3. In regards to the suspects of this investigation involving the theft of city funds I was unable to

uncover sufcient evidence to determine violations of law, That portion of this investigation
suspended unless further investigative leads are developed.

The alleged violations of law for Kyle Weiss are:

Misuse of ofcial information, RsMo. 576.050, Class A Misdemeanor.

4. A chronological synopsis of events is as follows:


a) On Wednesday, August 5, 2015, I was asked by Lieutenant P. Gregory, to conduct an
investigation regarding allegations of theft from the City of Pevely.

b) On Wednesday, September 2, 2015, at approximately 1015 hours, interviewed Pevely
Police Ofcer, Robert Young, badge number 775. Officer Young stated he purchased a

weapon and he paid for the weapon with cash. Officer Young stated he

the Firearms Transaction Record and had not signed one when he purchased his duty
weapon.

On Wednesday, September 2, 2015, at approximately 1033 hours, I interviewed Pevely


Police Ofcer, Corporal Edward Zeller, badge number 794. Corporal Zeller said he
bought his duty weapon and was provided a signed receipt for the purchase.
On Wednesday, September 2, 2015, at approximately 1055 hours, I interviewed Pevely
Police Chief, Ronald Weeks. Chief Weeks indicated he placed Captain Sullivan in

charge of selling the weapons to the officers and collecting the funds. Chief Weeks
indicated he purchased ve weapons and his daughter purchased two. Both paid by
check and neither have cleared the bank. Chief Weeks provided signed receipts for the
purchase of the weapons.
e) On Wednesday, September 2, 2015, at approximately 1132 hours, I interviewed Pevely
Police Ofcer, Detective Charles Moutray, badge number 795. Detective Moutray stated
he purchased two guns and he paid with cash. Detective Moutray added that he thought
he remembered signing a receipt but refused a copy from Captain Sullivan. Detective
Moutray also indicated Sergeant Weiss admitted to him he placed sensitive information
about David Bewig, Jr. on Facebook.

On Wednesday, September 2, 2015, at approximately 1210 hours, I interviewed Pevely


Police Sergeant, Gregory Long, badge number 779. Sergeant Long said he purchased his
duty weapon. Sergeant Long also stated he could not recall if he signed a receipt or not
and was not able to locate one.
Wednesday, September 2, 2015, at approximately 1231 hours, I interviewed Pevely
City Clerk, Amber Adams. Mrs. Adams said she and the City Manager, Dickie Brown,
searched the ofce for an envelope that may contain the funds, but were unable to locate
the missing money. Mrs. Adams said Windstream told her they do not capture who logs
into and out of their account or IP addresses.

h) On Wednesday, September 16, 2015, at approximately 1011 hours, I interviewed former


Pevely Police Captain, Kevin A Sullivan. Deputy Sullivan admitted to collecting the
money for the weapons and transferring it to Mr. Hanks. Deputy Sullivan also admitted
that Detective Moutray told him Sgt. Weiss made the post on Facebook.

On Wednesday, September 23, 2015, at approximately 1051 hours, Missouri State


Highway Patrol, Division of Drug and Crime Control, Sergeant P. L. Smith and I
interviewed former Pevely City Clerk, William C. Hanks. During the interview Hanks
states he was never given any money, from any person, for the purchase or transfer of the
police departInents guns.

j) On Thursday, October 29, 2015, at approximately 1045 hours, I interviewed Pevely

Police Officer, Sergeant Kyle M. Weiss. Sgt. Weiss admitted releasing sensitive
information about Dave Bewig, Jr. to a citizen who in turn posted the information to
Facebook.

5. Witnesses are as follows:


a) Sergeant Perry L. Smith, Missouri State Highway Patrol, Division of Drug and Crime

evidence collected, and documentation received during this investigation.

Evidence:
