Case no.1. Jagdish boarded an Express train from Mumbai to go Delhi on some
professional work. He was carrying with him a suit case in which there were research
material and cash of Rs.10, 000/-. He complained to the ticket examiner that a
stranger without reservation had entered into the compartment and despite protest
from him and other co-passengers, the stranger occupied the berth and the ticket
examiner did not do anything to detrain the stranger. When Jagdish woke up at 4.00
a.m. the next day, to his surprise, he found that his suit case was ransacked, and
important documents and cash were missing. He alleged that both the ticket examiner
and the guard were unwilling to receive his complaint and therefore he had registered
an FIR with the police at Delhi. Thereafter, he also filed a complaint before the

Case no 2 D draws a bill of exchange on A, payable to P. P transfers it to X, X to Y
and Y to Z. The bill is dishonoured. Who has to give notice of dishonour to whom?
Who may transmit the notice to the other parties?
Case no.3 A demand draft for Rs.30000/- payable to Ankit came into the hands of
Mayank who forged the indorsement purported to be made by Ankit and transferred
the draft by that indorsement to a firm M/S Arora & Co., who got the same and
encashed. Ankit filed suit for recovery as owner against M/S Arora & Co Is the
company liable to pay the amount to the owner of the draft?
Case 4. Nitin admitted his only infant son in a private nursing home. As a result of
strong dose of medicine administered by the nursing attendant, the child became
mentally retarded. Nitin wants to make a complaint to the district forum seeking relief
by way of compensation on the ground that there was deficiency in service by the
nursing home Does this complaint give rise to a consumer dispute and who is a
consumer in this case?
Case No. 5 Sunil purchased a fan for installation in his business premises and the fan
has been found defective. Sunil approaches you to lodge a complaint against the
manufacturer. Will Sunil be treated a consumer under the Consumer Protection Act,
1986?
Case no 6. Where patient was admitted in the morning and organ was removed in the
evening. Surgeon had never carried out tests to assess the renal functioning of patient
before resorting to surgery in such a hurry for which there was no urgency.
Complication had arisen within few days of surgery as septicaemia had developed.
Who is responsible? Does it amount to deficiency in service on the part of Surgeon?

Case no 7 one of the bank note for 500 dollars issued by the Hong Kong and Shanghai
Bank which remained in the pocket of a garment inadvertently was badly damaged
when the garment was washed. The note as recovered in damaged condition, still
indicated the name of the bank, the amount of the note, the promise to pay, bearer, and

the signatures of the bank officers. However the number of the note was missing. The
bank refused to pay. Is bank bound to make the payment? Decide
Case no 8 In the case of Pirbhu Dayal vs Jwala Bank, the plantiff was the customer
of the defendant bank. One cheque out of the cheque book was issued to the customer
was forged. It was purported to have been signed by the plantiff i.e. Pirbhu Dayal. A
sum of Rs 57805/- was paid on the cheque and the plantiff account was debited with
the amount. The plaintiff informed the bank that he had not issued this cheque and
wanted that his account should not be debited with the amount. He sued the bank for
wrongfully debiting his account. Decide who will bear the loss.
Case no 9 Consignment wrongly delivered to third person: In this case Where
consignment was wrongly delivered to third person without following proper
procedure which is in gross violation of express directions contained Airway Bill,
which has resulted in monetary loss to the complainant. Does it amount to deficiency
in service and who will bear the loss?
Case no 10. Where electric supply was supplied to tubewell free of cost without
charging consumption charges. In case of non-supply of electricity can he file a suit
under consumer protection act as a consumer? Decide.
