PROGRAM GUIDELINES

I.

PROGRAM SUMMARY

The Community Development Division administers the Unit Reduction Grant Program. Under
this program, property owners may obtain a grant to assist with the costs of permanently
eliminating residential rental units in homes previously converted from their original construction
to multi-unit residential rentals. The intent of this Program is to eliminate dysfunctional and unsafe
multi-dwelling rental units and return buildings back to owner occupied homes with suitable, code
compliant dwelling spaces. Owner occupancy with a compliant accessory dwelling unit or units is
possible. Grants are available to owners of selected, targeted buildings within the following
boundaries: 20th Street to 27th Street, Washington Blvd. to Monroe Blvd.

II.

REQUIREMENTS

1.

Grant Recipient Qualifications


a.
Property owners must own the property at the time the grant agreement is signed.
b.
Ownership in the property may be held in any form of legal ownership. However,
owner must own fee title, i.e., no contract ownership.

2.

Property Qualifications
a.
Mortgagor Approval: If the property is used as security for any mortgage, the
mortgagor must give approval for the removal of units.
b.
Property Standards: At the completion of the project, the building must meet
applicable sections of the Building Code adopted by Ogden City.
c.
Zoning: The home must be in compliance with applicable zoning regulations. Unit
reduction must render the building compliant with current zoning standards for
building use. Unit configuration after completion will be acknowledged as the new
maximum allowed number of units in that building.

Historic Preservation
a. National Historic Register: Regardless of the fund source (federal or local) used to
acquire and develop properties, and for every property assisted or impacted by the
Program, the procedures described in Section 106 of the National Historic Preservation
Act of 1966, as outlined in regulations 36 CFR Part 800, will be followed for
consultation with the Utah State Historic Preservation Office. This is a means of
determining the effect that any city sponsored action may have relative to identifying
and determining the effect on historic resources as well as gaining the input of a
qualified entity on how to mitigate and reduce negative effects on the historic resource.
b. Ogden Landmarks Register: For any property listed on the Ogden City Landmarks
Register, the city will follow all procedures established by ordinance prior to
conducting any construction or demolition activity.

Construction
a.
Unit reduction plan, drawings, and construction specifications, bids, contracts, and
time line for construction must be approved by Ogden City personnel.
b.
Property owner must enter into a construction contract with a contractor licensed
for the type of work required.

5.

Cash Management
a.
Grant proceeds will be held by Ogden City and disbursed prorata with other
construction funds, as payment towards documented costs associated with the
construction project. Any proceeds not used for construction will be disbursed to
owner at completion of the project and documentation of owner-occupancy, as
approved by Ogden City.

IV.

GRANT TERMS

1.

Grant funding is derived from Ogden City General Funds, and is subject to availability of
funds.
Grant amounts: $20,000 per unit permanently eliminated.
The property owner will enter into a Grant Agreement with Ogden City.
The grant amount will be a loan secured by a trust deed and promissory note. The note will
be forgiven with no payment required, and the deed reconveyed upon completion of the
unit reduction and documentation of owner-occupancy, as approved by Ogden City.
