CHAPTER 6

GOVERNMENT SERVANTS (EFFICIENCY AND DISCIPLINE) RULES, 1973


1.

FIXATION OF PAY

On promotion/appointment and move over to next higher scales, the pay of


individual be got fixed from the CMA's Office concerned. Pay fixation proforma (in
quadruplicate) along with office order and service books of the individuals be submitted to CMA's Office for approval. No increased pay will be claimed in pay bills
without approval of pay fixation proforma by the CMA concerned.
SRO. 12134173, dated 18th August, 1973.---1n exercise of the powers
conferred by section 25 of the Civil Servants Ordinance, 1973 (X1V of 1973), the
President is pleased to make following Hiles, namely:--a. Short title, commencement & application.---These rules may be called the
Government Servants (Efficiency & Discipline) Rules, 1973.

b. They shall come into force at once and shall apply to every civil servant],
(1)

Definitions. ln these rules, unless the context otherwise


requires.---

(a) "accused" means a Government servant against whom


is taken under these rules;

action

(b) "authority" means the 5[Prime Minister] or an officer or


authority
designated by him to exercise the powers of
the authority under these
rules;
(c) "authorised officer" means an. officer authorised by the
authority to perform functions of an authorised officer
under these rules or, if no officer is so authorised, the
authority;
(d) "misconduct" means conduct prejudicial to good order
or service .discipline or contrary to Government
Servants (Conduct) Rules, 1964or unbecoming of an
officer and, a gentleman and includes any act on the
part of a. Government servant to bring or attempt to
bring.political or other. Outside influence directly or
indirectly to bear on the Government or any
Government officer in respect of any matter relating to
the appointment, promotion, transfer, punishment,
retirement or
other conditions of service of a
Government servant; and
e.

"penalty" means a penalty which may be imposed under


these rules.

f.

Procedure to be observed by the Inquiry Officer and


Inquiry Committee. Where an Inquiry Officer or Inquiry

Committee is appointed, the authorised Officer shall:together with statement of the allegations explaining the
charge and of any other relevant circumstances which
are proposed to be taken into consideration.
g.

Require the accused within a reasonable time, which


shall not be less than seven days or more than fourteen
days from the day the charge has been communicated to
him, to put in a written defence and to state at the same
lime whether he desires to be heard in person.

h.

The Inquiry Officer or the Inquiry Committee, as the case


may be, shall enquire into the charge and may examine
such oral or documentary evidence in support of the
charge or in defence of
the accused as may be
considered' necessary and the accused shall be entitled
to cross-examine the witnesses against him.

i.

The Inquiry Officer or the Committee, as the case may


be, shall hear the case from day-to-day and no
adjournment shall be given except for reasons to be
recorded in writing. However, every adjournment, with
reasons therefor shall be reported forthwith to the
authorised officer. Normally no adjournment shall be for
more than a week.

J.

Where the Inquiry Officer or the Committee, as the case


may be, is satisfied that the aecused is 'hampering or
attempting to hamper, the progress of the enquiry he or it
shall administer a warning, and if thereafter he or it is
satisfied that the accused is acting in disregard of the
warning, he or it shall record afinding to that effect and
proceed to complete the enquiry in such manner as he or
it thinks, best suited to do substantial justice.

K.

The Inquiry Officer or the Committee, as the case may


be, shall within ten days of the conclusion of the
proceedings or such longer period as may be allowed by
the authorised officer, submit his or its findings and the
ground thereof to the authorised officer.

56A. Revision.--- (I) Subject to sub-rule (2), the authority may e l for the
record of any case pending before, or disposed of by, the authorized officer and pass
such order in relation thereto as it may deem fit;
(2) No order under sub-rule (1) shall be passed in respect of an accused
unless the authorized officer to be designated by the authority has informed him in
writing of the grounds on which it is proposed to make the order and has been given
an opportunity of showing cause against it, including an opportunity of personal
hearing if requested by the accused or is otherwise necessary in the interest of
justice, in particular, when the authority contemplates to pass an order adverse to
the interest of the accused:

Provided that no such opportunity shall be given where the authority, for
reasons to be recorded in writing, is satisfied that, in the interest of security of
Pakistan or any part thereof, it is not expedient to give such an opportunity."; and]
2.

Powers of Inquiry Officer and Inquiry Committee.--a.

For the purpose of an inquiry under these rules, the Inquiry Officer and
the Inquiry Committee shall have the powers of a Civil Court trying a
suit under the Code of Civil Proccdure, 1908 (Act V of 1908), in respect
of the following matters, namely:

(1) summoning and enforcing the attendance of any person and


examining him on oath;
(2) requiring the discovery and production of documents;
(3) receiving evidence on affidavits;
(4) issuing commissions for the examination of witnesses or
documents.
(5)

The proceedings under these rules shall be deemed to be


judicial proceeding within the meaning of sections 193 and 228
of the Pakistan Penal Code (Act XLV of 1860).

8. Rule 5 not to apply in certain cases.---Nothing in rule 5 shall apply to a


case:
(a) Where the accused is dismissed or removed from service or reduced in rank, on the
ground of conduct which has led to a sentence of fine or imprisonment ; or
Where the authority competent to dismiss or remove a person from service, or
to reduce a person in rank, is satisfied that, for reasons to be recorded in writing by
that authority, it is not reasonably practicable to give the accused an opportunity of
showing cause

Civil Servants (Seniority) Rules, 1993

In exercise of the powers conferred by section 25 of the Civil Servants Act,


1973 (LXXI of 1973), read with section 8, thereof, the President is pleased to make
the following rules, namely; a.

Short title, application and commencement, - (1) These rules


may be called the Civil Servants (Seniority) Rules, 1993.

a. They shall apply to all civil servants except those governed


under: (1)

The Police Service of Pakistan (Composition, Cards and


Seniority) Rules 1985;

(2)

The Occupational Groups and Services (Probation


Training and Seniority) Rules, 1990; and

4.

(3)

The Establishment Divisions O.M. No.1/2/74 ARC dated


23rd January, 1974, amended vide O.M.No.2/1/75-ARC,
dated 3rd March, 1976 and as amended from time to time.

(4)

They shall come into force at once.

Seniority on initial appointment.-

a.
Persons initially appointed on the recommendations of the selection
authority through an earlier open advertisement shall rank senior to those appointed
through a subsequent open advertisement.
b.
If two or more persons are recommended in open advertisement by the
selection authority their inter-se seniority shall be determined in order of merit
assigned by the selection authority.
c.

If only one candidate is recommended in open advertisement by


the selection authority, he shall count his seniority from__

(1)
the date of recommendation by the selection authority, if he was
already holding the same post on adhoc basis; and
(2)
the date of his joining the post after being recommended by the
selection authority, if he was not already holding the same post.
5.

Seniority on promotion.
Seniority in a service cadre, or post to which a civil servant is promoted shall
take effect from the date of regular promotion to that service cadre of post:
Provided that:a.

Civil servants selected for promotion to higher


posts on an earlier date shall be senior to those
selected for such promotion on a later date;

b.

Civil servants selected for promotion to higher


posts in one batch shall, on their promotion to the
higher post, retain their inter-see seniority as in the
lower post; and

c.
Civil servants eligible for promotion who could not
be
considered for promotion in the original
reference in circumstances
beyond their control or
whose case was deferred while their juniors were
promoted to the higher post, shall, on promotion,
without suspense-sion, take their seniority with the
original batch.

6.

Seniority on appointment by transfer.

Seniority in a service, cadre or post to which a civil servants is appointed by


transfer shall take effect from the date of regular appointment to the service cadre or
post:
Provided that: 4

a.
Persons belonging to the same service, cadre or post selected for
appointment by transfer to a service cadre or post in one batch shall, on their
appointment, take inter-see seniority in the order of their date of regular appointment
in their previous service, cadre or post an
b.
Persons belonging to different services, cadre or posts selected for
appointment by transfer in one batch shall take their inter-se seniority in the order of
the date of their regular appointment to the post which they were holding before such
appointment and, where such date is the same, the person older in age shall rank
senior.

General Principles of Seniority

Seniority, determination of. "Next below rule", applicability. Seniority


had to be determined according to S.8 of Civil Servants Act, 1973 which provides
that seniority in a post; service or cadre to which a civil servant was promoted
would take effect from date of his regular appointment to the post. Civil servants
who were selected for promotion to a higher post in one 'batch, would on their
appointment to the higher post, retain their inter se. seniority as in. the lower post.
Next below rule" was in direct conflict with provisions of S. 8, Civil Servants Act,
1973. Previous rule, if any, which was in conflict with the provisions of Civil
Servants Act, 1973, must yield to the said Act.
Seniority. Seniority in a date of regular officiation in particular post or
grade.'

Seniority inter se. Seniority of one of respondents (civil servant) having


been accepted and same having attained finality without any objection, other
respondent being placed in similar conditions could not be treated discriminately.
Seniority list. Vatedity. No departmental appeal having been filed against
promotions of respondents, .plea for rectification of seniority list only, would be
incompetent.9
Civil servant. -Direct. recruits and promotees. Seniority inter se. Promotees
of the same year would take precedenee of matter of seniority over those joining
on initial recruitment in the same year irrespective of their date of promotion or
joining. 1
Seniority. Appellants being direct recruits demanded ante-dation of their
appointment - with effect from 1995. when their case was recommended- by Public
Service Commission for - appointment as Associate Professors. Validity.
Recommendations of Public Service Commission had to be finally implemented by
the concerned Ministry. No law whatsoever existed to treat date _;of
recommendation as date of appointment. Date for reckoning of seniority could not
precede date of joining. Seniority had to be reckoned from date of joining' in
particular grade or post. Regular appointment would be treated from the. date of
appointees. take over assignment -atd not from any `date prior thereto. Process of
selection was initiated -in 1994; recommendations-were finalized in 1995 and
offers of appointments were issued in 1996. None of appellants having joined

earlier than January,-1996,. they could not be deemed to be batch of 1995; and
thus were not entitled to reckon their -seniority with effect from any date in 1995.

Direct recruitment through the Federal Public Service


Commission.

a.

Officers recruited directly by the FPSC through an earlier open


advertisement would rank senior to those recruited through a
subsequent open advertisement.

b.

two or more persons are recommended in open advertisement by the


FPSC, their inter-se seniority would be determined in the order of merit
assigned by the FPSC.

c.

If only one candidate is recommended in open advertisement by the


FPSC, he would count his seniority from the date of recommendation
by the FPSC, or the date of joining the post, which ever is later:

d.

If the person was already holding the same post on ad-hoc basis, he
would count his seniority from the date of recommendation by the
FPSC.

e.
If the person was not already holding the same post, he would count
his seniority from the date of his joining the post after being recommended by
the FPSC.
2.

Departmental promotion, a. Officers who are approved by the Selection Board/ DPC for promotion to
the higher grade on an earlier date shall rank senior to those who are
approved on a later date, provided that: b. an officer eligible for promotion who is inadvertently omitted from
consideration in the original reference and is susperseded, when he is
subsequently considered and approved for promotion, he will take his
seniority with the original batch;
c. when in a single reference, the Selection Board/DPC are asked to
recommended more than one person and the recommendation of the
Selection Board/DPC is held up in respect of one or for reasons beyond
the control of the persons concerned, the recommendation of the Selection
Board/ DPC in respect of such persons when made subsequently will be
deemed to have been made on the date when the recommendation in
respect of the original batch was made;

(1)

Officers approved by the competent authority, on regular basis, for


promotion to higher posts in the same batch shall retain the same
seniority on promotion as they were enjoying in the lower grade. In
case the date of continuous appointment of two or more officers in
the lower grade is the same, and there is no specific rule whereby

their inter-see seniority in the lower grade can be determined, the


officer older in age shall be treated senior;
(2)

The seniority of departmental promotees to the higher grade shall


count from the date of their regular promotion to the higher grade.
The word regular implies:

(3)

That the promotions to higher grades were made in vacancies


reserved for departmental promotion in accordance with the
prescribed roster;

(4)

that the promotions to higher grades were made in accordance


with the prescribed Recruitment Rules i.e on the recommendation
of the Departmental Promotion Committee or the Selection Board
(and in consultation with the FPSC where such consultation was
necessary under the Consultation Regulations) and with the
approval of the authority
competent to make these appointments; and

(5)

The promotions to higher grades were kept within the maximum


quota prescribed in the Recruitment Rules for Departmental
Promotion. In the event of the prescribed Departmental Promotion
quota being exceeded in any particular case or cases, the seniority
of the person or persons promoted in excess of the quota shall not
count from the date from which the promotion or promotions were
actually made, but from the date or dates from which they would
have been made, if the quota had been properly followed.

d.
Departmental promotees vis--vis direct recruitment Officers
promoted to the higher grade in a continuous arrangement and as a regular measure
in a particular year shall as a class be senior to those appointed by direct recruitment
in the same year.

PROMOTION PROCEDURE
9.

Guidelines for Departmental Promotion Committees/Central


Selection Boards.
1.

General
a.

The DPC/CSB shall consider the cases of eligible civil servants


in order of seniority and either: -

a.

recommended a civil servant for promotion to the next higher


post; or

c.

recommended a civil servant for supersession; or

d.

defer consideration of a civil servants promotion provided that


this step will be taken only if:

e. the CR dossier is in complete or any other decument information


required by the DPC/CSB for determining a civil servants suitability
for promotion is not a available;
f. disciplinary or departmental proceedings are pending against the
civil servant whose promotion case comes up for consideration
before the DPC/CSB; or
g. the civil servant is on deputation abroad to a foreign government,
private organization or international agency; or
h. the civil servant has not undergone the prescribed training or
passed the departmental examination for reasons beyond his
control; or
i. the civil servants inter se seniority is subjudice.

2.
If a civil servant is superseded he will not be considered for promotion
unless he has earned one more CR for one full year.

3.

The civil servant whose promotion has been deferred will be


considered as soon as the reason on the basis of which deferment
took place ceases to exist provided that a civil servant falling in the
category mentioned in 1 (c) (c) above will be considered for promotion
only on his return to Pakistan. If such an officer fails to return on expiry
of his approved deputation period, he will have to earn at least one
PER after his return to Pakistan before he is considered for promotion.

For the purpose of consideration by the DPC/CSB the PERs will be


quantified according to the formula given in the addendum. The civil
servants who fail to come up to the qualifying score shall not normally

be considered for promotion. Relaxation of this condition may only be


recommended by the DPC/CSB after recording detailed reasons for
the approval of the competent authority.
2.

Promotions on Seniority cum-Fitness Basis.


a.

Posts carrying basic pay scale 19 or below are non-selection


posts. Promotions to these posts are to be processed by the
DPCs on the basis of seniority-cum-fitness. Fitness would be
assessed primarily on the officers work in the lower post.

b.

For promotion to a post in basic pay scale 18, however, a civil


servant must fulfil the following additional requirements:

(a)
Qualifying Service: Possess five years service as an officer subject to
the provisions contained in Establishment Divisions O.M. No.1/980-R-II (A), dated 26-1983.
(b)
Eligibility threshold: attain a minimum score of 50 marks for his CRs in
accordance with the formula given in the addendum.

If only 2 reports or less have been recorded on a civil servants
work against a post in basic pay scale 17, the reports earned by him in the
next lower posts should also be included in the quantification.
3.

Promotion to Selection Posts


a.
Posts in basic pay scale 20 or higher are selection posts.
Promotions to these posts are to be processed through the Central
Selection Boards.
b.
In order to ensure the selection by these Boards does not
amount to a mere elimination of the unfit. The Establishment Division
shall place a larger panel of eligible officers before the Boards.
Depending on the availability of eligible officers in a cadre, the number
of officers to be included in the panel shall be as follows: (1)

For promotion to supervisory posts. A minimum of 2


officers for every vacancy.

(2)

for promotion to middle and A minimum of 3 officers for


senior management posts. Every vacancy.

4.

Promotion to Selection Posts


4 Posts carrying basic pay scale 19 are generally supervisory posts.
Supervision can be effective only if the supervisor has the relevant
experience. These officers are also required to make contribution to
policy making at the lowest rung of policy making hierarchy. For
promotion to these posts, therefore, a civil servant must fulfill the
following requirements:-

a.

Qualifying Service: possess 12 years service as an officer


subject to the provisions contained in Establishment Division
O>M No. 1/9/80-R-II(A) dt.02-06-1983.

b.

Eligibility threshold attain a minimum score of 60 marks in the


CRs in accordance with the formula given in the addendum.

c.

Qualification s:- as prescribed by the relevant recruitment rules.

d.

Relevance of Experience: possess experience relevant to the


functions of the post to which promotion is being made.

e.

Quality and Output of Work: and Integrity marks calculated in


accordance with the formula in determining the comparative
merit of an officer.

f.

He earned the following grading during his service against posts

LOAN AND ADVANCES


5.

HOUSE BUILDING ADVANCE

a. House Building Advance is granted to a permanent employee


who owns a plot of land in his own name at any place in
Pakistan including Azad Kashmir, from the Government
resources.
b. The advance will be granted for the constructions of new house
and for the bonafide residential requirements of the Government
servant himself. A second advance may however be granted to
a Government Servant for the construction of house in any
where in Pakistan subject to the condition that the Government
Servant concerned has fully repaid the building advance, drawn
from the Government together with interest if applicable
thereon.
c. The advance should not exceed 36 months running basic pay of
a Government Servant. Advance from G.P. Fund account for
the construction of house will not be taken into account for the
purposes of calculating total house building advance to which a
Government Servant is entitled.
d.

An advance for the new construction of a house may be drawn


in
two equal installments, the first will be paid on production of
documents establishing property rights in the land and the second
will be paid only when the house reaches plinth level.

6.

HOUSE PURCHASE ADVANCE

a. Advance for the purchase of a constructed house may also be granted


a permanent employee. The advance should not exceed 36 months
running basic pay of a Government Servant.

b. After drawl of advance the Government Servant will have to purchase


the
constructed house and get it mortgaged in the name of the
President
of Pakistan. The mortgage deed will be submitted within 6
months of the
drawl of advance or before the close of financial year
whichever is earlier. In
case of failure the employees will have to
refund
the
entire
amount of advance in lump sum into the Government
Treasury.
Alternatively, the amount will be recovered from the pay of
the Government
Servant by stoppage of his pay till final liquidation of
the amount.
7.

RECOVERY OF HOUSE BUILDING/HOUSE PURCHASE


ADVANCE
a. The amount of advance is recoverable in 120 installments. The
recovery of advance should start from the month immediately after
the drawl of the second installment, whichever is earlier. The
total
recovery of advance should be followed by
recovery of interest in
suitable installments in such a way
that amount of installment should
not exceed the amount of
installment of the advance.
b. In case of Government Servants, who are due to attain the age of
superannuation within ten years, the amount of advance
should be
reduced so much as would enable the
recovery of the advance
along with interest thereon
at a rate not exceeding one fourth of pay
in one month, before
attaining the age of superannuation, unless a
written
under taking is furnished by the Government Servant to the
effect that deduction on account of re-payment of amount of advance
and interest may be made at such rate (which should be
clearly
specified) so that the amount to advance and
interest there-on is
repaid in full before the date of
superannuation.
c. In order to secure Government from loss consequent upon a
Government Servant dying or quitting service before the repayment
of advance together with interest is completed the house so
built or
purchased and the land on which it stands
should be mortgaged to
the President of Pakistan
which will be released only when the entire
amount of advance
and interest is liquidated. The mortgage deed
should
be executed in form GFR 23, 25 or 29 as the case may be.
The sanctioning authority should scrutinize the deed and render a
certificate regarding its correctness. The deed will be kept in
the
custody of the sanctioning authority until the
advance and interest is
fully repaid.
d. A Government Servant drawing advance both from Government and

from his G.P. Fund account will have to execute separate mortgage
deeds covering the amount of advance from Government
resources
and G.P. Fund account and get registered.
Recovery of each
advance will be made concurrently.
8.

LOANS FROM

FINANCE

Loan applications of the F.G.E.I. Employees will be forwarded to the House


Building Finance Corporation through the Directorate.

GRANT
OF
HOUSE
BUILDING/HOUSE
PURCHASE
ADVANCE TO TEMPORARY GOVERNMENT SERVANTS

House Building/House Purchase advances may be granted to temporary


employees on the following conditions:
a. The temporary Government Servant has completed at least 10 years
continuous service. Grade-1 and 2 temporary employees are eligible
irrespective of the length of temporary service.
Note: The condition of completion of 10 years continuous service shall not be
applicable in case of a Government Servant directly recruited through the C.S.S.
competitive EXAMINATION/EVALUATION SYSTEM-2013
Ination or appointed through the Federal Public Service Commission, who has
successfully completed the prescribed period.
b. Head of Department certifies that the services of the Government Servant
concerned are not likely to be terminated within the period prescribed for
the repayment of advance
c. Surety of two permanent Government Servants (who are not likely to retire
before the house is built and mortgaged), is furnished which will be
released when the house has been built and mortgaged to the
Government.
d. Whsere the land already been acquired, it should be mortgaged together
with the house to be built there on before the advance is sanctioned.

4.

ADVANCE FOR PURCHASE OF CONVEYANCES

The Government Servants may be granted advances for purchase of


conveyances, if the competent authority is satisfied that the maintenance of a
conveyance will be in the interest of public service. Such advances will be
sanctioned by the Director, F.G.E.I. (C/G) Directorate to Employees.

5.

ADVANCE FOR THE PURCHASE OF MOTOR CAR


a.

Motor Car Advances arc granted to officers on the following


conditions:-

The officer is not likely to retire within 5 years from the grant of
advance.

c.

The officer should have served at least for 10 years. The officer is
already not in possession of a vehicle.

d.

The advance will be recoverable in 60 equal monthly installments


together with interest if accrued thereon.

e.

The vehicle purchased will be mortgaged to the President of Pakistan,


The mortgage deed will be submitted to Directorate' for safe custody.

f.

The vehicle will also be got insured from any -insurance Company.

ADVANCES FOR THE PURCHASE OF MOTOR CYCLE /


SCOOTER:

Motor Cycle/Scooter Advances are granted to employees on the following


conditions:a.

The employee is not likely to retire within 5 years from the grant of
advance.

b.

The employee should have served at least for 2 years.

c.

The employee is not already in possession of a vehicle.

d.

The advance will be recoverable in 60 equal monthly installments


together with interest if accrued thereon.

e.

The vehicle purchased will be mortgaged to the President of Pakistan.


The mortgage deed will be kept in safe custody by the respective
Regional Offices.
f.

The vehicle will also be got insured from any Insurance Company.

ADVANCES FOR THE PURCHASE OF BICYCLE


Bicycle advances are granted to low paid employees, on the following
conditions:-

a. The employee is not likely to retire from Government Service within


years of the grant of Bicycle Advance.

b. The advance will be recovered in 48 installments from permanent


Government Servants and in 30 installments from those who are
not permanent.
c. A Temporary Government Servant should produce a surety from a
permanent Government Servant.
14.

INTEREST FREE LOANS


As a special dispensation from normal rules mentioned in the
General Financial Rules (G.F.R.), Government has decided that no
interest may be charged on the House Building and Conveyance
advances drawn by a Government Servant whose deposit in the provident
fund carry no interest, subject to the following conditions:
a. The Government Servant has not received interest on his

Provident Fund accumulation prior to the drawl of the advance


from the Government.
b. The interest to be remitted under these orders shall not exceed
the amount of interest foregone by the Government Servant
concerned on his Provident Fund account upto the date on
which the interest on Government loans would become due for
payment.
c. if at any time in future the Government Servant who has availed
himself of this concession choose to take interest on his
provident fund deposits, he will be required to pay in full the
Government the amount of interest accrued on the advances
drawn by him from the Government
d. The above decision will also be applicable in the case of
Government Servants who have already drawn advances from
the Government, but the recovery of interest charges accrued
thereon has not been made from them.

UNDERTAKING
1.

1 understand that my employment under Government is temporary and


that my services may be terminated by Government at any time, without
assinging any reasons, by giving a notice for a period not less than 14
days or payment, in lieu of the notice; of- a sum equivalent to my pay for
14 days or for the period by which the notice falls short of 14 days. I
agree that if I wish to terminate my services under Government at any
time, I shall resign in writing and shall thereafter continue the Govt
service until my resignation is accepted.

2.

I also understand that if I absent myself from duty without resignation in
