Hi folks! It’s been such an incredible summer so far…
wow! We hope that you’re all enjoying yourselves out
there with all the fantastic rides & events that have been
going on. There is so much more to come throughout
the months ahead so be sure to keep your eyes on our
calendar of events here in the print magazine & our
online calendar at our site too. Our website is updated
almost daily. There you’ll find the latest & most up to date
information on what’s happening throughout the state of
Virginia & surrounding areas.
We’d like to remind you all to please dress safely
when you’re setting out on the open roads. I know, it’s
extremely hot out there with the sun blazing down on
you & there are days that you feel as though you’re in a
sauna. Being exposed to the elements as we are when
we ride, needs to be taken more seriously than a lot of
riders do. Nearly everyday, I see bikers, girls & guys alike,
wearing shorts, tank tops, tennis shoes, flips or sandals.
Folks – that is so dangerous! I know you’re lookin pretty
“hot” in your cool little summer outfits but come on…is that
really going to give you any protection if you happen to go
down or have a mishap? Absolutely not! Give yourself at
least a little added safety out there by wearing boots, long
pants (preferably jeans), a vest & some “shorty” gloves….
this goes for drivers & passengers. Save the sun tanning
for the beaches & your backyards. You can always take
things off once you get to where you’re going so take a
small backpack with a change of clothes, your sandals &
flips flops. Trust me, you’ll be glad you did. Summertime
can be a lot of fun on a bike but you need to keep yourself
safe. As we all know, many drivers still are not sharing the
road with us like they should & it only takes a second for
something to happen in the midst of their carelessness.
Dress safe, stay alert & sober, have fun & enjoy your ride.
We hope that you make the most of these wonderful
days of summer in July, especially on the 4th as we
celebrate our independence for our nations birthday. We
appreciate you sending in those “Hot Shots” & thanks for
all the emails that drop us a line to say hello…please keep
em coming! Peace, love & happiness to all the friends we
know & for all the ones that we have yet to meet. Stay
cool & ride safe…we’ll see you around next month!

Yorktown, VA Ahoy Mates! Ride to remember a fallen hero, Lt. Cmdr.
Joe “Cuervo” Rodriguez, who began his Coast Guard career as a rescue
swimmer, helped the DEA fight the war on drugs and led USCG law
enforcement teams. He founded and led the first anti-terrorism team
in the USCG. Joe served as the State Charter VP for the US Military
Vets Motorcycle Club in Virginia. Riders will leave from Hampton Roads

3rd Annual Wreath Ride
Outer Banks HOG Chapter and The Sgt. Mac Memorial Foundation present
the third Annual Wreath Ride to Benefit the National Wreath Project. The
foundation was formed by the parents of Marine Sgt. Eric McColley, killed on
February 17, 2006. The National Wreath Project began on Christmas Day
2006, when the McColley family placed 515 wreaths in Quantico National
Cemetery where their son is interred. In 2009 the project placed 3300 wreaths
in Quantico National Cemetery and Soldiers National Cemetery in Gettysburg,
PA. This year will mark the 5th wreath placement and the foundations
goal is to increase the number of wreaths placed to 5000 in three National

Rolling Thunder
Memorial Day weekend, May 29th-30th, 2010 at Harley-Davidson of
Washington, DC was another memorable event. Although the rumble and
thunder of motorcycles was heard throughout the DC metropolitan area,
there was a special pride that rolled throughout the dealership.
To reunite and remember the POW’s and MIAs from the past and pres-
ent, Harley-Davidson of Washington, DC, once again celebrated the
“Official Rolling Thunder Reunion Spot” on Saturday, May 29th, 2010. Al-
though the day was a little cloudy, supporters of Rolling Thunder® did not
hesitate to come out. There were over 10,000 guests in attendance that
enjoyed free food, vendor alley, and the DJ. The food vendors included
Mike’s BBQ & Catering, Chick-fil-a, & Moe’s Southwestern Grill. Famous
Dave’s catered the VIP tent and Dunkin’ Donuts did the coffee and do-
nuts for Sunday’s American Pride Yellow Ribbon Ride. In addition to the
national HOG Pin Stop, there were organizations raising money for our
soldiers through raffles and vendors selling merchandise such as leath-
ers, patches, cleaning supplies, jewelry, sunglasses, trinkets, ice cream,
tattoo artists and much more. Harley-Davidson of Washington, DC is the
only location where you can purchase the “Official” Rolling Thunder XXIII
T-shirts. Proceeds raised from these t-shirts are donated directly to Roll-
ing Thunder®, Inc. Among the 10,000 loyal patrons who visited Harley-
Davidson of Washington, DC for Rolling Thunder® XXIII, were some very
special members of the Harley-Davidson® Motor Company and Rolling
Thunder®, Inc. families. Keith Wandell, the new Harley-Davidson Motor
Company President and CEO, joined the festivities at the dealership for
his very first Rolling Thunder®. He was welcomed by the staff and our
HOG Chapter at Harley-
Davidson of Washington, DC. He spent the day taking it all in, chatting
with customers and enjoying the pride that
burst at the seams of the dealership. Also in attendance were other
members from Harley-Davidson® Motor Company,
Mark-Hans Richer, Chief Marketing Officer, Tim Hoelter, Vice President
of Government Affairs, Gregg Murdie, District Manager and Lori Watson,
SOAR. They spent time mingling with Rolling Thunder®, Inc.’s Execu-
tive Director, Artie Muller and the other officers as well as, singer, Nancy
Sinatra. Once again, Artie was very excited to take part in this event and
was part of many photo opportunities. It was very nice to have so many
important people participating in the festivities.
Even though the “Official Reunion Spot” on Saturday was a huge suc-
cess, nothing tops off the weekend more than the surreal picture that is
painted on Sunday morning with the American Pride Yellow Ribbon Ride.
The morning started early, around 7:30 a.m. with free coffee and donuts
for all, followed by the raising of the American Flag by the local Accokeek once again, on Memorial Day weekend 2011 as Rolling Thunder’s XXIV’s

abrasions, the loss of layers of skin. Years ago, a good
friend of mine swerved to miss a deer that had darted out
in front of him, dropped his bike down on the concrete
deck, and skidded on the pavement for awhile, then onto
the gravel shoulder. Needless to say, he spent about a
month in a hospital burn unit. Burn unit you say? Yes, a
burn unit. For those of you who already know, I do not
have to tell you that severe road rash victims are treated
and cared for like burn victims. In my career I have seen
many road rash victims. Not only from motorcycle ac-
cidents, but bicycle, ATV’s, sledding, and cars/trucks.
The most vulnerable areas are the legs, arms and back,
however, they can occur anywhere on the body. Usu-
ally, the severity of the road rash depends on the speed
one was going, the type of pavement, and the amount of
protective gear you have on. Like mentioned above, we
treat these as if they were burns, (first, second, third de-
gree). We use a sterile dry dressing to cover the wound
ASAP. This is to help prevent bacteria from entering
the vulnerable open area. We normally do not remove
foreign material from the wounds, this may cause the
victims unnecessary pain, the hospital will remove them.
We do not use any burn creams or oils because this may
cause additional burning and pain. If the pain is severe
enough, we will use pain management. So, how do we
help prevent such a terrible thing from happening to us?
Ride safely and be constantly aware of road hazards,
(goes without saying), wear appropriate protective gear,
(Leather, Denim, Kevlar is the best protection), and take
an approved motorcycle riders safety course. These
courses are very informative and they help teach you
ways to stay and/or get out of trouble. My friend above
did survive his unfortunate ordeal; however it did cause
him to quit riding. It is a beautiful summer, ride safe, ride
free, and please take care of the children. God bless our
servicemen and veterans.

 The “Turn Sentinel” Not Just Another Safety Item
I recently met a life-long biker that
has invented a very unique item. He
said it has been over 1 ½ years in
the making, but is getting very close
to having it on the market. It is a
LED lighted turn signal worn over two
middle or first fingers and extends
to your wrist, wrapping around and
fastening with Velcro. It is very easy to
use in the first couple of minutes, the
button is easy to push and easy to get
used to. It is being made entirely in the
US of 100% leather and Anthony says
as long as he has the ownership, “It
will always be made in the US.”
The name of the device is the
“TURN SENTINEL”. Yeah, I know,
when first said everyone says “turn
signal” but he has diligently patented,
trademarked and purchased the

tion which “as he puts it is a “Painfully
Slow” and “expensive process”. I met
Anthony at the Thunder Rally in OKC,
although being pulled in many direc-
tions, I was able to give him some time
as he had a great product, great story

in his eyes as it relates to a loss of
a friend, Trey, killed 19yrs ago by a
“cage” that didn’t see him, but only
saw his bike which had tossed him to
the street and turned over near the

maybe he might have been seen if he
had one of these on as it stays with

ON A NEW OR REBUILT ENGINE
THE FOLLOWING GUIDELINES SHOULD BE FOLLOWED!

1 Never allow the engine to lug. Anytime you hear RPM’s drop or run at slower city riding
speeds, drop down a gear or two and allow the engine to spin freely.
2 Do not allow the engine to idle for any excessive length of time. Avoid stop and go traffic
situations. Lack of airflow to the engine causes uneven heating and possible
overheating, causing rapid excessive wear. See note on proper engine warm up
below.
3 Always use a good grade of gasoline. Premium only, no alcohol, 91 grade octane or
higher.
4. Avoid subjecting new engine to excessively high engine RPM’s. The first 500 miles or
so should be on the easy side of normal (around 4,500 max.) 3,000 rpm is best cruise
speed. 3,500 rpm for Dressers or trailer towing. No trailer towing on new engines. This
excludes engines that have been broke in on the dyno.
5 Have the engine professionally serviced, checked and tuned between 500 and 1,000
miles.
6 For all Pre-Evolution engines. Occasionally check head bolt and cylinder base nut
torque.
OIL RECOMMENDATIONS
1 Use only a good grade of motorcycle oil. No car oils!
2 Normal use 30o F to 95oF 20w50
3 Extreme Summer 60o F to 110o F SAE50
4 After break-in synthetic oil may be used. Lucas and Redline both offer a very good
product and are highly recommended.
5 Change engine oil frequently. Do not exceed 2,500 miles between changes. Synthetic
oil offers slightly extended drain intervals.

PROPER ENGINE WARM UP IS AS FOLLOWS….

1. Do not use choke or enrichner any longer than absolutely necessary. Shut completely off
as soon as possible. Keep engine spinning freely using throttle.
2. Try not to allow engine to run longer than one minute without air flow.
3. Ride bike slowly keeping engine spinning freely until thoroughly warmed up. Usually 3 to 5
miles or so.

3 tablespoons milk
3 tablespoons oil
3 tablespoons chocolate chips (optional)
A small splash of vanilla extract
1 large coffee mug(MicroSafe)

Add dry ingredients to mug, and mix well. Add the egg and
mix thoroughly. Pour in the milk and oil and mix well..Add
the chocolate chips (if using) and vanilla extract, and mix
again. Put your mug in the microwave and cook for 3 min-
utes at 1000 watts. The cake will rise over the top of the
mug, but don’t be alarmed! Allow to cool a little, and tip out
onto a plate if desired. EAT ! (this can serve 2 if you want
to feel slightly more virtuous). And why is this the most
dangerous cake recipe in the world? Because now we are
all only 5 minutes away from chocolate cake at any time of
the day or night!

it in any area that flies or other insects could invade. The
science behind zip lock bags of water? Millions of mol-
ecules of water presents its own prism effect and given that

MYRTLE BEACH HELMET LAW OVERRULED
The South Carolina Supreme Court unanimously ruled
Myrtle Beach’s motorcycle helmet law is invalid because it
conflicts with state law and said there is an overriding need
for uniform laws across the state. In its ruling, issued June
8, 2010, the court invalidates not only the city’s helmet and
eyewear requirement, but also overturned several other
municipal ordinances that the city council enacted last year
to discourage motorcyclists from attending bike rallies there.
The high court decision was in response to a lawsuit filed
on behalf of 49 riders who were ticketed during a helmet
law protest ride on the first day of the new law, being
represented by Aid to Injured Motorcyclists (A.I.M.) attor-
ney Tom McGrath of Virginia. Testifying before the bench,
McGrath argued that the ordinance was invalid because
it pre-empted state law, which provides that anyone over
the age of 21 is not required to wear a helmet. The S.C.
Supreme Court agreed, adding that conflicting equipment
requirements would “unduly limit a citizen’s freedom of
movement” throughout the state; “Were local authorities al-
lowed to enforce individual helmet ordinances, riders would
need to familiarize themselves with the various ordinances
in advance of a trip, so as to ensure compliance.” Accord-
ing to McGrath, the favorable ruling is important because it
“sets a precedent by saying that cities, counties and towns
cannot supersede state law. Where the state legislature
has spoken on an issue, it’s the final word.” Although the
ruling dealt specifically with the helmet-eyewear law, the
court also found that the city impliedly repealed many of the
new laws itself when it repealed its own administrative court
ordinance after the court’s chief justices opined that the
creation of a special courts system was unconstitutional.
As a result, “All the civil ordinances got tossed because
there is no administrative hearing process to resolve the
citations,” explains McGrath. Only the ordinances involving
misdemeanor violations remain in effect in Myrtle Beach,
but those include an onerous exhaust ordinance that is far
stricter than that enacted by the state legislature. Therefore,
on Tuesday, June 15, The Law Offices of Tom McGrath
filed suit on behalf of several plaintiffs including ABATE of
South Carolina, asking the 15th Judicial Circuit Court to find
the muffler ordinance to be unconstitutional and therefore
invalid. A successful challenge could affect other cities en-
acting noise laws and exhaust requirements that are not in
accordance with existing state laws.
HELMETS STINK
Helmet LAWS Suck, but new technology can make helmets
smelly too! Helmet manufacturers inform buyers that they
should replace their helmet every couple of years because
miniscule cracks can develop over time rendering them
structurally unsound, or to discard a helmet immediately if it
is involved in an accident or even dropped. It’s sometimes
difficult to determine with the naked eye when a helmet
loses its effectiveness, but researchers at the Fraunhofer
Institute for Mechanics of Materials in Germany have devel-
oped a way for your nose to tell when your lid has outlived

its usefulness. When your helmet is getting past its prime, it
will start to smell. If it develops any large cracks... well, your
nose knows. The secret lies in odoriferous oils, enclosed
in formaldehyde resin microcapsules. These microcap-
sules are in turn added to liquid polypropylene, which is
injection-molded to form the shell of the helmet. When the
shell breaks, the capsules rupture, and stinking ensues.
The Fraunhofer researchers used a computer simulation
to calculate the number of capsules needed, then used
mechanical testing to check that they would rupture shortly
before complete structural failure. “Smell detection is al-
ready in use for coated metal components. We are applying
the process for the first time to polymer materials,” stated
Fraunhofer’s Dr.-Ing. Christof Koplin. “The cycle helmet is
being used as a demonstrator. Work on the capsules has
finished and we are now completing characterizing tests on
individual configurations.” Possible other applications could
include pressure hoses, and water and gas pipes.
U.S. DEFENDERS ASK JUDGE TO SEND MANSLAUGHTER
CASE TO TRIAL
A state district judge in Texas has rejected a plea bargain
that would have placed a blind woman on deferred proba-
tion in the traffic death of motorcyclist. Judge Ralph Strother
of Waco’s 19th State District Court refused to accept the
plea deal in a felony manslaughter case that involves a
vision-impaired 39-year-old who was driving without a
license and was cited at least twice before for the same
offense. The U.S. Defenders, a politically-active arm of the
Confederation of Clubs, conducted a “Call to Action” and
Judge Strother’s office was inundated with 1,200 letters
from motorcycle enthusiasts who urged him not to accept
the prosecutor’s recommended plea deal. Trena Evette
Mitchell, who is legally blind and had four children in her
car when she turned in front of Richard Craig Schroeder’s
motorcycle last December as he was returning from a toy
run, withdrew her guilty plea and her case is now set to go
to trial in mid-August. Mitchell had been scheduled for sen-
tencing in late July, but the judge moved up her case after
more than a thousand motorcyclists said they would ride to
the courthouse to show support for Schroeder, known as
“Hat Trick” to his biker friends. “Last year we worked with
the legislature to net a minimum fine for those who injure or
kill an innocent party by encroaching on their right of way,”
said Sputnik, State Chair for the Texas Motorcycle Rights
Association (TMRA-2) and Chairman of the National Coali-
tion of Motorcyclists’ Legislative Task Force (NCOM-LTF).
“We did not receive a single no vote in the House or Senate
on SB 1967. Unfortunately we did not take into consider-
ation a Plea Bargain where they could be given adjudica-
tion and end up not being found guilty. It is apparent that
we shall have to return to the bill’s sponsor Senator Carona
and reconstruct SB 1967 during the upcoming session to
make allowances for such an occurrence.”
ABATE OF FLORIDA RECEIVES STATE FUNDING FOR
MOTORCYCLE SAFETY

As Florida Governor Charlie Crist signed the 2010-2011
Florida Budget (HB 5001) into law on May 28, ABATE of
Florida will receive a quarter of a million dollars specifically
to promote motorcycle safety and awareness. “The Florida
Department of Highway Safety and Motor Vehicles recog-
nized ABATE of Florida for our continuing work attempting
to make the roadways of Florida safer for all motorcyclists,”
said James “Doc” Reichenbach II, President of ABATE of
Florida, Inc., and Chairman of the NCOM Board of Directors
in a prepared statement. The exact wording from the state
budget’s “CONTRACTED SERVICES FROM HIGHWAY
SAFETY OPERATING TRUST FUND” reads; “From the
funds in Specific Appropriation 2735, nonrecurring funds in
the amount of $250,000 are for the purpose of promoting
motorcycle safety awareness through public information
and educational campaigns. These funds are provided to
the American Bikers Aiming Toward Education of Florida,
Inc.” This is not the first time that ABATE of Florida has
received state funding from the DHSMV. Over the last few
years, the state government has recognized ABATE’s valu-
able Motorcycle Safety and Awareness Program (MSAP)
for saving lives of motorcyclists statewide. ABATE’s MSAP
program has been presented to local civic groups, schools
and public events by 32 ABATE chapters statewide, and an
independent audit is provided to ensure that the funds are
utilized to enhance motorcycle safety education.
SURVEY REVEALS MOTORCYCLE SAFETY PRACTICES
Consumer Report’s latest survey reveals the safety habits
of motorcycle and scooter owners across the U.S. A little
over half of more than 1,300 respondents said they had
taken a formal riding instruction course. Nearly 1 in 4 said
they don’t always wear a helmet when they ride. Half of the
respondents reported regularly wearing protective boots,
and less than half said they regularly wear gloves. About
25% said they always wear a leather, or other protective
jacket when riding. Fewer than 10% always wear protective
pants or clothing in high-visibility colors. Three out of five
riders admitted to riding in a short-sleeved shirt, and about
a quarter said they rode in shorts.
MOTORCYCLE-ONLY CHECKPOINTS CHALLENGED
Since 2007, the New York State Police, along with other
county and local police departments, have been conduct-
ing motorcycle-only police checkpoints on the roadways of
New York State, often targeting major motorcycle events.
Authorities claim that the purpose of these stops, at which
they issue numerous tickets for helmet and exhaust pipe
violations, is to advance motorcycle safety. “Being a motor-
cycle rider myself, as well as the Aid to Injured Motorcyclists
(A.I.M.) Attorney for New York State, I was asked by ABATE
of New York to contest this infringement on the rights of mo-
torcyclists,” said Mitch Proner, who then advised the State
Police and municipal authorities of his intent to file suit on
behalf of ABATE and the National Coalition of Motorcyclists
if the discriminatory roadblocks continued. “My letter was
ignored and consequently, with the help of then-President of
ABATE, Robert “Prospector” Boellner, I found class repre-
sentatives to bring my action against the New York State
Police as well as the other municipal agencies and elected
officials participating in these stops,” explains Proner. In the
first lawsuit of its kind in the United States, the NYC law firm
of Proner and Proner is challenging the constitutionality of
this unwarranted police action on First, Fourth, Fifth and
Fourteenth Amendment grounds in the Federal Court for
Northern District of New York. “The United States Supreme
Court has long recognized that when a motorist is stopped
on the roadway, there is a ‘seizure’ under the Constitution,”
Proner notes, adding that “Whether or not this ‘seizure’
is unconstitutional depends on whether or not objective
facts indicate that society’s legitimate interests warrant the
seizure and the degree to which it intrudes on the indi-
vidual’s personal liberties.” Although the lawsuit is still in the
discovery stages, internal memorandum which police have
been forced to disclose as result of the lawsuit indicate that
members of the NYS gang unit are assigned to work the
checkpoints and Proner thinks the Court will agree that the
stops are designed primarily for law enforcement purposes
as opposed to public safety purposes. “Rather than promot-
ing any legitimate public safety concern, the checkpoints
are intended to harass and intimidate motorcyclists attempt-
ing to attend motorcycle events thereby depriving them of
their First Amendment right to freedom of assembly as well
as their Fourth, Fifth and Fourteenth Amendment rights to
due process, equal protection and freedom from unreason-
able searches and seizures” he concludes.
WEIRD NEWS: WOMAN FINED FOR “NOT HAVING A
CLEAR FIELD OF VISION”
A woman driver wearing an Islamic face veil was ticketed
by French traffic police for not having a clear field of vision.
The 31-year-old French citizen was fined euro22 ($29) in
early April based on a rule that says drivers should have
freedom of movement and a sufficient field of vision, her
lawyer Jean-Michel Pollono said. Pollono told reporters that
he is protesting the decision, saying a veil is no different
from a motorcycle helmet in terms of hindrance to vision; “If
the veil is forbidden behind the wheel…then full helmets for
motorcyclists should be banned, because you can’t see on
the sides.” Following months of parliamentary discussion
and government talk about banning veils in public, the case
has escalated in the media spotlight. The woman’s hus-
band has since been accused of polygamy and fraudulently
benefiting from state financial aid for single parents paid to
each of his four wives -- all of whom wear veils.

These Bible verses are very beautiful in that they show
Christ’s great healing power and compassion. Consider
the condition of this man...he needs healing and yet no
one helps him. Others always push ahead of him, and
he misses the opportunity to be healed. Competition-
-selfishness--disobedience---these words seem to
describe today’s world as well! When others push
ahead of us and cause us to miss an opportunity--Jesus
Himself will supply the need!
“And he said unto me, My grace is sufficient for thee: for
my strength is made perfect in weakness. Most gladly
therefore will I rather glory in my infirmities, that the
power of Christ may rest upon me.” (2Corinthians 12:9)
When we are alone and needy, we can count on Jesus-
-not man-- to help us. He will do what it takes to bless
you! We don’t have to be #1 in the world--because
God supplies the need! There is no need to push ahead
of others and need to be first if we are trusting Jesus.

This is indeed a strange title for an article aimed at motorcy-
clists. You would not think that the above have anything to do
with each other. However, recent maneuvers by the Virginia
Department of Alcoholic Beverage Control (ABC) have
changed that. I have received numerous telephone calls and
emails from members of motorcycle clubs asking me if it is
illegal to wear colors or insignia in an establishment that has
an ABC license. I have also been asked whether it is legal
for the owner of such an establishment to refuse a person
wearing such colors or insignia admission into his or her
establishment. These questions are what have spurred me to
write this article.
Let’s start with the question of whether the owner of a private
establishment can refuse admission to patrons based upon
colors or insignia. The answer to that is yes they can. Is it
discrimination? Yes. However, contrary to popular belief,
discrimination is not illegal. The owner of private property can
refuse admission to anyone on any basis so long is it is not
a constitutionally impermissible basis such as race, creed,
color, sex, or religion. The owner can keep people with blue
shirts out while admitting those wearing red. Likewise he
or she can keep persons wearing certain colors out while
allowing people wearing other colors in. Discrimination is not
illegal in this situation.
However, things change when it is the government doing the
discriminating. While a restaurant owner can keep a person
out because he or she is wearing colors or insignia, a deputy
sheriff cannot keep the same person out of a courthouse for
that reason. Nor can that person be kept out of a city park or
library. That becomes the government taking action based
upon expressive speech. That is illegal.
This brings us to the Virginia Department of Alcoholic Bever-
age Control. They have been given a new weapon in their
arsenal against criminal street gangs. That weapon is Sec-
tion 4.1-225 of the Code of Virginia. It allows ABC to revoke
the ABC license of any owner of an establishment who has
such a license who allows, among other things, for his or
her premises to “become a meeting place or rendezvous
for members of a criminal street gang as defined in Section
18.2-46.1 . . “ Note that it does not make it illegal for the
member of the criminal street gang to be on the premises. It
provides no punishment for the member of the criminal street
gang. The punishment is aimed at the owner and holder
of the ABC license. It is a heavy handed way of forcing the
owner to keep such people out of his or her establishment.
To see the real problem with this statute we have to
look at the definition of a criminal street gang in Section 18.2-
46.1. Under that section, a criminal street gang is defined
as “any ongoing organization, association , or group of three
or more persons, whether formal or informal, (i) which has as
one of its primary objectives or activities the commission of
one or more criminal activities; (ii) which has an identifiable
name or identifying sign or symbol; and (iii) whose members
individually or collectively have engaged in the commission
of, attempt to commit, conspiracy to commit, or solicitation
of two or more predicate criminal acts, at least one of which

is an act of violence, provided such acts were not part of a
common act or transaction.” There, isn’t that clear? Now you
know what a criminal street gang is in Virginia. Actually you
don’t. You must also understand what a predicate criminal
act is so that you as an ABC license owner will know whether
the person in your establishment fits the definition of a mem-
ber of a criminal street gang. A predicate criminal act means
either an act of violence or any violation of Sections 18.2-42,
18.2-46.3, 18.2-51, 18.2-51.1, 18.2-52, 18.2-53, 18.2-53.1
, 18.2-55, 18.2-56.1, 18.2-57, 18.2-57.2, 18.2-59, 18.2-83,
18.2-121, 18.2-127, 18.2-128, 18.2-137, 18.2-138, 18.2-146,
18.2-147, subsections H, H1, or H2 of Section 18.2-248,
Section 18.2-248.01, 18.2-255, 18.2-255.2, 18.2-282.1, 18.2-
286.1, 18.2-287.4, 18.2-308.1 or 18.2-356. Additionally any
substantially similar offense under the laws of another state
or territory of the United States will suffice. Now you know
what a criminal street gang is.
As you can see, the owner of an establishment who
has an ABC license has absolutely no way of knowing which
group is a criminal street gang and which is not. He or she
must know the purpose of the club or organization, the activi-
ties of its members and their criminal histories. Since they
can’t possible know all of that, and since their ABC license
is their livelihood, many are just putting up “no colors” signs.
Also keep in mind that what is considered colors to one own-
er may not be to another. The owner of the Smithfield Tavern
may interpret colors to mean patches worn by gangs such
as the ones in West Side Story while the owner of Roanoke
Grill may think a person’s HOG vest is colors. It is completely
subjective.
So the answer to the question is that it is not illegal
to wear your colors or insignia in an establishment that has
an ABC license. However, other factors may prevent you
from being able to do so. I personally believe that this law is
unconstitutionally vague. The person subject to punishment,
the owner, cannot possibly know how to comply with the
law short of using a shotgun approach. The United States
Constitution requires that laws be written so that reasonable
persons can know how to comply with such laws. I do not
believe that Section 4.1-225 is written in such a way. For that
reason, my firm has a standing offer to the owner of any Vir-
ginia establishment with an ABC license to represent them in
challenging this law. We will do so for free. Too many motor-
cyclists are being affected by this overly broad statute.

Pro bono populi. That was just one of the many Latin
phrases hammered into my head throughout my time in law
school. Translated, it means “for the good of the public.” I
can think of no better embodiment of this principal than the
combined efforts of ABATE and our law firm to overturn the
unconstitutional ordnances passed by Myrtle Beach. What
many non-riders do not understand is that this victory is as
much theirs as it is ours, and it certainly goes far beyond
the freedom of choice to wear helmets.

If the Myrtle Beach Ordnances in question had gone

unchallenged it would have set a dangerous precedent for
all those in our state and potentially around the country.
Allowing municipalities to enact ordnances that conflict with
state law addressing the same subject matter would lead
to chaos. Under such a scenario, citizens and visitors to
a state would be unable to fully educate themselves as to
how to comply with the conflicting laws of each jurisdiction.
To take it a step farther, law coming from the State House
would lose power as county and city officials would simply
pass ordnances addressing the same subject matter with
conflicting language when these officials did not agree with
certain portions of state law. In a sense, this would bestow
line-item veto power to municipal officials, a power certainly
not allowed by our state’s Constitution.

To bring an action to oppose bad law is without a doubt “for

the good of the public.” As, I have told many over the past
few days, our civil rights are very similar to a beach and the
laws passed are the waves crashing upon it. You might not
notice the small amount of sand carried off with each wave,
but over time you will no longer have a beach. Instead, you
will be drowning in a sea of poor legislation with no land in
sight.

You as riders can rest assured that no one’s rights will be

eroded as long as we keep up the fight “for the good of the
public.” After all, nothing will bring us closer together and
circle the wagons faster than an attack.

In The Day
I recently took a class at a conference on the parking
of vehicles on highways and roadways during an emer-
gency situation. It was extremely informative, these types
of classes usually are. During one of the many videos that
we viewed during the class, I noticed that there was a
motorcycle police officer that was working an accident on
a busy suburban boulevard, along with other emergency
vehicles on the scene. Many emergency vehicles are
the target of secondary collisions at the original accident
