COMPLAINT

Plaintiff, Collectible Canvas LLC (Collectible Canvas), for its complaint against
Defendant, L & W Apparel Co., Inc. (Legacy), alleges the following:
Nature of Action
1.
This is a civil action for patent infringement under The Patent Act, 35 U.S.C.
1-376, to prevent Legacy from further infringing Collectible Canvas U.S. Patent D729,116 (the
116 patent) entitled Stretched canvas pennant, which is attached as Exhibit A.
Jurisdiction and Venue
2.
The District Court has original jurisdiction over this action pursuant to 28 U.S.C.
1331 (federal question) and 1338(a) (action arising under any Act of Congress relating to
patents and copyrights).
3.
Upon information and belief, Legacy regularly conducts business in the Western
District of Wisconsin. Moreover, upon information and belief, Legacy actively markets and sells
goods and products in this District, including but not limited to products that infringe Collectible
Canvas patent. For example, Legacy regularly sells its products through The University Book

Store in Madison, Wisconsin. Accordingly, venue in this District as to Legacy is proper under
28 U.S.C. 1400(b) and/or 28 U.S.C. 1391(b) and (c). Jurisdiction as to Legacy is proper
pursuant to Wis. Stat. 801.05(3) and/or Wis. Stat. 801.05(4).

business at W146S6450 Tess Corners Dr., Muskego, WI 53150. Collectible Canvas is engaged
in the business of manufacturing and selling stretched canvas pennants. Collectible Canvas is
the assignee and current owner of the 116 patent.

Upon information and belief, Defendant L & W Apparel Co., Inc., which
conducts business under the tradename LEGACY, is a Delaware company with its principal
place of business at 300 Fame Ave., Hanover, PA 17331.

Legacy manufactures, offers to sell, and/or sells a stretched canvas pennant that
infringes the 116 patent in violation of 35 U.S.C. 271. An example of Legacys stretched
canvas pennant is shown below.

Legacys stretched canvas pennant literally infringes the 116 patent, the four
figures of which are shown below in comparison to Legacys stretched canvas pennant.

Upon information and belief, Legacy continues to sell its infringing stretched
canvas pennants.

Upon information and belief, Legacy has knowledge of the 116 patent and is
willfully infringing the 116 patent by continuing to make, use, sell, and offer to sell its stretched
canvas pennants.

Upon information and belief, Legacy will continue to infringe the 116 patent
including, but not limited to, infringing upon Collectible Canvas rights in the 116 patent.

Legacys conduct shows a lack of the required duty to avoid infringement of the
patent.
116 patent such that this is an exceptional case; therefore, Collectible Canvas should be awarded
its reasonable attorneys fees pursuant to 35 U.S.C. 285.
