Nadia Sol Ireri Unzueta Carrasco, 29, came to the United States from Mexico City at the age of six and has lived in Chicago ever since. She is an organizer with the Chicago-based Organized Communities Against Deportations and has engaged in ‘numerous protests over U.S. immigration policy. In Mareh 2013, Unzueta Carrasco, who graduated from Whitney Young High School and the University of Ilinois at Chicago, was granted a two-year protection against deportation under the 2012 federal Deferred Action for Childhood Arrivals (DACA) program, Her application to renew her DACA status was denied in August 2015. In denying Unzueta Carrasco’s DACA renewal, U.S. Citizenship and Immigration Services (USCIS) cited "public safety concerns" with her case, pointing to her participation in civil disobedience actions between 2009 and 2013. The denial makes note of Unzueta Carrasco being arrested and charged with “civil disobedience, resisting arrest, obstruction of traffic and reckless conduct” in May 2013, shortly after she received DACA status. Unzueta Carrasco, who maintains she was never convicted on the charges she faced for civil disobedience, said the arrest in question involved a May 2013 anti-deportation protest outside a fiindraiser.President Barack Obama was attending in downtown Chicago. “We wanted to bring the number of deportations that his administration Had carried out to his attention, but also to the attention of the general public,” she said of the protesi, which involved blocking traffic on Michigan Avenue with a banner that read, "400,000: Not| More Deportation." Unzueta Carrasco's attorney, Mony Ruiz-Velasco with the Melrose Park-based P.A.S.O. - West Suburban Actidn Project, said her client's past “actions do not meet the definition of a public safety concem under the law." She called the DACA renewal denial "an erroneous decision, both legally and as a matter of discretion.” "Even though we've exhausted every other possibility of raising this within the agency, they have not re- reviewed (her case) to the point of overturning their denial," Ruiz- Velasco said. "Hopefully, not only will she be granted DACA, as she should have been from the beginning, but obviously, also, we want this to be made clear within the administration -- that it is not acceptable for activists to be denied deferred action because of their activism," Ruiz-Velasco said. "The very actions she's been taking over the years is exactly what got us DACA to begin with,” Ruiz-Velasco added. "Because if it hadn't been for the actions taken by youth earlier in 2010 and 2011, the administration would not have beeni pushed to issue this directive regarding deferred action for youth in 2012." We are extremely concemed by the denial of the renewal of the Deferred Action for Childhood Arrivals (DACA) request by Ms. Nadia Sol Ireri Unaueta Carrasco. We fully support Ms. Unzueta Carrasco’s request that DHS reconsider and approve her DACA request. Ms, Unzueta Carrasco is a long time resident of Chicago, Illinois, a graduate of Whitney Young High School and received a Bachelor of Arts degree summa cum laude from the University of tinois at Chicago. She is also a nationally-known immigrant rights organizer who has been at the forefront of fighting for the rights of immigrant students and other vulnerable populations. She currently mentors and teaches public high school students in Chicago. Moreover, as edueditors we have seen first-hand how students and young people benefit from participation in actions that use protected speech and civil disobedience to make their case. In ‘Chicago where Ms. Unzueta Carrasco studied and lives, in particular, we have seen our immigrant students lose their fear of sharing their stories, and join with other undocumented students in “coming out of the shadows” events, including the first National Coming Out of the Shadows Day on March 10, 2010.” Through Ms. Unzueta Carrasco's work, along side other young people around the country, undocumented young people have been empowered to make claims for legal status. In fact, it was this kind of protest that produced, at least in part, the ‘conditions under which President Obama instituted DACA in the first place. As one of the first ‘young people to engage in civil disobediences in the years before DACA was implemented, Ms. Unzueta Carrasco and her peers’ acts of civic engagement played an important role in prompting the federal action that led to DACA. Hundreds of thousands of youth have benefited from this policy thanks to her efforts and those of dozens of activists like her, including many of our students. Denying her DACA renewal, policy option she has long-struggled for, precisely because she struggled for it is highly problematic, profoundly unjust, and sets a dangerous precedent. Itis evident to those who know Ms. Unzueta Carrasco, including some of her teachers who have signed this letter that her acts of civil disobedience actions are an expression of her political views on punitive and unfair immigration laws. She seeks to bring about needed social change to improve the treatment of immigrants and other vulnerable populations in the United States. Each arrest mentioned in the email sent by USCIS to Ms. Unzueta Carrasco was in response to her speaking out to defend the rights of her family, immigrant communities or criticizing harmful immigration enforcement practices. DHS's denial sends a message that political expression in support of immigrants’ rights will not be tolerated. Ifthe requestor poses a threat to national security, the officer should refer the proposed denial for supervisory review after the case has been processed through the CARRP process; or © Has one or more departures which he/she claims were “brief, casual, and innocent” and therefore are not disruptive of the continuous residence requirement; or © Has not met the educational guideline; or Is inimmigration detention at the time of filing Form I-821D and remains in immigration detention; or Cannot receive prosecutorial discretion because it is not consistent with the Department of Homeland Security’s enforcement priorities. ° if the convictions and/or arrests occurred before tlie requestor filed the Form I 821D and the requestor did not disclose this derogatory information, include the withholding of the material fact(s) as one of the reasons for not exercising prosecutorial discretion in the case. When a DACA request is denied, the denial shall be issued using the Appendix F. In instances where an individual is unable to establish he or she warrants a favorable exercise of prosecutorial discretion under this process, and no other checkbox applies except “Vou have not established that you warrant a favorable exercise of prosecutorial discretion,” supervisors must refer the case to HASCOPS through the normal chain of command. Before routing the A-file to a supervisor, the officer should place a supervisory hhold on the case in C3. After the supervisor concurs with the issuance of a denial, the officer shall check the appropriate box on the denial template and process the cases in the system for denial. We are extremely concerned by the denial of the renewal of the Deferred Action for Childhood Arrivals (DACA) request by Ms. Nadia Sol Ireri Unzueta Carrasco. We fully support Ms. Unzueta Carrasco’s request that DHS reconsider and approve her DACA request. Ms. Unzueta Carrasco is a long time resident of Chicago, Illinois, a graduate of Whitney Young High School and received a Bachelor of Arts degree summa cum laude from the University of Illinois at Chicago. She is also a nationally-known immigrant rights organizer who has been at the forefront of fighting for the rights of immigrant students and other vulnerable populations. She currently mentors and teaches public high school students in Chicago. She is precisely the young person meant to receive relief from DACA. In fact, it was this kind of protest that produced, at least in part, the conditions under which President Obama instituted DACA in the first place. As one of the first young people to engage in civil disobediences in the years before DACA was implemented, Ms. Unzueta Carrasco and her peers’ acts of civic engagement played an important role in prompting the federal action that led to DACA. Hundreils of thousands of youth have benefited from this policy thanks to her efforts and those of dozens of activists like her, including many of our students, Denying her DACA renewal, a policy option she has long-struggled for, precisely because she struggled for it, is highly problematic, profoundly uinjust, and sets a dangerous precedent.
