A. Site Location: Describe the physical location of the site, both generally and specific to its immediate surroundings.
A commercial slrip mall w ith addresses that ranged from 7 I 99 through 7255 SoutJ1 76th Street (odd numbers only) in
Franklin, Wisconsin with tJ1e subject property (referenced as the Property) used as a dry cleaner (Bright Cleaners) and listed
as 7249 South 76th Street.
B.

Prior and current site usage: Specifically describe the current and historic occupancy and types of use.
The strip mall was constructed in 1993 and used as commercial space. The Property has always contained the Bright
Cleaners facility since its inception.

C.

Describe how and when site contamination was discovered.


Weaver Boos conducted a Phase I ESA in April 2011 on the strip mall identifying potential subsurfa,ce impacts associated
with dry cleaning operatjons as an REC. A L i mited Phase II ESA was conducted on tJ1e Property in May 2011 that included
advancing three soil probes with a hand cart. Select chlorinated solvents (VOCs) were detected in one soil sample collected
from the 2' to 4' below ground surface (bgs) interval.

The seEect chlorinated solvents detected during the Limited Phase II ESA in May 20 II are suspected! to have originated from
the dry cleaning operations conducted at the Property.

variations in soil types.
FiE! materials containing black asphalt and white crushed concrete from a depth of approximately 0 to I feet bgs;
Brown silty clay with trace sand from a depth of approximately I to 6 feet bgs; Brown silty sand seam from a depth of
approximately 6 to 7 feet bgs; Brown silty clay with trace sand from a depth o f approximately 7 to 8 feet bgs; Grayish
brown silty clay with trace sand and gravel from a depth of approximately 8 to I 0 feet bgs; B rown fine silty sand from
a depth of approximately l 0 to 12 feet bgs; and Gray silty clay from a depth of approximately 12 to 16 feet bgs.

ii.

Describe the composition, location and lateral extent, and depth of fill or waste deposits on the site.
FiU materials containing black asphalt and white cmshcd concrete from a depth of approximately 0 to I feet bgs were
observed across the Property.

iii.

Depth to bedrock, bedrock type, and whether or not it was encountered during the investigation.
Bedrock was not encountered during the investigation, but geologic maps and online databases suggest Silurian
dolomitic bedrock is present at depths greater than 50 feet.

iv.

Describe the nature and locations of current surface cover(s) across the site (e.g . natural vegetation, landscaped areas,
gravel, hard surfaces, and buildings).
The Property consists of a one-story tenant space with large asphalt parking area to the north, additional strip mall
tenalll space to the cast and west, and a small asphalt paved parking area to the south witJ1 an asphalt paved roadway
soutJ1 of the small parking area. Lallidscaping consisting of mowed grass is present south oftJ1e roadway and slrip mall.

Site Investigation Summary


A.

General
i.
Provide a brief summary of the site investigation history. Reference previous submittals by name and date. Describe
site investigation activities undertaken since the last submittal for this project and attach the appropriate documentation in
Attachment C, if not previously provided.
Weaver Boos conducted a Phase I ESA on April 26, 20 II, with a Phase I ESA Report dated May 27, 20 II on the strip
mall identifying ponential subsurface impacts associated with dry cleaning operations as the REC. A Limited Phase II
ESA dated May 13,2011 was conducted on the Property that included advancing three soil probes with a hand cart.
Select chlorinated solvent volatile organic compounds (VOCs) were detected in excess ofWDNR Residual
Contaminant Levels (RCLs) in one soil sample collected from the 2' to 4' below ground surface (bgs) interval. The
deeper sample collected from soil probe SP-1 (14-1 6' bgs) did not exhibited VOC impacts. Weaver Boos notified
WNDR of the aforementioned impacts on May 24, 20 II.
Furtl1ermore, on June 7, 2011 Weaver Boos advanced six hand probes to a depth of 4' bgs for purposes of characterizing
the VOC impacts observed in soil probe SP-1 I 2-4'. Laboratory results indicated VOC impacts were not detected in any
of the hand probe samples. As the VOC impacts were characterized, Hot Spot Removal activities were conducted and
included tlle excavation and removal of approximately 54 tons (38 cubic yards) of material. The final excavation
dimensions were 15' long by I 0' wide by 6' deep. Five confirmation samples were collected from tlle excavation, one
from each sidewall at 3' bgs and one from the center of the bottom at 6' bgs. Following receipt oflaboratory results
indicating VOCs were not detected above laboratory reporting limits, the excavation was backmled with 3/4" stone to
existing grade. The hand probing and Hot Spot Removal activities are documented in a Supplemental Response
Activities correspondence dated June 28, 20 II and prepared by Weaver Boos. The aforementioned Phase I ESA,
Limited Phase II ESA, and Supplemental Response Activities correspondence were provided to WDNR July 27, 2011.
No activities have since been completed at the Property.
ii.

Identity whether contamination extends beyond the source property boundary, describe the off-site media (e.g., soil,
groundwater, etc.) impacted, and the vertical and horizontal extent of off-site impacts.
Contamjnation does not extend beyond the Property.

iii.

Identity any structural impediments to the completion of site investigation and/or remediation and whether these
impediments are on the source property or off the source property. Identify the type and location of any structural
impediment (e.g., structure) that also serves as the performance standard barrier for protection of the direct contact or
the groundwater pathway.
No impediments exist.

8.

Soil
i.

Describe degree and extent of soil contamination at and from this site. Relate this to known or suspected sources and
known or potential receptors/migration pathways.
1,1 -Dichloroethene and l , l , I-Trichloroetl1ane were detected slightly above ofd1e Soil to Groundwater Pathway
objective. Trichloroetl1ene was detected slightly above of the Inhalation and l111gestion Pathway objectives, as well as
the Soi l to Groundwater Pathway objective. These impacts were detected in only one soil probe from 2 to 4 feet bgs and
due to their nature as chlorinated solvents typically used in dry cleaning and machining, the suspected source would be
the Bright Cleaners faci lity. These impacted soils were subsequently removed.

ii.

Describe the level and types of soil contaminants found in the upper four feet of the soil column.
I ,I -Dichloroetl1ene (0.053 mg/kg) amd I , I , I-Trichloroet11ane (4.0 mg/kg) were detected in excess of the Soil to
Groundwater Pathway. Trichloroetl1ene (0.44 mglkg) was detected in excess of the Inhalation and Ingestion Pathways,

as well as the Soil to Groundwater Pathway. These chlorinated solvent impacts were detected in only one soil probe
from 2 to 4 feet bgs. These impacted soils were subsequently removed.
iii.

Identify the ch. NR 720, Wis. Adm. Code, method used to establish the soil cleanup standards for this site: for example, a
Residual Contaminant Level (RCL) , a Site-Specific Residual Contaminant Level (SSRCL), or a Performance Standard
as determined under ss NR 720.09, 720.11 and 720.19, Wis. Adm. Code. Identify the land use classification that was
used to establish cleanup standards. Provide a copy of the supporting calculations/information in Attachment C.
Default RCLs for Soil to Groundwater Pathways listed in Chapter 720 (NR 720) " Soil Cleanup Standards" Table I and
in accordance with RR 682, generic RCLs for Ingestion, Inhalation, and Soil to GrOtmdwater Pathways for select.
constituents that do not have corresponding RCLs listed in NR 720 were calculated utilizing the EPA Soil Screening
Level website and applicable default parameters as provided within NR 720. The Non-Industrial land use classification
was utilized (see Attachment C.3).

C.

Groundwater
i.

Describe degree and extent of groundwater contamination at or from this site. Relate this to known or suspected sources
and known or potential receptors/migration pathways. Specifically address any potential or existing impacts to water
supply wells or interception with building foundation drain systems.
Groundwater was not encountered during investigation activities.

ii.

Vapor
i.
Describe how the vapor migration pathway was assessed, including locations where vapor or indoor air samples were
collected. If the vapor pathway was not assessed, explain reasons why.
Due to the I imited nature of VOC impacts observed in soil probe SP-1 I 2-4' and lack of groundwater presence during
investigation activities, the vapor migration pathway was not assessed.
ii.

Describe the presence of free product at the site, including the thickness, depth, and locations.
Groundwater was not encountered during i nvestigation activities.

Identify the applicable DNR action levels and the land use clas.sification used to establish them. Describe where the

Due to the limited nature ofVOC impacts observed in soil probe SP- 1 I 2-4' and lack of groundwater presence during
investigation activities, the vapor migration pathway was not assessed.

Surface Water and Sediment

Surface water and sediment were not in the vicinity of the Property, and therefore, were not sampled.

4.

Remedial Actions Implemented and Residual l evels at Closure

date. Identify remedial actions undertaken since the last submittal for this project and provide the appropriate documentation
in Attachment C.
Weaver Boos provided the W DN R with a Supplemental Response Activities correspondence dated June 28, 20 II detailing
the characterization and subsequent Hot Spot Removal activities and confinnation sampling of the lone impacted sample
location (SP-1 I 2-4').

To address chlorinated sol vent impacts present in the soil, Hot Spot Removal activities were conducted to remove the
impacted soil and disposal of the soil at a SubtitleD facility. Based on field screeni ng results, the excavation extended to
approximately I 0' wide by 15' long by 6' deep. Confirmation samples were collected from each sidewall and the bottom of
the excavation and exhibited concentrations below laboratory reporting limits.

This Industrial Waste & Disposal Services Agreement, consisting of the terms and conditions set forth herein, and Exhibit A, and/or Confirmation Lette~(s) and
the Profile Sheet(s) entered into from and after the date hereof from time to time (all of the foregoing being collectively referred to as the "Agreement"), IS made
as of the Effective Date shown above by and between the Customer named above, on its and its subsidiaries and affiliates behalf (collectively, "Customer")
and the Waste Management entity named above ("the Company").

TERMS AND CONDITIONS


1. SERVICES PROVIDED. The Company will provide Customer with collection, management, transportation, disposal, treatment, and recycling services ("Services") for Customer's non-hazardous solid waste, special waste,
and/or hazardous waste (collectively "Industrial Waste") as described on Exhibit A and/or Confirmation Letter(s) and/or applicable Profile Sheets. Solid
Waste means garbage, refuse and rubbish including those which are recyclable but excluding Special Waste and Hazardous Waste. Special Waste
includes polychlorinated biphenyl ("PCB") wastes, industrial process wastes,
asbestos containing material, petroleum contaminated soils, treated/decharacterized wastes, incinerator ash, medical wastes, demolition debris and
other materials requiring special handling in accordance with applicable federal, state, provincial or local laws or regulations. Hazardous Waste means
any toxic or radioactive substances, as such terms are defin~d by applicab~e
federal, state, provincial or local laws or regulations. Alllndustnal Waste that 1s
generated, handled and/or collected by Customer shall be managed exclusively by Company during the term of this Agreement. When Company handles special or hazardous waste for Customer, Customer will provide Company with a Generator's Waste Profile Sheet ("Profile Sheet") describing all
special or hazardous waste, and provide a representative sample of such
waste on request. In the event this Agreement includes transportation by
Company, Customer shall, at the time of tender, provide to Company accurate and complete documents, shipping papers or manifests as are required
for the lawful transfer of the special or hazardous waste under all applicable
federal, state or local laws or regulations. Tender of delivery shall be considered nonconforming if not in accordance with this Paragraph.
2. CUSTOMER WARRANTIES. Customer hereby represents and warrants
that all waste material delivered by Customer to Company shall be in accordance with waste descriptions given in this Agreement and shall not be or
contain any Nonconforming Waste. "Nonconforming Waste" means: (a) nonhazardous Solid Waste that contains regulated Special Waste or Hazardous
Waste; (b) waste that is not in conformance with the description of the waste
in Exhibit A, the Confirmation Letter(s) or the Profile Sheet incorporated
herein; (c) waste that is or contains any infectious waste, radioactive, volatile, corrosive, flammable, explosive, biomedical, biohazardous material,
regulated medical or hazardous waste or toxic substances, as defined pursuant to or listed or regulated under applicable federal, state or local law,
except as stated on the Profile Sheet or Confirmation Letter; or (d) waste
that is prohibited from being received, managed or disposed of at the designated disposal facility by federal, state or local law, regulation, rule, code,
ordinance, order, permit or permit condition. Customer (including its subcontractors) represents and warrants that it will comply with all applicable laws,

ordinances, regulations, orders, permits or other legal requirements applicable to the Industrial Waste.
3. TERM OF AGREEMENT; RIGHT OF FIRST REFUSAL. The Initial Term
of this Agreement shall be 36 months, commencing on the Effective Date set
forth above. This Agreement shall automatically renew thereafter for additional terms of twelve (12) months each ("Renewal Term") unless either party
gives to the other party written notice of termination at least ninety (90) days
prior to the termination of the then-existing term; provided however, that the
terms and conditions of this Agreement shall remain in full force and effect,
in accordance with its terms, with respect to any uncompleted or unfinished
Service provided for in an Exhibit A, Confirmation Letter and/or Profile Sheet
until such Service is completed . Customer grants to Company a right of first
refusal to match any offer which Customer receives or intends to make after
the completion of any Term of this Agreement relating to any services provided hereunder and further agrees to give Company prompt written notice
of any such offer and a reasonable opportunity to respond to it.
4. INSPECTION; REJECTION OF WASTE. Title to and liability for Nonconforming Waste shall remain with Customer at all times. Company shall
have the right to inspect, analyze or test any waste delivered by Customer. If
Customer's Industrial Waste is Nonconforming Waste, Company can, at its
option, reject Nonconforming Waste and return it to Customer or require Customer to remove and dispose of the Nonconforming Waste at Customer's expense. Customer shall indemnify, hold harmless (in accordance with Section
9) and pay or reimburse Company for any and all costs, damages and/or
fines incurred as a result of or relating to Customer's tender or delivery of
Nonconforming Waste or other failure to comply or conform to this Agreement, including costs of inspection, testing and analysis.
5. SPECIAL HANDLING; TITLE. If Company elects to handle, rather than
reject, Nonconforming Waste, Company shall have the right to manage the
same in the manner deemed most appropriate by Company given the characteristics of the Nonconforming Waste. Company may assess and Customer shall pay additional fees associated with delivery of Nonconforming
Waste, including, but not limited to, special handling or disposal charges,
and costs associated with different quantities of waste, different delivery
dates, modifications in operations, specialized equipment, and other operational, environmental, health, safety or regulatory requirements. Title to and
ownership of acceptable Industrial Waste shall transfer to Company upon its
final acceptance of such waste.
6. COMPANY WARRANTIES. Company hereby represents and warrantsthat: (a) Company will manage the Industrial Waste in a safe and workmanlike manner in full compliance with all valid and applicable federal, state

and local laws, ordinances, orders, rules and regulations; and (b) it will use
disposal facilities that have been issued permits, licenses, certificates or approvals required by valid and applicable laws, ordinances and regulations
necessary to allow the facility to accept, treat and/or dispose of Industrial
Waste. Except as provided herein, Company makes no other warranties and
hereby disclaims any other warranty, whether implied or statutory.
7. LIMITED LICENSE TO ENTER. When a Customer is transporting Industrial Waste to a Company facility, Customer and its subcontractors shall
have a limited license to enter a disposal facility for the sole purpose of offloading Industrial Waste at an area designated, and in the manner directed,
by Company. Customer shall, and shall ensure that its subcontractors, comply with all rules and regulations of the facility, as amended. Company may
reject Industrial Waste, deny Customer or its subcontractors entry to its facility and/or terminate this Agreement in the event of Customer's or its subcontractors' failure to follow such rules and regulations.
8. CHARGES AND PAYMENTS. Customer shall pay the rates set forth on
Exhibit A or a Confirmation Letter, which may be modified as provided in this
Agreement. The rates may be adjusted by Company to account for: any increase in or to recoup all or any portion of, disposal, transportation, fuel or
environmental compliance fees or costs; any change in the composition of
the Industrial Waste; increased costs due to uncontrollable circumstances,
including, without limitation, changes in local, state or federal laws or regulations, imposition of taxes, fees or surcharges and acts of God such as
floods, fires, etc. Company may also increase the charges to reflect increases in the Consumer Price Index for the municipal or regional area in
which the Services are rendered. Increases in charges for reasons other
than as provided above require the consent of Customer which may be evidenced verbally, in writing or by the actions and practices of the parties. All
rate adjustments as provided above and in Paragraph 5 shall take effect
upon notification from Company to Customer. Customer shall pay the rates
in full within 30 days of receipt of each invoice from Company. Customer
shall pay a late fee on all past due amounts accruing from the date of the
invoice at a rate of eighteen percent (18%) per annum or, if less, the maximum rate allowed by law.
9. INDEMNIFICATION. The Company agrees to indemnify, defend and save
Customer harmless from and against any and all liability (including reasonable attorneys fees) which Customer may be responsible for or pay out as a
result of bodily injuries (including death), property damage, or any violation
or alleged violation of law, to the extent caused by Company's breach of this
Agreement or by any negligent act, negligent omission or willful misconduct
of the Company or its employees, which occurs (1) during the collection or
transportation of Customer's Industrial Waste by Company, or (2) as a result
of the disposal of Customer's Industrial Waste, after the date of this Agreement, in a facility owned by a subsidiary or affiliate of Waste Management,
Inc., provided that the Company's indemnification obligations will not apply to
occurrences involving Nonconforming Waste.
Customer agrees to indemnify, defend and save the Company harmless
from and against any and all liability (including reasonable attorneys fees)
which the Company may be responsible for or pay out as a result of bodily
injuries (including death), property damage, or any violation or alleged violation of law to the extent caused by Customer's breach of this Agreement or
by any negligent act, negligent omission or willful misconduct of the Customer or its employees, agents or contractors in the performance of this
Agreement or Customer's use, operation or possession of any equipment
furnished by the Company.
Neither party shall be liable to the other for consequential, incidental or punitive damages arising out of the performance of this Agreement.
10. UNCONTROLLABLE CIRCUMSTANCES. Except for the obligation to
make payments hereunder, neither party shall be in default for its failure to
perform or delay in performance caused by events beyond its reasonable
control, including, but not limited to, strikes, riots, imposition of laws or governmental orders, fires, acts of God, and inability to obtain equipment, permit

changes and regulations , restrictions (including land use) therein, and the
affected party shall be excused from performance during the occurrence of
such events.
11. ASSIGNMENT. This Agreement shall be binding on and shall inure to
the benefit of the parties and their respective successors and assigns.
12. ENTIRE AGREEMENT. This Agreement represents the entire understanding and agreement between the parties relating to the management of
waste and supersedes any and all prior agreements, whether written or oral,
between the parties regarding the same; provided that, the terms of any national service agreement between the parties shall govern over any inconsistent terms herein.
13. TERMINATION; LIQUIDATED DAMAGES. Company may immediately
terminate this Agreement, (a) in the event of Customer's breach of any term
or provision of this Agreement, including failure to pay on a timely basis or
(b) if Customer becomes insolvent, the subject of an order for relief in bankruptcy, receivership, reorganization dissolution, or similar law, or makes an
assignment for the benefit of its creditors or if Company deems itself insecure as to payment ("Default"). Notice of termination shall be in writing and
deemed given when delivered in person or by certified mail, postage prepaid, return receipt requested. In the event Customer terminates this Agreement prior to the expiration of any Initial or Renewal Term for any reason
other than as provided herein, or in the event Company terminates this
Agreement for Customer's Default, liquidated damages in addition to the
Company's legal fees shall be paid and calculated as follows: 1) if the remaining Initial Term under this Agreement is six or more months, Customer
shall pay its most recent monthly charges multiplied by six; 2) if the remaining Initial Term under this Agreement is less than six months, Customer shall
pay its most recent monthly charges multiplied by the number of months remaining in the Term; 3) if the remaining Renewal Term under this Agreement
is three or more months, Customer shall pay its most recent monthly
charges multiplied by three; or 4) if the remaining Renewal Term under this
Agreement is less than three months, Customer shall pay its most recent
monthly charges multiplied by the number of months remaining in the Renewal Term. Customer acknowledges that the actual damage to Company in
the event of termination is difficult to fix or prove, and the foregoing liquidated damages amount is reasonable and commensurate with the anticipated loss to Company resulting from such termination and is an agreed
upon fee and is not imposed as a penalty. Collection of liquidated damages
by Company shall be in addition to any rights or remedies available to Company under this Agreement or at common law.
14. MISCELLANEOUS. (a) The prevailing party will be entitled to recover
reasonable fees and court costs, including attorneys' fees , in interpreting or
enforcing this Agreement. In the event Customer fails to pay Company all
amounts due hereunder, Company will be entitled to collect all reasonable
collection costs or expenses, including reasonable attorneys fees, court
costs or handling fees for returned checks from Customer; (b) The validity,
interpretation and performance of this Agreement shall be construed in accordance with the law of the state in which the Services are performed; (c) If
any provision of this Agreement is declared invalid or unenforceable, then
such provision shall be deemed severable from and shall not affect the remainder of this Agreement, which shall remain in full force and effect; (d)
Customer's payment obligation for Services and the Warranties and Indemnification made by each party shall survive termination of this Agreement.

WHEREAS, a petition for a zoning change was filed by Centres,


Inc., to change a parcel of land from R-8 (General Residence
District) and R-6 (Single Family Residence District) to a Planned

WHEREAS, public hearings were held on said petition before
the Plan commission on June 25, 1992 and July 10, 1992, pursuant to

WHEREAS, the Franklin Plan Commission has determined that the
proposed Planned Development District Number 16 conforms to the
standards for approval of a Planned Development District, as stated
in Section 13.3 of Ordinance No. 221, and supports the public
health, safety and welfare.
NOW, THEREFORE, the Common Council of the City of Franklin
does hereby ordain as follows:
SECTION 01

Ordinance No. 221, relating to the zoning and land


use map is hereby amended as follows:
"The zoning district for the above described parcel
is hereby changed from R-8 General Residence District
and R-6 Single-Family Residence District to Planned
Development District No. 16."

SECTION .02

The Zoning Code of Ordinance No. 221 is hereby


amended to create Section 13.19 entitled "Planned
Development District Number 16" as herebelow set
forth.

1.

PLANNED DEVELOPMENT DISTRICT NO. 16

Definitions
The following definitions shall pertain to this
Planned Development District:
A.

Exhibit "A": Drawing entitled "Site and


Landscape Plan", with a revised date of
August 27, 1992, prepared by National Survey
and Engineering.

B.

Exhibit "B": Building elevation drawing


entitled "Proposed Shopping center, Franklin,
WI", prepared by Furman & Furman, Architects.

c.

Developer: The applicant, centres, Inc. of


Brookfield, Wisconsin; and any future
assigns.

D.

Landscape Surface Ratio: The total area not


covered by a building or buildings, pavement,
curbs, and sidewalks in relation to total
site size, as a percentage.

E.

Outlot: The numbered areas on Exhibit "A"


for development with self-contained parking
and landscaping.

Pick 'N Save: The area so designated on


Exhibit "A" to be initially occupied by a
grocery store of some or similar name.

Service Uses: Any use, as the main part of


the business, offering a service to the
public and not offering the sale of a
tangible good, such as a dry cleaner,
laundromat, doctors office, dentists office,
hair salon, travel agency, etc.

Limits of Approval
A.

No site work shall commence, nor any permits


shall be issued, until commencement of
construction toward the widening of South
76th Street by Milwaukee County within the
City of Franklin, of Village of Greendale.
Construction shall mean any actual bridge or
road work, and shall not mean utility work.

B.

Should Milwaukee County not proceed with .. the


widening of South 76th Street, the City of .
Franklin shall follow all proper procedures
to rescind this approval.

c.

If construction of a structure within


Planned Development District No. 16 has not
commenced on or before December 31, 1995,
Section 13.19 shall be null and void without
further action by the Plan Commission or the
Common Council, and all development in
Planned Development District No. 16 shall be
governed by Section 7.8 of Ordinance No.
221. The criteria to be used in determining
if construction has commenced shall be that
the building foundations, for either the Pick
'N Save or Retail, have been completed and
walls brought up to grade.

D.

Prior to issuance of any building permit for


any Outlot, building construction shall
commence for the Pick 'N Save or Retail.

E.

Development of the property shall be in


substantial compliance with Exhibit "A" and
Exhibit "B", with revisions as permitted by
the specifications of this ordinance.

Permitted Uses
The following uses are hereby permitted within
the parameters as setforth below and referenced
on Exhibit "A".

Any use within the Pick 'N Save building


shall be a use consistent with the permitted
uses in the B-3 Business District of the City
of Franklin Zoning Ordinance, as may be
amended from time to time. Initial and
subsequent uses shall not require Zoning
Permit approval from the Franklin Plan
Commission.

B.

Any use within the Retail building shall be


consistent with the permitted uses in the B-3
Business District of the City of Franklin
Zoning Ordinance, as may be amended from time
to time. Initial and subsequent uses shall
not require Zoning Permit approval from the
Franklin Piari Commission; however, service
uses shall not occupy more than 10,000
square feet of the total Retail square
footage.

c.

Any subsequent professional office located


within Outlets 1 through 4, shall be a
permitted use after the initial Special Use
approval.

Special Uses
The following uses are hereby allowed when
approved as Special Uses within the parameters
setforth in the Zoning Ordinance, this Planned

Any special use within the Pick 'N Save


building and retail area shall be a special
use consistent with the uses in the B-3
Business District of the City of Franklin
Zoning Ordinance, as may be amended from time
to time.

B.

Uses within Outlets 1 through 4 shall obtain


Special Use approval for initial building
construction and subsequent uses; except for
subsequent professional offices; for any use
listed as a Permitted Use or a Special Use in
the B-3 Business District of the City of
Franklin Zoning Ordinance. Special Uses
on Outlets shall be controlled by the
following parameters:

Outlets 1 through 4 shall be limited to


one (1) drive-through and/or carry-out
restaurant, one (1) self-service

10.

Building Permit for Pick 'N Save and Retail


Prior to the issuance of any Building Permit for
the Pick 'N Save or Retail, the following
shall be completed.
A.

Developer shall apply for and gain approval


of the vacation of the 77th Street Right-OfWay on the property, and the 77th Street
Right-Of-Way immediately adjacent to the
property north of Terrace Drive. Approval of
said vacations shall not be unreasonably
withheld by the City.

B.

Developer shall submit for the approval of


the Planning & Zoning Administrator a final
site plan. The final site plan shall be in
substantial conformance with Exhibit "A",
with the following improvements:

Buildings and drives all fully


dimensioned.

2.

Proper turning radii for large vehicles


at parking lot corners and building
corners.

3.

The required 8 foot high fence along the


western property line shall not be placed
within any designated wetland area.

4.

Location of all ground level mechanical


equipment and utility boxes, subject to
approval by utility companies.

5.

Sidewalks on one side of entrance


drives from 76th Street, and a sidewalk
on one side of the entrance drive from
Rawson Avenue. Sidewalks shall connect
to proposed public sidewalk within 76th
Street, and shall provide handicapped/
bicycle curbs.

6.

Handicapped/bicycle curbs and bicycle


racks locations adjacent to Pick 'N Save
and Retail.

7.

Potential shared access road with neighboring Franklin Village Shopping Center.

Developer shall submit for the approval of


the City Engineer, a complete final
engineering plan. The plan shall include,
but not limited to:

All on-site and off-site utilities for


the development with a designation of
City maintained utilities.

A detailed site grading plan showing


proposed finished grades of buildings,
parking areas, curbs, sidewalks, and
landscaped areas on the site along with a
proposed site drainage plan and storm
water calculations. Elevations on such
site grading plan shall be based on the
City of Franklin datum and meet the
specifications of the City Engineer for
Master Subdivision Grading and Site
Plans. The site drainage plans shall
have provisions for controlling non-point
source pollution run-off from the site.

3.

An Erosion and Sediment Control Plan.

4.

All drives and parking areas improved


with a paved, dust-less surface; and curb
and gutter at the perimeter of all drives
and parking areas, with City specifications.

s.

All on-site pavement markings and traffic


control signs.

6.

The height of the berm along the south


property line shall be shown on the si te
grading plan, and shall be undulating at
a height of 6 to 8 feet above the top of
the Terrace Drive curb.

7.

The height of the berm along the east


property line shall be shown on the site
grading plan, and shall be a height of 4
feet above the top of the 76th Street
curb, after street reconstruction.

8.

Conformance with the final site plan.

Developer shall submit a Final Landscape Plan


for the approval of the Planning and Zoning
Administrator. Said Final Landscape Plan
shall be in substantial compliance with
Exhibit "A", and shall include the following:
1.

A cost estimate for all new landscaping.

2.

A tree preservation plan to preserve


existing trees and vegetation along the
western property line and northeast
corner of the site near Rawson Avenue.

3.

Detailed berm planting plan, for all


berms designated on Exhibit "A".

4.

Seeding or sodding of all Outlets within


nine (9) months of any occupancy permit
of the Pick 'N Save or Retail, if
construction on each subject Outlot has
not commenced.

E.

Developer shall submit all necessary


information to the City Engineer, and shall
gain City approval of a Subdivision Development Agreement. Said agreement shall outline
the adequate completion of public improvements, determined by the Final Engineering
Plans, and shall include Letter of Credits
for the public improvements and completion of
the landscaping. City approval shall not be
unreasonably withheld.

F.

Developer shall submit a letter from the


Milwaukee County Highway Department. Said
letter shall approve of the Final Engineering
Plans for highway access.

G.

Developer shall obtain approval of the


Architectural Board, which said approval
shall comply with, but not limited to, the
following:

2.

Complete screening of all roof-mounted


and ground mechanical equipment. Roofmounted equipment shall not be located
not closer the 30 feet from any building
edge.

3.

Noise suppression of all roof mounted


and ground mechanical equipment.

4.

Approval of dumpster enclosures design


and cart corral design, as located on
Exhibit "A".

5.

Approval of Pick 'N Save grocery cart


storage location either inside the
building or locations off of the adjacent
sidewalk.

6.

Approval of all external lighting with


luminous to prevent glare and light
spillover onto adjacent properties.

Developer shall complete the undulating six


(6) to eight (8) foot berm along the south
property line and shall provide as-built
grading plan to the City Engineer to certify
conformance of this berm with the approved
grading plan.

11.

Building Permits for Outlets


The issuance of a building permit for any
Outlot shall follow all applicable requirements
of Paragraph 10.

12.

Subdivision of Property
Developer may elect to subdivide the property
for the purpose of creating separate lots for
each outlot. If so, developer shall submit, for
the approval of the City Attorney, a common
maintenance agreement for the storm water
detention pond area only, for recording with the
subdivision, to insure the long-term proper
maintenance of this facility. Until such time
as outlets are sold, Developer remains
responsible for complete maintenance of the
property. Said Outlot divisions shall be in
substantial conformance with the Outlot perimeter
shown on Exhibit "A".

13.

Construction Requirements
The following shall be the requirements during
any construction on the site:
A.

The parking of any construction equipment or


vehicles, and worker vehicles, on any
external public Right-Of-Way or private
property, shall be prohibited.

B.

With the initial site grading, Developer


shall complete a gravel parking area for the
parking of construction equipment or
vehicles, and worker vehicles, on the subject
site. Said parking area shall be provided
on the site, with a minimum of gravel
surface, for the duration of construction on
the site.

c.

Developer shall provide and maintain a

minimum of a gravel surface drive connecting


construction site to a paved surface.

D.

c)

With the exception of construction of the


berm along the northern boundary of Terrace
Drive, at no time shall any construction
vehicles or equipment, or employee's
vehicles, have ingress/egress to/from Terrace
Drive, nor shall the same utilize Terrace
Drive or public Right-Of-Way south and
adjacent to for any purpose.

Occupancy Permit
A.

Prior to issuance of an occupancy permit for


an Outlot building, the building permit for
the Pick 'N Save must be issued.

B.

Prior to issuance of an occupancy permit for


Pick 'N Save, all berm landscaping, and
fencing must be completed in accordance with
the approved landscaping plan, and approved
by the Planning and Zoning Administrator.

c.

Prior to issuance of any occupancy permit on


the site, all proper inspection of the City
Engineer, Building Inspector, Fire Inspector,
and the Planning and Zoning Administrator
must be completed.

D.

Prior to issuance of any occupancy permit on


the site, all parking lot paving must be
complete for the parking required for the
occupied use.

Landscaping Completion
A.

In addition to Paragraph 14B, all other site


landscaping, in accordance with the final
landscape plan, must be completed within 90
days of granting of the occupancy permit for
Pick 'N Save or Retail, or by April 30th if
the Occupancy Permit is granted between
November 1st and March 31st.

B.

Within thirty (30) days of completion, if in


the opinion of the Planning and Zoning
Administrator, the southern berm landscaping
does not adequately screen out the view of
the site from the south, developer shall
plant additional material to the mutual
agreement of the Planning and Zoning
Administrator, and the Developer. The cost
of any such additional materials shall not
exceed $5,000.00.

Continuing Control
A.

Developer shall landscape and maintain the


property in a good, aesthetic condition at
all times.

B.

All new electric, telephone, and/or cable


television service wires or cables shall be
installed underground within the boundaries
of the property.

c.

Vehicles over 6,000 pounds, empty weight,


shall not be parked on the site, except for
vehicles making deliveries to on-site
businesses during business hours.

D.

All internal access drives, as shown on


Exhibit "A" shall remain open and clear of
any impediments, at all times, except for
repairs to pavement or utilities.

E.

All performance standards of Section 9.2(6)


of the Zoning Ordinance, especially Noise,
Odorous Matter, Toxin or Noxious Matter,
shall be followed at all times.

F.

All materials and supplies shall be stored


inside of buildings at all times, except for
the provisions of Paragraph SD.

G.

If any govermental jurisdiction determines


the necessity of providing a signalized
intersection at any intersection along 76th
Street between Rawson Avenue and Imperial
Drive within ten (10) years of the approval
date of this Planned Development District,
the Developer shall reimburse the City,
within thirty (30) days of billing, the
City portion of the cost of signal design and
installation, along with any reconstruction
of the intersection for the signalization,
according to the following schedule:

Developer shall not exceed $70,000.00.

Developer shall maintain all storm water


drainage areas, inlets, and the detention
pond in proper and functioning condition at
all times.
If the City determines
non-compliance with this requirement, the
City shall inform the Developer, in writing
of the deficiences.
If not corrected within
thirty (30) days of receipt of letter, City

shall cause correction of the deficiences and
charge the Developer of all City incurred
costs, at a rate of 125%. The charge shall
constitute a Lien on the property until paid,
but subordinate to financing.
17.

Signage
Prior to the installation of any sign on the
property, either freestanding or a wall sign,
Developer shall obtain a Sign Permit after
approval for the Architectural Board. Signs shall
comply with the City sign regulations, along with
the following additional requirements:
A.

All freestanding signs on the property shall


be constructed with a base materials and color
consistent with the natural and color of the
Pick and Save and Retail, except freestanding
signs advertising Outlot business shall be
consistent with the material and color of the
Outlot building.

B.

All freestanding signs shall have a minimum


yard setback from any adjacent Right-Of-Way of
twenty-five (25) feet, unless a greater sign
setback is required by the sign regulations
or the Architectural Board.

c.

All freestanding signs shall be located a


minimum of ten (10) feet from the back-of-curb
of any entrance drive, and shall maintain a
thirty (30) foot clear vision triangle,
measured from the intersection of the entrance
drive curb and public Right-Of-Way.

D.

All freestanding sign advertising business on


Outlets shall be monument-type signs with a
height of not more than seven (7) feet above
adjacent grade (measured from the maximum
height on any berm) and not any longer than
eight (8) feet in length.

E.

All wall signs shall be constructed of


individual, channelized letters.

F.

Wall signs shall be prohibited on the south


side of the Pick 'N Save and Retail, shall be
prohibitied on the west side of Pick 'N Save
except for the first 100 feet from the front
building face, and shall be prohibited on the
south side of any building on Outlot 1.

G.

Any external temporary devices or signs, such


as a reader board, balloons, hot air balloons,
pennants, streamers, flags, banners, paper
signs, etc., shall be prohibited anywhere on
the site; except for:

Initial grand openings of businesses on


the site, with proper permits.

2.

Uniform banners, not any larger than


thirty (30) square feet in size, securely
affixed to all light poles, indicating a
special event or time of year. Said
banners shall not become torn or tattered.

3.

On any Outlot, recognizable flags of a


government or business, not larger than
twenty (20) square feet in size, when
affixed to permanent flag poles with a
maximum height of twenty (20) feet, with a
maximum of three (3) poles per Outlot.

I.

Permanent and Temporary interior window signs


shall be limited to 20% of the total window
area of each business.

J.

All signs within the development shall relate


to a business or businesses on the some parcel
of land. All off premise signs shall be
prohibited.

Future Development
The area designated as Future Development on
Exhibit "A" shall not be developed unless
Developer applies for and receives approval of an
amendment of this Planned Development District.
Said amendment shall contain the following minimum
conditions:
A.

In no case shall the m~n~mum landscape


surface ratio on the entire site fall less
than 35%.

B.

Additional parking shall be provided.

SECTION .03

All Ordinances or parts of Ordinances in


contravention with this Ordinance are hereby repealed.

SECTION .04

This Ordinance shall take effect upon its passage and


publication as required by law.
