IX, Sec 40 (Repealing Cause) explicitly dediares that Republic Act No. 7164, otherwice known as the “Philippine Marsing Actaf 19917 is hereby repealed All otherlaws, decrees, orders, eirailars, issuances, rules and regulations and parts thereof which are inarnsistent with this Act are hereby repealed, amended armadifed accordingly"; And corollary herewith, Board of Nursing Resolution No 425 Series 2003 promulgating the Implementing Rules and Regulations to RA 9173-Rule VIL Sec-41 provides that- ‘Any issuance of the Board or Commission or of their respective chairpersons, including resolutions, memorandum, office onders/circulars, et. or any part thereof which is/are in conflict with the provisions of this IRR are deemed supersededor modiffed acm rdingly.” (While the Board of Nursing (BoN) finds that there exist mttain “CARRY OVER POLICIES” m both RA 7164 of 1991 and RA. 9173, some are NO LONGER enunciated or supported under the current law and yet still continue to'be “in effect’, Prevailing conditions demand renewed visi ning and change in palicy ‘consistent with provisions of RA 9173; In consideration of the above and the mandate of the Boani of Nursing to ensure “safe and quality practice” among Filipino Nurses for the essential benefit of the people we serve, adhering to the “Parens Patrfa” responsibility of the State enshrined in thePhilippine Constitution, and in order to protect life, health, property, and wellare of the people; AND (Concerned with the need toisme darstying directions appurtenant to all the observations stad above, hereunder are “BoN ADVISORIES’ DEEMED necessary in onder to provide the necessary guidance to all nurses and nursing groups: L The Intravenous (LV) Therapy Training started under RA No. 7164 (BON Resolution No 08S. 199.4) has in the last 15 years generated 2 competent pool of LV. Nurses. This however has mo specific carry over proviso in RA. No 9173 particularly in the continuance of LV. training. This policy for all legal purposes and intent is now rendered mull in keeping with Art. Thisinitiative currently being undertaken ‘shall require amendatory pronmlgationsfrom the Board of Nursing; 5. Considering prevailing and fast emerging developments in local and global nursing, and in order for the Philippine Nursing sector to respond adequawly to ‘these changes, it isnecessary that mechanisms be instituted towards the creation and building of pools of Filipino Nurse Practitioners to faster productivity and growth. Towards these endsnew initiatives are necessary after the: © Essential review amd revision of BoN Resolution No. 14 S. 1999 and Board Resolution Na 24, series of 1999 under RA. No. 7164, which qreated a National Nursing Specialty Certification Program and Nursing Specialty Certification Counal (NSCQ that need tm be harmonized with BoN Resolution No. 22, 5. 2009 under RA. 9173 - Promulgating a National Career Progression Program (NCPP) to achieve synchrony with the Continuing Professional Education and Devel opment Program (CPEDP) Policy of the Professional Regulation Commission (PRC) as tool wwards realizing Art. VIL Sec. 31 and 33; and Art. V1, Section 28 (e) of RA No. 9173; BoN Memorandum Grcular Na. 99-148. 1999 Mandates Compliance tothe Provisions of RA Na 7164 as to Qualifications of Deans and Faculty Members in Schools and Colleges of Nursing.
