make do on a day to day
basis.
But slowly I put my finances back on track. What had it going for me was that I was
and still is employed. I had committed myself to rebuilding my personal and
financial standing, I promised myself that I will not be remiss in any payments that
is due and should be debt free by 2010. BUT I will not be paying those loans/bills
that were accrued during those dark days, kumbaga GOING FORWARD, walang
utang, kung may utang magbayad!
At present, I am now 37 years old, and:

1. My wife and I have an insurance policy in place,


2. I have savings stashed, less than 100k lang, but better than having nothing.
3. I try to save 10k every month. this is for future expenses eg. tuition, emergency.
4. After savings we make do kung ano man ang matira sa salary ko.
5. I have a postpaid cellphone plan, globe internet and other utilities. Every month
paid in full.
6. I got a secured/prepaid credit card with a limit of 11k that I use for paying those
bills.
7. My wife was given, repeat, given a BDO credit card (20k limit) w/o any CI done.
Our theory is that she was able to maintain a savings account without going under
20k for the past 2 or 3 years. What's funny is that mas malaki pa credit limit niya
versus my Unionbank. Hers is unsecured pa hehe. We use this only for groceries. My
wife and I are very, very wary of our spending habits.
8. I currently have a chinatrust salary loan since 2006 which will be fully paid in
2010 (na renew kasi).
9. my three kids have a savings account of their own, which I don't 'make hiram'
anymore.
Apologies muna sa lahat at baka medyo mayabang ang dating ng monologue ko. My
point is that financial freedom can be achieved if you are committed and focused.
I'm lucky that my wife and I had the same goal in mind. Nagtipid kami, naghirap at
ilang beses napahiya. We did what we had to do to straighten our lives for our kids'
future.
There IS light at the end of the tunnel, Corny man pero totoo, in my case anyway.
To make it clear, I am not yet out of the tunnel, tanaw ko pa lang. Again I am still
not debt free and my savings is not yet three months worth of my salary (minimum
daw accdg kay Mr. Colayco).
Ang problema ko na lang is that, I am in a position to pay back those "dark days"
loans kahit installment lang, just so I can clear my name for Credit worthiness' sake.
Is this wise? Should I do this or just forget it and invest/save na lang ung dapat na
ibabayad ko? reason I'm asking is that my wife called and said na meron na namang
bagong CA na nagbigay ng sulat kay misis threatening so sue, get our property, etc.
blahblah. Wifey is medyo matatakutin so I said wag pansinin and I'm going to show
her your blogsite the moment I get home. I already printed your BAWAL PUMASOK
posts so she knows what to say when they come to our house again. Better get a pit
bull just to be sure na rin hehe.
It would also have helped if there were personal bankruptcy laws here sa pinas.
meron po ba mr. banker? It was an option I was willing to take back then kasi.

PS. I'm not the churchgoing type unlike my kids but I made it a point to thank HIM
before 2008 ended. He had a hand in it so give credit where credit is due.

other concerns beset me and I have just been consistently throwing my demand
letters straight to the trash. I do appreciate that my last comments were posted
again on this 2009 entry, and that I am still remembered in this helpful blog. At any
rate, I would want to revive my link with you guys because, still, I haven't really
gotten out of my credit card debts and I owe my peace of mind (despite
everything)to this blog. Tumatanggap pa rin ako ng demand letters, nire-receive ko
pa nga ung iba, pero deadma na lang. Hehehe. I still do plan to pay all my debts off,
though, when time comes that I have the money. I have transferred to a different
default blog site but you will see the links to all my blogs which I still maintain from

i have 2 hsbc card and well, i haven't been able to pay them kasi talagang wala
akong pera, wait ko sister ko pay niya kasi sya nman gumamit pero wala din sya
pera. Enzi started calling me 2 weeks ago at talagang everyday yan tatawag at
tatawag sila. I was supposed to settle the amount last March 2 kaso wala talaga, I
am not running away from my obligations kaya nga gumagawa ako paraan para
mabayarn sila. sa last text ko dun sa len tolentino, sabi ko magconsult ako ng
lawyer tapos text back niya_"sige magconsult ka para makausap din ng lawyer
namin. I have been having sleepless nights dahil dito kaya di ko na alam gagawin
ko. banker, pls give some advice. thank you so much.

hi banker my father is an ofw.. never ko po nakitang gumamit ng cc ang father ko
and isang araw nalang po meron ng naniningil samin bank daw po sa ibang bansa
and meron daw po utang ang papa po.. ngulat nalang po kami sobrang laki umabot
daw po ng hundred thousand because o the big interest at hangang ngauyon hindi
parin po matapos2, actually sa sobrang takot po namin ng mama at lola ko

may mga na-recieve ako letter from collectors at binibigayan ako deadline to pay
my utang sa hsbc
pag hindi ako nakabayad on that day kakasuhan ako ng RA 8484 eh fraud yun at
ako naman ang cc user st billing add ko yun pa din sabi ko naman sa kanila tapos
personal properties ko kukunin nila eh tv lang at ref. pwede ba sila manguha ng
kagamitan ko personal? eh wala nga ako kotse at sariling bahay, sa nanay na bahay
ko kasi naka-billing address. 6months to 10 years pa daw ako pag nakulong?

Hi Banker!
I'm doing a thorough read of your blog and posts and I also approached a friend to
ask of what to do if may mangungulit na CA. She told me to tell my parents and
work place na wala ako and/or I quit from the company and/or I transferred to
another home. In short, taguan and hide from them. Instead of "avoiding" calls, it'll
be like "hide" from calls.
What I wanna do is accept their calls and face them. It shows na hindi ako takot sa
kanila and I know my rights. Tama ba yung plan ko na gawin? Instead of hiding, I'll
face them up front? Or it's better na sundin yung suggestion ng friend ko?

This afternoon a girl from "EASTWEST BANK" told me na pag di daw ako nakapag
settle sa monday ng unpaid balance ko mag o occular/field inspection na daw sila..
d na ako natatakot... They can do whatever they want... Wla naman akong property
na pwede nilang kunin saken tsaka lagi naman akong wla sa bahay... kung sa
opisina pa makikita nila ako... Hehehe! Thank you po talaga sa mga nag-share
tungkol sa mga di na makabayad na cc holders tulad ko...

Hi,
Firstly, thanks for this very informative blog site.
I want to share my experience 3 years ago when an unexpected collector (with their
"CI") came to our house. Since I didn't know about this "trespass to dwelling" law, I
left with no choice but to entertain them. After telling them my incapacity to pay,
and when we were about to close our conversation, the collector handed me a piece
of a 1/4 sheet of paper (with blank fields in it) for me to sign to recognize their visit
and our face-to-face talk. And, because of so much tense and nervousness, I lost my
senses for a while and signed above my name WITHOUT even reading what was in
that paper. Only when they left that I realized my stupidity. (A lesson learned, I
know.)
The good news is, I have not been bothered and/or harassed by the CA for about 3
years now since my stay here abroad. Although there are still letters sent to our
house, which are unopened and unconfirmed if received.
My concerns:
1) What possible strategy they could use from that signed piece of paper against
me?
2) If I remember exactly, I used a different signature (my married signature) not the
signature I used in my cc application form or any of my cc documents. Do you think
such signature is valid for whatever purpose it may serve them against me?
I'm worried now because I will go back to the Phils. very soon, although I will not be
seen at the same address anymore, but the messenger can still drop the letters at
my old address.
Please enlighten me.

hi,
buti na lang nakita ko tong site nyo. hay,savior talaga! here's my situation, I had a
cc from RCBC. hindi ko na po nabayaran since last december. ngaun starting
february may kumokontak sakin na collections agency,kesyo law firm daw sila at
idedemanda nila ako. i changed my phone number so stop na din ang
communication.kaso last tuesday sabi ng tita ko may mga pumunta daw sa bahay
namin (nakikitira ako dati sa tita ko at yun ang address na dineclare ko sa rcbc) na
mga ocular inspectors.may binigay daw na letter at sabi i have until this friday take
care of my debt. 15k ang utang ko. sabi pag hindi daw ako nagbayad kakasuhan ako
"under the new law", naisip ko lang, my bagong batas ba about cc collections???
may iniwan silang contact nos. and im seriously thinking about calling them back
pra makapag-settle kasi nahihiya ako sa tita ko,sya ang nahaharass. sya lang kasi
ang naiiwan sa bahay kaya sya lagi ang nkkausap.tapos maghahatak daw sila ang
gamit, e hindi ko naman gamit yun,sa tita ko yun,baka mahatak nila.kawawa naman
ang tita ko. yung mga dineclare ko kasi na gamit nasa bagong apartment ko
ngayon. natatakot pa ang tita ko baka daw kasuhan ako. gusto ko din naman sana
iclear na ang utang ko.kaya lang gusto ko sana sa bangko mismo magbayad at hindi
sa collection agency.pwede po ba yun? makakapag settle pa din po ba ako sa
bangko kahit na-write off na ang cc acount ko? ano po ang dapat gawin ng tita ko
kapag may pumunta ulit at maghatak ng gamit sa bahay? salamat po.

First of all, medyo iwas tayo comment using "Anonymous" kasi commonly di sha
napapansin ng members and ni Banker :D
With regards to your problem, una mong gawin is sabihan mo mga tao sa bahay
niyo ng issue mo about your cards. Kelangan aware sila na may mga CA talaga na
bongga mang-harass. Ano yung "Under the Law"? Ayus ah... As for your question na
mangunguha sila ng gamit, as long as walang proof na nakapangalan sa iyo yung
property or items, wala silang "K" na kunin yun. Since you're living with your tita,
mas lalo silang walang karapatan kasi di sila pwede manlimas ng gamit UNLESS sa
iyo nakapangalan yun (which is something na mahihirapan sila i-prove). Can you
imagine? 15k DAW utang mo then ano kukunin nila sa house? Electric Fan? And may
mga proseso pang dadaanan before nila magagawa yun.
Sabihin mo sa tita mo, wag sila papasukin and if nambastos sila or namilit, pakuha
mo name, company and other details then sabihin mo, sila kakasuhan for
trespassing. Better, kunan sila ng picture para matakot mga mokong. Commonly
naman kasi if may mga nagpupupunta na CA sa bahay or office, magaabot lang yan
ng papel then sasabihin to call whoever there is to call then pagtumawag ka, same
spiel and paikot-ikot na conversation. Kakapagod lang. Then sabihan mo rin tita mo
and mga tao sa bahay na wag ibibigay new address mo. Hayaan mo sila maghanap.
Dun naman sila magaling. Mag-"research". HeheheLaw firm ba kamo? Meron bang mga attorneys or law firm people na uubos ng oras
na mangolekta ng pera sa defaulters KUNG meron silang ibang mas mahalagang
kasong hinahawakan? Collection agents lang yan. Ginagamit lang law firm para
matakot and mansindak.
Good luck sa yo. Keep on reading to learn more diskarte. Wag ka basta-basta
matakot. Marami kami nadaan diyan. Basta stand on your ground. May mga CA na
wagas mambastos and manakot.

May tumatawag po sakin for the past month from Anovuevo.. okay naman
makipagusap, kaya pinilit kong magbayad nung nagpagkasunduan naming
payment. Kaso kanina, naging clear sakin na ung nauna ko palang binayad ay
nabalewala na dahil lampas na daw ng 1 buwan kaya nareset at balik sa 'amnesty'
na bingay daw ng banko. Na high-blood ako sa narinig ko, na ung pinaghirapan kong
ibayad sa kanila ang nawala parang bula.
Ano po ba ang pwede kong gawin, pwede ko po ba tawagn ang banko para ibalik sa
knila ang billing sa card ko?
Totoo po ba na walang saysay ung naibayad ko na last month?

Malamang sa malamang, walang magpapakita diyan. The same thing happened to


me quite a lot of times na rin. Lagi nila sinasabi punta kami ng ganitong time then
wala naman pumupunta. If ever may pumunta, they'll just give you a sheet of paper
then papapirmahin ka that you received the letter then mangungulit ulit kung when
ka magbabayad. kung wala ka maipakita, then uuwi rin silang walang cash.
Pwede mo sila harapin then use the diskarte you learn here or pwede mo rin ipasabi
sa tao sa inyo na wala ka. Hehe

kapapanganak ko palang. nahaharrass na ako sa collection agents. is it ok kung

help naman po please kasi yung hsbc hinihingian ko po ng SOA pero ang sabi po
nila sakin hindi daw po sila authorized na kumuha ng SOA ako daw po na card
holder and dapat mag request sa hsbc nun..and pinipilit po nila ako mag bayad ng
5k til 24 hours..and sabi nila pupunta daw po sila sa office namin to talk about the
matter and have a black and white discussion...help po banker evryone..need your
suggestion what im going to do if pumunta na sila sa office namin...

Nasabihan na rin ako niyan before and wala naman pumunta dito sa office or sa
bahay namin but if ever pumunta sila sa place niyo, pustahan tayo.. Magaabot lang
yan ng papel na may note, tatawag yung messenger sa CA mo tapos kulitan blues
ulit.
You have the choice naman to face them or not.
Isipin mo.. Since they are endorsed ng bank, di ba dapat mas mabilis if sila na ang
kukuha ng SOA from the bank? Bakit sinasabi nila na ikaw na lang? And if ever ikaw
manghingi sa bank, baka matagalan ka rin before makakuha kasi it would take them
some time to find, process and compute yung mga billed amounts mo and interests
incurred.

mga styles nila eh. Yan ba yung way nila to "help" defaulters? Kung yan lang way
nila to help us, then, I don't need their help :P Dagdag stress lang sila sa buhay ko.

1: kapag inavail ko ang arrangement plan ng bank, totoo ba na magpapadala sila ng
certificate of clearance?
2. kapag natapos ko na yung aggrement ko sa ca. tapos na ba talaga ung utang ko
sa cc?. kasi ang lalabas lang daw sa soa ko ay yung payment na ginawa ko..iba daw
lalabas na outstanding..disregard ko na lang daw...sa contract daw ako

3. 2 cards ko na default,,ung isa tama birthdate yung isa mali....matatrace ba nila
yun? makakasuhan ba ako pag na-found out na mali...

5. nag-avail ako ng online soa para convenient, mahihinto ba pagpagdala nila sa
email address ko ng soa kung ndi na ko nakakabayad?.sabi kc sa terms and
condition pg may remaining pa rin, tuloy pa siya...kailan po ba natatapos
magpadala ng soa...
last, kailan nagsisimula at natatapos ang statute of limitations...

Hi Banker....
this morning CJM strategic management called me to settle my cc obligations in
hsbc...
nagulat nga po ako at bakit nila nalaman ung bago kong company...
anyway...ung agent po eh nag offer sa aking ng at least 75% discount sa utang ko
and me pinadalang agreement regarding sa babayaran ko and from 190K to 7K na
lang daw para ma close ung account ko...
if i signed the agreement po ba eh makakakuha ako ng certificate of full payment
and totally closed na ung utang ko sa kanila....
need your advice po....thanks

Ask ko lang si BPI nag file na ng case, and nag attend na din ako ng several
hearings, and palagay ko tama nga sinabi ninyo na since wala din naman ako
pambabayad, wag ko na ko attend sa hearing, and nag submit na din ako ng
proposal sa kanila and ayaw naman nila, nag double na kasi yung amount, kaya
lalong hindi ko na kaya bayaran, ang question ko lang po is if ever mag karoon na
ng decision ang Judge, and gaya ng nasabi niyo po before, ang ending is " you must
pay" , may right ba i freeze yung natitira namin money sa other bank? Maraming
salamat po Banker.
