Assignment Brief

Contract was signed between Unique glass Factory as Employer and Ranaweera Construction
Company as Contractor for the construction of plant building, batch house and warehouse.
Unique glass factory wanted to build the plant, batch house and ware house within a shorter period.
(10 months). Therefore, they decided to use traditional procurement method. Later on, they
(Ranaweera Construction) found out problems in the project.
The Contractor commenced work on the project on 15 th February and by 15th of March dispute and
differences arose because the Employer was unable to provide additional information, possession of
construction site on agreed date. Addition to this, the Employer wanted to build a tank farm within
the same contract period. So the Contractor raised an objection in the ground that he is not entitle to
do it within the agreed contract period and he want more time. But employer disagreed. Now
contractor want to terminate the contract and Health & Safety has been compromised due to
negligence of contractor. While scaffolding Three children faced to the accidents who play near by
the site. Neighbors bought an Injunction to prevent continuing the construction project claiming for
damages.

1. Evaluate the services and roles of the parties to the contract within the construction to
markets, organization and the professions.
2. Assume you are the Contractors Quantity surveyor and apply ethics.
3. Assume you are the Consultant Qs in the above project
3.1 Advice client to build the contractual relationship to avoid dispute and the process of
the time claim.
3.2 Determine a suitable procurement method to enable the contract to continue with a clear
rationale and critically evaluate your choice to standard vs. non-standard contract
choice.
4. Analyse the contractual procedures and practices within the industry with particular
reference to standard contracts. (JCT,NEC,PAM)
5. Explain the procedure of health and safety legalization with consideration of the time and
cost implications to the above mention project.
