The Grand Jurors of and for the State of New Jersey, upon
their oaths, present that:
COUNT ONE
(Official Misconduct - Second Degree)
MARC W. DENNIS
between on or about October 6,

2015, and on or about October 7,

2015, at the City of Asbury Park, at the City of Long Branch, at

the Township of Marlboro, all in the County of Monmouth, at the
Township of Ewing, at the Township of Hamilton, both in the
County of Mercer, elsewhere, and within the jurisdiction of Lhis
Court, did commit the offense of official misconduct, in that the
said MARC W. DENNIS, acting with the purpose to obtain a benefit
f_or.hims~lf or another or to injure or deprive another. of a
benefit, did commit an act relating to his office, but
consi~ituting an unauthorized exercise of his official functions,

knowing that such act was unauthorized or that he was committing

it in an unauthorized manner, or did refrain from performing a
duty imposed upon him by law or clearly inherent in the nature of
his office; that is, the said MARC W. DENNIS, then and there
being a public servant, to wit: a sworn member of the New Jersey
State Police having the rank of Sergeant, having thereby the
official functions and duties, among others, to follow and
enforce the laws of the State of New Jersey, to conduct himself
with undivided loyalty to his public trust, to perform his duties
in a legal and proper manner, to display good faith, honesty and
integrity, and to be impervious to corrupting influences, did
fail t.o perform calibration checks consistent with the
calibration procedure for Alcotest 7110 as established by the
Chief Forensic Scientist of the Division of State Police, but
nonetheless did file and submit falsified paperwork as if he had
properly performed the procedure, with the purpose to secure a
benefit to himself or another or to injure or deprive another of
a benefit, contrary to the provisions of N.J.S.A. 2C:30-2, and
against the peace of this State, the government and dignity of
the same.

COUNT TWO
(Tampering with Public Records or Information - Third Degree)

between on or about October 6, 2015, and on or about October 7,
2015, at the City of Asbury Park, at the City of Long Branch, at
the Township of Marlboro, all in the County of Monmouth, at the
Township of Ewing, at the Township of Hamilton, both in the
County of Mercer, elsewhere, and within the jurisdiction of this
Court, with purpose to defraud or injure anyone, did knowingly
make a false entry in, or false alteration of, any record,
document or thing belonging to, or received or kept by, the
government for information or record, or required by law to be
kept by others for information of the government, or made,
presented, offered for filing or used any record, document, or
thing knowing it to be false, and with the purpose that it be
taken as a genuine part of information or records belonging to,
received or kept by, the government for information or record or
required by law to be kept by others for information of the
government, including one or more Alcotest 7110 Calibration
Records and Certificates requiring a true signed statement that
calibration checks were performed consistent with the calibration
check procedure for Alcotest 7110 as established by the Chief
Forensic Scientist. of the Division .of State Police, when he had
not performed the procedure consistent with those standards, and

submitted them Lo the respective local police departments or the

Division of Stale Police, contrary Lo the provisions of N.J.S.A.
2C:28 -7a(1) and (2), and against the peace of this State, the
gov~rnm~nt and dignity of same.

COUNT THREE
(Falsifying Records - Fourth Degree)
MARL W. DENNIS
between on or about October 6, 2015, and on or about October 7,
2015, at the City of Asbury Park, at the City of Long Branch, at
the Township of Marlboro, all in the County of Monmouth, at the
Township of Ewing, at the Township of Hamilton, both in the
County of Mercer, elsewhere, and within the jurisdiction of this
Court, with purpose to deceive or injure another or to conceal a
wrongdoing, did falsify or utter a writing or record, that is,
one or more Alcotest 7110 Calibration Records and Certificates
,requiring a true signed statement that the calibration checks
were performed consistent with the calibration check procedure
for Alcotest 7110 as established by the Chief Forensic Scientist
of the Division of State Police, when, in fact, he had not
performed the procedure consistent with those standards, with the
purpose to defraud or injure the respective local police
departments or the Division of State Police or to conceal his own
wrongdoing, contrary to the provisions of N.J.S.A. 2C:21-4a, and
