Outsourcing Radiography Work of Ship Hull Structure at GRSE


1. GRSE intends to outsource radiography work of welded joints of hull structure
of ship under construction at GRSE to reputed and well established Contractor /
Laboratory in this field. Interested parties may submit their bid to GRSE, Quality
Assurance Dept.

2. The job to be carried out as per enclosed SOR for outsourcing radiography
work of ship hull structure at GRSE. SOR No.: SOR No. QA/NDT (RT)/2013- 15 Dtd
02 Apr 13 is placed at Annexure I.

3. The radiography work will be examined by GRSE (QA), Warship Overseeing


Team (Kolkata), and / or Classification Societies (ABS/IRS/LRS etc).

4. The time frame from execution of the project: 24 months from the placement
of order / LOI and would be extended for a period of another 06 months, if required.

5. Bids are to be submitted as per Standard Terms & Conditions placed at


Annexure-II in two parts consisting of Techno Commercial Part and Price Bid Part.

6. Price Bid to be submitted as per Price Schedule shown in Annexure-III.

7. EMD of Rs.26,000/- (Rupees twenty six thousand only) is to be submitted in


the form of DD/Pay Order/Bank Guarantee along with Techno-Commercial offer.

8. All documents enclosed with this tender are to be signed and attached with
Technical Bid as a proof of acceptance of Terms & Condition Stipulated in Tender
Documents.

9. Bids are to be submitted in two separate envelopes duly sealed and


superscribing the Enquiry No. and title Quotation for Radiography Work of Ship Hull
Structure at GRSE and to be submitted in tender Box kept in QA Dept. at GRSE
Main, 43/46, Garden Reach Road, Kolkata-700024, within 2 P.M, on ) 10.05.2013
and Technical Bid will be opened at 2.00 P.M on the same day. Bid, if not submitted
as above, is liable to be rejected.

10. Date of Meeting for TNC, CNC, Price Bid opening, PNC will be intimated in
due course of time.

11. GRSE reserves the right to accept or reject the offer in part or full without
assigning any reason.

12. No part order will be placed. Order will be placed on overall L-1 basis.

13. For further clarification regarding Tender/Project Work, if required, may be


obtained from the undersigned before submission of bid.

SOR FOR SUB - CONTRACTING RADIOGRAPHY WORK OF SHIP HULL


STRUCTURE AT GRSE

1. GENERAL

1.1. A large number of Radiographic Test of welded joints of hull structure of Ship,
both in fabrication at shops and erection sites, at GRSE vendors premises,
KoPT Dock to be undertaken by Contractor at GRSEs cost for evaluation of
soundness of welding.

1.2. Material specification of ship under construction are steel to DMR-249 A/ ABS
Gr B /IS:2062 or any other equivalent steel Plate/Pipe of thickness ranging from
3 mm to 40 mm.. This includes the radiographic examination on weldment of
non-ferrous material i.e. Al-alloy, Cu-Ni alloy, Gun Metal etc.

1.3. The selected Contractor shall have adequate infrastructure w.r.t. competent
manpower, availability of X-Ray machine / Ray equipment etc for execution
of the above activities and should have an office in and around Kolkata for
immediate reaction / execution of job.

1.4. The selected contractor shall be approved by classification society such as


ABS/IRS etc or accredited by NABL and shall have past experience of such
testing in fabrication works with a minimum turn Over of Rs. 25,00,000/- per
annum.

1.5. The Minimum size of radiographic film shall be of Size -


a) 4 x 7.5 for Block Joints.
b) b) 4 x various lengths between 7.5 15 befitting the accessibility of
welded joints for erection butt joints.

2. SCOPE OF WORK OF GRSE


2.1 GRSE will prepare relevant inspection note related to joint details,
thickness of plate, welding process etc. in association with surveyor.
2.2 Relevant documents enlisting joint detail, thickness, welding process,
identification no. of welders etc will be handed over to the contractor two
working days in advance for execution of radiographic work. GRSE will
identify/mark the location of welded joints prior to Radiographic
examination.
2.1 GRSE will provide assistance to the contractor by removing weld ripples
or weld surface irregularities on both inside and outside so that finished
surface may have reasonably uniform weld crowns.
3. SCOPE OF WORK OF SUB CONTRACTOR
3.1 The contractor will arrange for RT on the identified/marked location of the
welded joints with their own test equipment and AERB
authorized/qualified manpower.

3.2 The contractor will take back the exposed film along with the radiograph
equipment to their own premises for subsequent processing of the
exposed film.

3.3 The contractor will submit the processed films along with test certificates
incorporating test results showing their observation /comments in line
with specification NES 729.

4. SCOPE OF SUPPLY OF GRSE.


4.1 GRSE will assist the contractor by providing cranes, if necessary, site
clearance, labour assistance, proper staging/scaffolding, lighting facility,
clearance of the work place etc.

4.2 Necessary power supply required for operation of X- Ray machine.

5. SCOPE OF SUPPLY OF SUB CONTRACTOR

5.1 Consumable.
5.1.1 All X-Ray film to required quality and size to be used in this
radiographic examination and to be supplied by them.

5.1.2 Consumables required for generation of hard copy and soft copy
of the report.

5.2. Labourer and Tools.


5.2.1 Skilled/unskilled labourer required for handling Radiographic
equipment to be arranged by the contractor.

5.2.2 All tools and tackles required for tacking Radiographic


shots/exposure at site are to be arranged by the contractor.

5.3. Miscellaneous.
Contractor has to arrange sufficient number of area monitoring devices
required to forbid entry in the hazardous radiation area for safety of
personnel.
5.4. Transportation

Contractor will arrange their own transport required for bringing


their equipment and technician from their office to site as well as for
their return after completion of work on regular/daily basis.

6. INFRASTRUCTURE OF THE SUB CONTRACTOR

6.1 Equipment/Accessories

6.1.1 Radiation source: AERB approved Ir 192 Light Weight Portable


Remote operated radiography camera except Roli-1, along with cranking device.
Camera Model and SI No. are to be mentioned in their offer.

6.1.2 X-Ray Machine: 200 300 KV Portable type.


6.1.3 Viewing Radiographs: The contractor shall have an equipment to view
radiographs for interpretation. The viewer shall provide a variable light source
sufficient for essential IQI designated wire to be visible for specified density
range. Adjustable intensity of the illuminator to view the radiograph u pto 2-3
density.

6.1.4 Activity: As per decay chart.


6.1.5 Film: Medium/Slow Speed film of Laser/ Agfa Kodak complying
ASTM CL -II/CL -III depending upon the thickness of the job and type of
the material.

6.1.6 Lead Intensifying Screen: Minimum front and back 0.1 mm of


lead thickness with calibration certificate.

6.1.7 Image Quality Indicator: Material Steel /Al/Cu and Brass etc;
Identification number should be as per ISO DIN 54109.

6.1.8 Chemical: Developer and fixer of reputed make for processing


the film in their own A/C dark room.

6.1.9 Identification Markers: Lead letter, Lead numbers and arrow


markers.

6.1.10 Others: Magnet, cello tape, collimator (Lead /Tungsten) 2/3


TVT capacity.

6.2. Technical Personnel

6.2.1 The contractor shall have at least two BARC Level- I qualified
personnel and one Site in Charge (RT BARC Level II) on their pay roll.

6.2.2 Interpretation of Radiographic film shall be carried out by at least NDE


(ASNT /ISNT/BARC) Level II personnel.
6.3. Computer Facility

Contractors laboratory/office shall be equipped with computer facility viz PC,


Printer, Scanner etc. required for generation of soft copy and hard copy of
reports to be submitted to GRSE.

7. TEST PROCEDURE.

7.1 Exposure Technique

Single -wall single image exposure technique shall be used for radiography
in case of plate joint. In case of RT of pipe diameter < = 89 mm, double wall and
double image technique shall be applied and above 89 mm diameter pipe,
double wall single image technique shall be used.

7.1.1 Identification of Radiograph

Each radiograph shall be identified with the following:

Date of exposure.

7.1.2 Exposure Time


Exposure time shall be calculated based on the source strength, film
speed, thickness and type of material of weld joints and maximum possible
source to film distance. Recommended maximum values for the
Geometrical Unsharpness of the radiographs shall be as per T274.2 of Article
2, ASME Sec-V.

7.1.3 Sensitivity Required


Radiographic technique shall be such as to obtain sufficient sensitivity
level measuring 2% (min) w.r.t. wire type IQI and hole type IQI. The
radiograph shall also display the IQI designation numbers and letters.

7.1.4 Placement of IQI.


The IQI shall be placed on the source side except when inaccessibility
prevents placing of the IQI on the source side. Wire type IQI shall be placed
on the weld so that the length of the wires is perpendicular to the length of the
weld at end portion of the film.
7.2 Quality of Radiographs
7.2.1 All radiographs shall be free from mechanical, chemical or other
blemishes to the extent that they do not mask and are not confused with the
image of any discontinuity in the area of interest of the weld being
radiographed. Such blemishes are:
Fogging.
Processing defects such as streaks, watermarks or chemical marks.
Scratches.
False indications due to defective screen like scratches on the lead
screen.

7.2.2 Re take, if any, to be taken by the Contractor free of cost.

8. ACCEPTANCE CRITERIA

Interpretation of the radiographs should be compared with acceptance criteria


stipulated in NES- 729.

9. QUANTUM OF WORK.

9.1 Approximate no. of shots to be taken monthly: 150-200. This includes


exposure in block butt as well as in erection butt.

9.2 No. of visit required by the contractor to GRSE may be in all working days
including holidays/Sundays etc depending upon the necessity of work.

9.3 Radiography work to be undertaken within recess hours or after normal


working hours. The Radiography work to be carried out on Sundays and other holidays
also. Required site clearance is to be obtained from GRSE /Project leader /Shop in
Charges.

10. COMPLETION TIME

10.1 Offered jobs are to be organized within 48 hours of notice from GRSE and
processed films are to be submitted within 48 hours and final report will be generated
and submitted within 72 hours.

10.2 In case of urgency, the contractor will attend the job with 24 hours of
notice from GRSE and subsequently processed films will be submitted with 24
hours. No additional charge will be claimed by the Contractor.

11. TIME FRAME

Approximate time frame for this contract will be 24 months from the date of
issue of Purchase order/LOI and may be extended by 6 months if required.
12. PRICE /RATE

12.1 Price/Rate to be quoted as per price schedule in Annexure III.

12.2 Price / Rate, quoted by the Contractor shall be inclusive of


i) Cost of consumable.
ii) Hiring charge of equipment
iii) Transportation charge of technicians, labourer and test equipment
iv) Visit charges of the Technician, labourer.
v) Cost of documentation, report generation (Hard and Soft copy)

12.3 Minimum wages of the technician/labourer and payment should comply with
Central Govt Notification dtd 14 Sept 12 which may change from time to time.

13. PAYMENT AND CERTIFICATION

i) Job completion certificates will be issued by General Manager (Quality


Assurance), GRSE. Bill raised by the contractor will be routed through GRSE (QA)
Department for payment.

ii) Payment shall be made on pro-rata basis for the actual work performed as
per the yards requirement.

iii) Valid Invoice in quadruplicate shall be raised by the contractor on monthly


basis.

iv) 90% progressive payment will be released within 30 days of receipt of bill on
completion of test duly certified & supported with satisfactory job completion
certificates monthly basis. Balance 10% payment will be released on a total
completion of job.

14. PROJECT CO-ORDINATION.

14.1 Contractor will nominate one coordinator for liaising with GRSE during the
execution of the project.

14.2 GRSE, if required by the contractor, will provide office space inside GRSE
premises for effective functioning of radiography work.

14.3 No space/storage facility will be provided to the contractor for storage of


radiography source to be used by them for execution of work.

15. SECURITY.

The test results and other relevant documents generated by the test agency
are the properties of GRSE and should not be transferred to any other parties without
prior permission of GRSE.
16. STANDARD TERMS AND CONDITIONS

Payment terms, bid submission and other statutory requirements should


comply with STAC at Annexure II.

17. RADIATION SAFETY

17.1 During radiography exposure the following safety precaution shall be


maintained by the Contractor to avoid hazards:
17.1.1 The Site in charge/RT Level II shall ensure that all the safety
instructions stipulated by BARC/DRP 1971 should be followed strictly and a
logbook should be maintained regularly.
17.1.2 Suitable and calibrated radiation monitoring devices shall be
used to evaluate the radiation level.

17.1.3 All radiation workers shall wear the personnel radiation


monitoring devices i.e. film badges, TLD badges or Dosimeter.

17.1.4 If, possible, suitable beam limiting devices such as collimator


should be used to limit the area of primary beam and to reduce the unwanted
radiation level.

17.1.5 Camera should not be left unattended at site.

17.1.6 Source should not be left unattended at site during exposure.


17.1.7 Source should not be left in crowded area. Radiography
work should be done by cordoning off the site with rope with radiation
warning symbols. Depending upon the workload cordon-off distance will be
such that 0.1 mR/hr.

17.1.8 Unauthorized person should not be allowed to enter into the


cordon off area during exposure.

17.1.9 After each exposure and use, the safe return of source to the
camera to be ensured by using radiation survey meter.

17.2 During the entire radiographic work, proper precautionary measures to be


adopted for safety against radiation in accordance with BRAC guide line.

17.3 In case of accident, such as damage of camera or source assembly or stuck


off source within the guide tube or loss of camera or source, report should be made
immediately to the safety officer/coordinating officer from GRSE side and
subsequently to the HeadRPAD, BARC, Mumbai.

Annexure II
STANDARD TERMS AND CONDITIONS (STAC)

1. PAYMENT TERMS
i) 90% progressive payment will be released within 30 days of receipt of
bill on completion of test duly certified & supported with satisfactory job
completion certificates monthly basis. Balance 10% payment will be released
on a total completion of job.
ii) Check List as per Appendix C of Annexure II to be submitted duly
filled up by the contractor along with the Bill.
2. LIQUIDATED DAMAGE
For delay in completion of work, L.D @ % per week or part thereof on
the undelivered portion of the order value subject to a ceiling of 5% of the total
value of the order will be applicable.
3. RISK PURCHASE
In case of progress of work is not satisfactory and the contractor fails to
maintain the schedule, GRSE reserves the right to get the work done by
alternative source at the risk and cost of contractor.
4. JOB STARTING & COMPLETION TIME
Job requires to be started immediately on placement of order / LOI and
to be completed as per requirement of GRSE.
5. TENURE OF THE CONTRACT

The contract will remain valid for a period of two years from the date of
the issue of order / LOI or when the order value is consumed, whichever is
later.

6. MOBILISATION TIME

2 (Two) working days will be given for commencement of work.

7. PRICE

The quoted price should be inclusive of all statutory Taxes / Levies and
other charges as applicable. The price should remain firm & fixed till
satisfactory execution of the entire contract with no escalation applicable
whatsoever. Service tax will be paid extra as per the ruling rate. Service tax
registration certificates for the service being tendered is to be enclosed with
the techno-commercial bid. If the certificate is not obtained so far, copy of the
application for registration for the service under consideration is to be
enclosed. Service tax registration number to be quoted in all bills.
8. VALIDITY OF OFFER

Contractor offer should remain valid for a period of 3 (three) months from
opening of the price bid.

9. SUBMISION OF OFFER

i) a) Technical commercial offer in triplicate and

b) Price offer only in original.

Both the sealed envelopes should be put in the third envelope and the
third envelope should be sealed. Enquiry No. / Date, Due Date and
Title should be superscribed on all the envelopes and to be dropped in
Tender Box kept in Quality Assurance Dept., at GRSE (Main), 43/46,
Garden Reach Road, Kolkata 700 024, within the due date and time
as per the requirement. The contractors offer will not be considered if
the requirement is not complied with the above date and time schedule.

ii) GRSE reserves the right to accept / reject any Tender in full or in part
without assigning any reason. GRSE also reserves the right to enter into the
contract with one or more contractors for their requirement of whole or part
job.

iii) No Conditional offer will be accepted.

iv) When an order is issued to a vender / contractor for execution of a


particular job, the contractor shall not contract the job/a part of the job without
prior approval of GRSE.

v) Quotation received after due date and time will not be considered

vi) If a contractor is not interested to quote, in such case contractors


confirmation of having received the tender but not willing to quote / regretting
to quote, must be forwarded for GRSE reference & records. This should be
treated as a requirement for the Vendors name to be retained in GRSEs
select list.

vii) Declaration form as per AppendixA regarding License / PF / ESI is to


be filled up and submitted along with the techno-commercial bid. This is a
mandatory requirement without which the bid will be rejected.

viii) Questionnaires as regards to ISO 9000 which should be duly filled up


and submitted along with techno-commercial part of offer (see AppendixB)
ix) Bid Composition

a) The proposal shall be submitted in two-bid system as per


following:
Part I- Consisting of i) Technical Offer

ii) Commercial Terms and Condition

iii) Earnest Money Deposit

Part II- Financial Proposal consists of Price offer only.

EMD shall be kept in a separate sealed cover superscribed with


EMD & Tender No. All the envelopes, i.e. Part I & II and
EMD will be put in a separate cover sealed properly and
submitted.

This section to be read in consultation with Terms & Conditions


stipulated in Annexure II, STACS.

b) Technical Proposal shall clearly demonstrate the Inspection


Agencys understanding, capability and approach for carrying out the
task set forth in the SOTR through delegated competent personnel.
Technical proposal shall also contain the following:

A Concise, complete and logical presentation of the


approach and methodology to be adopted by the contractors
team to carry out the services to meet all the requirements of
SOTR.

An organization chart indicating assigned designation


amongst the organization and a list of personnel with their
Bio data, designation, to be engaged for execution of
contract.

One senior level officer with name, designation, posted at


Kolkata office, shall be nominated as single point contact
person for coordination and monitoring of activities to ensure
satisfactory progress and contract performance.

The Bidder shall submit an undertaking in prescribed format


(as shown in Appendix A in Annexure II) along with
Part I Bid.
c) Commercial Proposal shall be submitted as per guidelines of
Standard Terms and Conditions of Annexure II which is a part of the
enclosed tender document.

d) Financial Proposal for execution of the proposed Testing and


QA responsibilities as per SOR placed at Annexure-I is to be
submitted along with the Technical Proposal.

e) Mixing of Bid / offers and conditional offers are not acceptable


and stands liable to rejection.

f) Any Bid received after due date as prescribed, shall be returned


unopened to the bidder.

g) The bidder shall not be allowed to modify his bid after


submission. However in the event the due date for submission of bid is
extended after submission of bid, the bidder may be allowed to modify
his Bid by giving notice in writing before the revised due date, subject
to his submission of a fresh bid in place of submitted bid.

h) The proposal shall include a covering letter singed by person (S)


with full authorization to make legally binding contractual (including
financial) commitment on behalf of the organization.

10. EARNEST MONEY DEPOSIT (INTEREST FREE)

i) Tender must be accompanied with an interest free Earnest Money


Deposit (EMD) of Rs.26000/-(Rupees twenty six thousand only) in the form of
Pay Order / Demand Draft / Bank Guarantee (as per GRSE format placed at
Appendix D) on any schedule bank other than cooperative bank payable at
Kolkata, duly crossed favouring GRSE Ltd., without which the tender will be
liable for rejection. This will be refunded in case of unsuccessful bidders within
30 days after the tender is decided. Necessary application enclosed with
original copy of GRSE receipt is required for this purpose. EMD is to be
submitted (except B.G.) along with techno-commercial part of offer and same
to be indicated on the envelope.

ii) SSI units registered under single point NSIC may be exempted from
the earnest money deposit. However, this will be as per guidelines circulated
by Govt. of India, Ministry of SSI and or DPE from time to time. A copy of the
NSIC certificates with annexure is to be enclosed with the technical bid and
that the list of activities contained in the NSIC certificate should cover the
activity for which tender is issued.
11. FORFEITURE OF EMD

In case of withdrawal at any stage during negotiation prior to award of


contract or non-submission of Security Deposit and non-performance of the
contract by the contractor, EMD will be forfeited.

12. SECURITY DEPOSIT (INTEREST FREE)

a) Successful bidder will deposit an amount equivalent to 5% of the total


contract value as interest free Security Deposit (S.D.) in the form of Pay
Order / D.D. / Bank Guarantee (as per GRSE format shown in Appendix D)
on any schedule bank other than Cooperative bank payable at Kolkata, duly
crossed favouring GRSE Ltd. within mobilization time stipulated in the order /
within 15 days from the date of issue of Letter of Award / Firm order. EMD
paid by the contractor in the form of Pay Order / Bank Draft will be adjusted
towards security deposit. However, Bank guarantee as per GRSE format
towards Security Deposit will have to be submitted afresh. Fixed amount paid
by GRSE graded venders towards EMD as per GRSE grading policy, will not
be adjusted against S.D.

b) Before commencement of work, S.D is to be submitted. The same


would be returned after completion of job duly certified by competent
authority.

c) SSI units registered under single points NSIC may be exempted from
the security deposit. However, this will be as per guidelines circulated by
Govt. of India, Ministry of S.S.I and or D.P.E from time to time.

13. INDIVIDUALITY OF THE CONTRACT

This Contract should be treated as an individual contract and should


not be related with other orders with GRSE in respect of progress of work or
payment.

14. SECRECY OF INFORMATION

All drawings / documents related to this project are confidential in


nature and should be used explicitly for the purpose for which they are
provided. The drawings and documents forwarded to the contractor should
not be copied and should be returned on completion of job /work.

15. QUALITY ASSURANCE AUTHORITY

GRSE (QA) / WOT (Kol) / Classification Societies (ABS / IRS / LRS etc.)
16. FORCE MAJEURE

In the event of contractor being unable to fulfill the obligation under the
agreement owing to force majeure, such as war, fire, earthquake, flood, strike,
lockout at GRSE premises where the contractor is working, the contractor
shall not be held responsible for any failure or non performance of the duties
and obligations under agreement provided that all responsible efforts have
been made to overcome the consequences of such failure, or non
performance. The time for performance of the contractual obligation shall then
be extended by period not more than the duration of such events. In the
events of the force Majeure condition existing at contractors site in GRSE
premises or CPT areas for GRSE work, GRSE is to be intimated with details
of such happenings and cessations thereof, within 3 days. Force Majeure is to
be limited to contractors site in GRSE / CPT premises for GRSE work only.
Lock out / closure of contractors factory premises or office or any other place
outside GRSE / CPT / GRSE nominated place as indicated above cannot be
considered as a Force Majeure condition under this contract.

17. ARBITRATION

In case of dispute, if any, between GRSE and the contractor, the


matter shall be referred to the sole discretion / arbitration of CMD of GRSE or
his nominated representative and his direction will be final and binding.

i) If at any time, before doing or after the contract period, any unsettled
claim, question, dispute or difference arises between the parties, upon or in
relation to or in connection with or in any way touching or concerning this
order, the same shall be referred to the Chairman & Managing Director,
(CMD in short) of Garden Reach Shipbuilders & Engineers Limited. (GRSE
Ltd in short) for adjudication of the said disputes or differences, as Sole
Arbitrator, in accordance with the provisions of the Arbitration and Conciliation
Act, 1996.

ii) The CMD, GRSE Ltd. if he so desires, may nominate / appoint another
officer of GRSE Ltd. or person, whom he thinks fit and competent, for
adjudication of the disputes or differences, referred to him as the Sole
Arbitrator.

iii) Such arbitration shall, in all respects, be conducted in accordance with


the provisions of the Arbitration and Conciliation Act, 1996 and the rules
framed there under or any statutory modification and re-enactment thereof for
the time being in force.

iv) The Award of the Sole Arbitrator shall be final, conclusive and binding
upon the parties.
v) In the event of the death or resignation for any reason whatsoever of
the Sole Arbitrator, appointed by the said CMD of GRSE Ltd. the CMD of
GRSE Ltd. on an application from either of the parties in this behalf, shall act
himself as the Sole Arbitrator or nominate / appoint in place of the outgoing,
Arbitrator, another officer of GRSE Ltd. or a person whom he thinks fit and
competent to adjudicate the said disputes and difference in accordance with
law.

vi) Also in the event on Arbitration award is set aside by a competent court
on an application from either party and unless otherwise ordered by the said
court, the CMD of GRSE Ltd. on an application from either party, shall act as
sole Arbitration or nominate / appoint another officer or GRSE Ltd. or a person
whom he thinks fit and competent to adjusted the deputes and differences in
accordance with law.

vii) The cost of the Arbitration, fee of the arbitrator, remuneration of the
stenographer and clerk, stamp paper etc. as shall be decided by the Sole
Arbitrator, shall be shared equally by the parties. The venue of the arbitration,
unless otherwise decided by the parties or by the Sole Arbitration himself,
shall be the premises of GRSE Ltd. located at 43/46 , Garden Reach Road,
Kolkata 700 024.

18. JURISDICTION

Litigation, if any, pertaining to this contract will come under the


jurisdiction of High Court at Kolkata.

i) All contracts shall be deemed to have been wholly made in Kolkata and
claims there under are payable in Kolkata City and it is the distinct of the order
that no suit or action for the purpose of enforcing any claim in respect of the
order shall be instituted in any Court other than that situated in Kolkata City,
West Bengal State, India.

ii) The contractor is warranted that all service rendered by them shall
conform to applicable city, states & central laws, ordinances and regulations
and the said contractor shall indemnify / defend / relieve GRSE harmless,
form / of against loss, cost of damage, by reason or any actual or alleged
violation thereof.

iii) GRSE shall not be liable under the workmens compensation Act of
1923; in case any employee or workman receives injury while actually serving
his employer in connection with the latters work inside the compound of
GRSE Ltd.

iv) All existing applicable Laws such as ESI, PF, SERVICE, CONTRACT
LABOUR, CHILD LABOUR etc. as applicable, shall be binding for the
contract.
v) The contractor engaged in work are required to have registration under
the Service Tax.

19. MISCELLANEOUS

i) All tender documents should be singed as token of acceptance and


submitted along with techno-commercial bid.

ii) Clarification required, if any, regarding Tender Document, should be


got resolved by contacting competent authority of GRSE prior to submission
of bid.

whatsoever which under the law relaying to sureties would but for this provision have
effect of the so relieving us.
