Honble Court,

Most respectfully it is submitted that on 09.09.2015 a PCR call vide

DD no. 36A regarding quarrel was received at PS Vasant Kunj (South). On receipt of
same, S I Manoj Kumar along with staff reached at the place of information i.e 347-B
Vasant Kunj Enclave, New Delhi On enquiry, it came to notice that injured person
had been taken to the hospital for treatment. In the meanwhile, information
regarding MLC no. 5592/15 was received from Indian Spinal Injuries Centre, Vasant
Kunj. In hospital Injured Abul Maboob S/o Abdul Wadood r/o B-347, Vasant Kunj
Enclave, New Delhi was found admitted vide MLC no. 5592/15 who gave his written
complaint wherein he has alleged that at around 12:15pm on 09.09.2015, he was
informed by one of the residents that someone has come from SMD office Vasant
Vihar on decent the bore well in khasara no 1028. He went to the spot and the said
bore well was desealed by Sh. RI Singh, tehsildar, SMD (vasant vihar). It is further
alleged that offer desealing the bore well, while he was returning to his residence,
Sh. PS Tanwar along with Sh K. C Babu, Sh Gaur, Prem Singh Tomar and Sh Garg
were also going in the same direction. Sh K.C Babu instigated P.S Tanwar to assault
the complainant and accused PS Tanwar all of sudden started beating the the
complainant black and blue without any provocation. At that time umbrella was in
the hand of the complainant and when the complainant tried to protect himself with
the umbrella, accused P.S Tanwar snatched his umbrella and attacked the
complainant with the same umbrella. The umbrella was badly broken. During the
attack the broken frame of the umbrella got pierced on the upper lip of the
complainant and stuck it in. Fortunately the handle did not pierce into the neck or
head; otherwise it wouldve been fatal.

Accordingly, present case FIR was registered on the complainant of

Abdul Mabood and investigation taken up during the course of investigation Doctor
at the hospital produced the metal object measuring 17.7X3 cm which had been
pierced onto the upper lip of the complainant. The said metal object was taken into
police custody. The clothes (Pant and shirt) of the complainant and broken umbrella
were also taken into police custody through seizure memos.

During the course investigation, eye witness Sh K.R Garg s/o Late Sonkia Ram R/o
B-271 Vasant Kunj Enclave, ND & P.R Gaur R/o B-539, Vasant Kunj Enclave have
been examined and their statements u/s 161 CrPC have been recorded wherein
they have stated that there were some heated arguments and quarrels between Sh.
Abdul Mabood and P.S Tanwar. The umbrella was in the hand of the complainant
Abdul Mabood. During the quarrel both pushed each other and as a result on frame
was broken and pierced through the upper lip of the complainant and he got injured.

The result regarding nature of injury on the complainant /injured has not been
obtained from the Indian Spinal Injury Centre and the Doctor has opined the nature
of the injury as Simple Blunt.

Efforts have been made to arrest the accused. Several raids have been conducted
at residence and the possible hideouts of accused PS Tanwar, But he is at large
Notice u/s 41.1 CrPC has been sent to acused PS Tanwar to Join the investigation
which was received by his nephew Digvijay Tanwar, But accused PS Tanwar did not
join the investigation of the case and is deliberately evading the arrest.

The anticipatory bail application or accused was dismissed by the court of Sh.
Deepak Garg Ld. ASJ, Patiala house court on 17.09.2015

In view of above submissions, the undersigned is ready to abide by any

directions of the Honble Court may choose to pass.
