REGULATION ORDINANCE NO. 2010-275


AN ORDINANCE AMENDING REGULATION ORDINANCE NO. 00-054 AS
AMENDED BY REGULATION ORDINANCE NO. 2001-071 BY PROVIDING
ADDITIONAL INCENTIVES FOR THE HOUSES, BUILDINGS, AND
STRUCTURES DECLARED OR TO BE DECLARED AS HISTORICAL SITES
OR HERITAGE SITES BY THE ILOILO CITY CULTURAL HERITAGE
CONSERVATION COUNCIL

WHEREAS, under Article XIV, Section 14 of the 1987 Philippine Constitution, it is


provided that "the State shall foster the preservation, enrichment and dynamic evolution of a
Filipino national culture";

WHEREAS, the Iloilo City Government recognizes the value of old buildings, structures,
or sites with cultural significance; the protection and preservation of these irreplaceable cultural
and heritage sites is in consonance with public interest in as much as their legacy of aesthetic,
educational, economic, historical and religious significance need to be maintained and preserved,
for a better understanding of our past, enrichment of the present, and to pass over to our future

generations;

WHEREAS, there exists a need to enact additional measures to further strengthen the
goal of the city in safeguarding the cultural heritage of Iloilo City, foster civic and neighborhood
~:i beauty and accomplishments of the past, and a sense of identity, assist, encourage

and provide incentives to private owners for preservation, restoration, redevelopment and use of
outstanding historic buildings, districts, objects, sites and structures;

WHEREAS, the existing ordinance, Regulation Ordinance No. 00-054 and as amended
by Regulation Ordinance No. 2001-071 specifically Section 6 (d) only provides incentives in the
form of exemption from business taxes to those businesses located in the heritage zone;

WHEREAS, there are also heritage buildings, structures or places located outside of the
heritage zone that are not covered by the existing ordinance, hence, there should be a need to
amend the same and provide additional incentives to encourage owners to preserve these
buildings or structures;

WHEREAS, Article 3, Section 458 (2) (ii) of the Local Government Code states that the
Sangguniang Panlungsod can enact ordinances levying taxes, fees and charges, prescribing the
rates thereof for general and specific purposes, and granting tax exemptions, incentives or reliefs.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of


Iloilo, in session duly assembled, that:

Section 1. - Section 6 of Regulation Ordinance No. 00-045, as amended by Regulation


Ordinance No. 2001-071, is hereby amended in order to read, as follows:

"Section 6 (a) - Upon promulgation of the rules and regulations of the


council above mentioned, the owner, administrator, lessee or 01D' person who is
in charged of such heritage or legacy buildings or structure duly identified by the
council referred to in the preceding paragraph, is hereby prohibited from
undertaking 01D' repair, rehabilitation or construction of 01D' kind therein, unless
with the favorable recommendation of the Iloilo City Cultural Heritage
Conservation Council, which recommendation shall be appended to the
application of building permit to be issued by the Building Official or the City
Engineer. Provided, however, that should the rehabilitation or repair be urgent
in the interest of the safety of persons, such owner, administrator, lessee or
person in charge in connection with the said Council, shall make sure that the
faf'lde showing the architectural design of the building or structure be retained,
restored, copied or preserved

Section 6 (b) - The public plaza above enumerated shall not be used for
01D' historical, cultural or fiesta celebration or the like where structures whether
permanent or temporary are built on the grassy or planted portions or enclosures
are built in the area. The outer rim or perimeter of the said plazas or its outer
promenade and the trees or roads adjacent to it including the basketball court or
mini gym may be temporarily enclosed and used for purposes of such activities
which in no event shall exceed one (J) week.

Section 6 - The restoration, revival and revitalization of the old Central


Business District, located at the whole street of JM Basa, Mapa, Aldeguer,
Guanco and /mart Streets, shall be initiated by the Council with the full support
by the City Government and other non-government or civic institutions and shall
be designated officially as /loilo City Heritage Zone. Its purpose is to revive and
revitalize the thriving businesses of the past. The area shall likewise be used for
tourism purposes.

Section 6 (d) - INCEN11VE - to assure effective enforcement, a srstem


of incentives is hqebv provided to all uwners who will function as cooeerators
in the preservation anW'or restoration of these historical sites:

J. For every ten (JO) years of existence in the Heritage Zone. one (J)
year of exemption from business taxes but not exceeding three years;

2. For those putting up new business in the Heritage Zone with a


capitalization of at least one (1) million pesos - 25% of exemption on
business taxes for every one (1) million for one year;

3. Preservation, reconstruction and restoration of legacy or heritage


buiklings within our outside the heritage zone - The uwner shall be
granted fiftv percent (50%1 tax incentive on annual real, oropertv tax
on both land and stnlcture where it is sitllated. orovided, that the
whole land area forms part of the historv as certified bv the
ICCHCC. otherwise. it shall onJr qpply on the actllal lot where the
structure or building is actuallv situated; and provided, further. that
in the latter. at least two (21 meters of the lot from the periDheral
area su"ounding the stnu;ture or building shall be included as part
therein.

Section 2. - Period of Collection. - Payment of tu.es on the pmervation and


restoration of heritage structure shall be collected on the following year after the aporoval
of this ordinance, provided, the tax incentive shall only be applicable to the current tax due.

Section 3. - This ordinance amends Regulation Ordinance No. 2001-071, Series of 2001
and repeals any and all ordinances inconsistent with the provisions hereof

Section 4. - Effectivity. - This ordinance shall take effect ten (10) days after posting and
publication in a newspaper of general circulation in the City of Iloilo.
