governmentlandheldbytheAlcantaraownedAlsonsDevelopment&InvestmentCorporation(Aldevinco)underanIntegratedForestPlantationManagement
Agreement(IFPMA).
ThissurfacedafteracertainJimmyTang,listedasoneoftheownersofAvenueElectricalSupplyCorporation(Avesco),wrotetheofficeoftheLandRegistration
AuthorityrequestingfortheregistrationandsplittingofabigparceloflandcoveredbyOriginalCertificateofTitle(OCT)P2252.
Thetechnicaldescriptionoftheproperty,however,isthesameparceloflandthathasbeenoccupiedbyAldevincosince1964whenitacquiredthepasturelease
agreement(PLA)fromTuazonEnterprise.
ThedisputedpropertyisnowunderIFPMA21,whichexpiresin2035.

rightsoversome600hectaresfortheairportconstructionin1992,thesametimewhenIFMA21wasissuedbythen
PresidentCorazonAquino.
TheSaranganiAgriculturalCompanyInc.(SACI)wasleftwith899hectaresbutwasfurtherreducedto804whenit
cededanother95hectarestotheDepartmentofEnvironmentandNaturalResources(Denr).
ThemajorityoftheIFPMA21areaisnowplantedwithmango,pomelo,bananas,molave,mahoganyandsweetcorn.
SACI,whichmanagestheareaforAldevinco,says250cattlearestillgrazinginthearea.
Claimants
In2004,RomeoConfessorsurfacedtoclaimthatheandseveralotherswereinpossessionofanOCTissuedin1956
coveringthesameareaofpropertyunderIFMA21.
InAugust2004,theLandRegistrationAdministration(LRA)declaredthetitleundernamesofConfessoretalasfake.
TheLRAsaidthetechnicaldescriptionoftheConfessoretalOCTreportedlyshowedtheairportborderofthetitle.
Theairportpropertywasnotestablisheduntil1992,whenAldevincocededitsrightto600hectaresofthewholepropertyinfavorofthegovernment.
Inaddition,theLandManagementBureaureportedthatthesalespatentsthatweresupposedtobacktheclaimsofConfessorandcompanywerenowherenearthe
propertynowoccupiedbyAldevinco.
SalespatentV1776,asappliedbyoneDomingoGapata,wasfor9.0378hectaresoflandinKiamba.
SalespatentV1777covered12.8756hectaresinGuianga,DavaoCityandwasissuedinthenameofWilfredoFerrares.SalespatentV1778wasfor18.1642hectaresof
propertyinDapitan,ZamboangadelNorteunderthenameofJesusMorazawhilesalespatentV1779wasissuedinfavorofJoseJaucanforanareaof2.6050hectares
locatedinKidapawan,Cotabato.
Theotherinstrument,salespatentV1780,wasissuedtoAmbrocioFeridoforapropertycovering13.0037hectaresinTagum,Davao.
Confesor,accordingtoretiredSACIoperationsmanagerJulianMontemayor,hadneverbeeninactualpossessionnorhadheeveroccupiedevenaportionofthe
contestedproperty.
Confesor,whoisnowdead,wasaformersecurityguardwhorosetobecomeahearingofficerofthePhilippineCommercialandIndustrialBank(nowBDO).
ConfessorlaidclaimtothepropertyaftershowingatitletothelandoccupiedbyAldevinco.
HeallegedthataconsolidatedOriginalCertificateofTitle(OCT)P2252wasissuedonMay21,1955inthenamesofPedrodeRamos,ExelseaLauron,Raidencio
Confesor,JulitaConfesor,andtohimdespitetheissuanceofaPastureLeaseAgreement(PLA)covering860hectarestoacertainMagnoMateoinAugust1954.
MateosoldhisrightstoTuazonEnterprisewhointurnsoldtoAldevincoin1955.
AtthetimeoftheallegedOCTP2252issuance,Confesorwasreportedlyjust15yearsold.

Confessorhadreportedlysoughtfinancialbackingsfromsomeprominentbusinessmeninthecityinanefforttobankrollhisclaimsovertheproperty.
ThisisanallegationthatwasessentiallyconfirmedbyRodrigoJunjunRiveraJr.,whoin2006admittedissuingseveralcheckstoConfesoraspaymentfortheproperty.
Riverahoweverbackedofffromthetransaction,tellingthenSaranganiGovernorMiguelReneDominguezthathewasnotawarethatAldevincohadtenurialrightsover
theproperty.
DominguezisnowthevicepresidentofSACI.
HowtheConfessortitleendedupbeingsoldtoJimmyTangremainsunexplained.ButinadocumentTangsubmittedtotheLandRegistrationAdministration,fivedeeds
ofsalecovering7,076,266squaremetersor707.63hectaresweresoldseparatelybyPedrodeRamos,RomeoConfesor,CelestinaCuizon,ExcelseaLauronandRalderico
ConfesortoJimmyTangforP35,381,330.
ThedeedsofsaleweredatedJune6,2014andweresubscribedinImus,Cavite.
AllthesaleinstrumentssaidthevendorwerethesoleheirsofRomeoConfesorwhoreportedlydiedseveralyearsago.YettheDeedofSaleforRomeoConfesorsparcel
oflandwassignedbyConfesorhimselfonthesamedatethesalewasexecuted.

DocumentsobtainedbyRapplerrevealedthaton11August2014,Atty.PeterArmandHenares,headofthecityRegisterofDeeds,informedTangthathecouldnot
proceedwiththeissuanceofTransferCertificateofTitleinvolvingOCTNo2252,citingtheannotationthatthetitlehasbeenfoundspuriousperInvestigationReportof
theTaskForceTituloMalinis.

Nevertheless,HenaresforwardedthepetitionofTangtotheheadofficeofLRAwhichsetahearingonOctober23.
ButTangwrotealetteronOctober21,askingtheLRAtoexcusehimselffromthehearing,sayinghealreadysubmittedallevidenceanddocumentstosupporthisclaim
overthevastproperty.
AlsoabsentduringthehearingweretheotherownersofthesaidpropertyidentifiedasCelestinaCuison,ExcelseaLauron,PedrodeRamosandReldericoConfessor.
Henareslikewisedidnotappear.
ButthelawyerofSACIandAldevincoappearedtomanifestitsintentiontointervene.
TheoralrequestofSACIwasgrantedanditisnowpartytotheLRAcase.
TheenormityofthecasehascaughttheattentionofSenatorAquilino"Koko"PimentelIII,whopassedaresolutioncallingforaSenateinvestigationintotheproliferation
