Dear Mr. Brown:

I have reviewed the MOTOR VEHICLE CODE BOOK for CALIFORNIA


and in reading the 'code' I have come to understand that all MOTOR
VEHICLES and MOTOR CARRIERS must be registered and receive some
sort of license to 'operate' on the highways of CALIFORNIA. I
Conditionally Accept for Value this premise and I agree to abide by all
the precepts in the Motor Vehicle Code: This agreement is predicated
upon you providing 'Proof(s) of Claim' that this premise is applicable to
me in the pursuit of my Private Life and Business, in a/my private
conveyance, not involved in the business of transporting people or
property for hire or using the highways for gain or profit.

I have seen evidence to suggest that the most recent legislative


definition of a motor vehicle or motor carrier is found in CALIFORNIA
STATUTES and CALIFORNIA VEHICLE CODE, and that definition reads as
follows:
Motor Vehicle. "Motor Vehicle" means any self-propellled vehicle or
carrier movingover the public highways of this state and not moving,
operated, or driven upon fixed rails or track. It includes motor trucks,
motor buses, motor carriers and trailers, semi-trailers and other trailers
used in connection therewith.

If this definition still holds true, then it may indeed be that the
Motor Vehicle Code of California does not pertain to me as a private
man, engaged in my private life and business: Therefore your Proof(s)
of Claim are required to validate any claim that the STATE OF
CALIFORNIA may have that there is indeed a requirement that the
private conveyances, commonly known and referred to as
automobiles, be licensed and registered as "Passenger Vehicles" in the
STATE OF CALIFORNIA.

To save you time, I have provided a stipulated answer for you, in


underlined italics, to each requested Proof of Claim: If my answer is
correct, then you have no obligation to answer. However, if you find
my position in error and the stipulated answer is incorrect, then you
have an obligation to prvide your own Proof(s) of Claim and/or answer
point-for-point for the record within Ten (10) days.

To constitute an answer/response, you are required to Provide


Proof(s) of Claim as listed below:

1) PROOF OF CLAIM, that the legislature of the STATE OF


CALIFORNIA has enacted another definition of a MOTOR VEHICLE other
than theone provided in the CALIFORNIA STATUTES and CALIFORNIA
VEHICLE CODE. Stipulated answer of Edmund G. Brown: There is
no other legislative or California Vehicle Code definition of MOTOR
VEHICLE.

2) PROOF OF CLAIM, that a PASSENGER is not a person who pays to


be transported. Stipulated answer of Edmund G. Brown: A
passenger is someone who pays to be transported.

3) PROOF OF CLAIM, that the STATE OF CALIFORNIA through its


DIVISION OF MOTOR VEHICLES sells any other category of
license/registration than commercial. Stipulated answer of
Edmund G. Brown: The DIVISION OF MOTOR VEHICLES does not sell
and other category of license other than commercial.

4) PROOF OF CLAIM, that the STATE OF CALIFORNIA has any


authority to compel a private man into participation into a commercial
activity/contract, or to surrender his privtae interest/ownership to the
public police powers of the STATE or state corporation. Stipulated
answer of Edmund G. Brown: The STATE OF CALIFORNIA has no
authority to compel a private man to contract with the STATE.

5) PROOF OF CLAIM, that the STATE OF CALIFORNIA did not adopt


the UNIFORM COMMERCIAL CODE (UCC) as the definitive law
pertaining to PRIVATE CONTRACTS. Stipulated answer of Edmund
G. Brown: The STATE OF CALIFORNIA did adopt the UCC as the
standard for recognition of PRIVATE CONTRACTS.

6) PROOF OF CLAIM, that the STATE OF CALIFORNIA has the


authority to impair the obligations of contracts. Stipulated answer
of Edmund G. Brown: The STATE OF CALIFORNIA has no authority to
impair the obligation of contracts.

7) PROOF OF CLAIM, that the Undersigned's privately-held "Bill of


Sale" registered on a UCC-3 Financing Statement/Security Interest
does not constitute "lawful title" to the property named (a private
conveyance/automobile). Stipulated answer of Edmund G. Brown:
A privately-held "Bill of Sale" and UCC Financing Statement does
constitute lawful title.

8) PROOF OF CLAIM, that the DIVISION OF MOTOR VEHICLES does


not recognize a private registration, i.e., the acceptance of a VEHICLE
BILL OF SALE and the registration of the same upon a UCC-1/UCC-3,
naming the creditor as the owner and establishing a superior security
interest. Stipulated answer of Edmund G. Brown: The DIVISION
OF MOTOR VEHICLES does recognize a UCC registration as a legitimate
registration form and superior security interest.

9) PROOF OF CLAIM, that the STATE OF CALIFORNIA can produce


evidence of a claim of title/security interest to a conveyance
(automobile), which is superior to a private UCC-1/UCC-3 registration
filing. Stipulated answer of Edmund G. Brown: The STATE OF
CALIFORNIA can produce no superior claim or title.

10) PROOF OF CLAIM, that the STATE OF CALIFORNIA, in light of the


above Proof(s) of Claim, has any legal interest in a UCC-Registered
private conveyance (automobile) used by a Private Man as
transportation in the pursuit of his Private Life and Business.
Stipulated answer of Edmund G. Brown: The STATE OF
CALIFORNIA has no legal interest in such a conveyance (automobile).

11) PROOF OF CLAIM, that the Undersigned does not have a right to
file a tort claim for a refund on all past 'unlawful' registrations.
Stipulated answer of Edmund G. Brown: The Undersigned does
have the right to file a Tort Claim for a refund.
Due to the prevalent attitude of public law enforcement officers in
this State to stop, detain, threaten, harass, cite, and unlawfully take
the property of a Private Man engaged in his Private Life and Business,
while traveling in his private conveyance, it is imperative that you
answer the Proof(s) of Claim listed above within Thirty (30) days.

Per your failure or refusal to bring forth "Proof(s) of Claim," you will
be foundin dishonor and will have stipulated to the facts as they
operate in favor of the Undersigned, you will have failed to state a
claim upon which relief can be granted and you will have admitted that
a damage has occurred to this private man.

Further, you will have stipulated to the fact that the private man is
not subject to the CALIFORNIA VEHICLE CODE and that the
Undersigned has a right to tarvel in his private conveyance in non-
commercial use of same and that said 'private' conveyance(s) of the
Undersigned are EXEMPT from the regulation of such statutes and said
private conveyance(s) are outside of the State regulations for
'registration.'

Your official response being the requested Proof(s) of Claim are to


be sent to the Undersigned care of the below named Notary Public in
order to certify a response or want thereof.

Your failure or refusal to respond or to provide Proof(s) of Claim will


stand as your tacit agreement to the above, that this Conditional
Acceptance for Value becomes the Security Agreement between the
parties, and that you, as ATTORNEY GENERAL for the STATE OF
CALIFORNIA, loses any defense on the issue of 'registration' or
application of the Code upon the Undersigned by estoppel in any
jurisdiction within the STATE OF CALIFORNIA and you agree that any
'traffic stop' by any 'officer' at any level within this STATE for said
'registration' issue and others eminating from said 'stop' establishes
mis-application of the statute and fraud with damages at $250,000.00
per incident and that the STATE OF CALIFORNIA becomes a judgment
debtor to the Undersigned under necessity.
