KUASSA Kratos 2 Maximizer end user license agreement

END USER LICENSE AGREEMENT

Please read this contract carefully. This is a legal agreement between you and K
UASSA TEKNIKA, PT. By using all or any portion of the software you accept all th
e terms and conditions of this agreement. Kuassa Kratos 2 Maximizer is licensed,
not sold, to you for use only under the terms of this agreement. This license a
greement is your proof of license to exercise the rights granted herein and must
be retained by you. As between you and KUASSA TEKNIKA, PT., KUASSA TEKNIKA, PT
retains all title to and ownership of Kuassa Kratos 2 Maximizer and reserves all
rights not expressly granted to you.
EVALUATION
Kuassa Kratos 2 Maximizer is not free software. Subject to the terms and conditi
ons of this agreement, you are hereby granted the right to use Kuassa Kratos 2 M
aximizer for evaluation purposes without charge. If you intend to use Kuassa Kra
tos 2 Maximizer on an ongoing basis, in your productions, recordings and / or pe
rformances you are requested to register your copy. To register you will need a
license file that is purchased from KUASSA TEKNIKA, PT through the Kuassa web si
te. (http://www.kuassa.com)
GRANT OF LICENSE
A personal registration will grant you the personal license to use one or more v
ersions of this product to its full extent, including the royalty-free use of Ku
assa Kratos 2 Maximizer in your productions, recordings and / or performances. K
UASSA TEKNIKA, PT will provide you with information on which versions of Kuassa
Kratos 2 Maximizer that are covered by this license, and reserves the right to m
ake changes to this specification. A single license file may be used to register
the product on any number of concurrent installations, but you are expected to
un-register the product after use on a public or shared computer. You are prohib
ited to distribute, lend, or rent your personal license.
LICENSE TRANSFER
The full version / purchased license for this product can only be transferred to
a new user with a written permission from KUASSA TEKNIKA, PT. After a finished
transfer the old user must remove this program completely from his computers. Th
e old user's license is withdrawn, and replaced by the new user s license.
DISTRIBUTION
With the exception of alpha and beta versions of Kuassa Kratos 2 Maximizer you a
re permitted, without charge, to make as many copies of this software and docume
ntation you wish, give exact copies of the original release version to anyone an
d distribute the release version of the software and documentation in its unmodi
fied form via electronic means. You are prohibited from charging, or requesting
donations, for distributing Kuassa Kratos 2 Maximizer. You are also prohibited f
rom distributing the software and / or documentation with other products (commer
cial or otherwise) without prior written permission. Alpha and beta versions are
subject to special conditions. You may not distribute alpha and beta versions o
f Kuassa Kratos 2 Maximizer in any form without prior written permission from KU
ASSA TEKNIKA, PT It is strictly prohibited to distribute, lend or rent license f
ile.
TERMINATION
The license granted to you is effective until terminated. The license will termi
nate automatically without any notice from KUASSA TEKNIKA, PT if you fail to com
ply with any term or condition of this agreement. You agree upon any such termin
ation to destroy Kuassa Kratos 2 Maximizer software, license file and documentat
ion (including any portions or copies thereof). Upon termination, KUASSA TEKNIKA
, PT may also enforce any and all rights provided by law. You may also terminate
the license at any time by destroying Kuassa Kratos 2 Maximizer software, licen

se file and documentation (including any portions or copies thereof) currently i

n your possession or control. The provisions of this agreement that protect the
proprietary rights of KUASSA TEKNIKA, PT will continue in force after terminatio
n.
DECOMPILING, DISASSEMBLING OR REVERSE ENGINEERING
You acknowledge that Kuassa Kratos 2 Maximizer contains trade secrets and other
proprietary information of KUASSA TEKNIKA, PT. Except to the extent expressly pe
rmitted by the laws of the jurisdiction where you are located, you may not decom
pile, disassemble or otherwise reverse engineer Kuassa Kratos 2 Maximizer, or en
gage in any other activities to obtain underlying information that is not visibl
e to the user in connection with normal use of Kuassa Kratos 2 Maximizer. In par
ticular, you agree not for any purpose to transmit Kuassa Kratos 2 Maximizer or
display the object code on any computer screen or to make any hardcopy memory du
mps of the object code. If you believe you require information related to the in
teroperability of Kuassa Kratos 2 Maximizer with other programs you should reque
st such information from KUASSA TEKNIKA, PT. Upon receiving such a request, KUAS
SA TEKNIKA, PT will determine whether you require such information for a legitim
ate purpose and, if so, KUASSA TEKNIKA, PT will provide such information to you
within a reasonable time and on reasonable conditions.
WARRANTY
WARNING: THIS PRODUCT CAN CREATE HEARING LOSS!
Any use by you of Kuassa Kratos 2 Maximizer is at your own risk. Kuassa Kratos 2
Maximizer is provided for use "as is" without warranty of any kind. To the maxi
mum extent permitted by law, KUASSA TEKNIKA, PT disclaims all warranties of any
kind, either express or implied, including, without limitation, implied warranti
es or conditions of merchantability and fitness for a particular purpose. KUASSA
TEKNIKA, PT is not obligated to provide any updates or upgrades to Kuassa Krato
s 2 Maximizer.
LIABILITY
Any liability of the provider will be limited exclusively to product replacement
or refund of purchase price. In no event shall KUASSA TEKNIKA, PT be liable for
any damages whatsoever (including, without limitation, incidental, direct, indi
rect, special or consequential damages, damages for loss of business profits, bu
siness interruption, loss of business information, or other pecuniary loss) aris
ing out of the use of inability to use Kuassa Kratos 2 Maximizer, even if KUASSA
TEKNIKA, PT have been advised of the possibility of such damages. (Because some
countries do not allow the exclusion or limitation of liability for consequenti
al or incidental damages, the above limitation may not apply to you.)
INDEMNIFICATION
If you use or distribute Kuassa Kratos 2 Maximizer in violation of this agreemen
t, you hereby indemnify, hold harmless and defend KUASSA TEKNIKA, PT from and ag
ainst any and all claims or lawsuits, including attorney's fees and costs that a
rise, result from or are connected with the use of or distribution of Kuassa Kra
tos 2 Maximizer in violation of this agreement.

e Soras. Kuassa Kratos 2 Maximizer software and documentation is protected by In
donesian copyright laws and acknowledged by international treaty provisions. You
may not remove the copyright notice from any copy of Kuassa Kratos 2 Maximizer.
