AFFIDAVIT OF COMPLAINT
I, _________, Filipino of legal age, married and a resident of
Poblacion, San Pablo, Zamboanga del Sur, after having duly sworn to in
accordance with law, do hereby depose and avers that;
1.

I am an incumbent Municipal Vice Mayor of the Municipality of

San Pablo, Zamboanga del Sur;

2.

The Local Government Unit of San Pablo, sponsored a program

entitled HATOD SERBISYO SA BARANGAY; some of the highlights

of said programs, were medical outreach, social services and other
basic public services;
3.

On ________________ or prior to the implementation of the

program, the Municipal Government of San Pablo called all the

Barangay Captains/Chairmans within the jurisdiction of San Pablo; one
of the agendas in said meeting is the participation and coordination of
all barangay officials and the venue for every barangay where the
program is to be held. However, the Barangay Captain of Barangay
Sagansan did not attend the meeting. It instead send a representative
in the person of ________________;
4.

On said meeting, I then informed the representative of Barangay

Captain of Barangay Sagasan, San Pablo, that the program/activity will

be

held

on

__________

at

the

Barangay

Hall.

However,

the

representative manifested that he cannot decide for himself as to the

date and venue because as per instruction given to him by Barangay
Captain, the latter signify that they will not participate the activity and
suggested that it is better for us to look for another venue, other than
the barangay hall;

On the scheduled date March ____, 2016, I together with some

Sangguniang Bayan members and our team proceeded to Sitio

Mariguato, Barangay Sagasan, San Pablo, Zamboagna del Sur; and at
around 10:00 oclock in the morning, we then started rendering the
basic public services to the constituents of said barangay;

Aside from actually supervising the program/activity, I also

entertained any question from the constituents of said barangay;

7.

In the middle of the activity/program,

___________, Filipino, of

legal age and an incumbent Barangay Kagawad of Barangay Sagasan,

San Pablo, Zamboanga del Sur, suddenly arrived and without
legitimate and valid reason interrupted the activity, angrily scolded
some of our team; he then forcibly disarranged some of the tables
where our team actually rendered basic public service, causing the
people to panic; he then tried to dissolve the activity by forcibly
convincing the people who attended the activity to leave the area;;

When ________ saw me, the latter then walked towards my

direction; he then pointed directly his fingers to me and uttered a

statement in bisayan dialect MGA WALA MOY MANGA BATASAN,

KAPITAN, KINSA MAY NAG TUGOT NINYO DIRI NGA MO HATUD

RESPECT ME AND ALSO TO OUR BARANGAY CAPTAIN, WHO
GAVE YOU PERMISSION TO DELIVER PUBLIC SERVICES IN
BARANGAY SAGASAN?, I DONT AFRAID OF YOU);

While uttering the aforesaid statement, _________ repeatedly

smashed the table which is just beside me; he then kicked one of the
chair in front of me; at that moment, I then stood and tried to calm him
down, however, he tapped my hands and pushed me away;
10.

That instant when __________ laid his hand on me, some

Sanggunian Bayan members tried to approached him but I instructed

them to stay put and leave the matter to me, I then told ______ to calm
down and to settle the matter, but the latter refused to listen and
continue murmuring something; suddenly his wife____________ arrived
at the scene and in front of us, he told her husband NGANONG NAG
UNA-UINA MANKA DIRI, WALA MANKA KA HULAT NAMO UG
KANG KAPITAN (WHY DID YO GO AHEAD OF US HERE, YOU DID
NOT WAIT US AND TO CAPTAIN);

when I heard this statement, it was only then I together with our

team realized and learnt that ______________ together with his unnamed

companions have conspired and planned to harass, interrupt and tried

to dissolve the ongoing basic public services we have rendered and
delivered to the constituents of Barangay Sagasan, San Pablo,
Zamboanga del Sur;
12.

I then advised _________ and his wife to just leave the premises

so that we can proceed and continue to render and deliver the basic
public services to the constituent of Barangay Sagasan, San Pablo,
Zamboanga del Sur; the two then left the premises and went to a
nearby Sari-sari store;
13.

I then instructed my team to return to their respective place to

continue what we have started; I also called the people to come back;
14.

I am executing this Affidavit of Complaint to attest to the truth

and veracity of the foregoing statements for the purpose of instituting

criminal action against _________________ for Direct Assault and
Prohibition, Interruption and Dissolution of Peaceful Meetings and this
affidavit may also serve for any legal purpose;
