Massage therapist charged with sexual assault

Abdul-Aziz albekairi also known as Aziz was charged with

sexual assault. He has worked in many establishments
since 2006. According to police, A 26 year woman visited
the massage center where she was assaulted by the
owner Aziz. Police believe that there might be more
victims as this person has worked at many sites. He was
charged on 10th July and scheduled to appear in court on
10th august. (Westall, 2015)
Here in this case the person who affected directly is the
victim, a 26 year woman. Police department might get
affected as this sexual assault cases are happening most
often now days. Also the family members of Aziz are
affected directly. The society is indirectly affected as this
kind of case put a question on the woman security and
the law system. This profession of massage is also
affected indirectly somewhere due to this kind of cases.
It is the clear case of criminal injustice where Aziz tried to
violate fundamental rights of the woman. This case can
be reviewed by two perspectives. When we think this
case from the perspective of Aziz, is it okay to harass a
customer who is female just due to advance your desire
of sex? According to utilitarian perspective, the greater
happiness would have been only come if the victim is not
assaulted by Aziz. If she was treated normally, not
assaulted by the men then the woman would be happy,

the family member who directly affected by this case

would be happy. So according to utilitarian, sexual assault
should be avoided as it does not advance utility or
happiness.
Now if we see another perspective in this case from the
victim side. The victims right had been violated without
her consent, against her desire. According to
libertarianism, the woman has right to make decision on
what she wants and what she doesnt. it she is assaulted
without her consent then it would be the typical case of
criminal injustice.
Now from the perspective of police, the man should be
charged according to libertarianism concept as he
assaulted the woman which violates the liberty rights of
the victim. And according to utilitarianism, the man
should be warned and set free as it will give the greater
happiness than if he charged. The family of the man
would be happy. But if further investigations in this case
reveals that there are more victims of sexual assault by
Aziz then he should be charged.
According to my point of view, harassing someone would
violate the liberty rights of an individual who is being
harassed. it is completely against moral duties of a
responsible human being. I think utilitarianism best
explains this kind of case. For example, consider a
scenario of a woman doing job where she got promotion
because the boss wants to satisfy his sexual desire with
her without her consent. Here according to utilitarianism,
he should not treat the office staff according to their

gender. He should give promotion on performance basis

which will satisfy the staff not only the woman and the
greater happiness will come.
In any society, any culture the inequality occurs between
male and female. Females are often considered inferior to
male. This should need some changes. I think Aziz should
be warned and set free or given social lesion to treat
woman which will give greater happiness to society. But if
investigation reveals more victims assaulted by him then
he should be punished according to laws.
