PETITION

Petitioner, through the undersigned counsel, to this Honorable

Court respectfully states, that:

1. Petitioner, JON, is a Filipino citizen, of legal age, single, and is a

resident of Brgy. Lahug, Cebu City where he may be served with
summons and other court processes.

2. Robin Hood, henceforth Robin for brevity, for whom letters of

guardianship are prayed to be issued, is a the Filipino citizen, of
legal age, single, and is a resident of Brgy Lahug, Cebu City where
he may be served with summons and other court processes.

3. That Robin was diagnosed with Down Syndrome by John Strange,

M.D. Dr. Stranges medical findings are contained in his Medical
Report and herein attached as ANNEX A.

4. That on August 14, 2005, Robins parents died together in a

bombing incident which occurred at SM City Cebu, Brgy. Mabolo,
Cebu. A copy of the Death Certificate of Robins father and mother
are attached hereby as ANNEX B and ANNEX C, respectively.

4. Due to Robin medical condition incapacitating him to care for

himself and his parents untimely demise, he has been living with
herein petitioner, his uncle, at the latters residence in Brgy. Lahug,
Cebu since August 20, 2005.

5. That Robin has real properties consisting of a house and lot worth
of Php 10,000,000 and personal properties consisting of a Kia
Picanto Car worth Php 400,000.

6. The only relative of Robin is his uncle Jon who is of legal
age, residing at Brgy. Lahug, Cebu City.

7. It is necessary and convenient that a guardian over

Robins person and his property be appointed.

8. That the petitioner possesses all qualifications and none

of the disqualifications of a person to whom a letter of guardianship
should be issued. Herein attached as ANNEX D are copies of
documents proving petitioners good moral character.

PRAYER

WHEREFORE, it is most respectfully prayed that after due

notice and hearing, the Honorable Court grant this petition to be
appointed guardian over the person and properties of Robin Hood.

are true and correct of my personal knowledge and on the basis of
copies of documents and records in my possession;

4. I have not commenced any other action or proceeding

involving the same issues in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;

5. To the best of my knowledge and belief, no such action or

proceeding is pending in the Supreme Court, the Court of Appeals, or
any other tribunal or agency;

6. If I should thereafter learn that a similar action or proceeding

has been filed or is pending before the Supreme Court, the Court of
Appeals, or any other tribunal or agency, I undertake to report that
fact within five (5) days therefrom to this Honorable Court.
