Course Objectives:

This course will provide each student with an exposure to crucial aspects of Land laws of UP.
The legislative power to make laws relating to land and land ceiling is in the state list.
Different States have enacted their own laws on this subject.
The Constitutional perspectives relating to this subject have to be taught as an essential part of this course.
The provisions in the Constitution in Part III, IV and XII as well as those in Schedule VII relating to distribution of
legislative powers over land are essentially to be taught with emphasis.
Pre-requisites:
Basic knowledge of History and Development of Revenue system in India.

Student Learning Outcomes:

Appraise the various legal Rights endowed upon the citizens & remedies in case of their violation.
Analyze the impact of post independence land reforms.
Recognize the laws pertaining to Rent Control Act etc.
Review the various legislations with regard to land law, taking a note of contemporary developments.

Course Contents/Syllabus:

a) Fundamental rights, Property as Legal Right, Agriculture reform, Legislative Powers, The Union, The State, 30%
Local bodies. Constitutional Provisions on Agrarian Reform Legislation

Module II: Post-Independence Reforms

Abolition of Zamindaries, Abolition of Intermediaries, Tenancy Reforms, Land to the tiller, Personal Cultivation, 25%
Voluntary Surrenders.

Module III: Evaluation of land Reforms

Lack of Political will as an impediment to land reforms, Role of Law, Role of law and Legal Profession in
implementation, Position of Bars to the jurisdiction of Civil Courts , Role of administrative agencies.

b) Abolition of private landlordism
c) Consolidation of holdings

Pedagogy for Course Delivery:

The course will be delivered through a combination of theoretical and case study approach. Students
will be motivated to get updated with recent Supreme Court decisions through classroom discussions
and articles. Students will be assigned projects to integrate theory with practical aspects.
