AGREEMENT BETWEEN ARCHITECT AND

AGREEMENT
This Agreement is made on February 15, 2016.
Between The Client:
And Architect:
ABC,
Adajan, Surat.

XYZ Architects,
GCPIA, VNSGU, SURAT

For the following Project:


Comprehensive architectural services to Residence at Adajan, Surat.

Scope of work:
The architect is required to provide services in respect of the following:
o Taking clients instructions and preparation of design brief.
o Site evaluation, analysis and impact of existing and/or proposed development on its
immediate environs.
o Design and site development.
o Structural design.
o Sanitary, plumbing, drainage, water supply and sewerage design.
o Electrical, electronic, communication systems and design.
o Heating, ventilation and air conditioning design (HVAC) and other mechanical systems.
o Elevators, escalators, etc.
o Fire detection, fire protection and security systems, etc.
o Periodic inspection and evaluation of construction works.

Architects Responsibilities:
The architect shall, after taking instructions from the client, render the following services:
o

Preparation of sketch designs (including carrying out necessary revisions till the sketch
designs are finally approved by the client), making approximate estimates to enable the
Client to take a decision on the sketch designs

Submission of the site plans and other drawings to the municipal corporation of Surat
and obtaining its approval.

o Preparation of architectural working drawings, making structural calculations and


preparing all structural, mechanical, sanitary, plumbing, drainage, electrical drawings,
specifications, detailed estimates of cost or such other particulars as may be necessary for
the preparation of bills of quantities.
o

Preparation of landscapes and planting drawings.

o Preparation of six copies of the contract documents including all drawings, specifications,
bill of quantities, or other particulars and such further details and drawings, as are
necessary for the proper execution of the works.

o Supervision and inspection of the said works by the general contractor, sub-contractor,
consultant, etc. that may be engaged from time to time by visiting the site periodically.
o To check measurements of works at site, checking contractors bills, issuing periodical
certificates for payment and passing and certifying accounts, so as to enable the client to
make payments to the contractors and making adjustment of all accounts between the
contractors and the employer.
o Submission of detailed account of the steel, cement and any such other material as the
employer may specify, and certify the quantities utilized in the works.
o Obtaining of building completion certificate and securing permission of Municipal
Corporation or other authority for the occupation of the building and obtaining refund of
deposits, if any, made by the Client to the Municipal Corporation or other authority.
o Any other service connected with the said works usually and normally rendered by
architects and not referred to in any of the items referred to above.
o The architects shall not make any deviation, alteration, addition or omission from the
approved drawings without the prior written consent of the client.
o The employer or the architects shall not assign, sublet or transfer their interest in this
agreement without the written consent of the other.

Professional Fee:
o In consideration of the professional services rendered by the architect, client shall be
professional fee & other charges in accordance with the scale of charges.
o The client shall pay all the taxes as & when applicable on the professional services
rendered by architect as per the government rules.

Payments and Compensation to the Architect:


The employer shall pay fees to the architects in stages as follows:o 10% of the total fees, payable after completion and approval of the site plans by the
Client.

o 30% of the total fees payable after completion of all drawings and the approval of site
plan by the Municipal Corporation or other authorities.
o 10% on completion of detailed estimates, submission or recommendations on the
contractors rate to the Client, and execution of the contract documents for the various
trades. The Client may make part payments in proportion to the services completed in
respect of particular trades.
o Out of the remaining 50% of the total fees, 30% of the total fees shall be paid by
installments as the building work proceeds, and in proportion to the value of the said
works as certified from time to time and balance 10% after final completion of the
building and closing of accounts.
o In case this agreement is terminated earlier, fees shall be paid to the architects for the
actual services rendered as per stages referred to in this clause.

Clients Responsibilities:
The client shall discharge all his obligations connected with the project and engagement of the
Architect as follows:
o To provide detailed requirements of the project.
o To provide property lease or ownership documentation.
o To furnish specific conditions to be followed.
o To pay all fees & expenses.
o To give effect to the professional advice of the architect & cause no changes in the

drawings & documentation without the consent of the architect.


To honour architects bills within one month of its submission.
To appoint a site supervisor or construction management agency as per the architects
advice.

Termination of Agreement:
o Agreement between the architect and the client may be terminated by either one giving
the other a written notice of not less than 30 days, should either failed substantially to
perform his part of responsibilities/duties, so long as the failure is not caused by the one
initiating the termination.
o When termination of this agreement is not related or attributable, directly or indirectly to
any act, omission, neglect or default on the part of the architect.

In the event of architects firm closing its Business or the client having terminated the

agreement, the client shall have the right to employ another architect to complete the
wok, after making payment to the previous architects firm.

Note:
o Architect can suggest client different agencies, but architect will not take any responsibility
regarding any agencys work & service.
o If client is not satisfied with any agencys work, then client can deduct fees from agencys
final bill.
o Without architects approval or without any note from architects office client should not
release any payment to any agency.

Arbitration:
o All disputes or differences which may arise between the client and the Architect under

Conditions of engagement and Scale of charges with regard to the meaning or


interpretation or matter or thing done or to be done in pursuance hereof, such disputes
and differences shall be referred for arbitration to the Council of Architecture.
The arbitrator shall be appointed by the President, Council of Architecture. The
arbitration shall be conducted as per the provisions of the arbitration and conciliation
Act,1996. The decision and award of the arbitrator shall be final and binding on the
Architect and the Client.

IN WITNESS where of the parties here to have subscribed their respective hands here to and
on a duplicate hereof on the day and year hereinabove first mentioned.
