COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This COMPROMISE AGREEMENT is entered into by and between:
PEDRO M. TRESVALLES, of legal age, married, Filipino and a residentof

- and JENNIFER S. BALDUEZA, likewise of legal age, married, Filipino and a resident
of _____________________;
WITNESSETH:
WHEREAS, the above-named parties, with the assistance of their counsels,
have come up with a fair and reasonable compromise settlement of their dispute
involving P150,000.00 representing amount invested with the Second Party and
damages, the initial agreement consists in the payment of the following:

ACKNOWLEDGMENT RECEIPT/UNDERTAKING
I, CHERLY P. BLEN acknowledged receipt from SADAT A. BADRUDIN of the sum
of ONE HUNDRED TWENTY THOUSAND (Php 120,000.00) PESOS as payment
for the following:
EXPENSES FOR DELIVERY OF KYLE
DOWER

Php 70,000.00
Php 50,000.00
Php 120,000.00
TOTAL

The above payments are pursuant to the Order of the Shariah Case No. 1107 for
SUPPORT AND PAYMENT OF DOWER. It is understood that this P 50,000.00 payment
of dower is only 50% of the amount decreed by court.

I, SADAT A. BADRUDIN undertake topay the balance of P 50,000.00, the back

support in the amount of P 6,000.00 per month and the P 100,000.00expenses by
the undersigned (Cherly P. Blen) in SDC Special Proceeding Case No. 2012-291 for
APOSTACY within six (6) months from the date of this Acknowledgment
Receipt/Undertaking.
The DISMISSAL of Criminal Case No. 24911 for Violation of R.A. 9262 against SADAT
A. BADRUDIN and the execution of a Compromise Agreement to be submitted to the
Court shall be made upon full payment of the balance.
The amount of the back support to be paid shall be computed based on receipts and
other evidence available and verifiable.
Done this 31st day of August 2013 in Zamboanga City, Philippines.

WHEREAS,SADAT has faithfully and voluntarily performed, delivered and
complied with all the understakings set forth in the foregoing agreement, and he
hereby understakes to comply with the obligation of giving support to the child
under the applicable laws;
WHEREAS,the stipulated monthly support for NATHANIEL KYLEshall be Six
Thousand (P 6,000.00) Pesos to be deposited in a bank account for the purposes,it
is hereby understood that the support due to KYLE shall increase proportionate to
his needs in accordance with law;all receipts of expenses for additional support in
the future in case of unforeseen medical needs shall be provided SADAT A.
BADRUDIN;
WHEREAS, CHERLY P. BLEN,having acknowledged receipt of the full
amount of the balance under the foregoing Acknowledgment Receipt/Undertaking,
hereby voluntarily ceases and refrains from further prosecuting Criminal case No.
24911 and by virtue thereof, SADAT A. BADRUDIN is hereby released from further
prosecution;
WHEREAS, upon fulfillment of the undertaking provided in the foregoing
agreement (Acknowledgment Receipt/Undertaking), Cherly P. Blen agrees to
execute an affidavit of Desistance to terminate the case pending before the
Regional Trial Court of Branch 15, Zamboanga City docketed as Criminal Case No.
24911entitled People of the Philippines, Plaintiff, versus Sadat A. Badrudin, Accused
for Violation of Section 5(1) of RA 9262;
WHEREAS, this Compromise Agreement is entered into freely and
voluntarily; and the same is in accord with the state policy of protecting and
promoting the welfare and best interest of the child, and as well as promoting
harmony between the parties-litigants.
IN WITNESS WHEREOF, the PARTIES hereto have hereunto signed this
Compromise Agreement, this 28thday of February 2014, in the City of Zamboanga,
Philippines.

AFFIDAVIT OF DESISTANCE

I,CHERLY P. BLEN, of legal age, single, Filipino, a resident of San Roque, Zamboanga
City, under oath, hereby depose and state, that:

1. I am the private complainant in Criminal Case No. 24911 for Violation of RA 9262
against SADAT A. BADRUDIN for failure to give support to our minor son NATHANIEL KYLE.

2. On August 31, 2013, SADAT A. BADRUDIN and I had a lengthy and exhaustive
confrontation in the presence of our respective counsels and some family members and
all domestic issues and concerns were addressed and discussed. All misunderstandings
between us have been cleared and we both agreed that the best interest of our son
should take priority over our resentments and ill-feelings toward each other.

3. SADAT A. BADRUDIN has complied with the Decision of the Shariah District Court in
Shariah Case No. 1107 for Support and has faithfully paid his monthly support to our son

Nathaniel Kyle. He also paid back support to show his good faith. He now shows his
concern for our son and a father and son relationship between him and NATHANIEL KYLE
is slowly developing. Our son now knows his father even if he does not see his father
regularly due to distance.

4. Pursuant to the State policy of protecting and promoting the best interest of the
child, who in this particular case is a child with special needs, and in order to preserve
the present atmosphere of amity between us, after serious consideration, I have decided
not to pursue the prosecution of the instant case against him. He has learned his lesson
and he is now forthcoming and prompt in sending his support for our son. I have not
come to this decision lightly as it took me some six (6) months of serious thinking to
reach this decision.

5. I am executing this affidavit to categorically state that I am DESISTING from

prosecuting the instant case against SADAT A. BADRUDIN and I pray that the Honorable
Court shall DISMISS the case against the said accused.
