INFORMATION
The Undersigned Prosaecutor II, accuses JUAN DELA CRUZ y ALONZO, of the crime of
MURDER, defined and penalized under Article 248, of the Revised Penal Code, in relation
with by Republic Act No. 7659, committed as follows:
That on or about the 23rd day of January, 2016 in the City of Baguio,
Philippines and within the jurisdiction of this Honorable Court, the said accused, with intent
to kill and with treachery, did then and there, wilfully, unlawfully and feloniously, assault,
attack, and shot with a cal. 38 revolver, one John Dela Cruz y Alonzo, inflicting upon him
gunshot wounds upon his forehead, which directly caused his death.

RESOLUTION
The Philippine National Police (PNP), Baguio City, referred for inquest proceedings a
complaint for murder against Juan Dela Cruz y Alonzo of #29-C Pinsao Proper
Baguio City.
Culled from the joint affidavit of arrest executed by PO1 Paloma Martin and PO1
Policarpio Mercado about 11:00 oclock in the evening of January 23, 2016, they
were directed by their Chief of Police to respond to a shooting incident that
transpired in Pinsao Proper, Baguio City, which was within their precinct vicinity.
They complied.
At the crime scene they saw the dead body of John Dela Cruz y Alonzo. They
conducted investigation and were informed by Jason Dela Cruz and Juanita Dela
Cruz that the deceased victim was shot by his own brother, Juan Dela Cruz. During
the course of the investigation conducted, Juan Dela Cruz appeared and admitted
that he was responsible for the death of his brother. They immediately effected his
arrest.
Juanita Dela Cruz, the wife of the deceased-victim executed a sinumpaang salaysay.
She categorically stated that her husband was answering a call of nature when he
was shot by Juan Dela Cruz.
From the affidavit of arrest, and other supporting document submitted, the
undersigned prosecutor finds that respondent was lawfully taken into custody in
accordance with section 5, Rule 113 of the new Rules of Criminal Procedure. Thus
Inquest proceeding is proper. During the conduct of inquest, respondent was duly
assisted by Atty. Charlene V. Mira. After conferring with his lawyer, accused was
detained in Prison.

WHEREFORE, finding probable cause to indict the respondent, let an

information be filed charging JUAN DELA CRUZ y ALONZO of the crime of MURDER,
defined and penalized under Article 248 of the Revised Penal Code. The qualifying
aggravating circumstance of treachery attended the commission of the crime.
SO RESOLVED.
