ORDER
.On October 30, 2014, Sarangani Energy Corporation (SEC)
filed an application for authority to develop, own, and operate
dedicated point-to-point limited transmission facilities to connect its
phase II of its power substation to the General Santos Substation of
the National Grid Corporation of the Philippines (NGCP), with prayer
for provisional authority.
In the said application, SEC alleged, among others, that:

NATURE OF THE APPLICATION

Pursuant to Section 9 of Republic Act No. 9136 (R.A. No.

9136) or the "Electric Power Industry Reform Act of 2001"
or the EPIRA and Section 5, Rule 5 of its Implementing
Rules and Regulations (IRR), the application is submitted
to secure authority from the Commission for it to develop,
own,
and operate
dedicated
point-to-point
limited
transmission facilities connecting the second phase of its 2
x 105 MW power station, located in the Municipality of
Maasim, Sarangani Province, to the Mindanao Grid through
the General Santos Substation of the NGCP;
STATEMENT OF THE FACTS

4.

Need for additional long-term power supply in the

Mindanao grid. According to the Department of Energy
(DOE), the Mindanao grid has been experiencing under
generation since 20101 This is expected to continue, if not
worsen, if the rapid growth of the region's electricity
demand is not met:
a.

To illustrate, the demand in Mindanao is projected to

increase at an average annual growth rate of 4.57
percent - the highest growth rate among the three
grids2. Its peak electricity demand of 1,407 MW in
2012 is seen to increase to 2,068 MW in 2020, and
will increase further to 3,259 MW in 20303;

b.

Meanwhile, the supply situation in Mindanao is critical

since its power supply is barely sufficient to meet its
current demand, and it lacks the reserve power
needed to provide stability in the grid4. A total of
1,600 MW in additional capacity is needed to meet
the electricity demand and reserve margin of the
grid5;

c.

To underscore the perilous state of Mindanao's

power supply, the DOE has confirmed that any
breakdown or shutdown of a large power plant unit
will already cause outage on the grid6;

d.

The Mindanao grid is vulnerable to power outage,

especially during the long dry seasons due to its
reliance on hydroelectric power plants?, which are
dependent on the availabilit of water and are
affected by weather conditions.
To note, half of the
region's existing capacity is supplied by hydroelectric
power plants9;

There is, thus, an urgent need to ensure that power supply

in the Mindanao grid will be sufficient to meet its steadily
increasing demand.
Otherwise, the entire region will
continue to suffer from outages. Needless to say, the lack
of sufficient and reliable power supply has long hindered
the much-needed capital investment that would spur the
region's economy;

Private Sector Initiated Power Projects. To address the

need for long-term power supply, the government has
encouraged and mandated private sector investment in the
electric power industry, particularly in power generation, to
ensure additional capacity in Mindanao and the entire
country for the coming years;

7.

Additional supply from SEC. To help address such need

for additional supply, it has undertaken to construct, own,
operate, manage and maintain a 2 X 105 MW Circulating
Fluidized Bed Combustion Boiler Coal-Fired power station
in the Municipality of Maasim, Sarangani Province (SEC
Power Station):

a.

The SEC Power Station is a committed generating

plant in the Mindanao grid as indicated in the DOE
List of Private Sector-Initiated Power Projects, the
DOE Supply-Demand Outlook and the Transmission
Development Plan 2012 (TDP)1o. Attached to the
application as Annexes "B" an "B_1" are copies of the
DOE List of Private Sector-Initiated Power Projects
and the DOE Supply-Demand Outlook, respectively;

b.

The SEC Power Station is being implemented in two

(2) phases, each for one unit with a net generating
capacity of 105 MW;

c.

The construction of the second phase (SEC Phase II

Plant) is expected to commence in early 2015, and
commencement of full commercial operations is
expected in 2017. The SEC Phase II Plant shall be
connected directly to NGCP's General Santos
Substation through the connection assets that will be
developed, owned and operated by SEC. The said
assets are the subject of the application;

d.

The SEC Phase II Plant shall provide much-needed

power supply to the people of Mindanao, particularly
the
consumers
of Davao
del
Sur
Electric
Cooperative, Inc. (DASURECO), Cotabato Electric
Cooperative, Inc. (COTELCO), South Cotabato I
Electric Cooperative, Inc. (COTELCO), lIigan Light
and Power, Inc. (ILPI), Zamboanga del Norte Electric
Cooperative, Inc. (ZANECO), Zamboanga del Sur
Electric Cooperative, Inc. (ZAMSURECO-I)
and
Cagayan Electric Power and Light Company, Inc.

Under R.A. No. 9136, authorization from the Commission is

required for a generation company to develop, own, and
operate
point-to-point
limited transmission
facilities.
Hence, the application.

ABSTRACT OF THE PROJECT, THE CONNECTION ASSETS

AND RELATED INFORMATION
9.

Connection of the SEC Phase II Plant to the Grid. As

mentioned earlier, the SEC Phase II Plant shall be
connected directly to NGCP's General Santos Substation
through the connection assets to be developed, owned,
and operated by SEC (Project):
a.

The Project is more particularly described in the

Project Description and its supporting attachments,
attached to the application as Annex "C" (Project
Description) and series;

b.

The proposed connection is illustrated in a diagram, a

copy of which is attached to the application as Annex
"C-1'" ,

c.

Necessity of the Project.

The connection assets
are essential to the delivery of power from the SEC
Phase II Plant to the Mindanao grid in order to
comply with the N-1 contingency provision of the
Philippine
Grid Code (PGC) and to ensure
interconnection reliability;

10. Connection Assets. The connection assets are dedicated

point-to-point limited transmission facilities in the purview of
R.A. No. 9136. They are required only for the purpose of
connecting the SEC Phase II Plant to the Mindanao grid,
and will be used solely by the said Plant. They are not
intended to serve end-users or suppliers directly:
a.

Technical Configuration.
The connection assets
'involve 138 kV double circuit 1-795 MCM ACSR
transmission line, which will start from the plant site
located
inside
the
Kamanga
Agro-Industrial
Economic Zone, and which will connect to the
Mindanao grid through the NGPC's General Santos

Substation, which will serve as the connection point.
The said line will traverse Barangays Kamanga and
Tinoto of Maasim, Sarangani Province as well as
Barangays Sawing, San Jose, Sinawal, Siwlay-7,
Klinan-6, and Klinan-5 of General Santos City;
b.

The location map (Proposed 138 kV Transmission

Line Route) and the Transmission Line Route Plan
and Profile, copies of which are attached to the
application as Annexes "C-2" and "C-3," respectively,
to illustrate the route and plan of the said line;

c.

Further, the connection assets are more particularly

described
in the 138 kV Transmission
Line
Engineering Designs, 138 kV Structures List, the Line
Insulators and Line Protection Technical Data
Sheets, the Klinan 138 kV Switchyard Engineering
Designs and the Protection System Technical Data
Sheets, which are attached to the application as
Annexes "C-4" to "C-9," respectively;

d.

Selection of Connection Configuration.

The
proposed connection configuration is the most viable
connection to the Mindanao grid;

e.

The route was selected because it is the safest and

shortest possible route to NGCP's General Santos
Substation without traversing
heavily populated
areas.
The route likewise considers the safe
operations of the General Santos Airport;

f.

Further, the 138 kV line will utilize the route and the
right-of-way of the existing 69 kV line of South
Cotabato II Electric Cooperative, Inc. (SOCOTECO
II). Consequently, the proposed connection not only
optimizes the existing right-of-way, but is also costefficient since it dispenses with additional cost of
acquiring new right-of-way.

explanation on the selection of the said route is
attached to the application as Annex "0";

11. Results of the Grid Impact Study. NGCP has conducted

a Grid Impact Study (GIS) to determine the technical
feasibility of connecting the SEC Phase II Plant to the
General Santos Substation, as well as to ensure the
stability of the system:
a.

The GIS report reveals that the entry of the twophased power plant is generally feasible;

b.

The said report likewise indicates that, with the said

connection in place, the resulting fault level in the
area will not require upgrading or replacement of
existing circuit breakers.
Further, load flow
simulations reveal that during maximum dispatch,
either peak or off-peak load scenarios, no major
system degradation will be experienced by the grid.
Evaluation on voltage also shows that magnitudes of
the grid are within the standard limits;

as Annex "E'" ,

12. Result of the Facility Study. A third-party Facility Study

(FS) was likewise secured in preparation for the actual
construction and connection of the SEC Power Station:
a.

The FS describes the facilities required in order to

secure the intended delivery of the generated
capacities from the SEC Power Station.
It also
discusses
the
system's
protection,
telecommunications and metering, which are among
the most important aspects of the interconnection
facilities. It likewise presents the technical data and
specifications of the major equipment and materials
to be used. To note, the said data and specifications
are generally in accordance with the specific
standards being adopted by NGCP, the Nationa'l,
Power
Corporation
(NPC)
and the
National
Transmission Corporation (TRANSCO).

the FS is attached hereto as Annex "F";

13. Indicative Timeline.

A copy of the Project Timeline and
Schedule of the proposed connection assets is attached
hereto as Annex "C-11":
a.

Notably, the SEC Phase II Plant is scheduled to

commence commercial operations by 2017.
As
mentioned above, it will provide supply power to
various distribution utilities;

b.

The connection assets should be completed at the

soonest in order to immediately complete the
necessary testing and commissioning activities, and
ultimately to provide the considerable
power
requirements of several areas in Mindanao;

14. Estimated Project Cost.

The total project cost of the
connection assets is estimated at US$33,41 0,000.00;
A detailed breakdown of the said project cost is attached to
the application as Annex "G";
TECHNICAL AND FINANCIAL CAPABILITY

OF SEC

15. As discussed below, it is fully equipped to own, operate

and maintain the connection assets:
16. Technical Capability. it is a majority-owned subsidiary of
the Alsons Consolidated Resources, Inc. (ACR), a publicly
listed company engaged in the development, construction,
operation and maintenance of power generation facilities;
17. ACR is an established presence in the power industry,
having gained extensive experience not only in power
generation, but also in the operation and maintenance of
facilities for the conveyance of electric power;
18. ACR owns, operates and maintains the following
generation facilities, including the facilities connecting the
same to the Mindanao grid:

a)

Western Mindanao Power Corporation's (WMPC)

100 MW bunker C-fired diesel station in Sangali,
Zamboanga
City, which is connected to the
Mindanao grid;

b)

Southern Philippines Power Corporation's (SPPC) 55

MW bunker C-fired diesel power station in Alabel,
Sarangani, which is connected to the Mindanao grid;

c)

Mapalad Power Corporation's (MPC-IIigan) 114 MW

bunker C-fired diesel station in IIigan City, Lanao del
Norte, which is connected to the Mindanao grid; and

d)

PT Makassar Power's 60 MW diesel-fired power

station in Makassar, Sulawesi, Indonesia, which is
connected to the Indonesian transmission grid.

ACR, through MPC, also manages the power plant

operations of the following generation facilities which are
connected to their host distribution utilities:

a)

12 MW diesel-fired modular power station in the City

of Koronadal, South Cotabato; and

b)

15 MW diesel-fired modular power station in Digos

City, Davao del Sur;

20.

The said generation facilities have their own substation and

switchyard
facilities
that
have
been
in constant
communication with the grid operator and with the
distribution utilities being served by the said facilities.
Significantly, ACR has been operating and maintaining the
transmission lines involved;

21.

The above-said bunker stations of WMPC, SPPC, and

MPC-lIigan are connected to the grid through 138 kV lines.
The same applies to the PT Makassar power station;

22.

To note, the ACR has been operating and maintaining the

said substation and switchyard facilities as well as the
transmission lines involved;

ACR, through its former subsidiary, the Lima Utilities

Corporation (LUC), also acquired extensive experience in
the operation and maintenance of power distribution
system:
a.

LUC is located within Lima Land, Inc. (LLI) an

economic zone in Batangas that is registered with the
Philippine Economic Zone Authority (PEZA). ACR
owned the LUC from 2000 to 2013. In 2013, ACR
divested itself of its holdings in Lima Land, Inc. in
order to shift more focus to power generation,
particularly in Mindanao;

b.

LUC operates and maintains its own distribution

system within Lima Land, Inc. (LLI) in order to
provide power to the locators within the said
economic zone.
The said distribution system
includes a 50 MVA substation directly connected to
NGCP's Batangas substation with an alternate
connection to the Mak-Ban geothermal line;

c.

LUC operated and maintained the said substation

and transmission line from 2000 until 2013;

d.

In its Decision dated March 12, 2012 in ERC Case

No. 2009-036MC11, the Commission approved the
acquisition by LUC of the said line from TRANSCO.
Notably, the Commission ruled that LUC is qualified
to take over the responsibility
of operating,
maintaining, upgrading and expanding the said line;

e.

The existing management group of SEC is the same

management group of LUC. For reference, a copy of
the said Decision is attached to the application as
Annex "H" hereof' ,

Corporation (LUC), as Covered by Contracts to Sell, with Prayer for Provisional Authority,
National Transmission Corporation (TRANSCO) and Lima Utilities Corporation (LUC),
Applicants."

24. Indeed, SEC, through the ACR's collective experience in

operating and maintaining power facilities used for the
conveyance of power, has the technical knowledge,
manpower and over-all technical capability to operate and
maintain the connection assets subject of application. The
technical capability of SEC to operate and maintain the
connection assets is likewise discussed in the Company
Profile and Track Record of SEC, attached to the
application as Annex "I";
25. To complement its technical capability to operate and
maintain the connection assets, as well as to ensure full
compliance with pertinent rules, it intends to work with
contractors for the construction and management of the
said assets.
The prospective contractors have proven
track record in the construction, erection, installation and
operation of lines and related facilities;
26. It is worthy to note that the power circuit breakers and
associated equipment located within the NGCP's General
Santos
Substation
perform
transmission
functions.
Consequently, NGCP has the responsibility to operate and
maintain the said equipment;
27. Financial Capability. SEC, on its own, is capable of
financing the cost of the Project. A copy of SEC's latest
Audited Financial Statements is attached hereto as Annex
UJU.,
28. Compliance with the Rules and Standards.
SEC
undertakes to ensure that the SEC Phase II Plant will fully
comply with the applicable rules and standards set by the
PGC and Philippine Distribution Code (PDC). A summary
of the statement of compliance with the standards of the
PGC attached to the application as Annex "K";

ALLEGATIONS IN SUPPORT OF
THE MOTION FOR PROVISIONAL AUTHORITY
29. As discussed earlier, the construction of the SEC Phase II
Plant is expected to commence in early 2015.
It will
provide the much-needed power supply of electricity
consumers in Mindanao, particularly the consumers of
COTELCO, DASURECO, SOCOTECO I, ILPI, ZANECO,
ZAMSURECO I and CEPALCO;
30. The provisional approval of the application will allow it to
implement the timely construction and installation of the
connection assets, which will, in turn, enable it to supply
the power requirements of the electricity consumers in
Mindanao in a timely manner.
Clearly, the proposed
connection of the said Plant to the Mindanao grid, through
the connection assets to be owned, operated and
maintained by it, is indispensable to providing such power
supply;
31. Moreover, the provisional approval of the application is
necessary for it to continue securing the financing needed
for its Phase II Plant and its associated interconnection
system. Needless to state, the sooner its Phase II Plant is
completed, the sooner it can supply power to the abovecited distribution utilities:
a.

To illustrate, as a condition for the approval of the

said financing, SEC must secure the necessary
government permits for it to supply power from the
said Plant.
Such permits include the required
authorization subject of the application; and

b.

Moreover, the release of the proceeds of the loan is

necessary for the issuance of the Notice of Proceed
to its engineering, procurement and construction
contractor. The issuance of such Notice is, in turn,
necessary to commence with the construction of its
Phase II Plant and associated interconnection
system;

32. Given the foregoing, the issuance of a provisional approval

will enable it to connect to the grid in a timely manner, and
to expedite the supply of power to Mindanao. Hence, it
moves for the provisional approval of the application
pursuant to Rule 14 of the Commission's Rules of Practice
and Procedure. A copy of a sworn statement supporting
the said motion is attached to the application as Annex "L";
and
33. It prays that the Commission immediately issues an Order
provisionally approving the instant application and, after
due hearing, render judgment approving the instant
application with finality.
Finding the said application to be sufficient in form and in
substance with the required fees having been paid, the same is
hereby set for jurisdictional hearing, expository presentation, pre-trial
conference
and evidentiary hearing on February 26, 2015
(Thursday) at ten o'clock in the morning (10:00 A.M.) at the ERC
Hearing Room, 15th Floor, Pacific Center Building, San Miguel
Avenue, Pasig City.
SEC is hereby directed to cause the publication of the attached
Notice of Public Hearing, at its own expense, once (1x) in a
newspaper of general circulation in the Philippines, at least ten (10)
days before the scheduled date of initial hearing. It is also directed to
inform the consumers, by any other means available and appropriate,
of the filing of the instant application, its reasons therefor and of the
scheduled hearing thereon.
Let copies of the application, this Order, and the attached
Notice of Public Hearing be furnished the Office of the Solicitor
General (OSG), the Commission on Audit (COA) and the Committees
on Energy of both Houses of Congress. They are hereby requested,
if they so desire, to send their duly authorized representatives at the
scheduled hearings.
Likewise, let copies of this Order and the attached
Public Hearing be furnished the Offices of the Governor of
Province and the Mayor of the Municipality of Maasin,
Province for the appropriate posting thereof on their
bulletin boards.

SEC is hereby directed to furnish all those making requests

therefor with copies of the application and its attachments, subject to
reimbursement of reasonable photocopying costs.
On the date of the initial hearing, SEC must submit to the
Commission
its written
Compliance
with the jurisdictional
requirements attaching therewith, methodically arranged and duly
marked, the evidences of the actual posting and publication of the
Notice of Public Hearing consisting of certifications issued to that
effect, signed by the afore-mentioned Governor and Mayor or their
duly authorized representatives, bearing the seals of their offices, and
the affidavit of the Editor or Business Manager of the newspaper
where said Notice of Public Hearing was published together with the
complete issue of the said newspaper, and such other proofs of
compliance with the requirements of the Commission.
SEC and all interested parties are directed to submit, at least
five (5) days before the date of initial hearing and pre-trial conference,
their respective Pre-Trial Briefs containing, among others:
(a) A summary of admitted facts and proposed stipulation of
facts;
(b) The issues to be tried or resolved;
(c) The documents or exhibits to be presented, stating the
purposes thereof and proposed markings therefore; and
(d) The number and names of the witnesses, with their written
testimonies in an individual affidavit form, to be attached to
the Pre-Trial Brief.
