You badly want to move back to Ontario with the kids, where you were raised
and the rest of your large family lives.
Your husband objects, leading to your
marriage breaking up. Like you have all
along, you both co-parent the kids in the
roughly two years it takes for your divorce to be sorted out.

important that Cindy and Todd continue
to co-parent the kids.

Our BC appeal court recently re-visited


this thorny mobility question.
Hong Kong-born Cindy (names changed)
came to Toronto with her Chinese family
when she was four. She moved to Vancouver in 1998 after becoming a vet, and
met her future husband Todd the following year. In 2000 she joined him in Victoria where he lived and worked, and they
got married in 2002.
They had two children, Adam and Ellen,
but after some nine and a half years of
marriage, they split up over Cindys wish
to move the family to Toronto. Cindy
went to court for a divorce and permission to move with the kids.
The key question in these mobility cases
is always whether a move would be in the
best interests of the children. The court
looked at the various factors that have to
be balanced to decide this. It stressed that
each family situation needs to be treated
individually.
Here, both children had an excellent relationship with Cindy and Todd, who were
loving parents, and wanted to stay with
both. A psychological evaluation suggested what was best for the children go-

and benefit from more exposure to their
Chinese cultural heritage.

One significant element was that Adam


had fallen ill at 18 months and developed
learning and other difficulties. He was
diagnosed as hyper-active with attention
deficits and also had non-specific communication disorder. But with a special
individual education plan in school, he
was making progress and could now just
meet his minimum grade level standards.
He was well-liked by his classmates. The
disruption of moving him to a whole
new environment would set him back
more than other kids.
Also, Cindy could pursue her work
equally well in Toronto or Victoria, but
Todd couldnt. He had worked his way up
in one company over 20 years and now
held an executive position there, though
he didnt have corresponding academic
credentials. Unlike Cindy, if he moved to
Toronto to be near the kids, a similar position was likely out of reach, so he might
not be able to provide as well for the kids.
The court concluded that being co-parented in Victoria was best for the children in this case.

And Promises Auction

Christmas is coming to the Kootenay Gallery! It will be


here November 12 with the big Christmas Exhibit and Sale
the Kootenay Gallery has become famous for. The volunteers and staff have been busy seeking new and exciting
gift ideas. The whole gallery will be filled with a huge selection of handcrafted items made by local artists and artisans including metal work, wood, fiber, pottery, jewellery,
garden art, paintings, ornaments and much more. This is
the perfect opportunity to not only find that one of a kind
gift but also a chance to support local artists and artisans.
The opening reception for the Christmas Show and
Sale, a major fundraiser for the Gallery, will be held on
Saturday, November 12 at 7 pm. During this event a fun,
unique fundraiser called Promises for the Cultured Soul
will be held. The Gallery has received promises of Christmas baking, yoga lessons, beautiful weaving, golf package and so much more! The items are available to bid
online, with final bidding taking place at the opening of
the Christmas Sale. There is no admission charge to this
fun evening so come and enjoy some Christmas cheer and
goodies and get a start on you Christmas shopping.
The Kootenay Gallery is open Tuesday to Saturday,
10 am 5 pm. Starting December 1, the hours will
be extended to seven days a week, 10 am 5 pm until
December 24. We are located across from the Castlegar
Airport adjacent to the Doukhobor Discovery Centre on
Heritage Way.

Protein For People Project

About 200 people filled a festive banquet hall on Selkirk Colleges Tenth Street Campus for a meal featuring
protein, something that can be challenging to incorporate into a menu when one is on a limited budget. Protein
for People was a collaborative event that included Selkirk
College Resort and Hotel Management Program students
hosting families and individuals from around the West
Kootenay identified as having food security challenges.
Professional Cook Program students prepared a meal of
salmon, chicken, squash and salads and demonstrated
how to prepare two meals using canned salmon as a
protein.
As we teach our students how to host guests and prepare delicious fare, its important to understand that
healthy food remains out of reach for many people struggling with poverty. We also want our students to learn
the significance of giving back to community, says Selkirk College Hospitality and Tourism instructor Harry
Pringle.
The event was held just one day after the United Nations
International Eradication of Poverty Day, on October 17.
Protein for People Project was started in 2006 as an initiative by BCs labour unions to help support families in
need. Protein for People worked with local food banks
and the community to connect families and individuals impacted by job loss, low wages and limited incomes
with resources they may need to lift them out of poverty.
The many people who live in poverty are not always as
obvious to us as you may think. There are many families
struggling to feed themselves and they may be our own
neighbours, says Debbie Bird, West Kootenay Labour
Council president.
The West Kootenay Labour Council provided the
salmon, rented the Trail Smoke Eaters bus to transport
residents from Trail and Castlegar and coordinated additional community support for the event. Nelson at its
Best, The Salvation Army, Hall Printing, Save On Foods
and Safeway also contributed and the students of Monica
Markin at Trafalgar Middle School made origami boxes
to add to beautiful table dcor. Selkirk College Music and

Students hosted about 200 people for a food forum aiming to


help people struggling with poverty get protein into their meals.
Technology Program students as well as Dennis Leugner
provided entertainment.
Community resources available at the event included
Columbia Basin Alliance for Literacy, Nelson At Its
Best, Circle of Indigenous Nations, The Womens Centre, Canadian Union Of Postal Workers, West Kootenay
Labour Council and Selkirk College Student Union. Nelson City councilors Anna Purcell, Janice Morrison and
acting mayor Bob Adams also attended.
Everyone returned home with warm hearts and full
bellies, he says. Adds Bird, All the guests were overwhelmed by the excellent meal, music, atmosphere and
being treated so wonderfully by the Selkirk College
students.

Following the close of consultation on the future of the


Balfour inland ferry terminal, the Ministry of Transportation and Infrastructure will continue to do further work
on the communitys preferred option, which is to retain
the terminal at Balfour.
We presented options to the community and residents
of Balfour and the Queens Bay area overwhelmingly supported the terminal remaining in its present location, said
Transportation and Infrastructure minister Todd Stone.
We know there are challenges with keeping the terminal
at Balfour. However, as a result of what we heard, we will
focus on doing the technical analysis and work to retain
the terminal at Balfour, including the potential dredging
of the west arm.
The challenges that need to be addressed at the existing
terminal include the narrow channel and shallow lakebed.
In addition, safety improvements may have to be made at
the terminal to eliminate conflicts between highway and
ferry traffic. Further, to maintain the current service levels,
the second vessel, the MV Balfour, will have to be replaced.
The ministry received more than 2,600 online and
mailed submissions (survey questionnaires, emails and
postcards) during the public consultation, held between
June 15 and October 6, 2016. In addition, over 300 people
attended the open house at Redfish Elementary school on
June 15.
Members of the public from communities surrounding Kootenay Lake, business operators in Balfour, Queens
Bay residents, local public safety and community organizations all took the opportunity to express their views. A
summary of the consultation will be available this fall.
Ferry service on Kootenay Lake currently operates
between Balfour on the west side and Kootenay Bay on
the east side. The distance is about nine kilometres, with
a crossing time of about 35 minutes. The MV Osprey
provides year round service with the MV Balfour supplementing summer service. The Balfour ferry terminal has
been in place since 1947.
The Government of British Columbia invests approximately $29 million annually into operation of its 14 inland
ferry routes.

Interior Health (IH) is pleased to announce ANKORS


HIV/AIDS Network, Outreach and Support Society as the
successful proponent to create eight new support recovery
beds in Nelson to serve the Kootenay Boundary area.
These new beds are a great complement to the ongoing work of the mental health and substance use support
workers in the area, said health minister Terry Lake.
Were making progress to support those who have previously struggled to receive the care they require to get back
on their feet.
The eight support recovery beds are the first of their
kind in Nelson and will provide clients a safe, substance
free setting while they await residential treatment, return
from residential treatment or transition to a more stable
lifestyle.
Interior Health board director Patricia Dooley understands firsthand about the pain and suffering endured by
people with mental health and/or substance use issues
and their families. As both a mother and a board member, I am delighted to see the investment in recovery beds
throughout our region. My son Sean struggled for years
with depression, which resulted in periods of substance
use. These were very difficult times for him and those who
love him. There were no recovery beds available when he
was ready to seek help, so his employer and family paid
for private treatment which began his road back to health.
These eight new support recovery beds are long overdue
for the area and I am so happy to know other families will
be able to find help for their loved ones.
Strong partnerships between local governments and
local organizations are key when it comes to addressing
mental health and substance use issues, said City of Nelson mayor Deb Kozak. Its a team effort and the City of
Nelson looks forward to working with Interior health and
ANKORS to ensure our community residents receive the
care and supports they require.
ANKORS anticipates the new beds will begin receiving
clients towards the end of this year. Were very pleased
to be providing these beds right here in the Kootenay
Boundary area, said ANKORS executive director Cheryl
Dowden. Having these beds and the supports that come
with them closer to home is a huge step in helping individuals on their way to recovery.
On July 27, 2016 Premier Christy Clark announced a new
Joint Task Force on Overdose Prevention and Response.
The actions being taken under the task force support the
ongoing work to support and treat British Columbians
with substance use issues, a key priority of government.
In the past two years, the Province has opened more than
220 new beds as part of the commitment to add additional
substance use spaces and ensure better access to appropriate substance use supports.

Giving Tuesday

In an effort to balance the crazy getting and spending of the holiday season, philanthropic organizations
around the world have countered with a special day
that emphasizes giving. That giving can be expressed in
many different ways and doesnt need to be limited one
just one day during the year. In your community you can
look for special occasions that benefit local charities a
Christmas concert where the proceeds go to supporting a
local group, a community dinner perhaps and the many
opportunities to donate toward social inequities in our
own communities.
Thats the monetary side of it. But just as important are
gifts of time and talent that contribute to the welfare of
everyone in our community. We know of several music
students who will be taking their music to seniors homes
and extended care units this month. And every community is loaded with many volunteers who give generously
of their time in many different ways.
This is also the time of year when people with surplus
funds are looking for ways to make tax deductible donations. Community foundations are deliberately set up to
receive charitable donations to build permanent endowment funds that benefit communities in perpetuity. As of
2014 every community in the Columbia Basin is served
by a community foundation.
The Osprey Community Foundation in Nelson and
its three affiliate funds the Community Fund of North
Kootenay Lake, the Salmo Valley Fund and the Slocan
Valley Legacy Fund serve a large part of the West Kootenay with over $7,000,000 in endowments. The earned

interest from those endowments benefit the many registered charities in their communities on an annual basis.

A Burst Of Joyful Colour

For respite from these wet, grey days, the Nelson Public Library has the answer. Slocan Valley artist Katya
Coads brilliant floral and landscape paintings offer a
burst of joyful colour in an exhibition on now through
December.
Described as a whimsical gardenscape painter, Coads
work embraces growing things. If I were a flower or a
vegetable, who would I be and what would I see? she
asks. I express myself through the lens of the natural
world, frequently using a framework of playfully exaggerated abstraction along with vivid colour to heighten
the overall impact of my designs.
Her rustic lifestyle a counterpoint to her earlier Vancouver city life provides much of Coads inspiration.
Her work has been featured recently in the Columbia
Basin Culture Tour. She shows her acrylic paintings
throughout the region and beyond, offering prints and
cards along with original artworks.
The body of work presented here is a simply stated
reflection of my past experiences living within the natural world, which is where I place the faith that makes up
my hopes and dreams for the future of our planet, she
says.
Coad plans to offer two distinct exhibitions during her
two-month show at the library, with works celebrating
the snowier side of things on display during December.

Resurfacing The
Great Northern Trail

The Regional District of Central Kootenay (RDCK) has


now started resurfacing portions of the Nelson Salmo Great
Northern Trail (GNT), a project that will improve drainage
and create a more consistent trail surface for cyclists. The
initiative is a partnership between the RDCK, Bike BC and
the City of Nelson.
Resurfacing the Great Northern Trail will make cycling
easier and more accessible for everyone, said Ramona
Faust, chair of the RDCKs Nelson, Salmo, E, F, G Parks
Commission. The new granular surface, as well as the
drainage work, will greatly improve trail users experience.
The resurfacing/granular material specified for this project
has been used successfully on a number of rails to trails
projects in BC.
Work on this project is expected to take approximately
three weeks and is primarily focused on the section of trail
between the Svoboda Road and Falls Street/Cemetery trailheads. Trail users should expect intermittent localized closures during drainage work construction with a full trail
closure when resurfacing material is being installed. This
closure is necessary due to the many vehicles which will be
required to travel on the trail.

Students Financial Stress

Selkirk College has provided 43 outstanding new students with a great start to their post secondary education.
At a special Entrance Scholarship Award Ceremony on
the Castlegar Campus, a total of $66,000 was provided
to students beginning their educational pathways in a
number of different Selkirk College programs. Entrance
scholarships provide an outstanding start to students who
choose Selkirk College, said Selkirk College vice president of Student Advancement Cathy Mercer. Having the
opportunity to lessen the financial strain from the start of
their post secondary journey allows our learners to focus
on their studies and work towards their ultimate goal.
The majority of the students receiving entrance scholarships are recent high school graduates who have demonstrated strong academic achievement. Students apply
for the scholarships between February 15 and March
31 of the previous year. The awards are open to all first
time students in the Selkirk College region. Receiving
an award like this scholarship is a great honour to us students because we know that we are being recognized for
the academic accomplishments that we have worked very
hard to achieve in the past years, said recipient Jessica
Auger, who spoke on behalf of her peers at the ceremony.
It drives us even more to keep working on these accomplishments every day.
The entrance awards are worth $1,300 on average, helping students pay for tuition and books. Scholarships
play a vital role in a students academic journey because
it helps us get steady on our feet for the year, said Auger,
who is in the School of University Arts and Sciences. It
also reminds us of our accomplishments when we wobble
under the weight of four textbooks and it shows that we
are recognized for our academic skills.

The Nelson and Area Economic Development Partnership (NAEDP) set a strategic goal in 2015 to strengthen
our digital economy and to be recognized by the Intelligent Community Forum by 2018. As a result of the efforts
of a highly engaged group of entrepreneurs and community partners, an application was recently submitted to the
Intelligent Communities Forum to recognize Nelsons successful strategies to prosper in the broadband economy.
The results were announced Wednesday, October 19 at
the Intelligent Community Forum (ICF) in Niagara Falls,
Ontario and Nelson emerged as one of the top 21 cities
in the world. The forum recognizes the best practices of
communities around the world as they move forward in
using technology to improve the economic, social and
cultural well-being of citizens.
Mayor Deb Kozak says this is just one more reason to
be proud of our community. Broadband is part of a citys
infrastructure, just as important as sewer, roads and water.
If a community chooses to ignore this, they risk the possibility of being left behind. Nelson ranked in the top 21
out of 400 communities around the world including Moscow, Queensland, Australia and Edmonton, Alberta. Nelson also holds the proud distinction of having the smallest

Caring For Your Senior Pet

One thing pet owners can agree on is that we want our


pets to live as long as possible forever would be ideal!
As our beloved pets grow older, it can be difficult
to watch them begin to show signs of decline and its
common for pet owners to think of aging as a disease.
However, aging is not a disease its a progressive
process in which the pets body may lose the ability to
maintain normal bodily functions or respond to environmental factors.
Signs such as limping, losing weight, or changes in
drinking or eating habits are often not due to getting old
they may actually be symptoms of diseases that could be
alleviated with proper nutrition and medical care. Some
signs of aging are obvious and can be seen easily, such as
a greying coat. However, most signs of aging are more
difficult to see, so thats why its important to work with
your veterinarian.
What can you do for your aging pet?
Pay close attention to subtle changes nobody
knows your pet better than you do!
Make sure your pet receives an annual examination from your veterinarian they are trained to
pick up on changes and can diagnose and treat
disease before it worsens. Its not uncommon
for pets who come in for a routine checkup to
have one or more abnormalities appear on their
examination or blood tests, even when they
appear healthy.
Ask your veterinarian to perform a nutritional
assessment to determine the diet best suited for
your pet. Proper nutrition becomes even more critical as dogs and cats are aging and the best diet for
your pet will allow for a healthier skin and coat, a
well functioning digestive system, strong muscles
and support for internal organs.
As unrealistic as forever is, youre definitely able to positively influence your pets quality of life! With nutritious
food, routine preventative care and close monitoring of
any subtle changes in your pet, you may be able to prevent
a disease associated with aging or catch it earlier and slow
its progression. Which means more time to share with
your happy, healthy companion through their golden

National Child Day

Celebrate National Child Day on Wednesday, November 16 at the Castlegar Kootenay Family Place, 767 11th
Avenue. Professional story teller Shaya Jones will be on
site to present traditional, oral, stories around this years
theme we have the right to belong.
We will also host a Q&A session at 10 am and 1 pm with
our speech and occupational therapists. Developmental screening will be available throughout the day. Meet
with an early childhood professional and learn about your
childs development using a play based approach. Registration required for screenings, please call 778-460-5094.
The event will take place from 9 am to 5 pm and there
will be cake, snacks, arts and crafts and more. Story times
are 11 am and 11:30 am and 3 pm for school age children.

since 1993 to commemorate the United Nations adoption of two documents centered on childrens rights: By
ratifying the United Nations Convention on the Rights of
the Child in 1991, Canada made a commitment to ensure
that all children are treated with dignity and respect. This
commitment includes the opportunity for children to
have a voice, be protected from harm and be provided
with their basic needs and every opportunity to reach
their full potential.

Feast For The Peace In Vallican

On Sunday, November 20 from noon till 2:30 pm, the


Vallican Whole Community Centre will host a Feast for
the Peace. This is an information and discussion session
about the proposed Site C dam on the Peace River. We
are determined to present both sides of this issue as well
as we can, says organizer Moe Lyons. We will present the
governments reasons for wanting to do this and describe
other support it has, as well as share arguments from the
many voices against it. While we know most people who
come will want to stop it, if there are those who support
the project they are encouraged to participate. We believe
a well-rounded discussion contributes to an informed
opinion. We promise to keep it all civil.
Everyone is encouraged to bring a bag lunch and soup
will be served. Admission is a toonie. There will be people
in attendance who will take up a collection for the fight

Kootenay Seniors Fair A Big Success!

Over 350 seniors and friends turned out for the 2016
Kootenay Seniors Fair held September 30 at the Prestige
Lakeside Resort and Convention Centre in Nelson. Organizers, Nelson CARES Kootenay Seniors Service Provider
Group are thrilled with the turnout and with how much
fun everyone had!
In addition to 35 vendor tables offering information
about a wide variety of health and community services,
seniors participated in belly dancing, chair yoga and tai
chi. The Caf Area was popular, giving seniors a chance
to rest and visit over a cup of coffee. One of the biggest
hits was the vintage horse and carriage rides, provided
free of charge by Crystal and beautiful Percheron horse

that for many seniors the ride brought back childhood
memories and she enjoyed listening to their reminiscences along the way.
Seniors were also able to avail themselves of foot care
checks, hearing screenings and chair massages, as well
as fall prevention and lung health consultations. Outside
seniors toured a full-size city bus and HandyDART, learning about how to use transit. Seniors also got hands-on
computer experience at the Cyber Table and checked out
Nelson Tramways new wheelchair lift. Hourly door prizes
were made possible by donations from 14 local merchants
and artisans.
The Kootenay Seniors Fair is an annual event and organizers are already busy planning for next year. If you are
a senior who attended the Seniors Fair, the organizers

Backcountry Basics

As more winter outdoor enthusiasts venture into the


backcountry, the chances of someone getting caught in an
avalanche increase.
Snow conditions arent the only thing you should check
before heading out to ski, snowboard, or snowmobile this
winter. Its also critically important to study avalanche
advisories, and to understand how local weather conditions can affect the terrain at your destination. Leave a
trip plan behind with a responsible person before venturing into the backcountry and pack a beacon, shovel,
probe, and other emergency gear (such as an avalanche
transceiver). Once at your destination, watch for changing
weather conditions that may indicate new safety concerns.
Consider hiring local guides who have the special training
to keep you safe in the high country. Check the Canadian
Avalanche Associations website www.avalanche.ca for
current conditions. The Kootenay region is an exciting
and fun place to be in the winter. Be warm, have a great
time, and most importantly, be safe!
