CommencingDecember7,2015,theSupremeCourtofBCwillhavethefirstopportunityincourt
proceedingstohearthetruthaboutBCHydro'sflagrantdisregardofourCharterRightsinrelationtothe
deploymentoftheirmicrowaveradiationemittingsmartmeterprogram.
InadditiontothePlaintiffswhocommencedthislitigation,sixrepresentativeplaintiffsaresupportingthe
lawsuitbywayofpersonalaffidavitswhichexposeBCHydro'sunacceptableconduct.Thesituationofeach
plaintiffisrepresentativeofthedifferentcircumstancesforceduponthousandsofBCHydrocustomerswho
havehadtheirdemocraticrightsandfreedomstrampled.
ThescheduledBCSupremeCourtproceedingsinVancouver,B.C.fromDecember7to11,2015,are
applyingforthejudge'sapprovaltocertifythiscivillawsuitagainstBCHydroasaClassAction,thereby
providinglegalrepresentationforallBCHydrocustomerswhohavebeenactivelyandknowinglydeniedtheir
constitutionalrights.
ThePlaintiffs'positionisthatitisafundamentalpersonalchoiceforreasonthatthereexistsareasonable
basisforconcernabouthealthrisksoastogiverisetoarightofautonomyandfreechoiceastowhethera
microwaveradiationemittingMeterisoperationalfromonesownDwelling.DuetoBCHydro'sactions,
theplaintiffsexperiencelossofpersonalchoiceandlossofautonomytodecideforthemselveswhethera
microwaveradiationemittingMeterwilloperateattheirrespectivedwellingsorplaceofbusiness.
BCHydroactsasaprovincialgovernmentagentandissubjecttotheapplicationoftheCharterofRightsand
Freedomswithrespecttotreatmentoftheircustomers.ThePlaintiffspleadthatBCHydro'srequirementsfor
electricalservicearearbitrary,overlybroad,grosslydisproportionalandlackinginparity,andhavecomeinto
effectthroughalackofdemocraticprocess.
ThislawsuitchallengestheconstitutionalityofthefollowingconductbyBCHydro:
a)OperationofamicrowaveradiationemittingMeteratadwellingorworkplaceofaCustomerwhoatany
timerequeststhattherebenooperationofamicrowaveradiationemittingMeter.
b)ThreateningoreffectingaServiceRefusal.

c)ExactingpaymentfromaCustomerofanOptOutFeeinexchangeforBCHydro
abidingbytheCustomerschoicetobefreefromtheinstallation/operationofamicrowaveradiationemitting
Meterataparticulardwellingorworkplace.
d)ExactingpaymentfromaCustomerofaFailedInstallationFeerelatedtoBC
HydrosattendanceatadwellingorworkplacetoinstallamicrowaveradiationemittingMeterwhere
installationisnotcarriedoutbecauseofeitheranobjectionmadebyaCustomer
oranobstruction.
Thislitigationalsochallengestheconstitutionalvalidityofthevariouslegislativeand
administrativeactswhichBCHydroclaimsgivesthemauthoritytoactwithimpunity.

IfyoubelieveoursocietybenefitsfromadheringtoourCharterofRightsandFreedoms,ifyourefuseto
acceptthedeclineofafairandrespectfulsocietyinBC,ifyoubelievecitizenshavetherighttocontroltheir
personalspace,thensetasidesometimetostandupforourdemocraticvaluesbybeingpresentduringthese
importantcourtproceedingsagainstBCHydro'sinjustices.Theplaintiffswouldvalueyoursupportaswell,as
theyarefightingfortherightsofallpeopleinBC,thoseimposedwithsmartmetersagainsttheirwill,aswell
asthosewithlegacymeters.
Itisimportanttoknowthat96%ofBCHydrocustomersarenoteligibleforoptoutchoiceduetoarbitrary
andinequitablerulemaking,includingthoseobjectorsonwhomamicrowaveradiationemittingMeterhas
beenimposedagainsttheirwill.
Forabasiclifenecessitysuchaselectricity,whereparticipationisnotachoice,consumersmusthave
thefreedomtochoose.Theseareserioustimesworthyofsomeextraefforttostoptheerosionofour
liberties.Pleaseattendatthecourthouse.
OnJuly18,2013,BillBennett,MinisterofEnergyandMinesfortheBCProvincialLiberals,madethe
followingstatementbywayofpressreleaseannouncingBCHydrosMeterChoicesProgram:
Aswehavesaid,nobodywillbeforcedtotakeasmartmeter.Ibelievethatthisisafairandreasonable
solutionforallBritishColumbians.
Wellsaid,Mr.Bennett,andnow,weremindyoutostandbyyourwords.
IfMr.Bennetthadremainedtruetohisdocumentedassurancesoffairandreasonablesolutionsforall
peopleinBC,thesecourtproceedingswouldnothavebeennecessaryatall.
