REFORMS,AMENDINGFORTHEPURPOSECERTAINPROVISIONSOFREPUBLICACTNO.6657,
OTHERWISE,KNOWNASTHECOMPREHENSIVEAGRARIANREFORMLAWOF1988,ASAMENDED,AND
APPROPRIATINGFUNDSTHEREFOR

SECTION1.Section2ofRepublicActNo.6657,asamended,otherwiseknownastheComprehensiveAgrarian
ReformLawof1988,isherebyfurtheramendedtoreadasfollows:"SEC.2.DeclarationofPrinciplesandPolicies.
ItisthepolicyoftheStatetopursueaComprehensiveAgrarianReformProgram(CARP).Thewelfareofthe
landlessfarmersandfarmworkerswillreceivethehighestconsiderationtopromotesocialjusticeandtomovethe
nationtowardsoundruraldevelopmentandindustrialization,andtheestablishmentofownercultivatorshipof
economicsizefarmsasthebasisofPhilippineagriculture."TheStateshallpromoteindustrializationandfull
employmentbasedonsoundagriculturaldevelopmentandagrarianreform,throughindustriesthatmakefulland
efficientuseofhumanandnaturalresources,andwhicharecompetitiveinbothdomesticandforeignmarkets:
Provided,Thattheconversionofagriculturallandsintoindustrial,commercialorresidentiallandsshalltakeinto
account,tillers'rightsandnationalfoodsecurity.Further,theStateshallprotectFilipinoenterprisesagainstunfair
foreigncompetitionandtradepractices.

"TheStaterecognizesthatthereisnotenoughagriculturallandtobedividedanddistributedtoeachfarmerand
regularfarmworkersothateachonecanownhis/hereconomicsizefamilyfarm.Thisbeingthecase,ameaningful
agrarianreformprogramtoupliftthelivesandeconomicstatusofthefarmerandhis/herchildrencanonlybe
achievedthroughsimultaneousindustrializationaimedatdevelopingaselfreliantandindependentnational
economyeffectivelycontrolledbyFilipinos."Tothisend,theStatemay,intheinterestofnationalwelfareor
defense,establishandoperatevitalindustries."Amoreequitabledistributionandownershipofland,withdue
regardtotherightsoflandownerstojustcompensation,retentionrightsunderSection6ofRepublicActNo.6657,
asamended,andtotheecologicalneedsofthenation,shallbeundertakentoprovidefarmersandfarmworkers
withtheopportunitytoenhancetheirdignityandimprovethequalityoftheirlivesthroughgreaterproductivityof
agriculturallands."Theagrarianreformprogramisfoundedontherightoffarmersandregularfarmworkers,who
arelandless,toowndirectlyorcollectivelythelandstheytillor,inthecaseofotherfarmworkers,toreceiveajust
shareofthefruitsthereof.Tothisend,theStateshallencourageandundertakethejustdistributionofall
agriculturallands,subjecttotheprioritiesandretentionlimitssetforthinthisAct,takingintoaccountecological,
developmental,andequityconsiderations,andsubjecttothepaymentofjustcompensation.TheStateshall
respecttherightofsmalllandowners,andshallprovideincentiveforvoluntarylandsharing."Asmuchas
practicable,theimplementationoftheprogramshallbecommunitybasedtoassure,amongothers,thatthe
farmersshallhavegreatercontroloffarmgateprices,andeasieraccesstocredit.

"TheStateshallrecognizetherightoffarmers,farmworkersandlandowners,aswellascooperativesandother
independentfarmers'organizations,toparticipateintheplanning,organization,andmanagementoftheprogram,
andshallprovidesupporttoagriculturethroughappropriatetechnologyandresearch,andadequatefinancial,
production,marketingandothersupportservices."TheStateshallrecognizeandenforce,consistentwithexisting
laws,therightsofruralwomentoownandcontrolland,takingintoconsiderationthesubstantiveequalitybetween
menandwomenasqualifiedbeneficiaries,toreceiveajustshareofthefruitsthereof,andtoberepresentedin
advisoryorappropriatedecisionmakingbodies.Theserightsshallbeindependentoftheirmalerelativesandof
theircivilstatus."TheStateshallapplytheprinciplesofagrarianreform,orstewardship,wheneverapplicable,in
accordancewithlaw,inthedispositionorutilizationofothernaturalresources,includinglandsofthepublic
domain,underleaseorconcession,suitabletoagriculture,subjecttopriorrights,homesteadrightsofsmall
settlersandtherightsofindigenouscommunitiestotheirancestrallands."TheStatemayresettlelandless
farmersandfarmworkersinitsownagriculturalestates,whichshallbedistributedtotheminthemannerprovided
bylaw.

"Bymeansofappropriateincentives,theStateshallencouragetheformationandmaintenanceofeconomicsize
familyfarmstobeconstitutedbyindividualbeneficiariesandsmalllandowners."TheStateshallprotecttherights
ofsubsistencefishermen,especiallyoflocalcommunities,tothepreferentialuseofcommunalmarineandfishing
resources,bothinlandandoffshore.Itshallprovidesupporttosuchfishermenthroughappropriatetechnologyand
research,adequatefinancial,productionandmarketingassistanceandotherservices.TheStateshallalso
protect,developandconservesuchresources.Theprotectionshallextendtooffshorefishinggroundsof
subsistencefishermenagainstforeignintrusion.Fishworkersshallreceiveajustsharefromtheirlaborinthe
utilizationofmarineandfishingresources."TheStateshallbeguidedbytheprinciplesthatlandhasasocial
functionandlandownershiphasasocialresponsibility.Ownersofagriculturallandhavetheobligationtocultivate
directlyorthroughlaboradministrationthelandstheyownandtherebymakethelandproductive."TheStateshall
provideincentivestolandownerstoinvesttheproceedsoftheagrarianreformprogramtopromoteindustrialization,
employmentandprivatizationofpublicsectorenterprises.Financialinstrumentsusedaspaymentforlandsshall
containfeaturesthatshallenhancenegotiabilityandacceptabilityinthemarketplace.

"TheStatemayleaseundevelopedlandsofthepublicdomaintoqualifiedentitiesforthedevelopmentofcapital
intensivefarms,andtraditionalandpioneeringcropsespeciallythoseforexportssubjecttothepriorrightsofthe
beneficiariesunderthisAct."

SECTION2.Section3ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.3.Definitions.ForthepurposeofthisAct,unlessthecontextindicatesotherwise:"xxxxxxxxx"(f)
Farmerreferstoanaturalpersonwhoseprimarylivelihoodiscultivationoflandortheproductionofagricultural
crops,livestockand/orfisherieseitherbyhimself/herself,orprimarilywiththeassistanceofhis/herimmediate
farmhousehold,whetherthelandisownedbyhim/her,orbyanotherpersonunderaleaseholdorsharetenancy
agreementorarrangementwiththeownerthereof."xxxxxxxxx"(l)Ruralwomenrefertowomenwhoareengaged
directlyorindirectlyinfarmingand/orfishingastheirsourceoflivelihood,whetherpaidorunpaid,regularor
seasonal,orinfoodpreparation,managingthehousehold,caringforthechildren,andothersimilaractivities."

SECTION3.Section4ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.4.Scope.TheComprehensiveAgrarianReformLawof1988shallcover,regardlessoftenurial
arrangementandcommodityproduced,allpublicandprivateagriculturallandsasprovidedinProclamationNo.131
andExecutiveOrderNo.229,includingotherlandsofthepublicdomainsuitableforagriculture:Provided,That
landholdingsoflandownerswithatotalareaoffive(5)hectaresandbelowshallnotbecoveredforacquisitionand
distributiontoqualifiedbeneficiaries.IHAcCS"Morespecifically,thefollowinglandsarecoveredbytheCARP:"(a)
Allalienableanddisposablelandsofthepublicdomaindevotedtoorsuitableforagriculture.Noreclassificationof
forestorminerallandstoagriculturallandsshallbeundertakenaftertheapprovalofthisActuntilCongress,taking
intoaccountecological,developmentalandequityconsiderations,shallhavedeterminedbylaw,thespecificlimits
ofthepublicdomain"(b)AlllandsofthepublicdomaininexcessofthespecificlimitsasdeterminedbyCongress
intheprecedingparagraph"(c)AllotherlandsownedbytheGovernmentdevotedtoorsuitableforagricultureand
"(d)Allprivatelandsdevotedtoorsuitableforagricultureregardlessoftheagriculturalproductsraisedorthatcan
beraisedthereon."Acomprehensiveinventorysysteminconsonancewiththenationallanduseplanshallbe
institutedbytheDepartmentofAgrarianReform(DAR),inaccordancewiththeLocalGovernmentCode,forthe
purposeofproperlyidentifyingandclassifyingfarmlandswithinone(1)yearfromeffectivityofthisAct,without
prejudicetotheimplementationofthelandacquisitionanddistribution."

SECTION4.ThereshallbeincorporatedafterSection6ofRepublicActNo.6657,asamended,newsectionsto
readasfollows:EHTISC"SEC.6A.ExceptiontoRetentionLimits.Provincial,cityandmunicipalgovernment
unitsacquiringprivateagriculturallandsbyexpropriationorothermodesofacquisitiontobeusedforactual,direct
andexclusivepublicpurposes,suchasroadsandbridges,publicmarkets,schoolsites,resettlementsites,local
governmentfacilities,publicparksandbarangayplazasorsquares,consistentwiththeapprovedlocal
comprehensivelanduseplan,shallnotbesubjecttothefive(5)hectareretentionlimitunderthisSectionand
Sections70and73(a)ofRepublicActNo.6657,asamended:Provided,ThatlandssubjecttoCARPshallfirst
undergothelandacquisitionanddistributionprocessoftheprogram:Provided,further,Thatwhentheselands
havebeensubjectedtoexpropriation,theagrarianreformbeneficiariesthereinshallbepaidjustcompensation."
"SEC.6B.ReviewofLimitsofLandSize.Withinsix(6)monthsfromtheeffectivityofthisAct,theDARshall
submitacomprehensivestudyonthelandsizeappropriateforeachtypeofcroptoCongressforapossiblereview
oflimitsoflandsizesprovidedinthisAct."

SECTION5.Section7ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.7.Priorities.TheDAR,incoordinationwiththePresidentialAgrarianReformCouncil(PARC)shallplan
andprogramthefinalacquisitionanddistributionofallremainingunacquiredandundistributedagriculturallands
fromtheeffectivityofthisActuntilJune30,2014.Landsshallbeacquiredanddistributedasfollows:

"PhaseOne:Duringthefive(5)yearextensionperiodhereafterallremaininglandsabovefifty(50)hectaresshall
becoveredforpurposesofagrarianreformupontheeffectivityofthisAct.Allprivateagriculturallandsof
landownerswithaggregatelandholdingsinexcessoffifty(50)hectareswhichhavealreadybeensubjectedtoa
noticeofcoverageissuedonorbeforeDecember10,2008riceandcornlandsunderPresidentialDecreeNo.27
allidleorabandonedlandsallprivatelandsvoluntarilyofferedbytheownersforagrarianreform:Provided,That
withrespecttovoluntarylandtransfer,onlythosesubmittedbyJune30,2009shallbeallowed:Provided,further,
ThatafterJune30,2009,themodesofacquisitionshallbelimitedtovoluntaryoffertosellandcompulsory
acquisition:Provided,furthermore,Thatallpreviouslyacquiredlandswhereinvaluationissubjecttochallengeby
landownersshallbecompletedandfinallyresolvedpursuanttoSection17ofRepublicActNo.6657,asamended:
Provided,finally,asmandatedbytheConstitution,RepublicActNo.6657,asamended,andRepublicActNo.
3844,asamended,onlyfarmers(tenantsorlessees)andregularfarmworkersactuallytillingthelands,ascertified
underoathbytheBarangayAgrarianReformCouncil(BARC)andattestedunderoathbythelandowners,arethe
qualifiedbeneficiaries.Theintendedbeneficiaryshallstateunderoathbeforethejudgeofthecityormunicipal
courtthathe/sheiswillingtoworkonthelandtomakeitproductiveandtoassumetheobligationofpayingthe
amortizationforthecompensationofthelandandthelandtaxesthereonalllandsforeclosedbygovernment
financialinstitutionsalllandsacquiredbythePresidentialCommissiononGoodGovernment(PCGG)andall
otherlandsownedbythegovernmentdevotedtoorsuitableforagriculture,whichshallbeacquiredanddistributed
immediatelyupontheeffectivityofthisAct,withtheimplementationtobecompletedbyJune30,2012

"PhaseTwo:(a)Landstwentyfour(24)hectaresuptofifty(50)hectaresshalllikewisebecoveredforpurposesof
agrarianreformupontheeffectivityofthisAct.Allalienableanddisposablepublicagriculturallandsallarable
publicagriculturallandsunderagroforest,pastureandagriculturalleasesalreadycultivatedandplantedtocropsin
accordancewithSection6,ArticleXIIIoftheConstitutionallpublicagriculturallandswhicharetobeopenedfor
newdevelopmentandresettlementandallprivateagriculturallandsoflandownerswithaggregatelandholdings:
abovetwentyfour(24)hectaresuptofifty(50)hectareswhichhavealreadybeensubjectedtoanoticeof
coverageissuedonorbeforeDecember10,2008,toimplementprincipallytherightsoffarmersandregular
farmworkers,whoarelandless,toowndirectlyorcollectivelythelandstheytill,whichshallbedistributed
immediatelyupontheeffectivityofthisAct,withtheimplementationtobecompletedbyJune30,2012and"(b)
Allremainingprivateagriculturallandsoflandownerswithaggregatelandholdingsinexcessoftwentyfour(24)
hectares,regardlessastowhetherthesehavebeensubjectedtonoticesofcoverageornot,withthe
implementationtobeginonJuly1,2012andtobecompletedbyJune30,2013

"PhaseThree:Allotherprivateagriculturallandscommencingwithlargelandholdingsandproceedingtomedium
andsmalllandholdingsunderthefollowingschedule:"(a)Landsoflandownerswithaggregatelandholdingsabove
ten(10)hectaresuptotwentyfour(24)hectares,insofarastheexcesshectarageaboveten(10)hectaresis
concerned,tobeginonJuly1,2012andtobecompletedbyJune30,2013and"(b)Landsoflandownerswith
aggregatelandholdingsfromtheretentionlimituptoten(10)hectares,tobeginonJuly1,2013andtobe
completedbyJune30,2014toimplementprincipallytherightoffarmersandregularfarmworkerswhoare
landless,toowndirectlyorcollectivelythelandstheytill.

"Thescheduleofacquisitionandredistributionofallagriculturallandscoveredbythisprogramshallbemadein
accordancewiththeaboveorderofpriority,whichshallbeprovidedintheimplementingrulestobepreparedbythe
PARC,takingintoconsiderationthefollowing:thelandholdingswhereinthefarmersareorganizedandunderstand
themeaningandobligationsoffarmlandownershipthedistributionoflandstothetillersattheearliestpracticable
timetheenhancementofagriculturalproductivityandtheavailabilityoffundsandresourcestoimplementand
supporttheprogram:Provided,ThatthePARCshalldesignandconductseminars,symposia,information
campaigns,andothersimilarprogramsforfarmerswhoarenotorganizedornotcoveredbyanylandholdings.
Completionbythesefarmersoftheaforementionedseminars,symposia,andothersimilarprogramsshallbe
encouragedintheimplementationofthisActparticularlytheprovisionsofthisSection."Landacquisitionand
distributionshallbecompletedbyJune30,2014onaprovincebyprovincebasis.

Inanycase,thePARCorthePARCExecutiveCommittee(PARCEXCOM),uponrecommendationbythe
ProvincialAgrarianReformCoordinatingCommittee(PARCCOM),maydeclarecertainprovincesaspriorityland
reformareas,inwhichcasetheacquisitionanddistributionofprivateagriculturallandsthereinunderadvanced
phasesmaybeimplementedaheadoftheaboveschedulesontheconditionthatpriorphasesintheseprovinces
havebeencompleted:Provided,Thatnotwithstandingtheaboveschedules,phasethree(b)shallnotbe
implementedinaparticularprovinceuntilatleastninetypercent(90%)oftheprovincialbalanceofthatparticular
provinceasofJanuary1,2009underPhaseOne,PhaseTwo(a),PhaseTwo(b),andPhaseThree(a),excluding
landsunderthejurisdictionoftheDepartmentofEnvironmentandNaturalResources(DENR),havebeen
successfullycompleted.

"ThePARCshallestablishguidelinestoimplementtheaboveprioritiesanddistributionscheme,includingthe
determinationofwhoarequalifiedbeneficiaries:Provided,Thatanownertillermaybeabeneficiaryoftheland
he/shedoesnotownbutisactuallycultivatingtotheextentofthedifferencebetweentheareaofthelandhe/she
ownsandtheawardceilingofthree(3)hectares:Provided,further,Thatcollectiveownershipbythefarmer
beneficiariesshallbesubjecttoSection25ofRepublicActNo.6657,asamended:Provided,furthermore,That
ruralwomenshallbegiventheopportunitytoparticipateinthedevelopmentplanningandimplementationofthis
Act:Provided,finally,Thatinnocaseshouldtheagrarianreformbeneficiaries'sex,economic,religious,social,
culturalandpoliticalattributesadverselyaffectthedistributionoflands."

SECTION6.ThetitleofSection16ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadas
follows:"SEC.16.ProcedureforAcquisitionandDistributionofPrivateLands."

SECTION7.Section17ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
CSTEHI"SEC.17.DeterminationofJustCompensation.Indeterminingjustcompensation,thecostof
acquisitionoftheland,thevalueofthestandingcrop,thecurrentvalueoflikeproperties,itsnature,actualuse
andincome,theswornvaluationbytheowner,thetaxdeclarations,theassessmentmadebygovernment
assessors,andseventypercent(70%)ofthezonalvaluationoftheBureauofInternalRevenue(BIR),translated
intoabasicformulabytheDARshallbeconsidered,subjecttothefinaldecisionofthepropercourt.Thesocial
andeconomicbenefitscontributedbythefarmersandthefarmworkersandbytheGovernmenttothepropertyas
wellasthenonpaymentoftaxesorloanssecuredfromanygovernmentfinancinginstitutiononthesaidlandshall
beconsideredasadditionalfactorstodetermineitsvaluation."

SECTION8.ThereshallbeincorporatedafterSection22ofRepublicActNo.6657,asamended,anewsectionto
readasfollows:"SEC.22A.OrderofPriority.Alandholdingofalandownershallbedistributedfirsttoqualified
beneficiariesunderSection22,subparagraphs(a)and(b)ofthatsamelandholdinguptoamaximumofthree(3)
hectareseach.Onlywhenthesebeneficiarieshaveallreceivedthree(3)hectareseach,shalltheremainingportion
ofthelandholding,ifany,bedistributedtootherbeneficiariesunderSection22,subparagraphs(c),(d),(e),(f),and
(g)."

SECTION9.Section24ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.24.AwardtoBeneficiaries.Therightsandresponsibilitiesofthebeneficiariesshallcommencefromtheir
receiptofadulyregisteredemancipationpatentorcertificateoflandownershipawardandtheiractualphysical
possessionoftheawardedland.Suchawardshallbecompletedinnotmorethanonehundredeighty(180)days
fromthedateofregistrationofthetitleinthenameoftheRepublicofthePhilippines:Provided,Thatthe
emancipationpatents,thecertificatesoflandownershipaward,andothertitlesissuedunderanyagrarianreform
programshallbeindefeasibleandimprescriptibleafterone(1)yearfromitsregistrationwiththeOfficeofthe
RegistryofDeeds,subjecttotheconditions,limitationsandqualificationsofthisAct,thepropertyregistration
decree,andotherpertinentlaws.Theemancipationpatentsorthecertificatesoflandownershipawardbeingtitles
broughtundertheoperationofthetorrenssystem,areconferredwiththesameindefeasibilityandsecurityafforded
toalltitlesunderthesaidsystem,asprovidedforbyPresidentialDecreeNo.1529,asamendedbyRepublicAct
No.6732."ItistheministerialdutyoftheRegistryofDeedstoregisterthetitleofthelandinthenameofthe
RepublicofthePhilippines,aftertheLandBankofthePhilippines(LBP)hascertifiedthatthenecessarydepositin
thenameofthelandownerconstitutingfullpaymentincashorinbondwithduenoticetothelandownerandthe
registrationofthecertificateoflandownershipawardissuedtothebeneficiaries,andtocancelprevioustitles
pertainingthereto."Identifiedandqualifiedagrarianreformbeneficiaries,basedonSection22ofRepublicActNo.
6657,asamended,shallhaveusufructuaryrightsovertheawardedlandassoonastheDARtakespossessionof
suchland,andsuchrightshallnotbediminishedevenpendingtheawardingoftheemancipationpatentorthe
certificateoflandownershipaward.CTSHDI"Allcasesinvolvingthecancellationofregisteredemancipation
patents,certificatesoflandownershipaward,andothertitlesissuedunderanyagrarianreformprogramarewithin
theexclusiveandoriginaljurisdictionoftheSecretaryoftheDAR."

SECTION10.Section25ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.25.AwardCeilingsforBeneficiaries.Beneficiariesshallbeawardedanareanotexceedingthree(3)
hectares,whichmaycoveracontiguoustractoflandorseveralparcelsoflandcumulateduptotheprescribed
awardlimits.Thedeterminationofthesizeofthelandfordistributionshallconsidercroptype,soiltype,weather
patternsandotherpertinentvariablesorfactorswhicharedeemedcriticalforthesuccessofthebeneficiaries."For
purposesofthisAct,alandlessbeneficiaryisonewhoownslessthanthree(3)hectaresofagriculturalland.
"Wheneverappropriate,theDARshallencouragetheagrarianreformbeneficiariestoformorjoinfarmers'
cooperativesforpurposesofaffiliatingwithexistingcooperativebanksintheirrespectiveprovincesorlocalities,
aswellasformingblocsofagrarianreformbeneficiaries,corporations,andpartnershipsandjoiningotherfarmers'
collectiveorganizations,includingirrigators'associations:Provided,Thattheagrarianreformbeneficiariesshallbe
assuredofcorrespondingsharesinthecorporation,seatsintheboardofdirectors,andanequitableshareinthe
profit."Ingeneral,thelandawardedtoafarmerbeneficiaryshouldbeintheformofanindividualtitle,coveringone
(1)contiguoustractorseveralparcelsoflandcumulateduptoamaximumofthree(3)hectares.

"Thebeneficiariesmayoptforcollectiveownership,suchascoorkersorfarmerscooperativeorsomeotherform
ofcollectiveorganizationandfortheissuanceofcollectiveownershiptitles:Provided,Thatthetotalareathatmay
beawardedshallnotexceedthetotalnumberofcoownersormembersofthecooperativeorcollective
organizationmultipliedbytheawardlimitaboveprescribed,exceptinmeritoriouscasesasdeterminedbythe
PARC."Theconditionsfortheissuanceofcollectivetitlesareasfollows:"(a)Thecurrentfarmmanagement
systemofthelandcoveredbyCARPwillnotbeappropriateforindividualfarmingoffarmparcels"(b)Thefarm
laborsystemisspecialized,wherethefarmworkersareorganizedbyfunctionsandnotbyspecificparcelssuchas
spraying,weeding,packingandothersimilarfunctions"(c)Thepotentialbeneficiariesarecurrentlynotfarming
individualparcelsbutcollectivelyworkonlargecontiguousareasand"(d)Thefarmconsistsofmultiplecrops
beingfarmedinanintegratedmannerorincludesnoncropproductionareasthatarenecessaryfortheviabilityof
farmoperations,suchaspackingplants,storageareas,dikes,andothersimilarfacilitiesthatcannotbe
subdividedorassignedtoindividualfarmers."Foridleandabandonedlandsorunderdevelopedagriculturallandsto
becoveredbyCARP,collectiveownershipshallbeallowedonlyifthebeneficiariesoptforitandthereisaclear
developmentplanthatwouldrequirecollectivefarmingorintegratedfarmoperationsexhibitingtheconditions
describedabove.Otherwise,thelandawardedtoafarmerbeneficiaryshouldbeintheformofanindividualtitle,
coveringone(1)contiguoustractorseveralparcelsoflandcumulateduptoamaximumofthree(3)hectares.

"Incaseofcollectiveownership,titletothepropertyshallbeissuedinthenameofthecoownersorthe
cooperativeorcollectiveorganizationasthecasemaybe.Ifthecertificatesoflandownershipawardaregivento
cooperativesthenthenamesofthebeneficiariesmustalsobelistedinthesamecertificateoflandownership
award."Withregardtoexistingcollectivecertificatesoflandownershipaward,theDARshouldimmediately
undertaketheparcelizationofsaidcertificatesoflandownershipaward,particularlythosethatdonotexhibitthe
conditionsforcollectiveownershipoutlinedabove.TheDARshallconductareviewandredocumentationofallthe
collectivecertificatesoflandownershipaward.TheDARshallprepareaprioritizedlistofcertificatesofland
ownershipawardtobeparcelized.TheparcelizationshallcommenceimmediatelyuponapprovalofthisActand
shallnotexceedaperiodofthree(3)years.Onlythoseexistingcertificatesoflandownershipawardthatare
collectivelyfarmedorareoperatedinanintegratedmannershallremainascollective."

SECTION11.Section26ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.26.PaymentbyBeneficiaries.LandsawardedpursuanttothisActshallbepaidforbythebeneficiaries
totheLBPinthirty(30)annualamortizationsatsixpercent(6%)interestperannum.Theannualamortizationshall
startone(1)yearfromthedateofthecertificateoflandownershipawardregistration.However,iftheoccupancy
tookplaceafterthecertificateoflandownershipawardregistration,theamortizationshallstartone(1)yearfrom
actualoccupancy.Thepaymentsforthefirstthree(3)yearsaftertheawardshallbeatreducedamountsas
establishedbythePARC:Provided,Thatthefirstfive(5)annualpaymentsmaynotbemorethanfivepercent
(5%)ofthevalueoftheannualgrossproductionasestablishedbytheDAR.Shouldthescheduledannual
paymentsafterthefifth(5th)yearexceedtenpercent(10%)oftheannualgrossproductionandthefailureto

SECTION12.Section27ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.27.TransferabilityofAwardedLands.LandsacquiredbybeneficiariesunderthisActorotheragrarian
reformlawsshallnotbesold,transferredorconveyedexceptthroughhereditarysuccession,ortothegovernment,
ortotheLBP,ortootherqualifiedbeneficiariesthroughtheDARforaperiodoften(10)years:Provided,however,
Thatthechildrenorthespouseofthetransferorshallhavearighttorepurchasethelandfromthegovernmentor
LBPwithinaperiodoftwo(2)years.DuenoticeoftheavailabilityofthelandshallbegivenbytheLBPtothe
BARCofthebarangaywherethelandissituated.ThePARCCOM,ashereinprovided,shall,inturn,begivendue
noticethereofbytheBARC."Thetitleofthelandawardedundertheagrarianreformmustindicatethatitisan
emancipationpatentoracertificateoflandownershipawardandthesubsequenttransfertitlemustalsoindicate

landhimself/herself.Failingcomplianceherewith,thelandshallbetransferredtotheLBPwhichshallgivedue
noticeoftheavailabilityofthelandinthemannerspecifiedintheimmediatelyprecedingparagraph."Intheevent
ofsuchtransfertotheLBP,thelattershallcompensatethebeneficiaryinonelumpsumfortheamountsthelatter
hasalreadypaid,togetherwiththevalueofimprovementshe/shehasmadeontheland."

SECTION13.Section36ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.36.FundingforSupportServices.Inordertocovertheexpensesandcostofsupportservices,atleast
fortypercent(40%)ofallappropriationsforagrarianreformduringthefive(5)yearextensionperiodshallbe
immediatelysetasideandmadeavailableforthispurpose:Provided,ThattheDARshallpursueintegratedland
acquisitionanddistributionandsupportservicesstrategyrequiringaplantobedevelopedparalleltotheland
acquisitionanddistributionprocess.Theplanningandimplementationforlandacquisitionanddistributionshallbe

and/ortheirorganizations/cooperatives.Ineachcommunity,theDAR,togetherwiththeagenciesand
organizationsabovementioned,shallidentifythefarmers'association,cooperativeortheirrespectivefederations
approvedbythefarmersbeneficiariesthatshalltaketheleadintheagriculturaldevelopmentofthearea.In
addition,theDAR,inclosecoordinationwiththecongressionaloversightcommitteecreatedherein,withduenotice
totheconcernedrepresentativeofthelegislativedistrictpriortoimplementationshallbeauthorizedtopackage
proposalsandreceivegrants,aidsandotherformsoffinancialassistancefromanysource."

SECTION14.Section37ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.37.SupportServicesfortheAgrarianReformBeneficiaries.TheStateshalladopttheintegratedpolicyof
supportservicesdeliverytoagrarianreformbeneficiaries.Tothisend,theDAR,theDepartmentofFinance,and
theBangkoSentralngPilipinas(BSP)shallinstitutereformstoliberalizeaccesstocreditbyagrarianreform
beneficiaries.ThePARCshallensurethatsupportservicesforagrarianreformbeneficiariesareprovided,suchas:
"(a)Landsurveysandtitling"(b)Socializedtermsonagriculturalcreditfacilities"Thirtypercent(30%)ofall

marketingagreementsorexpectedharvests:Provided,Thatloansobtainedshallbeusedintheimprovementor
developmentofthefarmholdingoftheagrarianreformbeneficiaryortheestablishmentoffacilitieswhichshall
enhanceproductionormarketingofagriculturalproductsorincreasefarmincometherefrom:Provided,further,
Thatoftheremainingseventypercent(70%)forthesupportservices,fifteenpercent(15%)shallbeearmarkedfor
farminputsasrequestedbythedulyaccreditedagrarianreformbeneficiaries'organizations,suchas,butnot
limitedto:(1)seeds,seedlingsand/orplantingmaterials(2)organicfertilizers(3)pesticides(4)herbicidesand
(5)farmanimals,implements/machineriesandfivepercent(5%)forseminars,trainingsandtheliketohelp
empoweragrarianreformbeneficiaries."(c)Extensionservicesbywayofplanting,cropping,productionandpost
harvesttechnologytransfer,aswellasmarketingandmanagementassistanceandsupporttocooperativesand
farmers'organizations"(d)Infrastructuresuchas,butnotlimitedto,accesstrails,minidams,publicutilities,
marketingandstoragefacilities"(e)Research,productionanduseoforganicfertilizersandotherlocalsubstances
necessaryinfarmingandcultivationand"(f)DirectandactiveDARassistanceintheeducationandorganization
ofactualandpotentialagrarianreformbeneficiaries,atthebarangay,municipal,city,provincial,andnational
levels,towardshelpingthemunderstandtheirrightsandresponsibilitiesasownercultivatorsdevelopingfarm
relatedtrustrelationshipsamongthemselvesandtheirneighbors,andincreasingfarmproductionandprofitability
withtheultimateendofempoweringthemtocharttheirowndestiny.Therepresentativesoftheagrarianreform
beneficiariestothePARCshallbechosenfromthenomineesofthedulyaccreditedagrarianreformbeneficiaries'
organizations,orinitsabsence,fromorganizationsofactualandpotentialagrarianreformbeneficiariesas
forwardedtoandprocessedbythePARCEXCOM.DAHEaT"ThePARCshallformulatepoliciestoensurethat
supportservicesforagrarianreformbeneficiariesshallbeprovidedatallstagesoftheprogramimplementation
withtheconcurrenceoftheconcernedagrarianreformbeneficiaries."ThePARCshalllikewiseadopt,implement,
andmonitorpoliciesandprogramstoensurethefundamentalequalityofwomenandmenintheagrarianreform
programaswellasrespectforthehumanrights,socialprotection,anddecentworkingconditionsofbothpaidand
unpaidmenandwomenfarmerbeneficiaries."TheBagongKilusangKabuhayansaKaunlaran(BKKK)Secretariat
shallbetransferredandattachedtotheLBP,foritssupervisionincludingallitsapplicableandexistingfunds,
personnel,properties,equipmentandrecords."Misuseordiversionofthefinancialandsupportservicesherein
providedshallresultinsanctionsagainstthebeneficiaryguiltythereof,includingtheforfeitureoftheland
transferredtohim/herorlessersanctionsasmaybeprovidedbythePARC,withoutprejudicetocriminal
prosecution."

SECTION15.ThereshallbeincorporatedafterSection37ofRepublicActNo.6657,asamended,anewsection
toreadasfollows:"SEC.37A.EqualSupportServicesforRuralWomen.Supportservicesshallbeextended
equallytowomenandmenagrarianreformbeneficiaries.

"ThePARCshallensurethatthesesupportservices,asprovidedforinthisAct,integratethespecificneedsand
wellbeingofwomenfarmerbeneficiariestakingintoaccountthespecificrequirementsoffemalefamilymembersof
farmerbeneficiaries."ThePARCshallalsoensurethatruralwomenwillbeabletoparticipateinallcommunity
activities.Tothiseffect,ruralwomenareentitledtoselforganizationinordertoobtainequalaccesstoeconomic
opportunitiesandtohaveaccesstoagriculturalcreditandloans,marketingfacilitiesandtechnology,andother
supportservices,andequaltreatmentinlandreformandresettlementschemes."TheDARshallestablishand
maintainawomen'sdesk,whichwillbeprimarilyresponsibleforformulatingandimplementingprogramsand
activitiesrelatedtotheprotectionandpromotionofwomen'srights,aswellasprovidinganavenuewherewomen
canregistertheircomplaintsandgrievancesprincipallyrelatedtotheirruralactivities."

SECTION16.Section38ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.38.SupportServicesforLandowners.ThePARC,withtheassistanceofsuchothergovernment
agenciesandinstrumentalitiesasitmaydirect,shallprovidelandownersaffectedbytheCARPandprioragrarian
reformprogramswiththefollowingservices:"(a)Investmentinformation,financialandcounselingassistance,
particularlyinvestmentinformationongovernmentownedand/orcontrolledcorporationsanddisposableassetsof
thegovernmentinpursuitofnationalindustrializationandeconomicindependence:"(b)Facilities,programsand
schemesfortheconversionorexchangeofbondsissuedforpaymentofthelandsacquiredwithstocksandbonds
issuedbytheNationalGovernment,theBSPandothergovernmentinstitutionsandinstrumentalitiesaSIDCT"(c)
Marketingofagrarianreformbonds,aswellaspromotingthemarketabilityofsaidbondsintraditionalandnon

proceedsofthesaleofsuchlandsforruralindustrialization."Alandownerwhoinvestsinruralbasedindustries
shallbeentitledtotheincentivesgrantedtoaregisteredenterpriseengagedinapioneerorpreferredareaof
investmentasprovidedforintheOmnibusInvestmentCodeof1987,ortosuchotherincentivesasthePARC,the
LBP,orothergovernmentfinancialinstitutionsshallprovide."TheLBPshallredeemalandowner'sagrarianreform
bondsatfacevalueasanincentive:Provided,Thatatleastfiftypercent(50%)oftheproceedsthereofshallbe
investedinaBoardofInvestments(BOI)registeredcompanyorinanyagribusinessoragroindustrialenterprise
intheregionwheretheCARPcoveredlandholdingislocated.Anadditionalincentiveoftwopercent(2%)incash
shallbepaidtoalandownerwhomaintainshis/herenterpriseasagoingconcernforfive(5)yearsorkeepshis/her
investmentsinaBOIregisteredfirmforthesameperiod:Provided,further,Thattherightsoftheagrarianreform

SECTION18.Section50ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.50.QuasiJudicialPowersoftheDAR.TheDARisherebyvestedwithprimaryjurisdictiontodetermine
andadjudicateagrarianreformmattersandshallhaveexclusiveoriginaljurisdictionoverallmattersinvolvingthe
implementationofagrarianreform,exceptthosefallingundertheexclusivejurisdictionoftheDepartmentof
Agriculture(DA)andtheDENR."Itshallnotbeboundbytechnicalrulesofprocedureandevidencebutshall
proceedtohearanddecideallcases,disputesorcontroversiesinamostexpeditiousmanner,employingall
reasonablemeanstoascertainthefactsofeverycaseinaccordancewithjusticeandequityandthemeritsofthe
case.Towardthisend,itshalladoptauniformruleofproceduretoachieveajust,expeditiousandinexpensive

SECTION22.Section65ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.65.ConversionofLands.Afterthelapseoffive(5)yearsfromitsaward,whenthelandceasestobe
economicallyfeasibleandsoundforagriculturalpurposes,orthelocalityhasbecomeurbanizedandthelandwill
haveagreatereconomicvalueforresidential,commercialorindustrialpurposes,theDAR,uponapplicationofthe
beneficiaryorthelandownerwithrespectonlytohis/herretainedareawhichistenanted,withduenoticetothe
affectedparties,andsubjecttoexistinglaws,mayauthorizethereclassificationorconversionofthelandandits
disposition:Provided,Thatiftheapplicantisabeneficiaryunderagrarianlawsandthelandsoughttobeconverted
isthelandawardedtohim/heroranyportionthereof,theapplicant,aftertheconversionisgranted,shallinvestat
leasttenpercent(10%)oftheproceedscomingfromtheconversioningovernmentsecurities:Provided,further,
Thattheapplicantuponconversionshallfullypaythepriceoftheland:Provided,furthermore,Thatirrigatedand
irrigablelands,shallnotbesubjecttoconversion:Provided,finally,ThattheNationalIrrigationAdministrationshall
submitaconsolidateddataonthelocationnationwideofallirrigablelandswithinone(1)yearfromtheeffectivityof
thisAct."Failuretoimplementtheconversionplanwithinfive(5)yearsfromtheapprovalofsuchconversionplan
oranyviolationoftheconditionsoftheconversionorderduetothefaultoftheapplicantshallcausethelandto
automaticallybecoveredbyCARP."
SECTION23.Section68ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
"SEC.68.ImmunityofGovernmentAgenciesfromUndueInterference.Incasesfallingwithintheirjurisdiction,
noinjunction,restrainingorder,prohibitionormandamusshallbeissuedbytheregionaltrialcourts,municipaltrial
courts,municipalcircuittrialcourts,andmetropolitantrialcourtsagainsttheDAR,theDA,theDENR,andthe
DepartmentofJusticeintheirimplementationoftheProgram."

SECTION24.Section73ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:
SEIDAC"SEC.73.ProhibitedActsandOmissions.Thefollowingareprohibited:"(a)Theownershipor
possession,forthepurposeofcircumventingtheprovisionsofthisAct,ofagriculturallandsinexcessofthetotal
retentionlimitsorawardceilingsbyanyperson,naturalorjuridical,exceptthoseundercollectiveownershipby
farmerbeneficiaries"(b)Theforcibleentryorillegaldetainerbypersonswhoarenotqualifiedbeneficiariesunder

theeffectivityofthisAct,exceptafterfinalcompletionoftheappropriateconversionunderSection65ofRepublic
ActNo.6657,asamended.ThedateoftheregistrationofthedeedofconveyanceintheRegisterofDeedswith
respecttotitledlandsandthedateoftheissuanceofthetaxdeclarationtothetransfereeofthepropertywith
respecttounregisteredlands,asthecasemaybe,shallbeconclusiveforthepurposeofthisAct"(f)Thesale,
transferorconveyancebyabeneficiaryoftherighttouseoranyotherusufructuaryrightoverthelandhe/she
acquiredbyvirtueofbeingabeneficiary,inordertocircumventtheprovisionsofthisActacHETI"(g)The
unjustified,willful,andmaliciousactbyaresponsibleofficerorofficersofthegovernmentthroughthefollowing:"
(1)Thedenialofnoticeand/orreplytolandowners"(2)Thedeprivationofretentionrights"(3)Theundueor
inordinatedelayinthepreparationofclaimfoldersor"(4)Anyunduedelay,refusalorfailureinthepaymentofjust
compensation"(h)TheunduedelayorunjustifiedfailureoftheDAR,theLBP,thePARC,thePARCCOM,andany
concernedgovernmentagencyoranygovernmentofficialoremployeetosubmittherequiredreport,dataand/or

SECTION25.Section74ofRepublicActNo.6657,asamended,isherebyfurtheramendedtoreadasfollows:

byimprisonmentofnotlessthanone(1)monthtonotmorethanthree(3)yearsorafineofnotlessthanOne

SECTION26.CongressionalOversightCommittee.ACongressionalOversightCommitteeonAgrarianReform
(COCAR)isherebycreatedtooverseeandmonitortheimplementationofthisAct.Itshallbecomposedofthe
ChairpersonsoftheCommitteeonAgrarianReformofbothHousesofCongress,three(3)MembersoftheHouse
ofRepresentatives,andthree(3)MembersoftheSenateofthePhilippines,tobedesignatedrespectivelybythe
SpeakeroftheHouseofRepresentativesandthePresidentoftheSenateofthePhilippines.TheChairpersonsof
theCommitteesonAgrarianReformoftheHouseofRepresentativesandoftheSenateofthePhilippinesshallbe
theChairpersonsoftheCOCAR.TheMembersshallreceivenocompensationhowever,travelingandother
necessaryexpensesshallbeallowed.InordertocarryouttheobjectivesofthisAct,theCOCARshallbeprovided
withthenecessaryappropriationsforitsoperation.AninitialamountofTwentyfivemillionpesos(P25,000,000.00)
isherebyappropriatedfortheCOCARforthefirstyearofitsoperationandthesameamountshallbeappropriated
everyyearthereafter.CAaDTHThetermoftheCOCARshallendsix(6)monthsaftertheexpirationofthe
extendedperiodoffive(5)years.

SECTION27.PowersandFunctionsoftheCOCAR.TheCOCARshallhavethefollowingpowersand
functions:(a)Prescribeandadoptguidelineswhichshallgovernitswork(b)Holdhearingsandconsultations,
receivetestimoniesandreportspertinenttoitsspecifiedconcerns(c)Securefromanydepartment,bureau,office
orinstrumentalityofthegovernmentsuchassistanceasmaybeneeded,includingtechnicalinformation,
preparationandproductionofreportsandsubmissionofrecommendationsorplansasitmayrequire,particularlya
yearlyreportoftherecordorperformanceofeachagrarianreformbeneficiaryasprovidedunderSection22of
RepublicActNo.6657,asamended(d)SecurefromtheDARortheLBPinformationontheamountofjust
compensationdeterminedtobepaidorwhichhasbeenpaidtoanylandowner(e)SecurefromtheDARorthe
LBPquarterlyreportsonthedisbursementoffundsfortheagrarianreformprogram(f)Overseeandmonitor,in
suchamannerasitmaydeemnecessary,theactualimplementationoftheprogramandprojectsbytheDAR(g)
Summonbysubpoenaanypublicorprivatecitizentotestifybeforeit,orrequirebysubpoenaducestecumto
producebeforeitsuchrecords,reports,orotherdocumentsasmaybenecessaryintheperformanceofits
functionsaEIADT(h)Engagetheservicesofresourcepersonsfromthepublicandprivatesectorsaswellascivil
societyincludingthevariousagrarianreformgroupsororganizationsinthedifferentregionsofthecountryasmay
beneeded(i)ApprovethebudgetfortheworkoftheCommitteeandalldisbursementstherefrom,including
compensationofallpersonnel(j)Organizeitsstaffandhireandappointsuchemployeesandpersonnelwhether
temporary,contractualoronconsultancy,subjecttoapplicablerulesand(k)Exerciseallthepowersnecessary
andincidentaltoattainthepurposesforwhichitiscreated.

SECTION28.PeriodicReports.TheCOCARshallsubmittotheSpeakeroftheHouseofRepresentativesand
tothePresidentoftheSenateofthePhilippinesperiodicreportsonitsfindingsandrecommendationsonactions
tobeundertakenbybothHousesofCongress,theDAR,andthePARC.

SECTION29.AccesstoInformation.NotwithstandingtheprovisionsofRepublicActNo.1405andother
pertinentlaws,informationontheamountofjustcompensationpaidtoanylandownerunderRepublicActNo.
6657,asamended,andotheragrarianreformlawsshallbedeemedpublicinformation.

SECTION30.ResolutionofCases.Anycaseand/orproceedinginvolvingtheimplementationoftheprovisions
ofRepublicActNo.6657,asamended,whichmayremainpendingonJune30,2014shallbeallowedtoproceed
toitsfinalityandbeexecutedevenbeyondsuchdate.

SECTION31.ImplementingRulesandRegulations.ThePARCandtheDARshallprovidethenecessary
implementingrulesandregulationswithinthirty(30)daysupontheapprovalofthisAct.Suchrulesandregulations
shalltakeeffectonJuly1,2009anditshallbepublishedinatleasttwo(2)newspapersofgeneralcirculation.

SECTION32.RepealingClause.Section53ofRepublicActNo.3844,otherwiseknownastheAgricultural
LandReformCode,isherebyrepealedandallotherlaws,decrees,executiveorders,issuances,rulesand
regulations,orpartsthereofinconsistentwiththisActareherebylikewiserepealedoramendedaccordingly.

SECTION33.SeparabilityClause.If,foranyreason,anysectionorprovisionofthisActisdeclared
unconstitutionalorinvalid,theothersectionsorprovisionsnotaffectedtherebyshallremaininfullforceandeffect.
SECTION34.EffectivityClause.ThisActshalltakeeffectonJuly1,2009anditshallbepublishedinatleast
two(2)newspapersofgeneralcirculation.
